Implementation of the Third energy package into the legal order of the Czech Republic Summary This thesis discusses the implementation issue of the Third energy package, also known as the Third liberalization package, into the Czech national law. It consists of three regulations and two directives of the European Union, which determines the energy politics both on the European level and on the level of the member states. The first part of this thesis describes the ancestors of the Third energy package and their accomplishments or failures together with reasons for creating the next generations of liberalizing legislation. The author describes the liberalization in the form of the legal, functional and accounting unbundling separately for electricity and gas industry at the European level, and then the implementation at the level of the Czech legislation. In the next chapter it is further explained, what were the European legislator's incentives for creating the Third energy package, and what new institutes it stipulates. It is herein described that the European Union came with three different unbundling versions of the transmission system operators (TSO) - Ownership unbundling (OU), Independent system operator (ISO) and the Independent transmission operator (ITO). A Weaverian Study of President Ford's Efforts to Sell His Energy Package

This study analyzed President Gerald Ford's efforts in selling his energy package in February, 1975. Six major speeches and news conferences were examined in terms of Richard Weaver's rhetorical theory. Five criteria of this theory were studied: appeals to man's good values, choice of argumentation, use of "god" and "devil" words, adaptation to the historical setting of the speech, and ethical character of the speaker. This analysis concluded that Ford was a good Weaverian rhetorician because he appealed to good values in language well adapted to each audience, adapted well to historical settings, and elevated his ethos considerably. However, Ford sold himself but not his program because he relied too heavily on his own ethos and circumstantial argumentation and slighted refutation arguments

Depuis le début de la construction européenne, définir une politique énergétique européenne était un défi important. Malgré les Etats membres qui voulaient préserver l’autonomie de leur secteur énergétique, une vague de restructurations s’est mise en place dans le secteur européen de l’électricité et du gaz par la libéralisation du secteur. Dans ce cadre, le troisième paquet énergie avec la disposition de la séparation de la propriété qui envisageait de démanteler les grandes entreprises énergétiques, a suscité une grande polémique. En relation avec ce débat intensif, la genèse et l’institutionnalisation de la politique énergétique au niveau européen à partir de 1950 jusqu’à 2010 ont été étudiées. Le rôle des idées néolibérales, les pratiques quotidiennes des acteurs (les groupes d’intérêt, les fonctionnaires des institutions européennes, les parlementaires européens..), leurs rapports de force, les luttes de pouvoir dans l’établissement de cette politique ont été analysés. / From the beginning of the European integration, defining a European energy policy was an important challenge. Despite the Member States who intended to preserve the autonomy of their energy sector, a wave of restructuring has taken place in the European electricity and gas sector through the liberalization. In this context, the third energy package with the unbundling issue which envisaged dismantling the big energy companies, caused great deal of controversy and polemics. In connection with this intensive debate, the genesis and institutionalization of the European energy policy from 1950 to 2010 have been studied. The role of neoliberal ideas, stakeholders’ daily practices (interest groups, officials of the European institutions, MEPs...), their power relations, political struggles in the establishment of this policy were analyzed.

Energetická politika EU z pohledu lobbingu / EU energy policy from lobbying perspective

The diploma thesis aims to contribute to the clarification of the process of shaping new EU climate and energy policy and to describe European lobbying groups entering in the 2030 Climate and Energy Framework policy-making process. The thesis aims to assess influence and participation of selected lobbying groups in this policy-making process. The thesis is divided into three chapters. The first chapter is devoted to the theoretical aspects of energy policy, further it provides the definition of basic terms and description of the EU legislative process in terms of lobbying. The second chapter explains energy policy in the context of fight against climate change and defines this issue at international and European level. The last chapter of the thesis deals with the current policy-making process of the 2030 policy framework for climate and energy and specifically focuses on lobbying activities and the intensity of lobbying impact of selected political, governmental and social actors according to the classification of interest groups by Howlett and Ramesh.

Soutěžní politika EU a tzv. klimaticko-energetický balíček / Competition policy of the European Union and climate and energy package

The focus of the dissertation is based on the previous research of a relatively new field of environmental governance posed by climate change policy. The implementation of the climate change policy in Europe is then a subject to the discussion over the consistency of that policy with one of the fundamental goals of European integration. That goal is building an internal market as well as ensuring fair competition in such a market. The interaction of these two areas is a key objective of this research work. Given the complexity of the topic, the dissertation, for sake of clarity, is defined more narrowly. On one hand, the thesis provides with an analysis of European climate policy and its main instruments for regulating carbon emissions in the European economy - the European Union emission trading system (EU ETS). On the other hand, the thesis also provides with a description of the European competition policy. The reason is, as mentioned above, that the competition policy is a fundamental policy that guarantees the consistency of the implementation of environmental policies with the building of the internal market. The author analysed in the thesis basic measures implemented within the framework of those with the aim to prove out whether both policies are in mutual accord and whether they do function under the real terms. Based on the results achieved, the author can make following conclusions: The EU ETS mechanism decided for the European Union proved out to be a cost-efficient choice of emission reduction, despite of some temporary weakness that it has. Also, it can be concluded, that the allocation method is the ultimate criterion that determines both the efficiency of the climate action in Europe as well as its compliance with the competition policy. Stemming from that conclusion, there has been some strong evidence given that grandfathering has not been always in line with the state aid rules existing now in the environment protection. Last but not least, the optional use of the Article 10c of the Directive 2003/87/EC seems to be, from what one can say now, fully in line with the state aid rules valid in the European Union. However, further research in this field might be of very use in the future.

Since long the energy policy has been escaping the concept of the common European policies or has been only partially influenced through the harmonisation of other common policies. If energy sector was considered an exclusive competence of every State Member (or as a part of its national security), nowadays, it has made a big step forward. At present, we talk about the establishment of a competitive internal energy market. The energy policy became part of the Community law only after the adoption of the Lisbon Treaty when the sector was granted a separate chapter and henceforth decided upon through a co-decisional procedure. The energy markets were subsequently given a new liberalisation impetus by the approval of the 3rd energy package (July 2009). My thesis focuses entirely on the natural gas sector and its crucial amendment to the network sector regulations. The core subject of the Directive 2009/73/EC concerning common rules for the internal market in natural gas is the ownership unbundling regime which stipulates the separation of production and sale operations from their transmission networks. This separation from the former vertically integrated utilities is supposed to guarantee an equal and non-discriminatory access to the transmission networks. La libéralisation des marchés énergétiques est un objectif primordial pour tous les Etats membres et candidats à l'Union européenne. Dans le but d'arriver à un marché de l'énergie, la Commission européenne a mis en place trois paquets énergie pour l'ouverture complète des marchés électriques et gaziers à la concurrence étape par étape. Pour mieux comprendre les législations et les politiques énergétiques en France et en Turquie, il est indispensable d'avoir une connaissance principale sur l'organisation et le fonctionnement de leurs marchés électriques et gaziers dès l'origine en élaborant les institutions et entreprises monopolistiques en tant que EDF, TEK, GDF BOTAS, et leur évolution historique jusqu'à la mise en place des directives énergétiques européennes. Par la suite, il est important d'examiner chronologiquement chaque étape de libéralisation imposé par les paquets énergie (mise en place du marché intérieur 1996-2000, le deuxième paquet énergie 2000-2007, le troisième paquet énergie 2007-2011,prochaine étape Energy 2020), et comparer la procédure juridique du procès de la libéralisation des marchés énergétiques en examinant leurs législations en vigueur et leurs modifications pendant l'implémentation des directives énergétiques européennes. / The liberalization of energy markets is primary objective for each member and candidate State of the European Union. In order to achieve an internal energy market, European Commission set up three energy packages for electricity and gas market complete opening up to the competition step by ste^p. For a better understanding of the energy legislations and policies in France and in Turkey, it is essential to have a main knowledge related to the organisation and operation of their electricity and gas markets from the beginning by examining the institutions and monopolistic companies such as EDF, TEK, GDF, BOTAS, and their historical evolution period until the european energy directives implementation. Thereafter, it is prominent to examine chronologically every step of the liberalisation enforced by the energy packages (internal energy market 1996-2000, second energy package 2000-2007, third energy package 2007-2011, next step Energy 2020), and compare the legal procedure of the energy market liberalization process by analyzing their legislations in place and modifications during the european energy directives implementation process.

Le changement climatique a acquis, durant ces cinquante dernières années, une dimension politique et juridique. En 2009, le Traité de Lisbonne a intégré la lutte contre le changement climatique parmi les objectifs prioritaires de la politique environnementale internationale de l’Union européenne, en reconnaissant la volonté de l’Europe de jouer un rôle de leader mondial dans ce domaine. Cette thèse porte sur la lutte contre le changement climatique en droit de l’Union européenne. Dans la première Partie, nous analyserons tout d’abord l’ambition européenne dans le cadre des négociations internationales, lieu d’émergence de la gouvernance climatique. Puis, nous examinerons le système des compétences de l’UE pour évaluer si ce dernier permet de répondre efficacement aux défis que le changement climatique pose. La seconde Partie porte sur la mise en oeuvre de la politique climatique européenne, en présentant les principaux instruments – notamment le paquet énergie-climat – et en montrant les mécanismes à la disposition de l’Union européenne pour mettre en cohérence cette politique transversale et pour influencer l’action climatique globale par ses mesures internes. Cette analyse aide à la compréhension des apports européens, passés et présents, à la construction d’une gouvernance climatique mondiale efficace. Les caractéristiques spécifiques du changement climatique en font en outre un point d’observation privilégié pour l’étude de certaines dynamiques propres à la construction européenne. / Over the last fifty years, climate change has acquired a political and a legal dimension. In 2009, the Lisbon Treaty included combating climate change among the objectives of the European Union’s international environmental policy, demonstrating the will of the EU to play a leading global role in this domain. This thesis studies the development of the fight against climate change in EU law. In Part I we analyse European ambitions within the framework of international negotiations, where climate governance originally emerged. Then, we examine the European system of competence in order to better understand whether or not it actually serves as the most effective approach to tackling climate change issues. Part II concerns the implementation of the EU climate change policy. Here, we present its main instruments, i.e. the climate and energy package, and examine the mechanisms that the EU uses to give coherence to this cross-cutting policy and influence global climate action by way of internal measures taken. Our analysis furthers the understanding of European contributions, both past and present, to the construction of effective international climate governance. Moreover, the subject of climate change, a major global challenge with an array of specific characteristics, provides us with a privileged point of view to examine several dynamics of the construction of European integration.
