The thesis s author discusses in detail the concepts of otherness, corporeality, linguisticity, temporality, spaciality, mundaneity, and culpability in childhood and presents a register of the process of production of meaning in early childhood (from birth to six years of age). The author offers a drawn image which she calls The flower of life, in which the existentials appear as petals and mundaneity as the stem. The purpose is to show a conception of childhood in which the child s manner of being in the world is always holistic and understood as the child s coexistence with her body, with other people, with the time and space in which she lives, with her mother tongue, and with culpability. The author proposes a hermeneutics of childhood based on her work with children as theater teacher and psychotherapist. She concludes that the existencials ought to be carefully cultivated by adults, so that young children may acquire self-knowledge, knowledge of the other and of human culture. In this manner, under the guiding light of linguisticity, children from the earliest age on may acquire the capacity to express the meaning of their life experiences / Esta tese procura perscrutar as relações adulto-criança do modo como proposto pelo filósofo Maurice Merleau-Ponty em seus cursos na Sorbonne sobre pedagogia e psicologia da criança. Discute minuciosamente os existenciais outridade, corporalidade, lingüisticidade, temporalidade, espacialidade, mundaneidade e culpabilidade na infância e registra o processo da autora de produção de sentidos para a pequena infância (a criança de zero a seis anos de idade), na forma de relato de experiência. A autora cria uma imagem em desenho que denomina A flor da vida : imagem onde os existenciais aparecem como pétalas, e a mundandeidade como cabo da flor; seu objetivo é mostrar uma visão da infância onde o modo de ser e estar no mundo da criança pequena é sempre totalizado e compreendido na coexistência com seu corpo, com os outros, com o tempo e com o espaço vividos, com sua língua mãe e a culpabilidade. A autora propõe uma hermenêutica da infância a partir de seu trabalho junto a crianças como professora de teatro, psicoterapeuta e estudiosa de Fenomenologia, e conclui que os existenciais podem ser cuidadosamente cultivados pelos adultos, de modo a propiciar às crianças pequenas o conhecimento de si, do Outro e da Cultura humana. The constitutionalization of civil law implied the verticalization of these principles throughout all the law system. This has led to rising conflicts between constitutionally protected individual rights mainly due to the horizontal efficacy verified in private relationships. As a means of conflict resolution, in case of conflicts involving constitutionally protected rights of the same hierarchy, we propose the application of proportionality rules. This is a well known tool in the constitutional area, but still of little use in private law practice / A doutrina tem demonstrado que a diferença entre regras e princípios caracteriza-se por uma diferença estrutural onde as regras têm um conteúdo mais determinado, mais específico, e os princípios apresentam-se como enunciados abertos com um alto grau de generalidade. A constitucionalização do direito civil implicou na verticalização desses princípios em todo o ordenamento, levando à colisão entre direitos constitucionalmente protegidos nas relações entre particulares, devido à eficácia horizontal nas relações privadas. Como forma de solução de conflitos, onde ocorre colisão entre direitos constitucionalmente protegidos de mesma hierarquia, propomos a utilização da proporcionalidade, ferramenta que embora sedimentada na área constitucional, é pouco ou quase nada utilizada no direito privado

Num esforço de compreensão do contemporâneo definido como existência líquida, tensionei as interpelações das pedagogias culturais do tempo presente, que operam um tipo de formação para o consumismo de significados culturais e epistemologias que incluem e excluem, tentando modelar aquilo que temos sido nas contingências. Como rotas de fuga e desgoverno das totalizações da sociedade de controle, o currículo aqui forjado é articulado na produção teórica pós-crítica com a potência dos etnométodos dos atores curriculantes que interagiram neste processo de pesquisa com suas narrativas, instituindo epistemologia multicentrada em saberes experienciais e conhecimento. Fiz opção pela abordagem qualitativa e servi-me da etnopesquisa crítica, multirreferencial e implicada, produzindo, portanto, uma ciência implicada no social e nas novas racionalidades em multiplicidade de saberes. A pesquisa responde a como educadores refletem sobre mochilas existenciais e insurgências curriculares para interações com as pedagogias culturais do tempo presente como vibrações instituintes de etnocurrículo, por atribuírem políticas de sentido aos seus etnométodos como práticas de não-aderência e escape do consumismo de significados hegemônicos da existência líquida. Este estudo intencionou compreender/explicitar como tais educadores, implicados no segmento do Ensino Médio e da Educação de Jovens e Adultos, plasmam/forjam essa forma de currículo-vivo, (des)arrumando a escola nas contingências do espaço/tempo. Problematizou subjetivações produtoras de sujeitos e efeitos de verdades forjadas nos engendramentos dessas pedagogias culturais, criando possibilidades da escola tornar-se campo de profusão de etnocurrículo. Por fim, esta pesquisa configurou as mochilas existenciais e insurgências curriculares como empoderamento de práticas significativas que provocam rizoma formativo compósito, ampliando a noção de currículo/formação. / ABSTRACT The action that drives this research is the concept of the experienced knowledge amount and the curricular insurgencies as an ethnocurriculum establishing in the existencial plots in heterogeneous formation and with mediations of various fields of existence in their space/time of “belonging”. As an effort of understanding of contemporary defined as liquid existence. I tensioned cultural pedagogy interpellation of present time that causes a kind of formation to the consumerism of cultural meanings and epistemologies that include and exclude trying to shape what we have been in the contingencies. As escape routes and misrule of the aggregation of the society of control, the curriculum when forged is articulated in theoretical production pos-critique with the power of ethnomethods from those who interacted in this research process with their narratives establishing multicentered epistemology in experiential knowledge and knowledge. I made a choice on the qualitative approach and I used the critical multireferential and involved ethnoresearch producing thus a social compromised science and new social rationalities in multiplicity of “knowledges”. The survey answers how the educators reflect about the experienced knowledge amount and curricular insurgencies for interactions with the cultural pedagogies of the present time as ethnocurriculum former vibrations because they assign sense policies to their ethnomethods as practices of non – adherence and consumerism escape of hegemonic meanings of liquid existence. This study intended to understand/make clear as such educators involved with high school segment and education for youth and adults are forging this form of “live curriculum” disarranging education in contingencies of space/time. It rendered problematic subject producing subjectification and forged truth in engendering these cultural pedagogies creating possibilities of school becomes the ethnocurriculum profusion. [pt] O Supremo Tribunal Federal decidiu, na ADI n. 4815, que a publicação de biografias poderia ocorrer independentemente da autorização das pessoas retratadas, sob a alegação de que o direito à liberdade de expressão teria uma posição preferencial face aos direitos existenciais em risco, tais como a honra, a imagem e a privacidade, mesmo reconhecendo a existência e importância de tais direitos que, para o STF, só poderiam ser reclamados, via responsabilidade civil, depois da publicação. No entanto, como se demonstrará, a cláusula geral de tutela da pessoa humana, que engloba os direitos existenciais mencionados, e se externa a partir do princípio da dignidade da pessoa humana, não pode estar em posição inferior ao direito à liberdade de expressão, principalmente em razão de o princípio ter sido considerado, pelo constituinte de 1988, como um dos fundamentos da República. Deste modo, os direitos existenciais devem ser observados em compatibilidade com a relevância que o princípio da dignidade da pessoa humana ocupa na Constituição da República. Em consequência, ao biografado deve ser dada a possibilidade e a oportunidade de preservar seus direitos subjetivos existenciais, em especial as informações de caráter íntimo que, se reveladas, causarão constrangimento e eventual discriminação. Desta forma, o direito à privacidade como autodeterminação informativa permite que o biografado deva ter o controle sobre as informações que estão sendo recolhidas e que serão disponibilizadas aos leitores e esse controle só será possível se biografado for comunicado previamente a publicação da história de sua vida. Assim ele poderá acessar o Poder Judiciário e evitar que uma ameaça de lesão se torne uma efetiva lesão à sua dignidade. / [en] The Brazilian Supreme Court ruled in ADI No. 4815 that the publication of biographies could occur independently of the authorization of the persons portrayed, on the grounds that the right to freedom of expression would have a preferential position vis-à-vis the existential rights at risk, such as honor, image and privacy. Even though the Supreme Federal Court recognized the existence and importance of such rights, it could only be claimed, via civil liability, after the publication of the biography. However, as will be shown, the general clause of protection of the human person, which encompasses the existential rights mentioned, and is extracted from the principle of the human dignity, cannot be in an inferior position when comparing to the right to freedom of speech, especially because the principle was regarded by the 1988 constituent as one of the foundations of the Republic. In this way, existential rights must be observed in compatibility with the relevance that the principle of the human dignity occupies in the Constitution of the Republic. Consequently, to the biography subject must be given the possibility and opportunity to preserve his existential subjective rights, especially related to the publishing of intimate information that, if revealed, will cause embarrassment and eventual discrimination. Thus, the right to privacy as informative self-determination allows the biography subject to have control over the information that is being collected and will be made available to readers and this control will only be possible if the biography subject is communicated before the publication of the story of his life. Thus, he can access the Judiciary and prevent a threat of injury from becoming an effective injury to his dignity.

Adotando uma visão não-lexicalista, à luz da Morfologia Distribuída (HALLE & MARANTZ 1993), a hipótese norteadora desta pesquisa é a de que a matriz fonológica de ser é inserida pós-sintaticamente, sob a condição de que a categoria v esteja adjacente a um núcleo portador da versão interpretável do traço Deg (Degree), responsável pelo caráter avaliativo que marca as construções existenciais com esse verbo. Para embasar essa hipótese, a investigação se pauta nos estudos de Avelar (2004, 2009) em torno das construções existenciais com ter e estar com, segundo os quais a matriz fonológica do verbo existencial é selecionada pós-sintaticamente, a partir da combinação de traços resultante de procedimentos que se operam na computação sintática. A tese também segue a proposta de Embick (2003), que apresenta evidências favoráveis à ideia de que condições de adjacência são relevantes no processo de inserção vocabular, bem como explora desdobramentos da análise de Silbaldo (2006) em torno das Small Clauses Livres do Português Brasileiro, em particular no que diz respeito ao argumento de que tais construções trazem em sua configuração a projeção DegP (Degree Phrase) / Abstract: Based on the Minimalist version of the Principle and Parameters Theory (CHOMSKY, 1995), more specifically in accordance with the approach proposed in Adger (2004), this paper analyzes existential constructions with the verb ser (to be), comparing its syntactic behavior to that of existential sentences with verbs ter (to have) and estar/estar com (to be (with)). By adopting a non-lexicalist view, based on the theoretical assumptions of the Distributed Morphology framework (HALLE & MARANTZ, 1993), the guiding hypothesis of this research is that the phonological matrix of be is inserted post-syntactically, under the condition that the v category be adjacent to a head that presents an interpretable version of the Degree feature, responsible for the evaluative character that marks existential constructions with this verb. To support this hypothesis, the research follows the studies of Avelar (2004, 2009) related to existential constructions with the verbs ter and estar com. According to those studies, the phonological matrix of the existential verb is selected post-syntactically, based on the combination of features resulting from procedures that occur in syntactic computation. This doctoral dissertation also follows Embick's (2003) proposal, which presents evidence for the idea that adjacency conditions are relevant in the vocabulary insertion process.
