A orientação teórico-metodológica está numa leitura de mundo que rompe com velhos paradigmas como o cosmocêntrico, o teocêntrico e o antropocêntrico, e avança com outras possibilidades epistemológicas como a Perspectiva Eco-Relacional (PER), que contribui com as discussões socioambientais, nas dimensões cultural, crítica, política, moral, jurídica e afetiva, possibilitando que se perceba o mundo na sua totalidade. Trata-se de uma pesquisa composta das seguintes técnicas: observação participante, por meio da interação do pesquisador com os agentes concursados do TCE; entrevistas semiestruturadas, baseadas em um roteiro compostos por blocos de perguntas enfocando a relação dos agentes com o Tribunal; grupo dialógico, para ampliação dos elementos acerca da dimensão educativa da prática dos agentes do TCE, sob o enfoque da GA. Esta pesquisa é referenciada por uma proposta de Educação Ambiental crítica e dialógica que oferece dentre outros aportes da literatura de Paulo Freire a afetividade e o saber escutar. Os resultados expressam-se com base nos temas geradores: Crise Ambiental, Gestão Ambiental e Dimensão Educativa, que possibilitaram algumas categorias e sub-categorias interpretativas. A compreensão da crise ambiental apareceu associada a dimensões que passam pelo saber, pelo imaginário, o medo, sobretudo pela reflexão que sinalizam sentimentos de cooperação. A Gestão Ambiental pode ser entendida, na reflexão desta pesquisa, como um trabalho que deve começar com a problematização das questões do lugar, mediante o diálogo e da escuta afetiva, com todas as pessoas envolvidas nas relações. A dimensão educativa sob o enfoque da gestão ambiental apareceu em alguns depoimentos como sentimentos e reflexões de que, na vida, a educação formal e informal contribui efetivamente para as práticas ambientais consciente, associadas a valores adquiridos. Em síntese, a Educação Ambiental, que este trabalho propõe como contribuição para a gestão pública, deve partir dos projetos e leituras de mundo das pessoas envolvidas, com foco na superação de situações-limites, conquistando e construindo nos gestos, parcerias, mobilizações e diálogos tecidos pelos afetos.

In this context, the Ambient Education has been presented as an important tool for mitigation of the situation in screen, but the form in which the same one is implemented through practical the pedagogical ones applied for the teachers and the results externalized for pupils and felt by the society, the real effectiveness of this educative process has rank under questioning, as well as generated conceptual divergences in the agreement of the terminology. In such a way, this work aims at to evaluate the education of Ambient Education in the municipal public net of the city of Catalão (GO), having for reference the final series of Grammar school of the CAIC São Francisco de Assis, by means of the analysis of the application of the National Politics of Environmental Education (NPEA), Federal Law 9,795/99, throughout the period of 1999 the 2009. Different elements instrumentalize the research aiming at to elucidate to the maximum the questions related to the subject and to minimize possible mistakes, collaborating for a scientific, sober and beneficial inquiry. Being carried through a deepening of the theoretical questions by means of meticulous bibliographical revision around productions that present interfaces with thematic the proposal, the participation in scientific events and politicians and the development of the field work, as much in the pertaining to school unit of reference, how much in other institutions that they deal with the education and the environment the municipal level, such as, city departments of education and environment, Public prosecution service, Chamber of Councilmen and Municipal City hall. With the accomplishment of different procedures: Developed, among others material document survey and diverse data, projects and information; Pedagogical comments of lessons and plannings; Application of questionnaires; Interviews. The work is considered in carrying through an analysis anchored in the following ones estimated: Socio-environmental Crisis, Public Politics and Practical Pedagogical of Environmental Education, based, over all, in the commitment to contribute with the indication of possible ways for the materialization of practical pedagogical of Environmental Education capable to propitiate to the students and teachers, alternatives for the exercise of the citizenship and consequent transformations that allow to socioenvironmental improvements for all the society. / A temática ambiental tem se transformado em uma questão recorrente nas últimas décadas, consequência da crise ambiental deflagrada pelo processo de expropriação dos recursos naturais dentro da estrutura socioeconômica hegemônica, caracterizada como sociedade de consumo pautada na Racionalidade do Capital e na objetificação da natureza. Neste contexto, a Educação Ambiental tem sido apresentada como uma importante ferramenta para mitigação da situação em tela, mas a forma na qual a mesma é implementada através das práticas pedagógicas aplicadas pelos docentes e os resultados externados pelos/as alunos/as e sentidos pela sociedade, tem posto sob questionamento a real eficácia desse processo educativo, bem como gerado divergências conceituais no entendimento da terminologia. Desta forma, este trabalho visa avaliar o ensino de Educação Ambiental na rede pública municipal da cidade de Catalão (GO), tendo por referência as séries finais do Ensino Fundamental do CAIC São Francisco de Assis, mediante a análise da aplicação da Política Nacional de Educação Ambiental (PNEA), Lei Federal 9.795/99, ao longo do período de 1999 a 2009. Diferentes elementos instrumentalizam a pesquisa visando elucidar ao máximo as questões relacionadas ao tema e minimizar possíveis equívocos, colaborando para uma investigação científica, sóbria e proveitosa. Sendo realizado um aprofundamento das questões teóricas por meio de revisão bibliográfica meticulosa em torno de produções que apresentam interfaces com a temática proposta, a participação em eventos científicos e políticos e o desenvolvimento do trabalho de campo, tanto na unidade escolar de referência, quanto em outras instituições que lidam com a educação e o meio ambiente a nível municipal, tais como, secretarias municipais de educação e meio ambiente, Ministério Público, Câmara de Vereadores e Prefeitura Municipal. Com a realização de diferentes procedimentos: Levantamento de documentos e dados diversos, projetos desenvolvidos, entre outros materiais e informações; Observações de aulas e planejamentos pedagógicos; Aplicação de questionários; Entrevistas. O trabalho propõe-se em realizar uma análise ancorada nos seguintes pressupostos: Crise Socioambiental, Políticas Públicas e Práticas Pedagógicas de Educação Ambiental, pautado, sobretudo, no compromisso de contribuir com a indicação de possíveis caminhos para a materialização de práticas pedagógicas de Educação Ambiental capazes de propiciar aos estudantes e professores/as, alternativas para o exercício da cidadania e consequentes transformações que permitam melhorias socioambientais para toda a sociedade.

Contribuição ao estudo das medidas compensatórias em direito ambiental / Contribution to the study of compensatory measures in environmental law

Este trabalho estuda o instituto das medidas compensatórias como uma nova obrigação imposta pelo direito aos empreendimentos com potencial de causar impactos negativos ao meio ambiente. A pesquisa do tema se deu de forma crítica, enfrentando as contradições do sistema econômico vigente. Verificou-se que as medidas compensatórias emergiram da mais evidente crise ambiental ou à crescente escassez dos recursos naturais, buscando, ao mesmo tempo, a proteção ambiental e a manutenção do sistema de mercado. Procurando a melhor funcionalidade das medidas, pretendeu-se demonstrar que elas não se equiparam a uma forma de reparação por dano futuro, tampouco se enquadram necessariamente em uma espécie tributária; podem, como quis o Supremo Tribunal Federal, ser chamadas de compartilhamento de despesas entre o Poder Público e os empreendedores pelos custos da utilização dos recursos naturais no processo produtivo. Na verdade, em razão de serem dotadas das características da transversalidade e da interdisciplinaridade, as medidas compensatórias apresentam-se com diversas facetas, podendo mostrar características predominantes de mecanismos de comando e controle, como também de instrumentos econômicos. Assim, concluiu-se nesta tese ser um instituto híbrido, não enquadrável em uma categoria jurídica estanque. Verificou-se, ainda, ser necessária uma análise estrutural a fim de serem eficazes. Nesse sentido, propôs-se a sua instituição por normas primárias, nas quais se fixem padrões mínimos e com critérios objetivos de aplicação. Para tanto concluir, o estudo partiu dos debates já travados, tanto pela jurisprudência quanto pela doutrina, acerca da constitucionalidade, metodologia de cálculo e natureza jurídica de uma das medidas compensatórias, chamada compensação ambiental, instituída pela Lei nº 9.985/2000 (Lei do Sistema Nacional de Unidades de Conservação-SNUC). A partir daí, buscou-se demonstrar o processo subjacente à edição de normas ambientais, recaindo nos princípios do Direito Ambiental, dentre eles o importante princípio do poluidor-pagador, cuja premissa é internalizar os custos pela utilização dos recursos naturais no processo produtivo, para não serem assumidos pelo Poder Público e por toda a coletividade. Ainda, buscou-se diferenciar os conceitos de dano ambiental e de impacto negativo ao meio ambiente, porquanto as medidas compensatórias visam a compensar o meio ambiente pelos impactos negativos, significando uma perda aceita, prevista e gerenciada; o dano ambiental, por sua vez, é algo intolerável, indesejado e, por isso, objeto de reparação civil objetiva, de responsabilidade administrativa e, ainda, da penalização criminal / This paper studies the institution of compensatory measures, considered as a new obligation imposed by law for projects with the potential to cause adverse environmental impacts. The theme was investigated critically, facing the contradictions of the current economic system. In this regard, we verified compensatory measures instituted to cope with an increasingly apparent environmental crisis and the growing shortage of natural resources, while seeking environmental protection and maintenance of the market. In the search for a better functionality of the measures, we sought to demonstrate that they do not represent a form of compensation for future damages, nor do they necessarily fall within the range of any legitimate taxation. In fact, these measures were adopted by the Supreme Court more as a sharing of costs between government and entrepreneurs for the use of natural resources in the production process. Fundamentally, the compensatory measures of this instrument, equipped with characteristics of transversality and interdisciplinarity, present different aspects, which can deploy features to carry out command and control mechanisms, as well as economic instruments. Our thesis has therefore led us to the conclusion that this instrument is not readily classifiable under any isolated legal category, and should be looked upon as a hybrid mechanism. Nevertheless, we considered that a structural analysis was necessary to ensure the effectiveness of the measures. In this respect, we proposed it be instituted on primary norms, with the establishment of minimum standards and objective application criteria. This required starting with debates conducted in jurisprudence and doctrine over the constitutionality, method of calculation, and legal nature of a compensatory measure called environmental compensation, established by Law No. 9.985/2000 (Law of the National System of Conservation Units, SNUC). From there, we sought to demonstrate the process behind the issuing of environmental standards falling within the principles of environmental law; among which the important polluter pays principle, which is premised on the environmental externalities of economic activities that use natural resources, and prevents that pollution costs be borne by Government and, ultimately, by the whole community. We went on by delimiting the concepts of environmental damage and negative environmental impact, considering that compensatory measures aim at providing compensation for adverse impacts, which signify accepted, provided and managed losses. Environmental damage, in turn, is something unacceptable and undesirable, and must therefore be subject to civil liability, as well as criminal penalties.

It also sought to understand possible elements to be captured by the Social Work, towards a qualified, theoretical and practical approach at the issues surrounding the plots, contradictions and environmental degradation impacts on living conditions and fundamental rights guarantee. The methodology consists of a literature research of investigative nature, to provide knowledge about environmental issues. In this sense, we sought, in the first chapter, the approach of the ontological foundations of the relationship between man and nature, mediated by the work category. The second chapter aimed at demonstrating the criticism and assertions about social theory, especially regarding the social thought of Marx. Besides, it discusses the crisis of capital and, consequently, the environmental crisis, so as to show some resilience propositions of this crisis that has been advocated in recent times. The third part of this paper turns to Social Work, exploring mainly a topic of major relevance to the profession, given its pedagogical nature, which is the environmental education. The main result of this study confirms the thought that the environmental crisis follows a broader crisis, the structural crisis of capital. Thus, not only direct means of man's action on nature generate environmental degradation, but the whole social structure, especially in the capitalist mode of production, as a collective being and able to anticipate his actions. Thus, the environmental crisis is a refraction of the structural crisis of capital, but which permeates the problem of the inability of the capital to grow linearly and extends to a rationality crisis of a period which has mathematized all segments of life in Earth. / A presente dissertação se ocupa da aproximação de elementos da temática ambiental, que podem ser entendidos como fundamentos para a compreensão da relação entre o homem e a natureza no seio da sociedade capitalista. Também se buscou compreender elementos possíveis de serem capturados pelo Serviço Social, no sentido de imprimir uma abordagem qualificada, teórica e prática ante as questões que envolvem as tramas, contradições e os impactos da degradação do meio ambiente nas condições de vida e na garantia de direitos fundamentais. A metodologia consiste em uma pesquisa bibliográfica de cunho investigativo, de modo a proporcionar conhecimento sobre a temática ambiental. Nesse sentido, buscou-se, no primeiro capítulo, a aproximação dos fundamentos ontológicos da relação homem e natureza, mediada pela categoria trabalho. O segundo capítulo visou demostrar as críticas e asseverações sobre a teoria social, sobretudo no que tange o pensamento social de Marx. Ainda, são feitas considerações sobre a crise do capital e, consequentemente, a crise ambiental, para, na sequência, demonstrar algumas proposições de superação dessa crise que vem sendo preconizadas nos tempos atuais. A terceira parte do trabalho se volta para o Serviço Social, explorando, sobretudo, um tema de importante relevância para a profissão, dado seu caráter pedagógico, que é a educação ambiental. O principal resultado desse estudo é a corroboração da ideia de que a crise ambiental vem na esteira de uma crise mais ampla, a crise estrutural do capital. Nesse sentido, não só os meios diretos da ação do homem sobre a natureza é que geram a degradação do ambiente, mas toda a sua estrutura social, em especial no modo de produção capitalista, como um ser coletivo e capaz de antecipar suas ações. Assim, a crise ambiental é uma refração da crise estrutural do capital, mas que perpassa o problema da incapacidade de o capital crescer de forma linear e se estende a uma crise também da racionalidade de um período que tem matematizado todos os seguimentos da vida na terra.

An exploration of an indigenous African epistemic order : in search of a contemporary African environmental philosophy

Text and keywords in English, with abstracts in English, isiZulu and Sesotho / There is an urgent need to develop sustainable solutions to the epochal environmental problems that the world at large and Africa in particular are currently facing. The current environmental philosophy does not seem to be able to resolve satisfactorily all the environmental crises of our world, as they have been largely influenced by Western oriented perspectives on one hand that are laden with dualistic and anthropocentric view of the world, and are ethics based on the other hand, and as such focuses less on human beings’ relationship with Nature. To the extent that attempts were made by scholars to advance an African orientation in environmental philosophy, these attempts have been bedridden with over-reliance on ethics. Relying mainly on ethics as the philosophical framework for addressing environmental issues, it neglects the epistemological dimensions of the African intellectual thoughts. To this end, minimal results has been achieved in the quest for panacea to environmental crisis, especially in Africa. This study, thus, advances an African outlook in environmental philosophy that would be both participatory and interdisciplinary in the quest for more meaningful and pragmatic problem-solving frameworks in environmentalism. The research seeks to further improve in the development of an African oriented Environmental Philosophy by committing to the exploration of an African epistemic outlook for environmentalism. This exploration is hinged on the epistemic stance abstracted from indigenous knowledge systems of African people in general and the Yoruba and Igbo people of the Western part of Nigeria, in West Africa, in particular. Accordingly, the research queries the tendency of the current discourse of environmental philosophy to over rely on ethics. The study further argues for a shift in the conceptual framework, approaches and methods employable in confronting the environmental challenges besetting the world today. It opines that we construct African environmental philosophy from the idea of “African Epistemic Order” (AEO). It argues that an environmental philosophy that is African in orientation, must have a conceptual understanding of the ontological and relational holism pervading the African epistemic order. Such an understanding will enhance the reordering and healing of the damaged human’s relationship with the natural environment (Nature). [ES] La presente tesis doctoral investiga las posibilidades del arte colaborativo comprometido con la defensa socio-ambiental a través de una práctica y metodología interdisciplinar llevada a cabo entre 2016 y 2022 por Bea Millón en diferentes contextos del territorio mexicano. A través de cuatro series, reformula las relaciones con el territorio, acciona proyectos críticos, anti-coloniales y ecologistas en diálogo con realidades corporales, materiales, y ambientales diversos. A través de quatre sèries, reformula les relacions amb el territori, acciona projectes crítics, anti-colonials i ecologistes en diàleg amb realitats corporals, materials, i ambientals diversos. Aquestes sèries, que esdevenen en múltiples projectes desenvolupats principalment en contextos extractius, són al seu torn investigacions que produeixen altres sabers, sensibilitats i estratègies que retroalimenten la lluita pels béns naturals des de l'art contemporani. / [EN] This doctoral thesis investigates the possibilities of collaborative art committed to socio-environmental defense through an interdisciplinary practice and methodology carried out between 2016 and 2022 by Bea Millón in different contexts of the Mexican territory. Through four series, he reformulates relations with the territory, activates critical, anti-colonial and ecological projects in dialogue with various bodily, material and environmental realities. Currently the world is in the midst of a major ecological crisis, of which climate change is a key element. It is contended that this ecological destruction is largely a result of the underlying values controlling ethics and the controlling instinct of the modern worldview, which has been dominant for the past three centuries. The most recent and still emerging worldview, postmodernism, is examined and contrasted as a rebuttal to the modernistic tendencies and ethics. Utilising Ecclesiastes 1: 1-18, the ethical themes that the author of Ecclesiastes used are explored and paralleled to similar views found in postmodernism. Together, these biblical and postmodern thoughts illustrate how a strong environmental ethic can be formed that counters the modernistic worldview of controlling creation. This thesis examines the role of Melodi Ya Tshwane Christian Youth Ministry (MyT CYM) in the context of what is increasingly observable environmental crisis with a view of developing a contextual approach to ecological mission. The research does not focus primarily on the environmental crisis itself except to note that its scope incorporates not only environmental issues, but has some important implications for social justice as well. The research recognises the role that MyT CYM must play as part of their contribution towards addressing the environmental crisis. Such a role is based not on a pragmatic response to the situation, but flows from the missional nature and theology of the church. Therefore, the missional church has an obligation to address this issue, through Christian mission that takes seriously the biblical call to care and preserve the integrity of creation. White (1967:1203-1207) places the blame for the current raping of our environment on the Christians’ interpretation of Genesis 1:28 (“God blessed them and said to them: ‘Be fruitful and increase in number; fill the earth and subdue it. Rule over the fish of the sea and the birds of the air and over every living creature that moves on the ground”). White believes that the Christian interpretation of this verse teaches man to be arrogant toward nature and that God gives man the green light to exploit nature as man pleases. White has leveled serious accusations against the early Christians. This study interprets the Old Testament, New Testament and ancient theologians’ attitude towards creation and God. It deals with the accusations in accordance with the relevant Biblical and post-Biblical writers, to find the basis for the environmental crisis not in Christianity, but in animism. It is true that the ancient Christian writers were indeed more concerned about the hereafter than about the world as it is now.
