Previous issue date: 2010-05-20 / The objective of this paper is the study of rural labor analogous to slavery in Brazil of the 21st century. The goal of the research is to analyze the concept, characterization and the current mechanisms to combat this legal, social and economic phenomenon. Since some of the main obstacles to eradicating slavery-like working conditions are the absence of a precise concept of the phenomenon and the difficulty of its characteristics, this paper seeks to introduce the concept and identify the main features of this slavery-like labor, in hopes of contributing to its elimination. According to this paper, the concept of working conditions analogous to slavery outlined in article 149 of the Brazilian Criminal Code, with the wording of Law nº 10.803/2003, is broader than the concept of forced labor conceived by International Labor Organization. Thus, concludes this paper that the Brazilian Criminal Code´s Laws prohibit labor that is either forced or degrading, in essence using the concept of human dignity as its basis for outlawing all forms of modern slavery. This paper also concludes that although Brazil has achieved a prominent position in the fight against slavery-like labor, the legal mechanisms currently in existence to combat contemporary forms of slavery are not sufficient to solve the problem, a problem that is not only legal in scope, but also economic and social. Therefore, this paper defends the use of land expropriation as a mechanism to combat rural working conditions analogous to slavery for two reasons. First, because it represents the main instrument to implement agrarian reform, and, second, because land expropriation constitutes a penalty to the rural property owner who, ignoring the social function, forces workers to labor under slavery-like conditions. This paper uses the deductive method, relying on a qualitative research conducted from a bibliographic review of part of the available legal literature on the subject and from documents obtained in civil investigations and civil actions conducted by the public labor prosecutor. / O objeto da presente dissertação é o estudo do trabalho análogo ao de escravo rural no Brasil do século XXI. O ensaio tem por objetivo analisar o conceito, a caracterização e os mecanismos atualmente utilizados para combater esse fenômeno jurídico, social e econômico. Como dentre os principais entraves à erradicação do trabalho análogo ao de escravo contemporâneo encontram-se a ausência de um conceito preciso do fenômeno e a dificuldade de sua caracterização, a pesquisa procura definir trabalho análogo ao de escravo e indicar suas principais características, na esperança de contribuir para sua eliminação. Para o ensaio, de acordo com o art. 149 do CP, com a redação da Lei nº 10.803/2003, o conceito de trabalho análogo ao de escravo é mais amplo que o conceito de trabalho forçado concebido pela Organização Internacional do Trabalho, abrangendo tanto o trabalho forçado quanto o degradante, já que o principal fundamento para a vedação de todas as formas contemporâneas de escravidão é a dignidade da pessoa humana. Entende-se, ainda, que embora o Brasil tenha alcançado posição de destaque na luta contra o trabalho análogo ao de escravo, os atuais mecanismos jurídicos de combate às formas contemporâneas de escravidão não são suficientes para resolver o problema, que não é apenas de âmbito jurídico, mas também econômico e social. Assim, o estudo defende a utilização da desapropriação agrária como mecanismo de combate ao trabalho análogo ao de escravo rural por duas razões. Primeiro, por ela representar o principal instrumento de implementação da reforma agrária, e, segundo, porque a desapropriação agrária constitui uma pena ao titular do imóvel rural que, descumprindo a função social, explora o trabalho análogo ao de escravo. A dissertação utiliza o método dedutivo, apoiando-se numa pesquisa qualitativa, realizada a partir de uma revisão bibliográfica de parte da literatura jurídica disponível sobre o tema e a partir de documentos obtidos em inquéritos civis e ações civis públicas a cargo do Ministério Público do Trabalho.

Den europeiska domstolen för mänskliga rättigheter har tagit upp ett mål om tvångsarbete där de klargjort att en arbetsrelation kan utgöra tvångsarbete även om arbetaren initialt accepterat arbetsvillkoren om det finns exploaterande element. I uppsatsen används idé- och argumentationsanalys för att analysera domslutet genom applicering Iris Marion Youngs teori om fem ansikten av förtryck för att utröna om domstolens argumentation uppnår en nivå av moral i linje med teorin. Uppsatsen klargör bland annat, vikten av att domstolen sett till offrens hela livssituation från ett helhetsperspektiv och att de ansträngt sig att sätta sig in i sådant strukturellt förtryck som ofta är dolt i vardagliga beteenden. Uppsatsen visar att domslutet genom sitt tillvägagångssätt på ett tillfredställande sätt kunnat visa på förekomst av förtryck som annars kunde ha passerat ostraffat, och att motiven i beslutet utgår ifrån en moralisk grund i paritet med teorin. Argumentationen kunde dock ha innehållit en mer mångfacetterad beskrivning av strukturellt förtyck och dess konsekvenser på den sociala gruppen. / The European Court of Human Rights has made a judgement in favor of the workers in a case of forced labor in which they clarify that a working relationship can constitute forced labor even if the worker initially has accepted the working conditions if there are elements of exploitation. In this essay idea and argumentation analysis are used to analyze the judgement through the eyes of Iris Marion Youngs normative theory of the five faces of oppression, to explore if the courts argumentation reaches a moral standard in line with the theory. The essay reveals among other things, that an effort to explore the life situation of victims from a holistic perspective were crucial in the judicial process, as well as an effort to understand structural oppression hidden in the everyday life. The conclusions show that the judgment meets many aspects of Youngs theory in revealing oppression and giving arguments in line with its moral grounds. However, the argumentation could have been even more versatile around issues of structural oppression and consequences thereof on the social group.

Cette thèse a pour objet l'étude de l'encadrement normatif de l'internement concentrationnaire. Ce concept désigne les règles et procédures produites et appliquées par les administrations concentrationnaires et encadrant le quotidien des détenus internés dans les camps de concentration nazis. Notre étude est pragmatique. Elle se fonde principalement sur l'analyse des archives des administrations concentrationnaires : les règles et procédures concernant l'internement des détenus édictées par les administrations centrales et leur application au niveau du camp de Buchenwald principalement. Cette approche permet de démontrer que l'internement du détenu n'est pas caractérisé par l'arbitraire. Il se déroule au contraire conformément à un encadrement normatif aux caractéristiques spécifiques. Malgré des imperfections formelles dues à leur fondement spécifique sur la Volonté du Führer (Führerwille), les règles et procédures concentrationnaires encadrent l'ensemble de l'internement du détenu : les contacts avec l'extérieur, la répression disciplinaire, le travail forcé et la mort. La participation du personnel SS et civil ou des détenus au fonctionnement du camp se fait ainsi conformément à un encadrement normatif. Cela explique en partie pourquoi les différents acteurs, croyant leurs actes fondés et justifiés par cet encadrement normatif d'allure pseudo-juridique, participèrent au fonctionnement des camps. / The object of this thesis is to study the normative framework of concentration camp internment. The term ‘normative framework’ refers to the rules and procedures established and applied by the concentration camp administrations and which governed the internment of those prisoners in Nazi concentration camps. Our study is pragmatic. It is based primarily on the analysis of concentration camps’ administrative archives: the rules and procedures issued by central administrations concerning the internment of prisoners and their application, mainly at the Buchenwald camp.This approach demonstrates that the period of internment was not characteristically arbitrary. Rather, it occurred in accordance with a normative framework with specific characteristics. Despite formal imperfections due to their specific foundation in the Führer’s Will (Führerwille), concentration camp rules and procedures governed the inmate’s entire internment: contacts with the outside, punishment, forced labor and death. The participation of SS members, or employees of firms using detainee labor or even detainees themselves, was carried out in accordance with a normative framework. This explains in part why the various actors, believing their actions grounded in and justified by this pseudo-legal framework, took part in camp operations.

The purpose of this research is to explore the need for, and the legal implications of, harmonising labour laws in the Southern African Development Community (SADC).
Chapter One highlights a number of factors that call for the harmonisation of labour laws in the SADC region and discusses some of the reasons why labour laws are not well developed in the region.
The influence of globalisation on labour standards in southern Africa and the influence of regionalism on the harmonisation of labour laws are discussed at length. The inference that could be drawn from this discussion is that for a regionalisation process in southern Africa to be successful, there is an urgent need to harmonise the region’s labour law system. This thesis confirms that Southern Africa has many lessons to learn from the regional harmonisation of labour law in the European Economic Community and the current European Union.
The implementation of international labour standards in southern Africa is investigated. The main areas examined include (1) freedom of association, (2) collective bargaining, (3) forced labour and (4) discrimination. The findings of this investigation show that there is no uniformity in the implementation of International Labour Organisation (ILO) standards in the SADC region and, therefore, it is recommended labour law should be harmonised in terms of ILO standards.
In respect of the benefits to be derived from the harmonisation process, an empirical investigation was conducted in the SADC region and the following is recommended: the harmonisation of labour law in the SADC region will help with the implementation of ILO standards, protection of workers against the economic power of employers in the workplace and maintaining similar benefits for migrants in the region. / Mercantile law / LL.D.

Previous issue date: 2013-05-09 / This thesis approached a relatively complex phenomenon that is still observed in
the Brazilian society: the existence of slave labor and forced labor, both in rural
and urban areas. The main objective was to bring elements trying to show the
conceptual differences between both, as well as to propose subsidies to eradicate
these conditions, despite of conceptual aspects, wrong treatment even in the
public sphere -, ideological positions or even lack of clarity in the definition of each
of these concepts. Seeking to achieve this goal, this thesis is structured as follows:
it began with a historical review of slave labor in Brazil and worldwide; then, it
described what has happened on the international scene in terms of slave labor
and forced labor; after that, it included features of both, considering their
differences nowadays and highlighting the importance of the fundamental rights in
the understanding of this differentiation. In order to deep this discussion, this work
brought up the case of Bolivian immigrants in São Paulo, where it seems difficult
to say exactly what it is: forced labor or slave labor? Then became involved in the
revision of Brazilian legislation about the subject, showed the position of the
leading Brazilian institutions involved in the solution of the exploitation of human
labor, after revealing the extent of this problem in the Brazilian case. Finally, based
on this material, realized several of recommendations, suggestions and subsidies
to expand and improve the fight against forced labor and slave labor in Brazil,
whether in rural or urban areas. Among these, are stand out: the discipline of
terminology and standard of sentences in the sphere of the labor court; the
complement of the PEC in terms of clarity about what is slave labor, using the
concept of Decent Work for easier differentiation of terms; setting up
recommendations to make clear and consensual what is slave labor and forced
labor. The final conclusions bring the key messages that emerged from the
development of the thesis: persisting on the fight against the exploitation of human
labor in all its forms; taking out the ideological character of the discussion;
regulating the outsourcing; the need of clearly identify the phenomenon: criminal
problem or circumventing the labor laws?; understand them as an economic
phenomenon, indicating the need of prevention and not just combat, and the
absolute necessity of a clear concept of what the slave labor is / sociedade brasileira: a ocorrência de trabalho escravo e de trabalho forçado, tanto
nas áreas rurais como nas áreas urbanas. O objetivo central foi trazer elementos
procurando mostrar a diferença conceitual entre ambos, assim como propor
subsídios para que o mesmo venha a ser erradicado, independentemente de
aspectos conceituais, tratamento equivocado, inclusive na esfera pública,
posições ideológicas, ou até mesmo falta de clareza na definição de cada um
desses conceitos. Buscando atingir este objetivo maior, esta tese estruturou-se da
seguinte forma: iniciou-se com uma revisão histórica sobre o trabalho escravo no
Brasil e no Mundo; em seguida, descreveu o que tem ocorrido no cenário
internacional em termos de trabalho escravo e trabalho forçado; contemplou as
características de ambos, tendo em vista sua diferenciação nos dias atuais,
destacando a importância dos direitos fundamentais na compreensão desta
diferenciação. Buscando aprofundar esta discussão, trouxe à baila o caso dos
migrantes bolivianos em São Paulo, onde parece ser difícil dizer exatamente o
que se trata: trabalho forçado ou análogo ao escravo? Em seguida, enveredou-se
pela revisão da legislação brasileira sobre o tema; mostrou a posição das
principais instituições brasileiras envolvidas com a solução da exploração do
trabalho humano, após revelar a dimensão desse problema no caso brasileiro.
Finalmente, como base nesse material, realizou uma serie de recomendações,
sugestões e subsídios para ampliar e melhorar o combate ao trabalho forçado e
trabalho escravo no Brasil, seja na área rural ou no meio urbano. Dentre estas,
destacam-se: disciplinar a terminologia e padronizar as sentenças na esfera de
Justiça do Trabalho; complementar a PEC em termos da clareza necessária sobre
o que venha ser trabalho escravo; utilizar o conceito do Trabalho Decente para
facilitar a diferenciação dos termos, um conjunto de recomendações visando
tornar claro e consensual aquilo que se rotula de trabalho escravo e trabalho
forçado. As conclusões finais trazem as principais mensagens extraídas do
desenvolvimento da tese: persistir no combate à exploração do trabalho humano
em todas as suas formas; tirar o caráter ideológico da discussão; regulamentar a
terceirização; necessidade de se identificar claramente o fenômeno: problema
criminal ou burla à legislação trabalhista?; entendê-los como um fenômeno
econômico, indicando, assim, a necessidade de prevenção e não somente
combate; e necessidade absoluta de um conceito claro do que seja o trabalho
escravo

This diploma thesis follows history of camp in Hodonín Nera Kunštát during its existence since late 1930's until nowadays. The work describes changes in use of the camp in context of political regime's changes during the reviewed period. Examination will be subjected not only to the repressive role of the facility, but also to its post-war recreational function and, last but not least, to the current educational mission. The work will be compiled in chronological order using the method of comparison of individual stages of camp use. In certain aspects the issue of camp use will be analysed through perspective of its diverse subjects, in addition to its various stages. The work will be divided into trhee parts, namely the use of the camp as a tool of the state policy punishing, the recreational function and the so-called second life of the camp, that is to say, the period following the recreational educational function of the camp. In this part of the thesis, medial and political messages will be analyzed as a necessary evidence illustrating the complex path of transformation of the Hodonín grounds from the camp to the center of collective memory.
