Producing literacy practices that count for subject English

This thesis presents a study of the production of literacy practices in Year 10 English lessons in a culturally diverse secondary school in a low socio-economic area. The study explored the everyday interactional work of the teacher and students in accomplishing the literacy knowledge and practices that count for subject English. This study provides knowledge about the learning opportunities and literacy knowledge made available through the interactional work in English lessons. An understanding of the dynamics of the interactional work and what that produces opens up teaching practice to change and potentially to improve student learning outcomes. This study drew on audio-recorded data of classroom interactions between the teacher and students in four mainstream Year 10 English lessons with a culturally diverse class in a disadvantaged school, and three audio-recorded interviews with the teacher. This study employed two perspectives: ethnomethodological resources and Bernsteinian theory. The analyses of the interactional work using both perspectives showed how students might be positioned to access the literacy learning on offer. In addition, using both perspectives provided a way to associate the literacy knowledge and practices produced at the classroom level to the knowledge that counted for subject English. The analyses of the lesson data revealed the institutional and moral work necessary for the assembly of knowledge about literacy practices and for constructing student-teacher relations and identities. Documenting the ongoing interactional work of teacher and students showed what was accomplished through the talk-in-interaction and how the literacy knowledge and practices were constructed and constituted. The detailed descriptions of the ongoing interactional work showed how the literacy knowledge was modified appropriate for student learning needs, advantageously positioning the students for potential acquisition. The study produced three major findings. First, the literacy practices and knowledge produced in the classroom lessons were derived from the social and functional view of language and text in the English syllabus in use at that time. Students were not given the opportunity to use their learning beyond what was required for the forthcoming assessment task. The focus seemed to be on access to school literacies, providing students with opportunities to learn the literacy practices necessary for assessment or future schooling. Second, the teacher’s version of literacy knowledge was dominant. The teacher’s monologues and elaborations produced the literacy knowledge and practices that counted and the teacher monitored what counted as relevant knowledge and resources for the lessons. The teacher determined which texts were critiqued, thus taking a critical perspective could be seen as a topic rather than an everyday practice. Third, the teacher’s pedagogical competence was displayed through her knowledge about English, her responsibility and her inclusive teaching practice. The teacher’s interactional work encouraged positive student-teacher relations. The teacher spoke about students positively and constructed them as capable. Rather than marking student ethnic or cultural background, the teacher responded to students’ learning needs in an ongoing way, making the learning explicit and providing access to school literacies. This study’s significance lies in its detailed descriptions of teacher and student work in lessons and what that work produced. It documented which resources were considered relevant to produce literacy knowledge. Further, this study showed how two theoretical approaches can be used to provide richer descriptions of the teacher and student work, and literacy knowledge and practices that counted in English lessons and for subject English.

La protection du patrimoine culturel des minorités en droit international / The protection of cultural heritage of minority groups in international law

Le patrimoine culturel des minorités comprend l’ensemble des œuvres matérielles et non matérielles de ses artistes et de ses savants, ainsi que les créations anonymes du groupe, comme la langue, les rites, les croyances, et les modes de vies, qui marquent l’identité culturelle du groupe et qui donnent un sens à la vie de ses membres.Comment protéger le patrimoine culturel de ces groupes et assurer leur contribution au patrimoine commun de l’humanité ?La première difficulté est le présupposé selon lequel la reconnaissance de l’identité culturelle collective de ces groupes dépend de leur reconnaissance juridique dans l’ordre juridique international. De ce point de vue, le droit international est un système constitué par et pour des personnes juridiques comme les États et les organisations internationales. La personne humaine ne trouve sa place dans cet ordre qu’en tant qu’individu sujet des droits de l’homme. Mais les entités comme les peuples, les minorités et les peuples autochtones ont besoin d’une reconnaissance juridique. La généralité du concept même de patrimoine culturel des minorités constitue un second obstacle. En l’absence de conventions explicites, le patrimoine culturel de ces groupes recouvre une réalité vaste et complexe, difficile à appréhender en droit. Dans cette thèse nous étudierons comment le droit international protège le patrimoine culturel des minorités. En effet, nous considérons que, bien qu’il n’existe toujours pas de définition précise et unifiée du patrimoine culturel, les développements juridiques récents démontrent bel et bien l’émergence d’une coutume internationale protégeant le patrimoine culturel des minorités. / The cultural heritage of minorities comprises the works of its artists, its intellectuals, as well as all the creations arisen from its memory and the collective knowledge, such as the languages, the shared rituals, beliefs, and ways of life, those mark the cultural identity of the group and give the sense to the lives of its members. How to protect the cultural heritage of these groups and ensure their contribution to the common heritage of mankind? The first difficulty in this regard is the presumption that the cultural heritage of these groups is linked to their collective identity. Thus, the protection of the identity depends to the recognition of the group as the subject of international law. From this point of view, international law is a system made by and for the legal entities such as States and the international organizations. The individual finds its place in this order as subject of human rights. Nevertheless, collective entities like peoples, minorities and indigenous peoples need a legal recognition. On the other hand, the generality of the concept of cultural heritage it self is a second obstacle before its legal recognition. In the absence of explicit conventions defining it, the cultural heritage of these groups covers a vast and complex reality hard to recognize in legal terms. In this thesis we analyze how does international law protects the cultural heritage of minorities. We consider, although there is not still any clear and unified legal definition of cultural heritage, recent developments demonstrate the emergence of a customary international law protecting the cultural heritage of these groups.

A atuação de consultores na gestão da diversidade em organizações / The consultant´s performance at managing diversity in organizations

A discriminação no trabalho e a gestão da diversidade nas organizações têm sido um tema para a Psicologia Organizacional e do Trabalho no Brasil desde 1995, sendo que, ora os estudos caracterizam a discriminação, ora apontam as medidas e os efeitos da gestão da diversidade nas organizações. Esta pesquisa teve como objetivo descrever e analisar a atuação de consultores nas ações de gestão da diversidade em organizações. Com base em entrevistas realizadas com seis consultores, foi possível formular cinco categorias. A primeira, denominada os consultores, evidenciou as diversas formações deles, o compromisso ético assumido, as sugestões que fazem para os procedimentos de gestão de pessoas com vistas à promoção da igualdade e seu papel de facilitador da mudança cultural na organização. A segunda categoria significados da gestão da diversidade, descreveu as diferenças que os consultores percebem entre realizar promoção da igualdade para pessoas com deficiência e realizar promoção da igualdade para negros, bem como o horizonte positivo que envolve a mudança de práticas de discriminação para as de valorização da diversidade nas organizações, e as práticas que são denominadas de gestão da diversidade. Na terceira categoria, denominada benefícios da gestão da diversidade, foram apontados os benefícios para a organização, para o público-alvo e para todos os funcionários da organização. A quarta categoria, descreveu a forma de atuação dos consultores na ação de mudança cultural sensibilizar: promover a identificação e empatia, sensibilizar para a experiência, induzir a uma nova formação de grupo; - conscientizar: estabelecer a diversidade como um valor, evidenciar a discriminação, desfazer a padronização de uma única referência identitária, explanar sobre o respeito às diferenças e informar sobre a promoção de igualdade. A quinta categoria dificuldades enfrentadas pelos consultores mostrou a resistência à mudança nas organizações e a pouca priorização do tema da diversidade no país. Os resultados do estudo indicam que a atuação dos consultores em gestão da diversidade tem como foco a mudança cultural nas organizações. O consultor é um facilitador que se utiliza de conhecimentos da psicologia, em especial da psicologia social e organizacional, focalizando a mudança dentro da própria cultura organizacional, com a reversão dos estereótipos atribuídos às pessoas com deficiência e aos negros. A realização do presente estudo permitiu formular três níveis de recomendações: a) recomendações acadêmicas de desenvolver estudos teóricos que aproximem a psicologia social da gestão da diversidade e pesquisas que analisem os resultados das ações de gestão da diversidade; b) recomendações para as organizações de desenvolverem as ações em forma de programa de diversidade; c) recomendações para os psicólogos organizacionais chamando a atenção para o potencial de atuação desses profissionais nos programas de diversidade realizado nas organizações / Discrimination at work and diversity management in organizations has been an issue for Work and Organizational Psychology in Brazil since 1995, and, now studies characterize discrimination, sometimes pointing measures and the effects of diversity management in organizations. This study aimed to describe and analyze the role of consultants in the actions of diversity management in organizations. Based on interviews with six consultants, it was possible to formulate five categories. The first, called \"the consultants\", showed them the various formations, the ethical commitment assumed, suggestions for procedures that make people management with a view to promoting equality and its role as a facilitator of cultural change in the organization. The second category \"meanings of diversity management\", described the differences between the consultants perceive accomplish equality for people with disabilities and realize equality for blacks, as well as the positive horizon that involves changing practices of discrimination for appreciation of diversity in organizations, and practices that are called diversity management. In the third category, called \"benefits of diversity management\", were appointed the benefits for the organization, for the audience and for all employees of the organization. The fourth category, described the manner of performance of the consultants in the action of cultural change - awareness: promoting the identification and empathy, awareness of the experience, inducing the formation of a new group; - consciousness: establish diversity as a value, highlight the discrimination, standardization undo a single identity reference, explain about respect for differences and report on the promotion of equality. The fifth category \"difficulties faced by the consultants showed resistance to change in organizations and that the issue is not a priority for the country. The study results indicate that the performance of consultants in diversity management focuses on cultural change in organizations. The consultant is a \"facilitator\" who uses knowledge of psychology, especially social psychology and organizational change focusing within the organizational culture, with the reversal of stereotypes attributed disabled people and blacks. The study design allowed formulate three levels of recommendations: a) academic recommendations - to develop theoretical studies that approximate the social psychology of diversity management and research analyzing the outcome of the actions of diversity management, b) recommendations for organizations - to develop actions in the form of program diversity, c) recommendations for organizational psychologists - drawing attention to the potential of these professionals in diversity programs conducted in organizations

Tendo em vista que há uma necessidade de incluir o Ensino Religioso na proposta curricular desse programa, uma vez que esse ensino é reconhecido pelas legislações da educação brasileira global e local enquanto uma área de conhecimento. Essa argumentação se fortalece pelo fato de que o Ensino Religioso passa ser uma especificidade da Educação Popular, pois essa educação vislumbra seu olhar para a diversidade cultural. A problemática que está sendo levantada foi apoiada, legitimada e concluída através das legislações que rege o Ensino Religioso, entre elas a Constituição de 1988, a Lei de Diretrizes e Bases da Educação (LDB de n° 9394/96), Parâmetros Curriculares Nacionais para o Ensino Religioso (PCNER, 1997), além disso, foi feito interlocuções bibliográficas com principais teóricos como: Freire (1980, 1981, 1983, 2004), Zotti (2004), Passos (2007), Junqueira e Blanck (2013), Silva (2011), entre outros autores, e também através dos procedimentos metodológicos qualitativos realizados nesse estudo, o qual foi feito um Estado da Arte das bibliografias disponíveis pelo Programa de Pós – graduação em Educação (PPGE/UFPB), pela análise do material pedagógico (planejamento e sistematização) do ano e atuação da autora no Programa Escola Zé Peão (PEZP) e pelas análises dos discursos dos educadores, os coordenadores e idealizador desse programa.

Para tal fim, a pesquisa apresenta um breve histórico da implantação do serviço de TV paga no Brasil com ênfase para a evolução das regulações direcionadas ao conteúdo. Descreve, com base no modelo do Ciclo de Políticas Públicas, o estágio de implementação da Lei 12.485/11 e o texto final da mesma. Para subsidiar a avaliação, o conceito de cultura nacional é discutido, desvelando as concepções de culturas híbridas (CANCLINI, 2008) e identidades emergentes (BHABHA, 1998) e o papel destes dentro do ambiente cultural globalizado. A presente investigação permite compreender a maneira como se deu a introdução das diretrizes voltadas ao conteúdo na regulação do setor e a forma como estas influenciaram o mercado de produção audiovisual para a TV paga no Brasil. / This research aims to evaluate the efficiency of the Conditional Access Service Law (Pay TV Law - Law 12.485/11) from indicators promoting cultural diversity, fostering of independent productions and regional production. For this purpose, the research presents a brief history of pay TV service deployment in Brazil with emphasis on the development of regulations directed to the content. It describes, based on the model of the Public Policy Cycle, the implementation stage of Law 12,485/11 and the final text of the same. To support the evaluation, the concept of national culture is discussed, revealing the concepts of hybrid cultures (CANCLINI, 2008) and emerging identities (BHABHA, 1998) and their role within the global cultural environment. This research allows us to understand the way how was the introduction of guidelines geared to the content in the sector regulation and how they influenced the audiovisual production market for pay TV in Brazil.

EU, Turkey and the Kurds : The Turkish Discussion on Minority Rights

This is a study of the Turkish discussion on minority rights. The minority issue in Turkey was placed on the Turkish agenda in connection with intensified negotiations with the European Union on Turkish membership. The unusual and complex circumstances regarding the minority issue in Turkey makes it interesting and relevant to study this topic. The particular focus of this study is on the Kurdish minority and on the alternative discussion regarding the minority issue pursued within civil society groups and the academic sphere. The aim is to contribute to the understanding of the debate on minority rights within these groups. Interviews and collection of literature were made during a field study in Turkey in 2006. A result of this field study was the observation that there are forces working for a change in the notion of Turkish citizenship, and that the minority concept is controversial in Turkey for a number of reasons. Another observation was that the tension between assimilation and cultural identity is an important aspect of the discussion on minorities in Turkey. The Turkish debate has been contrasted to the debate on multiculturalism within political theory. This debate on multiculturalism is about how to deal with culturally diverse societies. There is one main position in favour of multiculturalism and one against. The ideas put forward in the Turkish discussion have been compared with this debate and it has been found that the Turkish discussion differs from this debate in some respects.

This work investigates the hypothesis although culture in the Northeast region lacks access and market of industrialized products and services - especially in what concerns cultural infrastructure - represents a remarkable cultural diversity when compared to other Brazilian regions in popular culture expressions. This hypothesis allow us to also make a significant relation between the reality presented in Northeast culture statistics and regional cultural public policies, especially when it comes to financing programs, such as Lei Rouanet . We realize that this cultural diversity is not followed by public investment in culture, still highly concentrated in Brazilian Southeast. All numbers and data were extracted from the Anuário de Estatísticas Culturais 2009 , published by the Ministry of Culture. Our work includes the main statistic researches of the Federal Government since 2004, period in which there is a higher amount of information produced about culture. The importance of this subject concerns the role of culture as a tool for socioeconomic development in regions, nations and the world, as we can see in the relevant participation of this sector in national economies, whether in the generation of jobs and incomes or in a better quality of life in communities as a whole. Culture and development over the last decade has also been a theme strongly present in the discussions of internationally recognized institutions such as UNO (United Nations Organization). / O presente trabalho investiga a hipótese de que, apesar da cultura no Nordeste ser carente no acesso, produção e oferta de bens e serviços culturais industrializados e de massa, especialmente no que tange à existência de equipamentos e infraestrutura cultural, ela oferece uma destacada diversidade cultural quando comparada às demais regiões brasileiras nas manifestações relacionadas à cultura popular. A partir da hipótese proposta, é possível ainda a construção de uma relação significativa entre a realidade apresentada pelas estatísticas de cultura no Nordeste e as políticas e financiamentos públicos culturais para a região. Observa-se que essa riqueza cultural não é acompanhada por investimentos público em cultura, altamente concentrados no Sudeste brasileiro. Todos os números e dados estudados foram extraídos do Anuário de Estatísticas Culturais 2009 (Ministério da Cultura), sendo que nosso trabalho inclui as principais pesquisas estatísticas realizadas pelo Governo Federal desde 2004, período em que há maior quantidade de informações produzidas sobre este setor. A relevância do tema concerne ao papel da cultura como vetor de desenvolvimento socioeconômico nacional e regional no Brasil e no mundo, conforme se observa na significativa participação do setor na economia das nações, seja na geração de emprego e renda ou na melhor qualidade de vida das populações em geral. A importância da cultura também ser observa em sua presença crescente nas discussões de organismos como a Organização das Nações Unidas (ONU).

Selecionamos unidades de conservação (UCs) que carregam pressupostos distintos em relação à possibilidade de conservação ambiental e presença humana: o Parque Nacional do Jaú e a Reserva de Desenvolvimento Sustentável de Mamirauá, ambos situados no Amazonas. A análise de situações de ação observadas nestas UCs, a partir da ótica do pluralismo jurídico, permitirá discutir se e como as normas positivadas pelo Estado são impostas e como são manipuladas, negociadas e subvertidas no âmbito local. Elas nos levam a refletir também sobre a importância e os limites do conhecimento científico, do direito positivado e do próprio Estado como entes legítimos para definir e gerir as políticas públicas brasileiras, notadamente as destinadas à proteção ambiental e à proteção da diversidade cultural. A partir do reconhecimento de que o direito estatal não tem o monopólio dos Direitos que regem a sociedade, e de que a ciência não tem o monopólio da verdade, este trabalho desnuda algumas fragilidades nas formas modernas de conhecimento e de juridicação, evidencia a crise das instituições estatais na criação, legitimação e efetivação de direitos e políticas públicas, e ressalta a importância da participação dos grupos sociais locais para a definição das regras e acordos socioambientais e, em última medida, para a efetivação da democracia / Abstract: From an interdisciplinary approach, focused on human sciences, this work is concerned with action situations that have occurred in protected environmental areas. We have selected two protected areas that have different presuppositions in relation to the possibility of conservation and human presence: Parque Nacional do Jaú (Jaú National Park and Reserva de Desenvolvimento Sustentável de Mamirauá (the Mamirauá Sustainable Development Reserve), both located in the Amazon. From a juridical pluralistic viewpoint, the analysis of action situations observed in these protected areas allows us to discuss if and how the positivated norms are imposed and how they are manipulated, negotiated and subverted on the local level. These action situations do not involve only questions regarding socio-environmental rights and obligations seen from a state juridical point of view - here we are dealing with the superposition of two constitutionally protected domains: environment and cultural diversity. These actions also lead us to reflect on the importance and limits of scientific knowledge, on the positivated rights, and on the State itself as legitimate delineators, capable of defining and managing Brazilian public policies, in particular those destined to the protection of the environmental and cultudiversity. After recognizing that state law does not have a monopoly on the Laws that regulate society, and that science does not have a monopoly on the truth, this work reveals some fragile settings in modern forms of knowledge and jurisdiction, highlighting the crisis of the state institutions in creating, legitimating and effectuating public policies and rights, and stresses the importance of the participation of local social groups in defining socio-environmental rules and agreements and, last but not least, effectuating democracy / Doutorado / Doutor em Ambiente e Sociedade
