The import(ance) of conflict minerals : An ideal type analysis of the EU’s regulation on conflict minerals

The purpose of this study is to determine to what extent the European Union (EU) functions as a market power in the case of conflict mineral regulation. Previous research by Partzsch has shown that the EU response to conflict minerals only somewhat qualifies for the EU to be seen as a normative power. There appears to be a clash between the norms of sustainable development and economic development, which could explain why the EU does not fully qualify as a normative power. Another theoretical framework has thus been chosen to explain the EU’s function in the case of conflict minerals. This theoretical framework is Market Power Europe (MPE) by Damro, which does not look to the collective norms of the EU, but rather on the market-related policies that the Union uses to influence other actors. With the use of an ideal type analysis of EU policy and official documents, this study found that the case fills the criteria to function as a market power in the case of conflict minerals.

This thesis elaborates on a complex, multilayered gender perspective of mineral exports in the conflict of the eastern Democratic Republic of the Congo. The focus lies on the Dodd-Frank Act and its implications for sexual gender-based violence, both conflict and non-conflict related, as well as socioeconomic dimensions. The in-depth analysis of these factors indicates, that after the initiation of the well-intended Act, the occurrence of sexual gender-based violence has increased and socioeconomic situation for women have worsened. Possible reasons can be found in the sole focus on Western narratives and the neglect of local perspectives.

Tracking of SVHC : Investigating current methods and creating a new method for tracking Substances of Very High Concern in products

This research explores how substances of very high concern (SVHC) are tracked today. Tracking the material content of products has grown increasingly important in the last decade. Material tracking is critical for the construction equipment machine builder (OEM) which is used to analyze if materials are clean from the dangerous substance, for example lead. It is important for all businesses to know whether their products are clean. As a result, most factories and businesses require a filter to distinguish between clean and hazardous chemicals. The goal of this research is to design a solution that will track the harmful substance content in products and investigate those that contain SVHC. To accomplish this, there was an evaluation of how the tracking is done today and thereafter the two methods, blockchain and centralized database were compared. A solution based on blockchain technology which will prevent companies from lying about the possession of products that contain SVHC by tracking them was then created based on the results. This thesis conducts qualitative research, which means it was based on qualitative data. The data was gathered using a mix of two types of research methods: semi-structured interviews and theoretical research. Based on the results of the comparison, a blockchain technology solution was devised to facilitate the tracking and to reduce cheating with SVHC. The proposed solution has been implemented in form of a cryptocurrency using the blockchain technology. In conclusion the result of this study was that the problems with the current method were clarified and a blockchain-based solution for tracking SVHC was designed.

Bakgrund: I maj 2017 beslutades det att EU-reglering 2017/821 om konfliktmineraler kommer träda i kraft den 1a januari 2021. Regleringen kräver att företag inom EU kan försäkra sig om att tenn, volfram, tantal och guld (3TG) endast importeras från ansvarsfulla och konfliktfria källor. Inom litteraturen presenteras en problematik kring försörjningskedjors komplexitet och svårigheterna att spåra konfliktmineraler. Studien avser därför att skapa ökad förståelse för leverantörshantering avseende konfliktmineraler och praktiska implikationer för bolag som önskar ökad förståelse inför införandet av EU-reglering 2017/821.  Syfte: Syftet är att skapa ökad förståelse för hur företag strategiskt arbetar mot hållbarhet genom leverantörshantering avseende konfliktmineraler, samt vilka möjligheter respektive utmaningar som kan uppstå under detta förändringsarbete. Metod: Studien har ett realistiskt perspektiv samt ett induktivt angreppssätt med abduktiva inslag. Kvalitativ data har inhämtats genom sex semistrukturerade intervjuer med representanter från Atlas Copcos inköpsfunktioner, från två affärsområden, som arbetar med alternativt är bekanta med Atlas Copcos upprättade process för leverantörshantering avseende konfliktmineraler. Slutsats: Studieförfattarna finner att strategiskt arbete mot hållbarhet genom leverantörshantering avseende konfliktmineraler kan delas upp i tre övergripande områden; identifiering av prioriterade intressenter, utveckling av förändringsarbetesstrategier samt strategiska partnerskaps bidrag till synlighet inom leverantörskedjan. Dessa tre aspekter bidrar tillsammans till identifieringen och arbetet med möjligheter respektive utmaningar inför fortsatt hållbarhetsarbete med leverantörshantering avseende konfliktmineraler, vilket kan sammanfattas genom fortsatt utveckling av intern dialog samt värdet av att arbeta med Supplier Relationship Management. Kunskapsbidrag: Studiens teoretiska kunskapsbidrag är att skapa ökad förståelse för hur drivkrafter för implementering av hållbarhetsarbete, förändringsarbete samt arbete med försörjningskedjan kan bearbetas inom kontexten för leverantörshantering vid hållbarhetsarbete, samt hur dessa aspekter inverkar på varandra. / Problem discussion: In May 2017, it was determined that EU-regulation 2017/821 will enter into force the 1st of January 2021. The regulation requires that companies within the EU are able to assure that tin, tungsten, tantalum and gold (3TG) merely is imported from responsible and conflict free sources. Within literature, issues regarding supply chain complexity and difficulties with tracking conflict minerals are presented. This study therefore aims to create increased understanding for supplier management regarding conflict minerals and practical implications for other companies that aim for increased understanding before the introduction of EU-regulation 2017/821. Aim: The aim is to create increased understanding for how companies strategically work towards sustainability through supplier management regarding conflict minerals, and which opportunities respective challenges that may occur during the process of change. Method: This study has a realistic perspective and an inductive approach with abductive features. Qualitative data has been obtained through six semi structured interviews with representatives from Atlas Copco’s sourcing functions, from two business areas, who work with or are familiar with Atlas Copco’s constructed process for supplier management regarding conflict minerals. Results: The authors of this study find that strategic work towards sustainability regarding conflict minerals can be divided into three overall subjects; the identification of prioritized stakeholders, development of change management strategies and strategic partnerships contribution to visibility within the upstream part of the supply chain. These three aspects contribute to the identification and work with possibilities and challenges regarding continued sustainability efforts with supplier management concerning conflict minerals, which can be summarized through continued development of internal communication and the value of working with supplier relationship management. Science contributions: The study’s theoretical science contribution is to create increased understanding for how drivers for implementation of sustainability efforts, change management and work with the supply chain can be processed within the context of supplier management concerning sustainability work, and how these aspects affect each other.

Conflict Minerals and Corporate Social Responsibilities in Sweden : How do Swedish companies respond to the conflict minerals issue and what are the challenges?

This study focuses on one of the emerging issues in Corporate Social Responsibility (CSR), “conflict minerals”. The discussion of the “conflict minerals” issue is that the trade of “conflict minerals”, originating from the eastern Democratic Republic of the Congo (DRC), helps to finance conflicts characterized by extreme violence including killing and rape, therefore, the downstream companies which indirectly buy these minerals should take actions (Global Witness, 2010).This study first seeks to provide an overview of the Swedish companies’ progress on the conflict minerals issue through desktop research, and later tries to find out the driving forces, the measures and the existing challenges related to the conflict minerals issue through case studies. In the case studies, interviews were carried out with Sony Ericsson and Atlas Copco. The results of the study show that most companies studied in the six industries have not addressed the conflict minerals issue while companies in the electronic industry has made the most progress on conflict minerals in Sweden. In the case studies, the results present that external pressure is one of the major driving forces for both companies, and Sony Ericsson have taken several measures which seem to be aligned with supply chain risk management approach and OECD DD Guidance. In addition, both companies have tried to integrate conflict mineral management into existing supply chain management. The challenges are different depending on the progress of the companies.The study contributes to providing a better understanding of the current situation surrounding the conflict minerals issue in Sweden and to elaborating examples of the measures and the existing challenges.

The thesis concers the issue of conflict minerals in the Democratic republic of Congo. The situation in the country has been monitored by the NGO Global Witness for decades. Human rights violation, illicit trade followed by exporting of minerals out of the country, have been supervised by militaristic rebel groups. As a result these groups have been indirectly founded by international corporations.The aim of this thesis is to evaluate the performance of Global Witness at the agenda setting of conflict minerals, including a critical assessment of legislative measures.

As already the title of the diploma thesis is saying " Conflict minerals and the Democratic republic of Congo" aims at discussing issues around conflict minerals produced in DRC, including illicit trade, exports, smuggling minerals from DRC and committing crimes such as human rights abuses including rapes, sexual violence, executions, forced recruitment, abduction, child work etc. The militarisation mostly in eastern parts of the country leads to escalated conflict, in which rebel groups are warring in order to obtain power and control over rich natural resources in country. Long lasting conflicts, insecurity in the country, failed governance, wide-spread corruption, illegal exploitation of natural resources and of miners as well have reach the level of poverty, economic weakness, as well as political inability to lead the country and control its own natural wealth and prevent from any kind of foreign touch, mostly by armed or rebel groups. This thesis presents measures, which have to be taken in order to mitigate rebel groups power in the country, enhance transparency, remove corruption and exercise due diligence for responsible supply chain and thus strengthen economic and political development as well as human right

Sustainable Mining for Long Term Poverty Alleviation in the Democratic Republic of the Congo

This thesis explores the poverty alleviation and peace-spoiling power of the mineral extraction sector in the Democratic Republic of the Congo to arrive at a set of strategic goals for the country moving forward. Although subterranean minerals are often a source or perpetuator of violence, the potential to lift the country’s rural communities out of extreme poverty makes the mining industry an essential part of the nation’s development strategies. Lessons from Tanzania, Côte d’Ivoire, Guinea, Ethiopia, Zimbabwe, Nigeria, Ghana, Zambia, Uganda and Sierra Leone to arrive at best practices for increasing the multiplier effect of large-scale mining, formalization, beneficiation, capital resource development, stakeholder harmonization and conflict control. The study also finds that in order to smoothly construct and implement new programs, the traditional roles and positioning of government, corporate and community stakeholders must change toward increased inclusion.
