The adopted methodology was the bibliographical research, approaching the mainly subjects: Information Science, University Libraries, Copyrights and Information Right. Among the raised solutions, the Open Access, the Text Book Program, e-books and the project Folder of the Professor. Are focus one expectation with this work is that the presented solutions can help to derease the doubts and shows viable ways to solve the differences between the Information Right and the Copyright. Thus opening way for the practical professionals based on the effective culture of the area that in many cases is more restrictive than the instituted laws or the codes of ethics. / Este trabalho analisa a rela??o entre Direito Autoral e Direito ? Informa??o a fim de estabelecer as bases conceituais e fazer um levantamento de solu??es, para que os profissionais da informa??o, atuantes em bibliotecas universit?rias, possam atender ?s necessidades informacionais dos seus usu?rios, ao trabalharem com essas duas formas de direito. A metodologia adotada foi a pesquisa bibliogr?fica, que abordou, principalmente, os temas: Ci?ncia da Informa??o, Bibliotecas Universit?rias, Direitos Autorais e Direito ? Informa??o. Dentre as solu??es levantadas, destacam-se o Acesso Aberto, o Programa de Livro Texto, os e-books e o projeto Pasta do Professor. Espera-se com este trabalho que as solu??es apresentadas possam auxiliar a diminuir as d?vidas e apontar caminhos vi?veis para a resolu??o dos impasses existentes entre o Direito ? Informa??o e o Direito Autoral, o que abrir?, o caminho para a revis?o de pr?ticas profissionais baseadas na cultura vigente da ?rea, as quais, em muitos casos, s?o mais restritivas que as leis institu?das ou que os c?digos de ?tica.

Esta pesquisa objetiva confrontar os fundamentos das atuais regulamentações dos direitos autorais com aspectos de processos de registro e difusão musicais entre grupos Mbyá-Guarani no Rio Grande do Sul. A emergência da música étnica no mercado musical mundial, a promoção de políticas públicas de proteção ao patrimônio cultural e a difusão de meios tecnológicos de registro musical são tomados nesta pesquisa como fatores que afetaram significativamente os processos de criação musical entre grupos indígenas nas últimas três décadas. Nesta etnografia procurei privilegiar casos em que nem mesmo a atribuição de autoria a uma coletividade é suficiente para resolver impasses surgidos em tentativas de definição autoral destas criações, o que evidencia certas limitações dos sistemas de proteção vigentes, restritos a uma perspectiva antropocêntrica e individualista. As concepções êmicas referentes a mediações por onde circulam as expressões musicais apontam, simultaneamente, para a participação de diferentes categorias de entidades que povoam o cosmos nos processos de criação musical, o que varia em relação a cada repertório, e para a relevância do controle sobre a circulação destas expressões. / This research aims to confront the foundations of current regulations of copyright issues with the processes of recording and broadcasting music between groups Mbyá- Guarani in Rio Grande do Sul The emergence of ethnic music in the music world, promoting public policies to protect the cultural heritage and the dissemination of technological means of recording compatibility are taken in this research as factors that significantly affected the processes of musical creation, among indigenous groups in the past three decades. Therefore, the copyright became a strategic element to the social, economical, political and cultural configuration of the Information Society. The history of copyright, including the creation of the current international regime for the protection of intellectual property rights, reveals the link established between this category of protection and international political economy. At the same time, new information and communication technologies allow diversification in creating process and access to knowledge, as well as enable the making of new devices which enhance the protection of intellectual assets. This scenario led to the questioning of the forms of regulation of copyright that goes through a process of reconstruction of meaning. The contradiction that is established in the Information Society is emphasized in the field of scientific production and communication, since it involves legitimate social interest as well as principles common to the scientific community. The present study aims to examine this contradiction in the international scenario considering the normative aspects linked to the international copyright protection, evaluating and comparing documents and international regulatory actions of the following international organizations: UNESCO, WIPO and WTO. The objective is to verify, by comparative analysis and data from interviews with key informants, the level of openness of organizations to dialogue with civil society. It will analyze the specific case of the inclusion of Open Access on the Agenda for Development administered by WIPO, and the effects of these debates on the international regime for the protection of intellectual property, as well as on the reconstruction of the legal framework of copyright in Brazil. / A Sociedade da Informação é definida em termos da produção, circulação e acesso ao conhecimento. Por isso, o direito autoral torna-se elemento estratégico para a configuração socioeconômica, política e cultural da Sociedade da Informação. A história da criação do direito autoral, incluindo a formação do atual regime internacional de proteção dos direitos de propriedade intelectual, nos revela o elo que se estabeleceu entre essa categoria de proteção dos bens intelectuais e a economia política internacional. Ao mesmo tempo, as novas tecnologias da informação e comunicação possibilitam a diversificação nos processo de criação e acesso ao conhecimento, bem como permitem a criação de novos dispositivos que intensificam a proteção dos bens intelectuais. Esse cenário provocou questionamento quanto às formas de regulação do direito autoral que passa por um processo de reconstrução de significado. A contradição que se estabelece na Sociedade da Informação é ressaltada no campo de produção e comunicação científica, uma vez que envolve interesses sociais legítimos, além de princípios e práticas comuns à comunidade científica. O presente estudo tem a finalidade de analisar essa contradição no cenário internacional considerando os aspectos normativos ligados ao regime internacional de proteção dos direitos autorais, avaliando e comparando documentos internacionais e ações regulatórias das seguintes Organizações Internacionais: UNESCO, OMPI e OMC. Objetiva-se verificar, pela análise comparativa e dados obtidos em entrevistas com informantes-chave, o nível de abertura dessas organizações para o diálogo com a sociedade civil. Será analisado o caso específico da inclusão do Open Access nas discussões da Agenda para o Desenvolvimento administrada pela OMPI e os efeitos disso para o regime de proteção da propriedade intelectual, bem como para a reconstrução do marco legal do Direito Autoral no Brasil.
