House arrest came into Czech criminal law with the adoption of the new Criminal Code 1st of January 2010. House arrest was expected to be used as the most stringent alternative to the sanction of imprisonment in cases where there is no need for a significant intervention into the life of the offender, but at the same time there is a need for more severe penalty than the usage of other alternative punishments. The thesis is divided into five chapters. Chapter one is solely devoted to concept and aim of punishment. Chapter two deals with alternatives punishments, demarcation of unconditional sentence of imprisonment to alternatives punishments and restorative justice. Chapter three focuses on the house arrest and its position in the Czech criminal law system. First part of this chapter illustrates the position and importance of house arrest in Czech criminal law system, furthermore the most important terms are also described there. Final passages of chapter three discussed in detail the conditions for the imposition of house arrest and the manner of its exercise. Chapter four is focused on an electronic control system of house arrest. House arrest punishment, its execution and control The aim of this thesis is to summarize as fully as possible the treatment of house arrest both the substantive criminal law and procedural, conditions for the sentencing and its carrying out as well as the control of respect and subsequent consequences in case of violation of the punitive terms. The thesis is divided into twelve chapters, which are further divided into subchapters. The introduction is followed by a first chapter providing a theoretical introduction to the concept of punishment, its purpose and function. Determining firstly the purpose of punishment on the basis of three theories, I concluded with a detailed description of the purpose of punishment in accordance with Czech legislation. The second chapter provides an overview of the system of penalties and includes a listing of punishments provided for by the Criminal Code. 91 Abstract - Means of substitution of custody The topic of this thesis are the means of substitution of custody. The institute of custody is a very actual topic that is developing dynamically and is still controversial. Thanks to both domestic and international courts, the standard of protection of basic human rights keeps increasing and custody is therefore considered an extreme securing measure that can only be used in case there are no usable milder means. The aim of this thesis is to introduce these means of substitution of custody, stating their issues in theory and in praxis, their critical evaluation and suggestions de lege ferenda. The first chapter of this thesis focuses on general characteristics of custody and conditions of its use. The first chapter is a crucial part of the thesis as the means of substitution of custody directly relate to the institute of custody itself. The second chapter of this thesis focuses on the development of individual means of substitution of custody. It is a rather brief overview of the most significant amendments to legislation. The equation liberty-security that is suffused by the effectuation of rights is also problematized. The research is situated in what Michel Foucault called neo-liberal governmentality and investigates the recent strategies of conducts conduction that extends the penal control to out of the bodies confinement spaces, without abdicating them. It is showed how the offenders tracking waters down the prison limits by its coupling to electronic modulations that formats jails without walls, mobile and flexible, in open environment. Punctual precedence of monitoring technologies in the United States is studied, as well as its transformations serving the current penal economy. Different punitive practices that nowadays are resized in electronic controls are presented. Eclectic discourses and the several political forces that bring about the offenders tracking are analysed. The implementation of the electronic monitoring of condemned and processed people by the penal system in Brazil is situated as a truth construction from the inextricable relation between legalisms and illegalisms. The questioning of the continuity of the punishment over bodies as a support of the politics that is today exercised and lengthened by means of new punitive controls anchored in the expansion of the double rights-security. / Este trabalho apresenta a emergência de novas técnicas de controle e punição, exercidas por meio de monitoramentos telemáticos, efetuados sobre os designados criminosos, atendendo às atuais demandas por segurança. Problematiza-se a equação liberdade-segurança atravessada pela efetivação de direitos. A pesquisa situa-se diante da consolidação do que Michel Foucault chamou de governamentalidade neoliberal e investiga as recentes estratégias de condução das condutas que estendem o controle penal para fora dos espaços de encerramento de corpos, sem abdicar ao confinamento. Mostra-se como o rastreamento de presos faz diluírem-se os limites do cárcere por meio de seu acoplamento a modulações eletrônicas, que formatam prisões sem muros, móveis e flexíveis, em ambientes abertos. São estudadas procedências pontuais de tecnologias de monitoramento remoto nos Estados Unidos, bem como os deslocamentos que o fazem atender à atual economia da pena. São apresentadas as diferentes práticas punitivas que hoje se redimensionam em controles eletrônicos. Disertacijoje kompleksiškai teisiniu lyginamuoju rakursu nagrinėjamas vienas iš bausmių vykdymo teisės institutų – lygtinis paleidimas iš pataisos įstaigų. Disertacija apima visapusišką lygtinio paleidimo tyrimą nuo jo teorinio iki praktinio realizavimo pažinimo. Pažymėtina, kad lygtinio paleidimo samprata Lietuvos moksle nėra atskleista, o šio instituto taikymo ir turinio teisinis reguliavimas ne visuomet užtikrina sėkmingą nuteistųjų resocializaciją. Taigi, disertaciniame tyrime modeliuojama lygtinio paleidimo teisinė sąvoka, taip pat jame pateikiama nauja skyrimo pagrindų ir vykdymo tvarkos, pagrįstos nuteistųjų pakartotinio nusikalstamo elgesio rizikos, kriminogeninių veiksnių (poreikių) vertinimu ir efektyvia nuteistųjų resocializacija, koncepcija. Šiame mokslo darbe nagrinėjama lygtinio paleidimo sąvokų ir rūšių įvairovė, jam būdingi elementai, identifikuojama vieta teisės sistemoje, nagrinėjama raida, analizuojama institucinė lygtinio paleidimo taikymo sistema, jo skyrimo apimtis ir pagrindai, o taip pat kriterijų vertinimo metodai, nuteistųjų, lygtinai paleistų iš pataisos įstaigų, priežiūra (socialinė reabilitacija ir kontrolė, elektroninis monitoringas), jų teisinė padėtis, tiriami šiuolaikiniai jų priežiūros modeliai, ir galiausia – teisinių santykių, susijusių su lygtiniu paleidimu, pasibaigimo ypatumai bei ankstesnis nuteistųjų atleidimas nuo lygtinio paleidimo priežiūros. [toliau žr. visą tekstą] / The doctoral dissertation presents complex comparative legal analysis of parole release from correctional institutions. The thesis encompasses versatile parole research from theoretical to practical realization recognition. It is necessary to highlight, that neither parole conception within Lithuanian doctrine is not disclosed, nor national legal regulation of parole doesn’t warrant successful offender’s rehabilitation. Regarding these issues the novel theoretic definition of parole as well as original legal parole model reasoned on risk and need assessment and efficient offender’s rehabilitation is proposed in the thesis. The diversity of parole definitions and types, components, it’s place in the legal system, historical genesis, institutional system, extent and grounds of application, evaluation methods of decision making criterions, offender supervision (social rehabilitation and control, electronic monitoring), legal status of parolees (their obligations and rights), and finally, – the revocation of parole are analyzed in this study, also the implementation of early discharge from active supervision of parolees is examined in the research. The main features of parole and differences between similar legal institutes – parole and early discharge from punishment are highlighted in the thesis.

Trest domácího vězení jako forma nápravy pachatele / The punishment of homeprison as a form of the offender´s rectification

Each human society creates during its existence a system of reactions against undesirable activities of persons, who break the rules of the smooth passing of a particular community and contravene the standards and values of the community. The view of these reactions {--} punishments, changes over time and also with a respect to culture of the community or the state and its approach to an individual and his rights. In the past, the forms of punishments were, and in some countries still are, mainly primitive, such as amputations of body parts. However, the civilised world, especially, in case of non-arrestable offences, tends to prefer non-custodial service, such as home detention. Home detention as a form of penalty has been used in various alternatives for many years in countries such as Italy, Germany etc. However, the Czech legal system did not allow to impose this penalty until 2010. This form of penalty should facilitate the situation in Czech crowded prisons. It might be imposed on thousands of the sentenced a year and, at the same time, it would save money of the tax payers. The thesis deals with the legislative framework, where the home detention belongs and it is also focused on the fact how the other states, where home detention has been applied for years, have adopted this form of penalty. The objective of the Probation and Media Service of the Czech Republic is also mentioned in this work. The theoretical part of the thesis is divided into two parts {--} the first part deals with the punishment in general, the other one is focused on home detention in particular.

House arrest, its execution and control Abstract The presented diploma thesis deals with the alternative punishment of house arrest. This punishment became the part of Czech penal system when the new Penal Code came into force on the first of January 2010. The aim of this diploma thesis is to summarize valid substantive and procedural legislation of this alternative punishment, to evaluate its advantages and disadvantages and to propose possible changes and improvements of weaknesses of current legislation. First three parts of this diploma thesis are focused on essential concepts, such as punishment, purpose of punishment and its functions, alternative punishments, their introducing to legal orders, negative aspects of custodial sentence and explanation of retributive and restorative conception of justice. Following parts are focused on issues related to valid legislation of house arrest punishment. These parts are major essence of the thesis. In the fourth part of this thesis there is analysed evolution of this punishment and there are described and explained requierements for this punishment. In this part there is also explained the essence and the content of house arrest and issues linked to house arrest execution.
