Cold Counsels and Hot Tempers: The Development of the Germanic Amazon in Old Norse Literature will trace how the evolution of the powerful woman in literature shaped the development of female characters in the classical Icelandic family sagas and the Fornaldarsögur, or later sagas of ancient times. The thesis will focus on the conception and representation of the proverb köld eru kvenna ráð cold are the counsels of women specifically tracing the function of women in feud structures and folk motifs that involve assault and acts of revenge. In the early Germanic sources, women are direct participants in violence; they train themselves in warfare, take up weapons, begin feuds, avoid unwanted marriages and hold kingdoms through force of arms. In later Norse literature, women rely on verbal persuasion to force men into action; they use goading, seduction, and insult to engage men in violence. Cold Counsels and Hot Tempers will examine these changes in womens roles and investigate the different methods women use to access power.

Skiljemäns (o)partiskhet : Särskilt om relationen mellan skiljeman och partsombud / Arbitrators’ (Im)partiality : Particular on the Relationship between an Arbitrator and a Legal CounselGunnarsson, Jonathan January 2012 (has links)
En av de mest framstående fördelarna med skiljeförfarande som tvistlösningsmetod är att parterna har möjlighet att utse skiljemän som de känner förtroende för och som har sär- skild kompetens för tvistens avgörande. Enligt 8 § lagen (1999:116) om skiljeförfarande (LSF) ska en skiljeman vara opartisk, och om det finns omständigheter som rubbar förtro- endet för skiljemannens opartiskhet ska denne skiljas från sitt uppdrag. Om en skiljeman är partisk kan även skiljedomen klandras och upphävas. Denna uppsats syftar till att utreda skiljemäns (o)partiskhet enligt 8 § LSF samt att försöka fastställa gällande rätt för partiskhet i relationen mellan skiljeman och partsombud. Relationen mellan skiljeman och partsombud är inte reglerad i LSF men i rättspraxis finns vägledning för vilka omständigheter som kan vara av förtroenderubbande karaktär. HD har fastslagit att en hög standard ska gälla för den aktuella relationen. Enligt domstolen är det förtroenderubbande om en advokatbyrå där skiljemannen är anställd har en affärsmässigt betydelsefull relation med en part eller närstående till part i skiljeförfarandet. Vidare har HD anfört att det även kan vara förtroenderubbande för skiljemannens opartiskhet om en advokatbyrå medverkat till att en viss skiljeman ofta får skiljeuppdrag. Svea hovrätt har konstaterat att det även är förtroenderubbande om en delägare i en advokatbyrå tjänstgör som skiljeman i ett skiljeförfarande där ena parten är motpart i en annan tvist till ett annat företag som har skiljemannens advokatbyrå som ombud. Vidare har advokatetiska regler en preventiv funktion för att motverka partiska skiljemän. En advokat som handlar i strid med sådana regler är dock inte automatiskt att anse som partisk enligt 8 § LSF. / One of the most prominent advantages of arbitration as a form of dispute resolution is that the parties may appoint arbitrators who they have confidence in and that have particular expertise in the question of the dispute. According to 8 § of the Swedish Arbitration Act (SAA), an arbitrator must be impartial and an arbitrator shall be discharged if there exists any circumstance which may diminish confidence in the arbitrator's impartiality. The arbi- tration award may also be challenged and set aside, if the arbitrator is biased. This thesis aims to examine the arbitrators’ (im)partiality according to 8 § SAA, and to de- termine when the relationship between an arbitrator and a legal counsel is considered to undermine the confidence in the arbitrator's impartiality. The relationship between an arbitrator and a counsel is not regulated by SAA but circum- stances that diminish the confidence of the arbitrator’s impartiality have been subject to ju- dicial review. The Supreme Court has set high standards for the relationship in question. For example, it is according to the Court confidence diminishing if the arbitrator’s law firm currently has a significant commercial relationship with one of the parties in the arbitration as well as when a law firm contributes to that a particular arbitrator often receives assign- ments as an arbitrator. In addition, attorneys’ codes of conduct have a proactive function to prevent biased arbi- trators. However, a lawyer who violates such rules is not automatically seen as biased ac- cording to 8 § SAA.

A história da infância em Santarém compreende os vários contextos, desde a
vivência de celebridades que fazem a história de nossa gente, até apanhados
escritos de autores que se dedicaram e se dedicam em defesa aos direitos da
criança. O olhar de Philippe Ariès, em sua obra Historia social da criança e da
família, fez-nos aprofundar nos relatos medievais e modernos da população infantil,
nas várias formas do ser criança, no desrespeito e preconceito que a cercava.
Maria Luiza Marcílio, em sua obra História das crianças no Brasil, apresenta-nos as
causas do abandono de crianças no século XlX, dentre elas a questão da pobreza,
morte ou descaso dos pais, doenças, defesa da honra de mulheres nobres,
elitizadas, a honra de família. No século XX, fatores como a urbanização, imigrações
da zona rural para a zona urbana, a imigração europeia e a isenção da mulher no
mercado de trabalho foram, e têm sido, as muitas causas do abandono de crianças.
Os relatos de Mary Del Priori, em sua obra História das crianças no Brasil, serviram
de suporte para o entendimento da figura infantil no período do Brasil Colônia,
Império e República. O menosprezo educacional, emocional e ético a esta classe é
perceptível desde os primeiros fundamentos de nossas políticas; somente a classe
dominante gozava de privilégios, a partir de uma filosofia exclusivista e excludente.
No passado, mercaram as famosas Santas Casas de Misericórdia, as Rodas dos
Expostos, hoje a nomenclatura mudou para pastorais da criança, creches, abrigos,
lares, ONGs para crianças. Os relatos obtidos nas atas das instituições que militam
pelos direitos da criança nos serviram de base para averiguação histórica do antes,
durante e depois de sua implantação. A criança santarena não tinha seus direitos
assistidos por falta de conhecimento, ações políticas que a salvasse ou guardasse,
a classe política que deveriam fomentar os projetos não tomavam atitude, até que a
sociedade civil se organizou e iniciou os primeiros fomentos em prol dos direitos da
criança, iniciando o Conselho de Direitos, o Fundo e o Conselho Tutelar. Atualmente,
inúmeras instituições, especialmente a sociedade civil e religiosa, têm seus projetos
articulados e registrados em parceria com o Conselho Municipal dos Direitos da
Criança e do Adolescente, órgão de grande importância no desenvolvimento de
políticas públicas em defesa dos interesses das crianças pequenas. / The history of childhood in Santarém includes several contexts, from the celebrities
existence, which build our peoples history, to résumé of writings of authors who were
and are dedicated in defense of childs rights. Philippe Ariès glance, on his work
Social history of child and family, has brought us near to medieval and modern
reports on childish population, to many ways of being a child, to the disrespect and
prejudice that surround children. Maria Luiza Marcílio, on her work History of children
in Brazil, presents us the causes of childrens abandonment in 19th century, among
them, the subject of poverty, death or parents disregard, diseases, defense of noble
womens honor, elitized, the family honor. In the 20th century, factors as urbanization,
emigrations from rural area to urban area, the European immigration and womans
exemption on job market were and have been one of many causes of childrens
abandonment. Mary Del Prioris reports, on her work History of the children in Brazil,
have been served as support to understand the childish illustration in the periods of
Brazil Cologne, Empire and Republic. The educational emotional and ethical
contempt to this group is perceptible since the first foundations of our politics; only
the dominant group has enjoyed privilege because of an exclusionist and excluding
philosophy. In the past, the famous Saint Houses of Mercy, the Wheels of the
Exposed Ones were remarkable. Today the nomenclature has been changed for
childs pastorals, day cares, shelters, homes, NGOs for children. The obtained
reports at the records of the institutions that militate for childs rights have served us
as base for historical verification before, during and after their implantation. The child
of Santarém had not its rights warranted because of the lack of knowledge and
political actions that could warrant or protect it. The political group, which should
foment projects, didnt take an attitude, until the civil society was organized and has
began the first fomentations on behalf of childs rights, starting the Council of Rights,
Fund and Guardian Council. Now, countless institutions, especially the civil and
religious society, have articulated and registered their projects in partnership with
Municipal Council of Child's and Teenagers Rights, an agency of great importance
on the development of public politics in defense of the tiny childrens interests.

Previous issue date: 2010-08-26 / A Igreja Católica Apostólica Romana entende a vocação para a vida religiosa (como no caso de padres, freiras, irmãos consagrados) como um chamado específico somente para alguns homens e mulheres especiais. Esta vocação é fundamentada pela existência de três votos obrigatórios: a pobreza, a obediência e a castidade. Aqueles que são chamados para esta função são compreendidos como especiais a partir de Deus. Porém, Eugen Drewermann, em sua obra Funcionários de Deus, problematiza este modelo ideal. A partir da Psicologia Profunda, ele busca entender os motivos psicológicos inconscientes que levam um jovem a buscar como opção de vida a vocação religiosa. Partindo das constatações feitas pelo autor, o objetivo desta pesquisa é analisar algumas questões, como os motivos que levam um jovem a buscar como ideal de vida a opção pelo sacerdócio na Igreja Católica, quais aspectos psicológicos interferem nesta escolha, como se sente quem se julga chamado, verificar o seu entendimento a respeito dos três conselhos evangélicos e discutir as propostas feitas à Igreja Católica para que os conflitos vivenciados pelos “eleitos” sejam minimizados. / The Roman Catholic Church understands religious vocation (as in the case of priests, nuns and consecrated brothers) as a specific calling for only a few special men and women. This vocation is established by the existence of three binding vows: poverty, obedience, and chastity. Those who are called to this function are comprehended as special from God. However, Eugen Drewermann, on his work "God's Servants", renders problematic this ideal model. Through Depth Psychology he seeks to understand the unconscious psychological motives that lead a young person to look for religious vocation as a way of life. Proceeding from the author's statements, the purpose of this research is to examine some issues, like the reasons that lead a young person to look for priesthood on the Catholic Church as a way of life, what psychological aspects affect this choice, and how does it feel for someone who judges himself called, to verify his understanding about the three evangelical counsels and to consider proposals made to the Catholic Church in order to minimize the conflicts experienced by the “elected”.

Aujourd'hui, dans l'Église Catholique Romaine, des nouvelles formes de communautés « associatives » émergent et posent un certain nombre de questions au regard du droit canonique de l’Église. L'une d'entre elles concerne les personnes qui font le choix du célibat pour vivre un état de « vie consacrée » dans ces nouvelles formes de vie associative. Au-delà des structures et des critères organiques de vie consacrée qui asphyxient bien souvent toute réflexion sur la consécration, quels sont les critères qui, in utroque iure, permettraient la reconnaissance d’un tel état de vie ? En droit public français, ces nouvelles formes de vie consacrée au sein de l'Église Catholique interrogent aussi : certaines de ces nouvelles formes acquièrent un statut d’association publique internationale en droit canonique, et demandent, par exemple, leur reconnaissance légale comme « congrégation religieuse » (notamment, quant à la sécurité sociale, au droit du travail, et d’autres encore) avec le statut congréganiste. Ce sont ces critères essentiels pour ces mouvements que notre étude se propose de préciser, comme la profession des conseils évangéliques, les liens sacrés, la stabilité, une vie fraternelle, une soumission à une règle de vie approuvée : afin que l’état de vie consacrée soit plus manifeste dans ces mouvements qui attendent, pour une part, une certaine reconnaissance de la part de l’Église, sans compter les contentieux, relativement nombreux, relatifs notamment aux régimes de sécurité sociale et de retraites, devant les juridictions étatiques. / Today in the Roman Catholic Church new forms of “associative” communities are emerging and posing a certain number of questions in regard to Canon Law. One of the questions concerns those who choose to live a celibate state of "consecrated life" in these new forms of community life within the Church. Beyond the structures and organic criteria of consecrated life, which sometimes in itself can frustrate any serious reflection, what are the criteria in utroque iure, that would allow for the recognition of such a state of life in Canon law? New forms of consecrated life in the Catholic Church can also question French law. Some of these new forms acquire the status of an international public association in Canon law, and ask, for example, for legal recognition as a “religious congregation", in French law. Questions than arise on matters such as social security, labor law, and other issues within this legal congregational status. These are the essential canonical and French legal criteria for these movements that our study is to clarify. How can the profession of the evangelical counsels, the sacred bonds, stability, fraternal life, and submission to an approved rule of life, all canonical requirements be fulfilled, while also satisfying French legal requirements, such as social security, pension schemes and litigation activity, in the new forms of “associative communities?”
