From the mid 1850s through the early 1900s, the white middle and upper class inhabitants of British Columbia persevered in their attempts to solve the ‘servant problem’ and to re-create the British domestic sphere in a new land. Some families emigrated with their British servants in tow. There were repeated efforts to import English girls and women en masse. And many employers were obliged to tolerate ‘strangers’ (Aboriginal and Chinese servants) in their homes. British Columbia’s peculiar ‘servant problem’ ensured that the Imperial vision of employer-servant relations and domestic order could not be exactly reconstructed.

Servidão doméstica : uma análise do caso Siwa-Akofa Siliadin à luz das normas da organização internacional do trabalho

O presente estudo tem por escopo analisar o caso da jovem Siwa-Akofa Siliadin, aliciada no Togo, em 1994, para prestar serviços na França como doméstica. Ao chegar no país foi submetida à servidão, impedida de completar os seus estudos e sem receber qualquer remuneração pelos serviços prestados, tampouco direitos laborais mínimos como o limite da jornada de trabalho diária, o descanso semanal remunerado e a habitação adequada lhe foram fornecidos. Trata-se de um leading case que aborda as práticas de tráfico humano, de trabalho forçado e de servidão doméstica. A escravidão contemporânea ocorre através do trabalho forçado, este se dividindo em espécies dentre as quais estão o trabalho escravo, a servidão e a servidão por dívida. Com quaisquer destas práticas pode ocorrer simultaneamente o tráfico de pessoas. A prática da escravidão doméstica, também chamada de servidão doméstica, inclui-se no rol de trabalhos forçados, verificando-se no caso concreto a qual das espécies de servidão pertence. Ocorre tanto em países ricos quanto em países emergentes e tem como grupo de pessoas mais vulnerável aos aliciadores as mulheres, os menores de idade, os migrantes, os pobres, os de baixa escolaridade. Normas internacionais laborais proíbem a escravidão contemporânea em todas as suas formas e obrigam os Estados a legislar a fim de coibir tenazmente em seu território tais condutas. Quando um Estado falha em prestar a necessária proteção ao trabalhador, não sendo possível a este se socorrer sequer no Poder Judiciário, pode a vítima pleitear alguma reparação nas Cortes Internacionais de Direitos Humanos. No caso ora analisado, as decisões das cortes nacionais francesas poderiam ter sido proferidas com base em normas da Organização Internacional do Trabalho internalizadas pela França, bem como normas não ratificadas poderiam ter sido utilizadas em caráter interpretativo da vaga e escassa legislação pátria. Em âmbito internacional, o Tribunal Europeu de Direitos Humanos não é o único órgão dotado de capacidade punitiva, a própria Organização Internacional do Trabalho pode ser acionada por meio de reclamação ou queixa contra Estados Membros que ratificam normas e as descumprem ou negligenciam sua efetividade, podendo esta punição ser aplicada concomitantemente à proferida pela supracitada Corte. O estudo é dividido em três partes: a primeira aborda as especificidades do caso Siliadin, conceitos pertinentes aos fatos narrados, estudo do processo judicial em âmbito francês e análise da decisão do Tribunal Europeu de Direitos Humanos; a segunda analisa as normas da Organização Internacional do Trabalho como normas de jus cogens laboral e núcleo duro de direito laboral, ressaltando como consequências à violação das referidas normas as reclamações e as queixas à Organização Internacional do Trabalho; a terceira analisa a incorporação e aplicação do direito internacional no âmbito interno dos Estados, frisando a possibilidade do emprego de normas da Organização Internacional do Trabalho na solução do litígio entre Siliadin e os empregadores.O método utilizado no presente trabalho é o indutivo, bem como se valeu da análise de caso com base em normas específicas da Organização Internacional do Trabalho sobre trabalho forçado (nº 29 e nº 105), discriminação (nº 100 e nº 111), trabalho doméstico (nº 189), trabalho infantojuvenil (nº 138 e nº 182) e trabalho do migrante (nº 143). Por fim, conclui-se pela necessária aplicação do direito internacional laboral na esfera processual interna dos Estados e a maior ingerência dos organismos internacionais trabalhistas a fim de garantir a efetividade das normas internacionais laborais. / This study aims to analyze the case of Siwa-Akofa Siliadin, a teenager enticed in the Togo, in 1994, into providing services as a domestic servant in France. Upon arriving in the country she was subjected to bondage, could not go to school and received neither payment for her services nor the minimum labor rights, such as limit to daily working hours, weekly paid rest and an adequate housing. It is a leading case which deals with human trafficking practices, forced labor and domestic servitude. Contemporary slavery takes place through forced labor, comprised into species among which are slave labor, servitude and debt bondage. With any of these practices trafficking of persons can occur simultaneously. The practice of domestic slavery, also called domestic servitude, is included in the list of forced labor, verifying to which species of bondage each case belongs. It occurs both in rich countries and emerging countries and the most vulnerable persons are women, minors, migrants, the poor, and the less educated. International labor standards prohibit contemporary slavery in all its forms and require states to legislate to curb such conduct tenaciously in their territory. When a state fails to provide the necessary protection to workers, not making possible for them even to seek help from the judiciary power, the victim can claim some compensation in the international human rights courts. In the case under analysis, the decisions of the French national courts could have been rendered based on standards of the International Labour Organization internalized by France, and unratified standards could have been used to interpret vague and scarce national legislation. Internationally, the European Court of Human Rights is not the only body with punitive capacity, the International Labour Organization itself can be activated by means of complaint or claim against member states that ratify standards and then violate or neglect their effectiveness, and this punishment may be applied simultaneously to that decided by the above cited court. The study is divided into three parts: the first one dealing with the specificities of the Siliadin case, concepts related to the facts narrated, the study of the judicial process in French courts and analysis of the decision of the European Court of Human Rights; the second examining the norms of the International Labor Organization as labor jus cogens and labor law hard core, highlighting as consequences to the violation of these rules complaints and claims to the International Labor Organization; the third analyzing the incorporation and application of international law in the domestic sphere of the States, emphasizing the possibility of the use of International Labor Organization rules in resolving the dispute between Siliadin and the employers. The method used in this work is the inductive, and also the case analysis based on specific standards of the International Labour Organization on forced labor (no. 29 and no. 105), discrimination (no. 100 and no. 111), domestic service (no. 189), child labor (no. 138 and no. 182) and migrant labor (no. 143). Finally, it is concluded by the necessary application of international labor law in the domestic procedures of the States and the greater interference of international labor organizations in order to ensure the effectiveness of international labor standards.

AMERICAN CULTURE OF SERVITUDE: THE PROBLEM OF DOMESTIC SERVICE IN ANTEBELLUM LITERATURE AND CULTURE

My dissertation argues that domestic service alters a culture’s relationship to the laboring body. I theorize this relationship via popular literary and cultural antebellum texts to explore the effects of servitude as a trope. Methodologically, each chapter reads a literary text in context with social and legal paradigms to 1) demonstrate that servitude undergirds myriad articulations of antebellum power and difference; 2) show how servitude inflects the construction of these paradigms; and 3) trace Americans’ changing relationship to the concept of servitude from the Early Republic through the Civil War. I begin with James Fenimore Cooper’s The Pioneers (1823), exploring the famous Leather-stocking character – not (as has canonically been the case) as an icon of American independence, but as an icon of American servitude. I historicize this reading with the legal history of master/servant statutes in the early nineteenth century. While public opinion quarantined servitude to an oppressed racial minority, the apparatuses of the law were dramatically expanding servitude’s purview, rendering the master/servant relation the touchstone from which to understand all employment relations. Following, my second chapter examines Caroline Kirkland’s A New Home, Who’ll Follow? (1833). I show that Kirkland’s text dramatizes the narrativity of identity-formation and its potential class consequences. Throughout, Kirkland suggests that this is particularly a women’s problem, whose narratives of self are charged with maintaining the narratives of the family and, synecdochically, the nation. Maria Susanna Cummins’s The Lamplighter (1854) is a revolutionary intervention into the narratives of laborless-ness. I read the adoptions within the novel alongside the legalization of bounded servitude for children, since antebellum minors could be adopted or sign indentures if doing so was determined to be in their “best interest.” In my fourth and final chapter, I examine Civil War draft resistance. In her House and Home Papers columns for The Atlantic (1863-4), Harriet Beecher Stowe turned to the tropes of servitude to make sense of these violent eruptions. Yet this strategy laid bare servitude’s place as the basis for many other forms of state power (including military service) and servitude’s incompatibility with principles of individual sovereignty.

Forskning visar att arbete mot våld i nära relation är viktigt. Detta examensarbete syftar till att undersöka vilken erfarenhet personal inom hemtjänsten har av arbetet med våld i nära relation bland äldre, för att öka kunskapen om hur personal inom hemtjänsten skulle kunna arbeta med våld i nära relation. För att besvara detta syfte använde vi oss av kvalitativ metod i form av tre semistrukturerade gruppintervjuer. Respondenterna var hemtjänstpersonal i två kommuner i södra Sverige. Materialet som samlades in transkriberades och analyserades tematiskt, vilket utmynnade i åtta teman: Åtgärder, Sjukdom- en riskfaktor för våld i nära relation, Chefens roll, Sekretess, Brist på kunskap, Det dolda våldet, Det förebyggande arbetet samt Ansvaret. Vi har haft en hermeneutisk ansats för att förstå oss på helheten i det komplexa sociala problemet med våld i nära relation bland äldre. Resultatet visar att det finns en brist på kunskap gällande arbetet med våld i nära relation bland äldre. Respondenterna känner sig inte trygga med att arbeta med våld i nära relation då de inte vet vad som förväntas av dem. De intervjuade grupperna saknar mål och riktlinjer och inget förebyggande arbete bedrivs. Resultatet visar att våldet inte sällan beror på sjukdom men att det annars främst sker i det dolda. Detta gör att det kan vara svårt för hemtjänstpersonalen att uppmärksamma våldet. / Research shows that work preventing against domestic violence is important. This degree essay aims to investigate what experience home care staff have of working with domestic violence among the elderly, in order to increase knowledge of how staff in home care could work with violence in close relationships. To answer this purpose, we used a qualitative method in the form of three semi-structured group interviews. The respondents were home care staff in two municipalities in southern Sweden. The material we collected was transcribed and analyzed thematically, resulting in eight themes: Actions, Illness - a risk factor for violence in close relationships, The manager's role, Secrecy, Lack of knowledge, Hidden violence, Preventive work and Responsibility. We have had a hermeneutic approach to understand the completeness of the complex social problem of domestic violence among the elderly. The results show that there is a lack of knowledge regarding work with domestic violence among the elderly. The respondents do not feel safe working with violence in a close relationship as they do not know what is expected of them or how they should act on it. The interviewed groups lack goals and guidelines and no preventive work is conducted. The results show that the violence is not infrequently due to illness, but that otherwise it mainly takes place in the hidden. This means that it can be difficult for the home care staff to see the violence.

Until recently, the legal position of domestic workers in South Africa could be described as a relic of the nineteenth century, when the contract of employment and the common law defined the employer-employee relationship. The legal rules which regulate the relationship between the domestic worker and her employer are examined. International labour standards and the legal position of domestic workers in other countries are considered. Cognisance is taken of the social phenomenon which finds domestic workers at the convergence of three lines along which inequality is generated, namely gender, race and class. Furthermore, the unique economic forces at play in this sector are examined. The law will be stretched to its limits when attempting to resolve what is, essentially, a socio-economic problem. However, the working lives of a million people are at stake. The legislature has a constitutional, political and moral responsibility to attend to reform in this sector as a matter of urgency. / Private Law / LL.M.

隨著經貿全球化下,勞動力的遷徙也不再受到國界的限制。然而,在全球經貿議題談判的桌上,國家機器將經濟發展至於首要發展位置,遷徙勞工的人權、勞動權利卻是被忽略。其中,最容易被忽略的乃是女性居多所從事的家事服務業。另外,國際勞工組織從1994年極力推展的國際核心勞動基準,已受到全球經貿組織、區域組織,與非政府組織的重視。其中,禁止就業歧視核心公約更是將種族、民族血統、性別等等清楚的納入禁止範圍。次之,聯合國「所有移民勞工及其家屬權利保障國際公約」對於遷徙勞工的人權保障更是一大進步。於此,可發現國際對於遷徙勞工的人權、勞動權利之重視。 台灣在拼經濟之際,也不忘趕上以引進廉價外傭而逃脫於福利產業責任的趨勢。然而,於引進、聘僱外傭的過程中,國家政策對於外傭的勞動權利的「保障」便是本文的討論重點。從國際保障規範遷徙勞工的趨勢、透過訪談在引進、聘僱在台外傭過程中的各個角色、學者相關田野調查的資料等,來觀察在台外傭所可能遇到的就業歧視,與觀察台灣又是否能夠真正與人權外交畫上等號?

Livelihood and status struggles in the mission stations of the Universities' Mission to Central Africa (UMCA), north-eastern Tanzania and Zanzibar, 1864-1926

This thesis is about the social, political, and economic interactions that took place in and around the Universities’ Mission to Central Africa (UMCA) in two very different regions: north-eastern Tanzania and Zanzibar. The mission was for much of the period a space in which people could – often inventively – make a living through education, employment, and patronage. Indeed, particularly in the period preceding British colonial rule, most Christians were mission employees (usually teachers) and their families. Being Christian was, in one sense, a livelihood. In this era before the British altered the political economy, education had only limited appeal, while the teaching profession was not highly esteemed by Africans, although it offered some teachers the security and status of a regular income. From the 1860s to the 1910s, the UMCA did not offer clear trajectories for most of the Africans interacting with it in search of a better life. Markers of coastal sophistication, such as clothing or Swahili fluency, had greater social currency, while the coast remained a prime source of paid employment, often preferable to conditions offered by the mission. By the end of the period, Christians were at a social and economic advantage by virtue of their access to formal institutional education. This was a major shift and schooling became an obvious trajectory for future employment and economic mobility. Converts, many of whom came from marginal social backgrounds, sought to overcome a heritage of exploitative social relations and to redraw the field for the negotiation of dependency to their advantage. However, as this thesis shows, the mission also contributed to new sets of exploitative social relations in a hierarchy of work and education.
