Master's thesis "EU agreements with South Korea and Japan and their impact on the European market" analyzes the impact of trade agreements between the European Union and South Korea and Japan on the EU industrial competitiveness. The impact is evaluated in terms of the development of trade flows with chemical, food, textile and automotive products and also in terms of the existence and reduction of non-tariff barriers. The study also includes trade balances developments between the respective countries. The results of the analysis showcase the overall positive impact of the agreement with South Korea on the EU industrial competitiveness and predict the impact of the agreement with Japan.

El algodón peruano alguna vez reconocido por su alta rentabilidad, actualmente, se encuentra en una crisis de producción debido a diversos factores, siendo uno de ellos la rentabilidad. Motivo por el cual el Estado peruano decretó diversas normativas para mejorar la situación en el sector. Sin embargo, no se obtuvo los resultados previstos ya que en el 2019 se tuvo una dependencia de las importaciones de EE.UU. el cual abastecía el 58% de la demanda nacional. Referente a ello, la apertura de mercado a través de los Tratados de Libre Comercio puso en desventaja a dicho rubro por la falta de previsión de los actores involucrados y sus efectos relacionados. Con ello, el presente trabajo de investigación tuvo como objetivo principal determinar en qué medida las importaciones del algodón sin cardar ni peinar de la subpartida nacional 5201.00.20.00 están relacionadas con la producción de algodón en la región de Ica, durante el periodo 2009-2019, en el marco del TLC Perú-EE. UU. Por ende, se consideraron como dimensiones de la importación a la competitividad de precios, demanda interna y preferencia arancelaria. Asimismo, en la producción de algodón se determinó como dimensión a la producción de algodón de la región de Ica. En esta investigación se usó un enfoque mixto, con un diseño transversal correlacional. Por un lado, para la recolección de datos cuantitativos, se usaron bases de datos de diferentes instituciones como el MINAGRI, BCRP y SUNAT, procesando la data en el programa SPSS. Por otro lado, para los datos cualitativos, se realizaron entrevistas a diversos grupos de actores claves pertenecientes a la cadena textil algodonera. Cabe resaltar que esta se utilizó para la explicación e interpretación de los resultados cuantitativos. El análisis de esta información se trabajó mediante el software Atlas.ti. Los resultados obtenidos mediante la correlación de Pearson indicaron que sí existe una relación inversamente proporcional entre las importaciones de algodón sin cardar ni peinar y la producción de algodón de la región de Ica en el período 2009-2019 en el marco del TLC Perú-EE.UU. Además, se evidenció que la dimensión de competitividad de precios, analizada bajo el indicador de tipo de cambio, sí cuenta con dicha relación, en contraste, el indicador precio internacional es independiente. Asimismo, la demanda satisfecha evaluada con el volumen producido presenta una relación negativa considerable. Por último, las preferencias arancelarias evaluadas acorde a las entrevistas realizadas, sí cuentan con una relación inversamente proporcional para el grupo de productores algodoneros, a diferencia de las empresas importadoras el cual es positivo. / Peruvian cotton, once recognized for its high profitability, is currently in a production crisis due to various factors, one of them being profitability. Reason why the Peruvian State decreed various regulations to improve the situation in the sector. However, the expected results were not obtained since in 2019 there was a dependence on imports from the United States, which supplied 58% of the national demand. Regarding this, the opening of the market through the Free Trade Agreements put this item at a disadvantage due to the lack of foresight of the actors involved and its related effects. With this, the main objective of this research was to determine to what extent the imports of cotton without carding or combing of the national subheading 5201.00.20.00 are related to the production of cotton in the Ica region, during the period 2009-2019, within the framework of the Peru-US FTA. Therefore, price competitiveness, domestic demand and tariff preference were considered as dimensions of imports. Likewise, in cotton production, cotton production in the Ica region was determined as a dimension. In this research a mixed approach was used, with a correlational cross-sectional design. On the one hand, for the collection of quantitative data, databases of different institutions such as MINAGRI, BCRP and SUNAT were used, processing the data in the SPSS program. On the other hand, for qualitative data, interviews were conducted with various groups of key actors belonging to the cotton textile chain. It should be noted that this was used for the explanation and interpretation of the quantitative results. The analysis of this information was processed using the Atlas.ti software. The results obtained using the Pearson correlation indicated that there is an inversely proportional relationship between the imports of cotton without carding or combing and the cotton production of the Ica region in the period 2009-2019 within the framework of the Peru-USA. In addition, it was evidenced that the dimension of price competitiveness, analyzed under the exchange rate indicator, does have such a relationship, in contrast, the international price indicator is independent. Likewise, the satisfied demand evaluated with the volume produced presents a considerable negative relationship. Finally, the tariff preferences evaluated according to the interviews carried out do have an inversely proportional relationship for the group of cotton producers, unlike the importing companies, which is positive. / Tesis

This thesis addresses the Free Trade Agreement between the European Union and the Republic of Korea, which is the first one of the new generation free trade agreements for EU. First, the issue is explained in the theoretical framework of the theory of international systems and the theory of neoliberal institutionalism, which allows to grasp it adequately in the international political context. Then, the work presents the development of the legislative environment concerning the common trade policy and the transformation of strategic thinking in this area. Further, it defines the scope of economic interactions between the two participants and their common interests leading to the conclusion of the agreement. Subsequently, the thesis analyses the existing contractual relationships of both participants and defines the main aspects of the newly accepted agreement. Lastly, the current effect of the efficiency of the agreement on the trade with goods and services is analysed.

This paper focuses on the role of the human rights in the European Parliament decision process. It was created as reaction to blame the European Parliament for not considering the human rights when voting for Free Trade Agreement between the EU and Colombia and Peru. The purpose of this paper is to find out whether the European parliament is the protector of human rights in the world or not. An in- depth examination of the Trade Agreement itself, level of democracy in both countries, actions taken by European Parliament and an extensive discourse analysis proves that the European parliament is the protector of human rights. Part of the paper is also devoted to the question of readiness of the Parliament to get involved and to intervene in case that the democratic situation in Colombia or Peru gets worse. The compliance with intellectual property laws and their enforcement in Jordan : a post-WTO review & analysis

This thesis examines the implementation, enforcement and evolution of IP laws and regulations in the Hashemite Kingdom of Jordan. The period of interest includes the last decade of the twentieth century and the first decade of the twenty first century, with emphasis on the role played by Free Trade Agreements struck between Jordan and the United States, the European Union, and Jordan’s accession to the World Trade Organization. This thesis also examines the enforcement of the current set of IP laws in Jordan, and looks at their social and economic compatibility with the Jordanian societal norms and economic realities. This thesis argues that Jordanian IP laws lack a meaningful social and economic texture, and have failed to be evenly enforced in Jordan, essentially because they do not fit the Jordanian culture and are not compatible with Jordan’s economic stage of development. Additionally, the thesis argues that IP laws have had insignificant economic impact on the Jordanian economy as the majority of technologies used in Jordan, and the majority of foreign direct investments attracted to Jordan, are not IP related. Finally, the thesis argues that the current Jordanian enforcement model, which is built on coercion by donor countries, is serving the interests of foreign companies to the exclusion of the local citizens, and will not, in the long run, produce an enforcement model based on self-regulation by Jordanians, themselves. The laws, therefore, are unable to produce tangible results for the Jordanian people, or help meet their economic interests. The last part of the thesis deals with recommendations and suggestions aimed at creating an integrated approach to the adoption of IP policies.

中韓自由貿易協定之研析 / Study of a free trade agreement between China and South Korea

中國與南韓正在從事自由貿易協定之洽簽程序,本篇論文的目的即在於評估其經濟效果。本文應用多國多部門之一般均衡模型,模擬二國農工商品完全自由化在靜態及考慮資本累積之動態效果。 實證效果顯示,上述二種模擬情境下,中國與南韓的整體社會福利都有正面效益,因此本文建議中韓應儘速完成可行性研究階段並開始諮商。如此,中國可以早日扮演建立東亞經濟整合的領導角色,而南韓也可以享受中韓自由貿易協定加上美韓自由貿易協定所產生之綜效。 目前亞洲任何一個已形成或是正在洽簽的自由貿易協定皆不包含台灣,故台灣應積極參與多邊體系下的貿易談判,以減低自由貿易協定所帶來的歧視,並應採納多樣化的協定而非拘泥於自由貿易協定之形式。同時應優先考量可以避免中國政治壓力及可擴大台灣經濟利益的議題,例如:雙邊投資協定及避免雙重課稅協定,以為洽簽正式之自由貿易協定鋪路。 關鍵字:中國、南韓、自由貿易協定、多國多部門之一般均衡分析 / China and South Korea are in the process of pursuing a free trade agreement. The purpose of this study is to assess its economic effects. The paper employs CGE models and the GTAP database to conduct a simulation with full elimination of tariffs in all sectors. Two CGE models are used. One is a static CGE model that captures the short-run effects, and the other captures the static effects as well as the capital accumulation effects arising from higher savings and investment induced by the static gains. The study finds that both South Korea and China will enjoy the welfare gains from the deals. We suggest that China and Korea complete feasibility studies and start the negotiation process at the earliest possible time for the purposes that China can play a leading role in building an East Asian economic integration and that Korea can enjoy the effects of multiple FTAs due to the Korea-China FTA plus Korea-US FTA. In addition, none of the bilateral agreements in Asia includes Taiwan. Taiwan should aggressively engage in trade negotiations under a multilateral system to decrease the discrimination caused by the free trade agreements and adopt diversified forms of agreements instead of focusing on “FTAs” only. Besides, Taiwan should prioritize the issues that can avoid the political pressure from China and expand Taiwan’s economic benefit, such as Bilateral Investment Agreement and Double Taxation Agreement, in order to pave the way for a formal FTA. The right to health, the TRIPS agreement and the public health safeguards to encourage the universal access to essential medicines

The privileges arising from patent protection on pharmaceutical products often prevent the full realization of the right to health, especially in developing countries with scarce resources. This thesis first identifies the international agreements that have established the right to health in international law, obligations and violations associated with it, the problems encountered in the implementation of human rights on the field, compared with the implementation and sanctions associated with economic rights from the World Trade Organization regulatory framework. A comparative study of the legislative frameworks of both developed and developing countries will reveal to what extent Canada, the United States, the European Union, Brazil, India, and South Africa conformed with patent protection exceptions arising from international patent law to protect public health. Finally, the author identifies the crucial indicators that need to be considered in order to assess the conformity of a given approach with the right to health, before he underscores the temporary character of the relevant WTO measures, and the future stakes concerning an increased access to essential medicines. / Les droits issus des brevets d'invention sur les produits pharmaceutiques empêchent souvent la réalisation pleine et entière du droit à la santé, plus spécialement dans les pays en voie de développement ayant des ressources plus limitées. Ce mémoire de recherche retrace d'abord les accords internationaux ayant établi le droit à la santé en droit international, les obligations et les violations qui en découlent, la problématique quant à la mise en oeuvre des droits de l'homme sur le terrain, en comparaison avec la mise en oeuvre et les sanctions pour le non-respect de droits économiques dans le cadre réglementaire de l'Organisation Mondiale du Commerce (OMC). Ensuite, une étude comparative des cadres législatifs de pays développés et de pays en développement révèlera dans quelle mesure le Canada, les États-Unis, l'Union Européenne, le Brésil, l'Inde, et l'Afrique du Sud se sont conformés aux exceptions aux règles de protection issues du droit international des brevets pour cause de santé publique. L'auteur identifie finalement les points de première importance qu'il considère primordial de considérer afin d'évaluer si une approche conforme au droit à la santé a été respectée dans le commerce de médicaments essentiels, avant de souligner l'aspect temporaire des mesures courantes prévues dans l'OMC et des futurs enjeux quant à l'accroissement de l'accès aux médicaments essentiels.

La presente investigación busca determinar los factores que influenciaron en la evolución de las exportaciones de las tablillas y frisos para parqué sin ensamblar del Perú a la República Popular de China durante los años 2009 - 2017. En el primer capítulo, se estudiarán conceptos relacionados al comercio exterior, desde las teorías de liberalización hasta acuerdos comerciales como el de Perú con China; aspectos relacionados a las tablillas y frisos para parqué, factores críticos de éxito, internos y externos. Entendemos que la firma del Tratado de Libre Comercio origina la desgravación, lo cual significa que los productos de ambos países tendrán una eliminación progresiva, parcial o total de los aranceles para ambos mercados. De acuerdo a lo mencionado anteriormente y relacionándolo con la teoría del liberalismo comercial, entendemos que luego de 9 años desde la entrada en vigencia del Tratado, encontramos en base al modelo de estudio cualitativo que existen otros factores que tienen más relevancia con respecto a la firma del TLC, los cuales se desarrollarán más adelante. Asimismo, en el segundo capítulo se expondrá el planteamiento de la investigación tanto como el problema, hipótesis y objetivos principales y específicos. En el tercer capítulo se expondrá el método de investigación cualitativo exploratorio porque se quiere conocer mediante datos empíricos, cuales eran para los entrevistados los factores determinantes en la evolución de las exportaciones de las tablillas y frisos para parqués sin ensamblar, todo ello con a través del recojo y el análisis sistemático de datos. Además, mediante esta investigación cualitativa se determinará la muestra, categorías, procedimiento, procesamiento de los resultados, la clasificación de las categorías y las limitaciones que se presentaron en la investigación. En el cuarto capítulo se presentan los hallazgos de la investigación en relación con las entrevistas realizadas a cada participante. Se analizó de manera empírica la información y se plasmó en tablas de acuerdo con el número de menciones por factor para determinar a los que tuvieron mayor influencia en la evolución de las exportaciones. Finalmente, en las conclusiones se presenta el factor que tuvo mayor impacto para luego determinar si se cumplieron los objetivos de la investigación y la hipótesis. / The present investigation seeks to determine the factors that influenced the evolution of the exports of the slats and friezes for parquet without assembling from Peru to Popular Republic of China during the years 2009 - 2017. In the first chapter, concepts related to foreign trade will be studied, from liberalization theories to trade agreements such as Peru with China; Aspects related to the slats and friezes for parquet, critical success factors, internal and external. We understand that the signing of the Free Trade Agreement results in the elimination of tariffs, which means that the products of both countries will have a progressive, partial or total elimination of tariffs for both markets. According to the aforementioned and related to the theory of commercial liberalism, we understand that after 9 years since the entry into force of the Treaty, we find based on the qualitative study model that there are other factors that have more relevance with respect to the signature of the FTA, which will be developed later. Also, in the second chapter the research approach will be exposed as well as the main and specific problem, hypothesis and objectives. In the third chapter the method of exploratory qualitative research will be exposed because we want to know through empirical data, which were for the interviewees the determining factors in the evolution of the exports of the slats and friezes for parquet without assembling, all with the I collect and systematic data analysis. In addition, this qualitative research will determine the sample, categories, procedure, processing of the results, the classification of the categories and the limitations that were presented in the investigation. In the fourth chapter, the findings of the research are presented in relation to the interviews conducted with each participant. The information was analyzed in an empirical way and was reflected in tables according to the number of mentions by factor to determine those that had the greatest influence on the evolution of exports. Finally, in the conclusions, the factor that had the greatest impact is presented to determine if the objectives of the research and the hypothesis were met. / Tesis

Factores que influyen en el nivel de exportaciones de aceite de pescado con partida arancelaria 1504.2010.00 entre Perú y la República Popular de China durante el período 2007-2017

La presente investigación se realizó con el fin de encontrar los factores que influyen en la exportación de aceite de pescado (1540201000) a China, durante los años 2007 al 2017. Por tal motivo, se analizó todos los factores que se consideraron influyente al tema, siendo estas: las Medidas Sanitarias y Fitosanitarias, el Valor FOB y los Fenómenos Ambientales-El Niño. Debido a esto, se investigó sobre las Medidas Sanitarias y Fitosanitarias presentadas por China, para poder exportar y entrar a su país con este producto, ya que debido al Tratado de Libre Comercio, en el 2010, este tipo de medidas fueron más rigurosas, lo cual fue una barrera comercial para los exportadores porque eran nuevos requerimientos por obtener. Así también, se revisaron los valores FOB exportados a China del aceite de pescado, que vienen influenciados por la poca o la mucha producción de dicho producto, dependiendo de la temporada. Además, se analizó el impacto que causan ciertos fenómenos ambientales, tales como el Niño, que afecta directamente a la producción, a la biomasa de la anchoveta y su consecuencia con las exportaciones al mercado de China. Para la realización de esta proyecto, se utilizó el método de investigación cualitativo, tomando en cuenta información de expertos relacionado al tema de empresas exportadoras de aceite de pescado a China, y entidades como IMARPE, SANIPES y la Sociedad Nacional de Pesquería, con la finalidad de poder obtener una información más confiable para el desarrollo de la tesis, así mismo se utilizaron herramientas metodológicas como datos estadísticos de SUNAT y MINCETUR. / The present investigation was conducted in order to find the factors that influence the export of fish oil (1540201000) to China, during the years 2007 to 2017. For this reason, factors that were considered influential to the subject were analyzed, being these, the Sanitary and Phytosanitary Measures, the FOB Value and the Environmental-El Niño Phenomena. Due to this, it is investigated which are the Sanitary and Phytosanitary Measures presented by China, to be able to export and enter their country with this product, since due to the Free Trade Agreement, in 2010, this type of measures were more rigorous, which was a commercial barrier for exporters because they were new requirements to obtain. Likewise, the FOB values exported to China from fish oil were reviewed, which are influenced by the low or high production of said product, depending on the season. In addition, we analyzed the impact caused by certain environmental phenomena, such as El Niño, which affects production, anchovy biomass and its consequence with exports to the Chinese market. To carry out this project, the qualitative research method was used, taking into account information from experts related to the topic of fish oil exporting companies to China, and entities such as IMARPE, SANIPES and the National Fisheries Society, with the purpose of of being able to obtain a more reliable information for the development of the thesis, likewise, methodological tools were used as statistical data of SUNAT and MINCETUR. / Tesis
