Assessing the impact of integrated development planning (IDP) on gender equality and women's empowerment in South Africa: a case study of the Nelson Mandela Bay Metro Municipality

The South African local government is expected to conform to all national policy directives including the principle of gender equality. Local government provides an immense opportunity for redressing imbalances and empowerment of women as they are the most negatively affected by poverty as a result of inequality. The South African Government has developed a wide range of legislation that ensures that women are empowered and participate in their own development. With all the legislation in place, women‟s empowerment as envisaged in the South African Constitution has, however, not yet been yielded the desired results as evidenced by the fact that women continue to remain disadvantaged in relation to men. This study therefore seeks to investigate whether and how the Nelson Mandela Bay Metropolitan Municipality (NMBMM) has mainstreamed gender in support to the principles of gender equality and women‟s empowerment in the implementation of Integrated Development Planning (IDP) with particular reference to wards 15 and 17. The researcher used a mixed methods research approach, this means that the study followed both the qualitative and quantitative approaches for in-depth understanding followed in the design and implementation of the IDP process. Data was collected from women participants by conducting surveys, making use of questionnaires. Structured interviews were conducted with municipality officials in order to give more insight more insight into how the IDP process is initiated in the Nelson Mandela Bay Metro Municipality. The findings of the study revealed that there is a lack of a strategic understanding of gender mainstreaming particularly by the leadership of the municipality. This as a result, has made operationalisation and engendering the IDP difficult. Due to this strategic vacuum, gender is generally not taken seriously when compared to other developmental challenges such as infrastructure provision. Moreover, the municipality does not have a coordination mechanism nor does it have a proper consultation mechanism to ensure that the nature of development projects is appropriate, effective and actually targets women‟s developmental needs. The leadership of the municipality must commit to the process of gender mainstreaming if the IDP is to be an effective tool in addressing the gender imbalances.

Social policy and the state in South Africa: pathways for human capability development

The main focus of this thesis is the challenges that are facing social policy development and implementation in South Africa in relation to the enhancement of human capability. The study adopted a historical approach to assess the model of social policy in South Africa and identified that social relations of domination inherited from the apartheid era continuing to produce inequalities in opportunities. Social policy under the democratic government has not managed to address social inequalities and the main drivers of poverty in the form of income poverty, asset poverty and capability poverty which are the underlying factors reproducing deprivation and destitution of the majority of the population Although South Africa prides itself of a stable democracy, social inequalities continue to undermine the benefits of social citizenship because political participation in the midst of unequal access to economic and social resources undermine the value of citizenship. Also, inequalities in the distribution of income and wealth, and in the control of economic production undermine political equality which is an ethic upon which social rights are predicated. As a result, state interventions are lacking inherent potential to build human capability for people to live the life that they have reason to value. The paradox of social policy in South Africa is that the majority of those who are marginalised are those who were excluded by the apartheid regime even though state intervention is claimed to be targeting them. This points to the failure of incremental equalisation of opportunities within a context of stark social inequities. It is also an indication that the economic growth path delivered by the political transition is working to reinforce the inherited legacy of deprivation and it is avoiding questions related to the structural nature of poverty and inequalities. Therefore, a transformative social policy is an imperative for South Africa. Such a framework of social policy should be premised upon a notion of human security in order to built human capability. Human security focuses on the security of individuals and communities to strengthen human development. It emphasises on civil, political and socioeconomic rights for individual citizens to participate fully in the process of governance. Although this thesis is a case study of social policy in South Africa, it can be used to appreciate the role of social policy in other developing countries, particularly the impact of political decision making on social distribution. Poverty and social inequalities are growing problems in developing countries and so is the importance of putting these problems under the spotlight for political attention.

Mainstreming black African women into managerial positions in the South African private sector : a critical analysis of transformative legislative interventions, challenges, and prospects

Thesis (LLD.) -- University of Limpopo, 2021 / The private sector in South Africa lags in proliferating black African women into managerial positions. This is so despite the Employment Equity Act (EEA) requiring that the private sector must ensure that all occupational levels are equitably represented and reflects the demographics of South Africa. Since the EEA, the private sector has been white male-dominated and white females enjoy preference in terms of recruitment compared to black African women. Despite the legislative gaps in South Africa, the South African private sector demonstrates its unwillingness to transform it's by managerial positions by engaging in race-based recruitment, failing to train and develop black African women within the workplace, failing to create pipeline mechanisms into managerial positions and creating a workplace environment that caters for the needs and interest of women at leadership levels. The progression of black African women requires South Africa to adopt a quota system that will result in the private sector being compelled to appoint suitably qualified black African women. The EEA does require the private sector to apply affirmative action measures to achieve equity in the workplace. It is submitted that since 1998 the private sector has been provided with an opportunity to set their targets to achieve equity, 20 years later black African women are excluded in key managerial positions. Some private sector companies engage in fronting practices to obtain a Broad-Based Black Economic Empowerment (BBBEE) certificate that enables the company to do business with the State. Black African women who are appointed as a ‘front’ do not obtain the necessary experience in managerial levels and as such limits their economic participation. Exposing black African women in managerial levels enhances their skills and increases their prospects to promotions and assuming further leadership roles in the private sector. Without a clear, a quota law in South Africa, the South African private sector would not be persuaded to accelerate the equitable representation at its managerial positions. xiii

Beyond equality and difference: empowerment of black professional women in post-apartheid South Africa

South Africa has embarked on a journey of transformation since 1994. The ruling ANC has introduced many policies aimed at achieving equality, known as "black empowerment". The `empowerment' of black women professionals is especially critical in the transformation era. Empowerment is defined as a process, which "involves individuals gaining control of their lives and fulfilling their needs, …as a result of developing the competencies, skills, and abilities necessary to effectively participate in their social and political worlds" (Kreisberg, 1992:19). From this perspective, empowerment is the essential expression of individualism and self-determination since it embodies the belief that the individual has the ability to effect changes and improve their lives. This individually oriented definition presupposes the importance of constructing one's `self' as unitary and independent. The `unitary self' is a support of the logic of the `Same', which entails the exclusion of otherness and difference. In contrast to this approach, the postmodern theory of Julia Kristeva, with its inherent suspicion of doctrines of pure origins and essences, is corrosive of discourses such as `empowerment' that are developed according to the logic of the Same. Kristeva proposes a subject which is always already `in process'. Identity is a constructed process, rather than a fundamental essence. The Oedipal model, extracted from the Kristevan theory of subjectivity, shows how the nine professional women who partook in this study constructed their selves by placing equality and difference in an antithetical relationship. However, a deconstruction of the Oedipal model opens the construct up to its blind spots and, these subjects are shown to base their identities on the splitting off of their feminine capabilities. Instead of being `unitary self', the subjects are subjects-in-process, and they operate both across and within the competing discourses of traditional femininity and masculinity. As a possible alternative to the positivist paradigm of `empowerment', a Kristevan `herethics' is considered. In South Africa, this is exemplified by the `ubuntu' principle, which entails the recognition of our interdependence. Finally, in order to assist these professional women to embrace the alterity within, whilst competing in a constantly changing and intellectually challenging world, life skills coaching which focuses on the often repressed, emotional aspects, is recommended. / Psychology / D.Litt et Phil. Possible selves in social context

South Africa has been going through severe social changes over the past two decades. In light of these changes the present study aimed to understand adolescents’ expectations of their personal future. Based on the Theory of Possible Selves (Markus & Nurius, 1986) the present research addressed the overall question whether adolescents’ personal future plans incorporate the views they share about the present and the future of their social context. Social context was not only limited to factors such as gender, ethnicity and school environment, but also included both the daily lived experiences of inequality, as is the case in South Africa, and the projected social context of the future. A total of 631 pupils from four Gauteng high schools took part in this cross sectional study. The results support the hypotheses especially within the possible selves’ domain of academic achievement. Racism and law : implementing the right to equality in selected South African equality courts

Racism has informed South African society since colonial times. Racist beliefs found expression in the laws of colonial and apartheid South Africa and shaped both state and society. The constitutional state that South Africa has become since 1994, is based on the values of ‘human dignity’, ‘the achievement of equality’ and ‘nonracialism’, among others. Law formed the basis of the racist state prior to 1994, and now law has a fundamental role to play in the transformation of the state and society in an egalitarian direction by addressing socio-economic inequalities on the one hand, and by changing patterns of behaviour based on racist beliefs forged in the past, on the other. This thesis examines one of the legal instruments that is intended to contribute to transformation in the latter sense, namely the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (the Equality Act), with specific reference to the issue of racism. The provisions of this Act and the framework for its operation against the background of South Africa’s racist past, and within the broader framework of international and constitutional law, are examined. These two legal frameworks are analysed for the purpose of determining the standards set by international and constitutional law regarding racial equality in order to determine whether the Equality Act measures up. This thesis also incorporates an analysis of the practical application of the provisions of the Equality Act to complaints of racism in selected equality courts. The theoretical analysis of the Act’s provisions and their application in the equality courts point to various problematic formulations and obstacles which negatively affect the application of the provisions and thus hamper social change. The thesis concludes with recommendations for refining the Act’s provisions and its application.

Constructions, negotiations and performances of gender and power in lobolo: an African-centred feminist perspective

This study aimed to explore how gender is constructed, negotiated and enacted in the customary practice of lobolo. Lobolo, sometimes incorrectly referred to as bridewealth or dowry is a practice that centres around the transference of wealth from the groom or a groom’s family to the bride’s family towards the formalisation of marriage. Framed within an African-centred feminist approach I analyse, through narrative discursive analysis, how 27 men and women ages 27 -71, from Johannesburg and Cape Town account for gender and power dynamics in their narratives of participating in lobolo. The African-centred feminist approach I employ critically engages with historical as well as present-day reproductions of patriarchy, capitalism, heteronormativity and other mechanisms of exclusion that are perpetuated through the cultural practice of lobolo. I show how masculinities and femininities are constituted, negotiated and disputed in the narratives of men and women who have participated in lobolo. By employing an African-centered feminist approach I show how gendered dynamics within the practice are shaped by historical and contemporary social, political and economic factors which enable and constrain the exercise of power in various ways. By exploring lobolo through an African-centered feminist narrative approach I demonstrate how the process is more than simply a transference of wealth but rather a complex practice that is used as an apparatus to exercise and expand power in the different stages of the lobolo process. Within this African-centered feminist approach, I argue that lobolo functions to legitimise particular gender positions that can be adopted through marriage; but it can also be used to challenge and contest these roles. The findings of this study suggested that the different stages and process of lobolo reflect a gendered script, which determines the position that men and women are able to adopt, and that this script sets the parameters for the ways in which these roles may be enacted. I find also that the meanings and descriptions of lobolo are embedded within, and reproduce gendered identities but that these identities are not fixed but rather are constantly renegotiated. I conclude that lobolo is not only a custom for formalising marriages but also a tool used by men and women to perform a range of sometimes contradictory functions, including at times establishing and strengthening hegemonic masculinities and femininities but at other times challenging and dismantling these. / Psychology / Ph. Affirmative action, equality and Section 8 of the constitution

The constitutionality of affirmative action in terms of section 8 of Act 200 of 1993 is investigated. The study contends that in constitutional interpretation it is permissible to have recourse to ethical precepts as long as these are anchored within the four corners of the Constitution. It is contended that the •equality clause• does not prescribe equality of outcome in favour of substantive equality of opportunity. It is asserted that group-based affirmative action may justifiably be attacked as being unconstitutional; either on the basis that it infringes the nonbeneficiary's equality rights in terms of sections 8(1) and 8(2) or that it falls beyond the constitutional protection afforded to affirmative action in terms of section 8(3). Furthermore, group-based modalities of affirmative action may also not constitute a permissible limitation on the fundamental right to equality, if compared to an individual-based socio-economic affirmative action model. / Jurisprudence / LL.
