Le choix du prénom chez le trans, s’agit d’une thèse qui fait des approches à la question trans à partir de la clinique psychanalytique proposée par Sigmund Freud et Jacques Lacan.À la question principale sur laquelle repose cette recherche –comment une personne peut-elle changer de prénom (et de sexe ou de genre) ? –, s'y ajoute une autre, qui vise à se demander s’il est justifié ou non –et pourquoi– de continuer à faire une différenciation structurelle basée sur les critères de la psychanalyse.Dans la tension entre ces deux questions réside tout l’effort de l’auteure pour parvenir à une réflexion qui se réfère à la théorie psychanalytique mais qui prend racine dans ce qui interroge la théorie, voire la conteste, c’est à dire la complexité des rencontres cliniques avec des personnes trans.L’ensemble de la recherche s’appuie sur trois ensembles de travaux : la psychiatrie et la théorie queer des États-Unis ; la psychiatrie, la sexologie et le féminisme du Mexique, et la psychanalyse de France. Spécifiquement par rapport à l’enseignement de Lacan, considérant que la caractéristique du travail fait appel à la question du choix du prénom, la période à laquelle se circonscrit la thèse va de 1961 –l'année où il a commencé son séminaire L’identification– à 1965 –celle consacrée aux Problèmes cruciaux de la psychanalyse–, période au cours de laquelle Lacan travaille davantage sur la question du nom propre. Cette délimitation n'exclut pas, cependant, lorsqu'il a été nécessaire, de faire des liens vers d'autres moments de son enseignement, en tenant compte de leur contexte et de leur pertinence pour le développement.L'ensemble se compose de huit chapitres, divisés en deux sections : dans la première, du chapitre un au chapitre quatre, est développé le cadre théorique ; dans la deuxième, du chapitre cinq au chapitre huit, est développé le thème du prénom et son choix chez les trans / The choice of the first name in the trans, is a thesis that makes approximations to the trans question from the psychoanalytic clinic proposed by Sigmund Freud and Jacques Lacan.To the main question that gives rise to this investigation - how is it that a person can change their name (and sex / gender)? -, one more is added, which aims to ask whether it is justified or not -and why- continue making a structural differentiation based on the criteria of psychoanalysis.In the tension between these two questions lies the author's effort to formulate a reflection that refers to psychoanalytic theory but that takes root in what interrogates the theory, and even discusses it based on the complexity of clinical encounters with transgender people. The whole of the research is based on three working groups: psychiatry and queer theory of the United States; psychiatry, sexology and feminism of Mexico, and psychoanalysis of France.Specifically in relation to the teaching of Lacan, considering that the specificity of the work appeals to the question of the choice of the first name, the period to which it is circumscribed goes from 1961 -Year in which his seminar begins, The identification- to 1965 -that dedicated to the crucial problems for psychoanalysis-, a period in which Lacan works with greater emphasis, the question of the proper name. This necessary delimitation does not exclude, however, when it was necessary, the presence of links to other moments of its teaching, taking into account the context of them and the pertinence within the development.The structure of this research consists of eight chapters, which are divided into two sections: from the first to the fourth, the theoretical elements - theoretical framework - that will support the second section, which goes from chapter five to eight, where it is specifically developed the theme of the first name and its choice in trans people

A argumentação e a mudança de prenome de transexual na jurisprudência

No. of bitstreams: 1 2143.pdf: 731901 bytes, checksum: 7839f374d3998a856e66c4044b914170 (MD5) Previous issue date: 2008-03-28 / From the perspective of the Semântica do Acontecimento (Semantics of the Events) and the French Discourse Analysis, which the firs theoretical field dialogues with, we have studied the way the argument ( argumentação ) for changing a transsexual s first name is built through the speaker-petitioner s own words, as well as through the argument and the designations used by the speaker-judge in order to authorize the alteration of a transsexual s first name. In the legal process, proceeded in the enunciation space of São Carlos, state of São Paulo, the petitioner transsexual Agnaldo requests the modification of his masculine first name into the feminine name Ângela. For that study we have adopted the concepts of designação (designation) reescritura (re-writing), cena enunciativa (enunciation scene), politico (politician) and argumentação (argument). Through the analysis of the corpus we could understand how the process of conception of the transsexual s own identity takes place, and how the process of social inclusion of the transsexual subject occurs (the politician being considered) for the subject, once socially excluded, is now included for the modification of the first name sentenced by the judge. There is always the liaison between the social and the politician (político), once the social recognition needs to be legally legitimated so that it can politically happen: the Constitution guarantees the political in the social perspective. Thus, in the political instance, the fragmentation takes place because the speaker-petitioner needs a place of belonging (recognition) and this place (recognizing himself as a subject being a woman ) is legitimated in the juridical discourse. Then, we understand how the process of social identification, connected with the scientific discourse, which has its own crystallized place, may contribute to the alteration of the transsexual s first name in the argumentation of the speaker-judge. Consequently, we can claim that the event and the litigation make the speaker-petitioner s speech move into the memorable (memorável) of the social environment, of the esthetical perspective and of the psychological constitution in order to change the name and that inserts him in the identity of a transsexual. And under the perspective of a liberal subject position, the speaker-judge sentenced favorably for the legitimating of the first name Ângela, who the speaker-petitioner has semantically a new body. This substitution of the official first name by the real one consolidated a new jurisprudence. / A partir da Semântica do Acontecimento e da Análise do Discurso Francesa, com a qual a primeira dialoga, estudamos como se dá a argumentação no que diz respeito à mudança de nome próprio de transexual em recortes do locutor-requerente, bem como pormeio da argumentação e da designação que se vale o locutor-juiz para autorizar a mudança de prenome do transexual. Nesse processo jurídico tramitado no espaço enunciativo de São Carlos, Estado de São Paulo, o requerente transexual Agnaldo solicita a retificação de seu prenome masculino para o feminino Ângela. Para tal, mobilizamos conceitos como designação, reescritura, cena enunciativa, político e argumentação. E, a partir dos recortes analisados, compreendemos como se dá o processo de identificação do transexual e como se dá a inclusão de tal sujeito no social (o político sendo considerado), pois o sujeito, antes excluído juridicamente pela sociedade por não ter ainda a legitimação oficial de seu prenome feminino, é incluído socialmente na/pela sociedade enquanto transexual a partir da mudança do prenome sentenciada pelo juiz. E o tempo todo há o jogo entre o social e o político, uma vez que o reconhecimento social precisa ser legitimado juridicamente para o ser politicamente: a constituição garante o funcionamento político no social. Assim, no político, a divisão se dá porque o locutor-requerente precisa de um lugar de pertencimento legitimado no discurso jurídico. Então, compreendemos como o processo de identificação social, aliado ao discurso científico, que já tem o seu lugar cristalizado, pode contribuir para a mudança de prenome do transexual na argumentação do locutor-juiz. Assim, podemos dizer que o acontecimento e o litígio põem em movimento a fala do locutor-requerente no memorável do convívio social, estético, e da constituição psicológica para mudar de nome, o que o inclui na identidade de transexual. É sob a perspectiva de uma posição sujeito liberal, na qual o locutorjuiz sentenciou favoravelmente à legitimação do prenome Ângela, que o locutor-requerente passou a ter semanticamente um novo corpo. Essa substituição do prenome oficial pelo social consolidou a criação de uma nova jurisprudência.

Issues considered as complexes, however, such as transsexualism that according to the International Classification of Diseases (CID 10) is considered to be a 'Sexual Identity Disorder' and still raises deeper understanding from part of Society, the judiciary power, the executive power and the legislative power. The Brazilian Health System – SUS – has began allowing in Brazil the gender reassignment surgery, in which sexual reassignment is done, and legal criteria was therefore settled for this accomplishment. After surgery, however, comes a new problem: civil identity; because the person's new gender is not in line with his/her new civil register, causing him/her embarrassment. There is no law that regulates this matter at all. From this research observation, the present study aims to explore judicial decisions, from all states in the federation, by means of research in sites from respective courts, as well as high courts, seeking with terms as: 'transsexual' and 'first name'; using time filtering in the search, since 1988, which was the promulgation year of the Citizenship Letter, through the end of 2010. Having in view the lack of a law to regulate this issue, the primary scope here consisted in obtaining the narrative of how demands have been decided into this regard. The study conclusion suggests that although there is no established legal framework, the discourse of the judiciary power uses several arguments from the social, psychological and legal order, being properly, systematic and appreciated, as well as the legal principles, being in this case the principle of human person's dignity, as laid down in the Magna Carta, the most used one. / À luz do instituído pela Constituição Federal de 1988, os direitos fundamentais passaram a ser vistos sob um novo olhar. Todavia, temas considerados complexos, como o transexualismo, segundo a Classificação Internacional das Doenças (CID 10) considerado 'Transtorno de Identidade Sexual', ainda suscitam maior aprofundamento por parte da sociedade, do poder judiciário e do poderes executivo e legislativo. O Sistema Único de Saúde – SUS passou a permitir a cirurgia de transgenitalização no Brasil, na qual se opera a redesignação de sexo, tendo sido estipulados por lei critérios para a sua realização. Após a cirurgia, surge um problema: o da identidade civil, uma vez que o novo gênero da pessoa operada não se coaduna com o seu registro civil, causando-lhe constrangimento. Não há lei que regule a matéria. A partir desta constatação, o presente estudo se propõe a explorar as decisões judiciais de todos os estados da Federação, por intermédio de pesquisa nos sites dos seus respectivos tribunais, bem como das cortes superiores, buscando os termos 'transexual' e 'prenome' e utilizando o filtro temporal a partir de 1988, ano da promulgação da Carta Cidadã, até final de 2010. Tendo em vista a falta de lei que normatize a matéria, o escopo primordial consiste na obtenção de uma narrativa de como vêm sendo decididas as demandas na temática ora proposta. A conclusão do trabalho sugere que apesar de não haver um marco normativo estabelecido, o discurso do poder judiciário se utiliza de diversos argumentos de ordem social, psicológica e jurídica, devidamente sistematizados e apreciados, bem como de princípios jurídicos, sendo, nesse caso, o princípio da dignidade da pessoa humana, previsto na Carta Magna, o mais utilizado.
