本論文では、日米両国の環境法における理論状況が法体系の性質からも大いに異なることを前提とした上で、米国において1970年代以降に制定された様々な環境法をめぐる議論を取り上げ、各種救済の態様について、事後救済、事前予防の両面から検証を行った。具体的には、我が国で検討の不十分な環境市民訴訟規定適用の根拠および要件と救済の機能、各種環境規制の導入において生じる収用をめぐる議論の検討を行った。 / This research examined the remedies of U.S. environmental law after 1970s. While their legal systems are quite different, the argument in U.S. could be helpful that of Japanese. The focus point of research is on the ground of citizen suits provisions and on the case when the plaintiff made consent decree. The Message of the Jerusalem Council in the Acts of the Apostles: A Linguistic Stylistic Analysis

This study investigates how the book of Acts addresses certain local problems in Luke's community through a linguistic stylistic analysis that utilizes models of verbal art and intertextuality within a systemic-functional linguistic framework. This methodology is suited to demonstrate how Luke symbolically articulates a message to his audience through his stylistic patternings of language of the Jerusalem Council in Acts 15 and the texts with which it shares thematic content. The scheme of the study begins with the analysis of the Cornelius episode in Acts 10:1-11:18, continues with the Jerusalem Council in Acts 15:1- 29, and concludes with Paul's return to Jerusalem where he stands accused of forsaking the Law of Moses in Acts 21:17-26. Each of these episodes, sharing patterns of repetition, plays a role in the symbolic articulation of a message in the book of Acts. First, the Cornelius story establishes the legitimacy of table fellowship among Jewish and Gentile believers against opposing Jewish value positions regarding moral purity. Next, the Jerusalem Council in Acts 15 recapitulates the Cornelius episode but then further develops value orientations concerning social relations among Jewish and Gentile believers in the church, principally by means of the Apostolic Decree. Then, the repetition of the Apostolic Decree in Acts 21 clarifies its meaning according to different situational variables. The thesis of this study is that these patterns reveal contextual elements of a particular conflict the early church faced over the communal integration of Jewish and Gentile believers - namely, that Jews were susceptible to splitting off from multi-ethnic churches due to the pressures of a Jewish separationist ideology. The book of Acts subverts this ideology by means of the foregrounded patternings identified in this study. These patternings, which serve to identify foregrounded thematic formations, orient the reader to the proper heterglossic backdrop and reveal that Luke engages a particular Noahic tradition associated with the discursive practice of rewriting sacred scripture in Second Temple Jewish literature, not to align with its value orientations but to subvert it and thereby convince Jewish believers not to withdraw from the community of God.

Chile) in the light of the parties positions / Análisis de los principales elementos de la sentencia de la Corte Internacional de Justicia en el caso de la controversia marítima (Perú c. Chile) a la luz de las posiciones de las partes

On January 27, 2014 the International Court of Justice, principal judicial organ of the United Nations ruled in the case of the maritime dispute (Peru v. Chile), being Peru the one that brought forth the case in January 2008. During the proceedings in Court, the parties presented fundamentally different positions on the existence of a maritime boundary between them and how the Court should proceed solving the dispute. The Court should have considered the multiple legal reasonings presented by the States parties over the years to arrive to its ruling. Particularly, some of the legal reasonings presented by Peru were accepted by the Court and considered in the ruling, beginning from the interpretation given to the proclamations of Peru and Chile in 1947, going through the reasonings Peru presented about the 1952 Santiago Declaration (It was the main topic presented by Chile, which was discarded by the Court) until the reasoning presented by Peru saying that the 1954 Special Maritime Frontier Zone Agreement didn’t create a zone of tolerance that extends to 200 nautical miles. However, the Court considered that in the 1954 agreement the parties accepted the existence of a tacit agreement, but this existence was not presented by them in the Court even though it has a legal support in the jurisprudence of the International Court of Justice. Then, the Court had to determine the extent of the tacit agreement, a very difficult duty because the parties hadn’t considered the existence of that situation and its extension. After establishing the implied legal agreement was for 80 nautical miles along a parallel of latitude, the Court proceeded to establish a maritime boundary applying thoroughly the rules and principles of maritime delimitation presented by Peru, which applied to the case determine the presence of an equidistant line. In relation to the starting-point of the maritime boundary, the Court didn’t use the point presented by Peru but, in a correct way, made it clear that the starting-point of the maritime boundary and the starting-point of the land boundary don’t have to match necessarily. Finally, the way how the Court established the maritime boundary recognizes, with no doubt, that the area previously named “outer triangle” belongs to Peru, as this country claimed and as Chile opposed repeatedly over the years. In summary, it is a decision based on International Law and adopted under the evidence presented in Court. The Court applied and confirmed various legal arguments presented by Peru during the process, in spite of the opposing position of Chile. / El 27 de enero de 2014, la Corte Internacional de Justicia (CIJ), órgano judicial principal de la organización de las Naciones Unidas, dio su sentencia en el caso de la controversia marítima (Perú c. Chile), el cual el Perú presentó ante ella en enero de 2008. Durante el proceso ante la Corte, las partes presentaron posiciones fundamentalmente distintas sobre la existencia de un límite marítimo entre ellas y sobre cómo la Corte debía proceder para resolver este caso. Para llegar a su fallo, la Corte debió evaluar esos múltiples argumentos legales planteados por ambos Estados a lo largo de años. En particular, varios de los argumentos legales planteados por el Perú fueron aceptados por la Corte y acogidos en el fallo, desde la interpretación que dio a las proclamaciones de Perú y Chile de 1947, pasando por los argumentos que planteó el Perú sobre la Declaración de Santiago de 1952 (que había sido el núcleo del caso argumentado por Chile, el cual fue descartado por la Corte), hasta el argumento peruano en el sentido de que el Convenio sobre Zona Especial Fronteriza Marítima de 1954 no creó una zona de tolerancia que se extienda por doscientas millas marinas. Sin embargo, la Corte consideró que en ese tratado de 1954 las partes reconocieron la existencia de un acuerdo tácito, figura que no argumentaron las partes ante la Corte, pero que tiene su fundamentación legal en jurisprudencia previa de la CIJ. La Corte luego tuvo que determinar la extensión de ese acuerdo legal tácito, labor sumamente difícil ya que las partes no habían contemplado la existencia de esa figura ni argumentado hasta dónde se habría extendido la misma. Luego de establecer que el acuerdo legal tácito se extendía por ochenta millas marinas a lo largo de un paralelo de latitud, la Corte procedió a establecer un límite marítimo siguiendo exactamente las normas y principios sobre delimitación marítima planteados por el Perú, los cuales aplicados al caso determinan el establecimiento de una línea equidistante. Con relación al punto de inicio del límite marítimo, la Corte no empleó el punto planteado por el Perú pero, correctamente, dejó en claro que el punto de inicio del límite marítimo y el punto de inicio del límite terrestre no tienen necesariamente que coincidir. Finalmente, la manera como la Corte estableció el límite marítimo reconoce sin lugar a duda que el área antes llamada «triángulo exterior» corresponde exclusivamente al Perú, como ese Estado argumentó y Chile se opuso repetidas veces a lo largo de los años. En resumen, se trata de una decisión ajustada al derecho internacional y tomada sobre la base de la evidencia a disposición de la Corte, en la que esta emplea y confirma diversos de los argumentos legales planteados por el Perú durante el proceso, a pesar de todo lo que Chile argumentó contrariamente.

The aim is to provide a view on the development of the functions, aims and content of interest-based adult education based on the study of historical documents. Historical and political context is mentioned. Chosen strategic and legislative documents, which influenced the development of interest-based adult education, are analysed in detail. Both the specifics and the institutional support of interest- based adult education in each epoch are described. Diploma Thesis „Polyfunctional building“. The work deals implementation project of polyfunctional building in Jihlava. Object is situated on Jihlava suburb in emerging part called „Horní Kosov“. Land is gently sloping from west to east. It continues for Buková street. The building has six floors and a basement. The basement is made from monolithic reinforced concrete. It is used as garages. Floors are made of ceramic bricks with isolation . First floor contains four commercial premises and main entry for housing part. Seventeen flats are situated from second to sixth floor. Sizes of apartments are 1+kitchen corner to 4+kitchen corner with terraces and balcony. Roofing is solved with simple flat roof. Heating will be ensured with central heating. Every apartment, commercial premises, shared premises are going to have it’s own gas boiler. Polyfunctional building is connected on a local road – Buková street, which is connected to new communication. Within multifunctional building twenty parking slots is designed at the basement. Next fourteen parking slots is designed outside.

Comme son titre l’indique, la présente thèse porte sur la canonicité de la Conférence des évêques. Elle vise à réfléchir au degré d’autorité decette nouvelle institution spécifiquement latine. La Conférence des évêques est devenue un organe permanent, alors que le Synode desévêques né en 1965 sous le pontificat de Paul VI n’a pas reçu cette caractéristique. La Conférence des évêques est-elle une expression de lacollégialité épiscopale ? Le Concile Vatican II (1962-1965) l’a admise comme l’une des composantes de cette collégialité. Vatican II l’aconsacrée et institutionnalisée (Constitution Lumen Gentium et Décret Christus Dominus), mais sans parvenir à lever toutes les questionsliées à son autorité et à sa juridiction. Le Synode des évêques de 1969, dont le thème annoncé était précisément la collégialité vécue, a aussiabordé la question des Conférences épiscopales. À cette Assemblée synodale, le débat a concerné principalement les moyens à mettre enoeuvre pour réaliser une coopération réelle et efficace entre Rome et les Conférences épiscopales et pour garantir une meilleure autonomie àces Conférences, sans pour autant entraver la liberté du Pape, ni porter atteinte à l’autorité de l’évêque diocésain. Il s’en est suivi une plusgrande détermination des principes qui régissent d’une part les relations entre les Conférences épiscopales et Siège apostolique, et d’autrepart les liens des Conférences épiscopales entre elles.Mais ce débat n’a toujours pas été tout à fait dirimé, surtout quant à l’autorité magistérielle de la Conférence des évêques. La qualificationjuridique en 1983 par les soins de la codification latine semble n’avoir pas suffi. Témoigne de ce malaise persistant le Synode des évêques de1985. Celui-ci a formellement demandé une réévaluation de l’institution de la Conférence des évêques : « Puisque les Conférencesépiscopales sont particulièrement utiles, voire nécessaires dans le travail pastoral actuel de l’Église, on souhaite l’étude de leur « status »théologique pour qu’en particulier la question de leur autorité doctrinale soit plus clairement et plus profondément explicitée, compte tenude ce qui est écrit dans le décret conciliaire Christus Dominus n° 38 et dans le Code de droit canonique, can. 447 et 753 ». Cela aoccasionné deux efforts institutionnels, l’un consultatif (L’Instrumentum laboris de 1987 de la Congrégation pour les évêques), l’autre décisionnel (le Motu proprio Apostolos suos de 1998). Dans cette dernière norme de requalification théologique et juridique, le Pape Jean-Paul II réaffirme de manière plus décisive la spécificité de la Conférence des évêques. Ce vaste dossier peut sembler redondant et lancinant. Les chercheurs peuvent constater que le problème de l’autorité de la Conférence des évêques s’avère encore difficile à trancher. En effet, les principaux paramètres de l’édifice ecclésial ne sont-ils pas profondément interrogés ? / As it is suggested within the title, the present thesis focuses on the canonicity of the Conference of bishops. It aims to reflect the degree ofauthority of this new specifically Latin Institution. The bishops Conference has become a permanent body, while the Synod of bishops whichwas born in 1965, under Pope Paul VI did not receive this feature. Is the Conference of bishops an expression of episcopal collegiality? TheSecond Vatican Council (1962-1965) was admitted as a component of this collegiality. Vatican II was consecrated and institutionalized(Constitution Lumen Gentium and Decree Christus Dominus), but failed to raise any issue relating to its authority and jurisdiction. The 1969Synod of bishops, whose theme was announced, more precisely lived collegiality, also addressed the question of episcopal conferences. Atthe Synod Assembly, the debate has mainly concerned the means to implement in order to achieve a real and effective cooperation betweenRome and the bishops' conferences, and to ensure greater autonomy to these conferences, without impeding the freedom of the Pope, orundermining the authority of the diocesan bishop. There ensued a greater commitment to the principles which govern, on the one hand, therelationship between the Episcopal Conferences and the Apostolic See, and on the other hand, the links between the different episcopalConferences.But that debate has still not been completely invalidated, especially as it refers to the teaching authority of the Conference of bishops. Thejuridical qualification, in 1983, through the efforts of the latin codification seems to have been insufficient.The Synod of Bishops, in 1985, demonstrates this persistent discomfort. It has formally requested a reassessment of the institution of theConference of bishops: « Since the Episcopal Conferences are particularly useful, even necessary in the current pastoral work of theChurch, we want to study their theological " status " so that in particular the issue of their doctrinal authority would be more clearly anddeeply explained, taking into account what is written in the conciliar Decree Christus Dominus, item N° 38 and in the Code of Canon Law,can. 447 and 753 ». This situation derived to two institutional efforts: an advisory one (The Instrumentum laboris of 1987 of theCongregation for bishops), then another one, a decision (the Motu proprio Apostolos suos 1998). In this last theological standard and juridicalrequalification, Pope John Paul II reaffirms, more decisively, the specificity of the Conference of bishops. This extensive file may seem to beredundant and haunting. Researchers can notice that the problem of authority of the Conference of bishops remains difficult to determine. Infact, are the main parameters of the ecclesial structure not deeply questioned ?
