Consumerism is a superlative of purchases, belongings and use, a dependence of non essential goods (superfluous) to satisfy endless desires. It is impossible to satisfy endless desires: therefore the expression transcendental goal of consumption, beyond the capacity to be achieved. The transcendental dimension of consumption, through the symbolism of merchandises potencialized by the prestige brands, give enchantment and sense to the individual, and fulfills the territory that belonged to the family, Church and community. The subject tries to obtain, with the brand-fetished merchandise, a satisfaction of his mimetic desire, and/or compensate absent or fragile values, which is strengthened by advertising. The ultimate meaning of life of materialistic individuals produces immediate effects which are positive for them as well for the economy, but in the future potentially negative for the planet, for the society, as well as for the individuals. / Esta tese objetiva comprovar que, na sociedade de consumo, indivíduos consumistas transcendem sua relação funcional com as mercadorias, buscando nas marcas de prestígio uma dimensão espiritual, que substitui ou complementa as experiências religiosas tradicionais, e que se revela fetichizada. O consumismo é superlativo de compras, posses e uso, uma dependência de bens não essenciais (supérfluos) para atender aos desejos sem fim. É impossível satisfazer a desejos sem fim: daí a expressão meta transcendental do consumo, posicionada além do alcance e da capacidade de atingi-la. A dimensão transcendente do consumo, por meio do simbolismo das mercadorias potencializado pelas marcas de prestígio, propicia encantamento e sentido ao indivíduo, e se presta a preencher o espaço outrora ocupado pela família, Igreja e comunidade. O sujeito busca, na mercadoria fetichizada pela marca, satisfazer seu desejo mimético, e/ou compensar valores frágeis ou ausentes, o que é reforçado pela propaganda. O sentido último da vida dos indivíduos materialistas produz efeitos imediatos que são positivos para eles e para a economia, mas potencialmente negativos mais à frente para o planeta, para sociedade e para os indivíduos.

Developing a model for prodicting customer satisfaction in relation to service quality in University libraries in Sri Lanka

Customer satisfaction, from the service quality perspective, has emerged as a new modus operandi for assessing customers’ perceptions and/or expectations of services in order to re-orient and regulate existing services. University library administrators in Sri Lanka, realising the necessity of complying with customer perception of high quality service, have begun to search for alternative ways to satisfy their clientele on the basis of service quality. This study therefore aims to meet this need by developing a model to assess the extent to which service quality indicators and other explanatory attributes may be used to predict customer satisfaction, from a service quality perspective. The research process used in the study was the “onion model,” which involved a combination of positivist and phenomenological inquiries that led to the use of qualitative and quantitative approaches in line with the purpose of the study, which was exploratory in nature and searched for causality. The design of the study involved two main stages: the exploratory stage and the main stage. In the exploratory stage, attributes and domain identification of service quality was carried out with a sample of 262 subjects. Based upon the exploratory study, four provisional models were constructed and tested in the main study, using a sample of 1840 subjects. The model based on the performance-only paradigm and the linearity assumption between the constructs was found to be the best parsimony model that provided for enhanced predictive performance, calibration and potential insight into attributes and domain relevance. Regarding overall satisfaction, responsiveness, supportiveness, building environment, collection and access, furniture and facilities, technology and service delivery as quality domains, involvement with the service, and knowledge of the customers as situational attributes and age, member category, university and gender as socio-demographic attributes were found to be significant. The final model may be used to design a simple measurement or monitoring process of library performance, and it may also be a useful tool for diagnosing service quality locally. This research further provides a keystone for other studies and may also stimulate the momentum of current research on service quality and/or customer satisfaction / Information Science / D. Entwicklung von Berufspräferenzen im Schulalter

Ausgehend vom Rahmenmodell zur Persönlichkeitsentwicklung von Schüler/inne/n nach Pekrun/Helmke (1991), der „Eingrenzungs- und Kompromisstheorie der Berufswahl“ von Gottfredson (2005) und der Typologie des Aufbaus von Berufsidentitäten Fends (1991) wird der Berufsfindungsprozess von Schüler/inne/n der Grundschule (Kl. 5) bis in die Sekundarstufe (Kl. 9) untersucht. Analysiert werden die Berufswünsche von 600 bis 3000 Befragten und ausgewählte Variablen des längsschnittlichen Datensatzes der DFG-Projekte NOVARA, SABA und AIDA (geleitet von Prof. Dr. Renate Valtin). Es werden zwei Fragestellungen verfolgt: (1) Ist die Berufswahltheorie von Gottfredson geeignet, empirisch verifiziert die früh zu beobachtende geschlechtsspezifische Weichenstellungen in der beruflichen Orientierung fundiert zu erklären? (2) Lassen sich Zusammenhänge zwischen einer krisenhaften Bewältigung der Entwicklungsaufgabe „Berufswahl“ und der Entwicklung ausgewählter schulleistungsrelevanter Persönlichkeitsmerkmale nachweisen? Wenn ja, ab wann? Die Analysen bestätigten die Forschungsbefunde zur Geschlechtstypik der beruflichen Interessenorientierung, zum Wandel vom „Traumberuf“ zum realistischen Berufswunsch sowie zu Schwankungen der Häufigkeit geäußerter Berufswünsche in Abhängigkeit von Klassenstufe und Schulform. Des Weiteren bestätigte sich die in der Berufswahltheorie von Gottfredson beschriebene Bedeutung der Kategorie „Geschlecht“ für die Präferenz bestimmter Berufswünsche, des noch akzeptierten Prestiges der Berufswünsche und des mit der Realisierung und Ausübung des gewünschten Berufs verbundenen noch zu bewältigenden kognitiven Anspruchs. Zusammenhänge zwischen der Entwicklung schulleistungsrelevanter Persönlichkeitsmerkmale ab dem Grundschulalter und einer krisenhaften Bewältigung der Entwicklungsaufgabe „Entwicklung einer beruflichen Orientierung“ in der Sekundarstufe I konnten in Bezug auf die allgemeine Schulfreude der männlichen Befragten nachgewiesen werden. / Based on Rahmenmodell zur Persönlichkeitsentwicklung von Schüler/inne/n by Pekrun and Helmke (1991), "Eingrenzungs- und Kompromisstheorie der Berufswahl" Gottfredson (2005) and Typologie des Aufbaus von Berufsidentitäten Fends (1991), the career choice process of primary school students (Class 5) to secondary school (Class 9) is examined longitudinally. The career desires of 600 to 3000 subjects are examined longitudinally, along with selected variables of the longitudinal dataset from the DFG projects NOVARA, SABA and AIDA (led by Prof. Dr. Renate Valtin). Two questions are considered: (1) is the ''Circumscription und Compromise Theory'' according to Gottfredson suitable for explaining the empirically verified gender-specific directions in career orientation, which can be observed early, on a theoretical basis? (2) Can interconnections between a critical mastering of the development task "career selection" and the development of selected school performance-related personality attributes be demonstrated? If yes, from when? Analyses confirm the gender-specification of career orientation, about the change from "dream job" to realistic career choice and about the fluctuations in frequency of stated career desires depending on school year and type of school. Moreover, the importance of the category "gender" described in the "circumscription and compromise theory" of career choice by Gottfredson is confirmed for the preference of certain career desires, of the still accepted prestige of the career desires and of the cognitive requirement yet to be mastered in conjunction with the realisation and exercise of the desired profession. Connections between the development of school performance-relevant personality attributes from primary school age and a critical mastering of the development task "development of a career orientation" in Sekundarstufe I (equivalent to Key Stage 3) could be demonstrated with regard to general happiness at school of the male subjects.

Conflito civil e liberdade: o antagonismo de desejos como fundamento da liberdade republicana em Maquiavel / Civil conflict and freedom: the antagonism of desires as the basis of the republican freedom in Machiavelli

More specifically, is the understanding of the concept of republican freedom giving special attention to his theory of the humors. The central hypothesis is that the freedom can only be reached by a balance point among the forces in conflict. For that, it is necessary that the conflict, not being annulled, be rationally regulated and normalized by the republican institutions, changing from negative force into force capable to converge in the State the commonwealth, the social order and the freedom of the whole political body. The republican law, born of the permanent confrontation of the antagonistic desires, subverts the negative character of the humors of big and people and it channels the force for the political life, demanding active citizenship of their members, it means, the participation of both humors in the public space as political agents for the maintenance of the freedom. To make it clear, we analyzed, firstly, the position of the tradition and the perspectives of the republicanism towards the problem of the political conflict in order to verify the republican elements present in Machiavelli s political thought. In a second moment, we tried to demonstrate the characteristics of the conflict of the humors, in agreement with those which the desire of the big gets confused with a desire of power, while the desire of the people is associated to freedom. In this perspective, we sought to elucidate the meaning of the good and the bad conflicts for the political life. Afterwards, we tried to highlight the need and the importance of the continuous foundation and re-foundation of the freedom front to the corruption of the republic, resulting from the homogenization of the manners of wanting of the humors in conflict. And, finally, we presented the dynamics of the conflict of the humors of big and people in the civil principality. In this regime, Machiavelli presents the conflict much more in the context of the political alliances than properly in relation to the freedom. From this point of view, we sought to demonstrate that in the civil principality the conflict is thought by Machiavelli not from the optics of the freedom, what is possible only in the republic, but from its role in the conservation and in the maintenance of the prince s power. For this reason, we tried to defend the theory of the republicanism of Machiavelli, according to the true political freedom is only possible when the antagonistic humors can relieve their desires through the participation in the public space of debates and collective decisions, what can only happen in a republican regime. / O objetivo deste trabalho consiste em analisar o lugar que o conflito de grandes e povo ocupa no pensamento político de Maquiavel e investigar a sua relação com a liberdade política. Mais especificamente, trata-se de compreender o conceito de liberdade republicana concedendo especial atenção à sua teoria dos humores. A hipótese central é a de que a liberdade somente pode ser alcançada mediante um ponto de equilíbrio entre as forças em conflito. Para isso, é necessário que o conflito, não sendo anulado, seja racionalmente regulado e normalizado pelas instituições republicanas, convertendo-se de força negativa em força capaz de fazer convergir no Estado o bem comum, a ordem social e a liberdade de todo o corpo político. A lei republicana, nascida do permanente confronto dos desejos antagônicos, subverte o caráter negativo dos humores de grandes e povo e canaliza sua força para a vida política, exigindo cidadania ativa de seus membros, isto é, a participação de ambos os humores no espaço público como agentes políticos para a manutenção da liberdade. Para esclarecê-lo, analisamos, primeiramente, a posição da tradição e as perspectivas do republicanismo frente ao problema do conflito político a fim de verificar os elementos republicanos presentes no pensamento político de Maquiavel. Num segundo momento, procuramos demonstrar as características do conflito dos humores, de acordo com as quais o desejo dos grandes se confunde com um desejo de poder, enquanto o desejo do povo se associa à liberdade. Nesta perspectiva, buscamos elucidar o significado dos bons e dos maus conflitos para a vida política. Em seguida, procuramos destacar a necessidade e a importância da contínua fundação e re-fundação da liberdade frente à corrupção da república, resultante da homogeneização dos modos de desejar dos humores em conflito. E, por fim, apresentamos a dinâmica do conflito dos humores de grandes e povo no principado civil. Neste regime, Maquiavel apresenta o conflito muito mais no contexto das alianças políticas do que propriamente em relação à liberdade. Deste ponto de vista, buscamos demonstrar que no principado civil o conflito é pensado por Maquiavel não a partir da ótica da liberdade, o que é possível apenas na república, mas do seu papel na conservação e na manutenção do poder do príncipe. Por esta razão, procuramos defender a tese do republicanismo de Maquiavel, segundo a qual a verdadeira liberdade política somente é possível quando os humores antagônicos podem desafogar seus desejos mediante sua participação no espaço público dos debates e das decisões coletivas, o que pode ocorrer apenas num regime republicano.

Theoretical part features information about marketing in service sektor, shows in legal profession domain and gets acquainted with used methods. Practical part analyses contemporary state in legal office. By means of suitable methods is drafted the measure, how to eliminate barriers, handicaps and reserves and to take advantage of opportunities.

New Criminal code came into power in 2003. It changed the concept of indecent assault. The new modern concept of indecent assault is more related to the changes in society, but sometimes is difficult to apply, because of its novelty and indetermination. Therefore it is necessary to determine the legal concept of indecent assault in order to avoid controversial evaluation of sexual offences and their elements of proof. So the aim of this study is to analyse indecent assault from historical point of view, to describe forms of indecent assault and aggravating circumstances. The proposed review of indecent assault contains legal evaluation of all attributions according to their legal evaluation in Lithuanian and foreign criminal law. Theoretical evaluation of indecent assault is linked to the examples of court’s practise by underlining controversial aspects of concept of indecent assault and proposing possible ways to define them.

Consumption in life transition : How do unemployed consumers behave in the marketplace?

Background: We live in a world where not everyone is employed; numerous people havelost their jobs due to several factors where one of them is the economic crisis. This has hada huge impact on Sweden and the unemployment rate. Previous research has shown thatinflation, unemployment, and high interest rates represent risks to consumer welfare. We all consume daily, or on occasions, but how do unemployed consumers consume, what do they consume and why? In this area, the authors have found a knowledge gap in literature; therefore exploring this phenomenon is of interest.   Purpose: The purpose of this study is to explore and illustrate how consumers who have experienced a life transition, from employment to unemployment, are affected by this and how it has an impact on their consumption.   Method: This is an exploratory study performed with a qualitative and an abductive approach, where the authors used primary data collection through semi-structured in-depth interviews in Swedish with 16 unemployed consumers. These unemployed consumers were selected at Arbetsförmedlingen, the public employment service, in Jönköping.   Results: By living in unemployment the consumers have been affected psychologically, physically, financially and socially. Their identity has changed for each of them since they have to adapt to the new circumstances in their life. The new life situation has had an impact on the consumer’s well-being where depression, anxiety, and a feeling of being the underdog in the society is present. Their new life situation has implied a change in their consumption behavior since they nowadays have to prioritize the basic needs. Many of the respondents used explicit and implicit shopping-list in order to reduce their impulse buying. The contribution that the authors have done to the theory of resistance is a fourth category called ‘Everyday life resistance’ which explains the behavior of people who live in unemployment, i.e. they always have to think about resisting temptations, wants, desires, and avoiding situations where the result may be unnecessary consumption. The consumers in this study are highly involved in their consumption behavior, which the authors have chosen to call ‘reversed habitual decision making’. This kind of involvement is very high despite the high- or low risk category of the product. Their new life situation has made them more aware of product alternatives, market supply, prices, and also knowledge about their own resistance in the marketplace. / Bakgrund: Vi lever i en värld där inte alla har en anställning, en omfattande andel av befolkningen har förlorat sitt jobb på grund av flera faktorer, där en av dem är den ekonomiska krisen. Detta har haft en stor påverkan på Sverige och dess arbetslöshet. Föregående studier har visat att inflation, arbetslöshet och hög räntesats representerar risk för konsumentens välbefinnande. Vi alla konsumerar dagligen eller vid speciella tillfällen, men hur konsumerar en arbetslös konsument, vad konsumerar dem och varför? Inom detta område har författarna funnit ett kunskaps gap i litteraturen, därav är en undersökning av detta fenomen av intresse.   Syfte: Syftet med denna studie är att utforska och illustrera hur konsumenter som har genomgått en livsförändring, från att ha varit anställd till att vara arbetslös, är påverkade av detta och hur detta har inverkat på deras konsumtion.   Metod: Detta är en explorativ studie genomförd med en kvalitativ och abduktiv tillvägagångssätt där författarna har använt sig av primär information samlad genom, till viss del, strukturerade djupgående intervjuer på svenska med 16 arbetslösa konsumenter. Deras identitet har förändrats då de måste anpassa sig till den nya livssituationen. Den nya situationen har påverkat konsumenternas hälsa då de känner av depression, ängslan och känner sig mindre värda i samhället. Deras nya livssituation har inneburit en det förändringar i deras konsument beteende eftersom de numera måste prioritera sina primära behov. Många av studiens deltagare använde sig av explicita och implicita inköpslistor för att minimera spontanköp. Författarnas bidrag till teorin om motstånd är en fjärde kategori kallad ‘Vardagligt motstånd’ vilket förklarar beteendet hos arbetslösa personer dvs. de måste hela tiden tänka på att motstå frestelser, begär och försöka undvika situationer där onödiga inköp kan uppstå. Konsumenterna i denna studie är synnerligen involverade i sitt konsument beteende, detta har författarna valt att benämna ’omvänt rutin besluts genomförande’. Denna typ av involvering är väldigt hög oavsett om produktkategorin innebär hög- eller låg risk. Deras nya livssituation har gjort dem mer medvetna om alternativa produkter, marknadens utbud, priser och ny kunskap om deras egna motstånd inom konsumtionssamhället.

Deras identitet har förändrats då de måste anpassa sig till den nya livssituationen. Den nya situationen har påverkat konsumenternas hälsa då de känner av depression, ängslan och känner sig mindre värda i samhället. Deras nya livssituation har inneburit en det förändringar i deras konsument beteende eftersom de numera måste prioritera sina primära behov. Många av studiens deltagare använde sig av explicita och implicita inköpslistor för att minimera spontanköp. Författarnas bidrag till teorin om motstånd är en fjärde kategori kallad ‘Vardagligt motstånd’ vilket förklarar beteendet hos arbetslösa personer dvs. de måste hela tiden tänka på att motstå frestelser, begär och försöka undvika situationer där onödiga inköp kan uppstå. Konsumenterna i denna studie är synnerligen involverade i sitt konsument beteende, detta har författarna valt att benämna ’omvänt rutin besluts genomförande’. Denna typ av involvering är väldigt hög oavsett om produktkategorin innebär hög- eller låg risk. Deras nya livssituation har gjort dem mer medvetna om alternativa produkter, marknadens utbud, priser och ny kunskap om deras egna motstånd inom konsumtionssamhället.</p>
