Determinantes do sucesso e fracasso das coalizões internacionais nas negociações da Organização Mundial de Comércio (OMC) / Determinants of success and failure of the international coalitions in the negotiations of the World Trade Organization (WTO)

O principal objetivo deste trabalho é entender como coalizões de países em desenvolvimento são bem-sucedidas nas negociações do GATT (General Agreement on Tariffs and Trade) e da Organização Mundial de Comércio (OMC). Normalmente, sustenta-se que coalizões temáticas são mais bem-sucedidas do que grupos abrangentes (Higgot e Cooper, 1990; Cooper, Higgot e Nossal, 1990); e que coalizões com maiores recursos de poder são mais bem-sucedidas do que grupos fracos (Narlikar, 2003). Como hipótese alternativa, sugerimos que quanto maior for o grau de abertura comercial da coalizão - ((exportações+importações)/PIB) - maior será a chance de elas serem bemsucedidas nas negociações do GATT/OMC. Utilizaremos uma abordagem multimétodos (qualitativa e quantitativa) para realizar nossa pesquisa. Analisaremos um número (N) médio (entre 28 a 39 casos) de coalizões internacionais para descobrir quais as principais causas dos sucessos e fracassos destes grupos de países. Codificaremos a variável dependente (sucesso versus fracasso) conforme as descrições de casos particulares conduzidos por pesquisadores independentes. A variável independente categórica (coalizões temáticas versus abrangentes) será mensurada segundo procedimento semelhante. Por fim, o PIB agregado das coalizões (nossa medida de poder) e a abertura comercial agregada e abertura comercial média das coalizões (nossas medidas de abertura comercial) foram coletadas na base de dados Penn World Table 6.2. Os trabalhos que conhecemos sobre o tema utilizam a abordagem qualitativa de maneira pura, especialmente estudos de casso. Assim, até onde sabemos, este trabalho realizará a primeira análise estatística sobre o tema. / The main goal of this study is to understand how developing country coalitions obtain benefits in the GATT/WTO negotiations. Usually it is argued that issue-based coalitions are more successful than broad-based groups (Higgot and Cooper, 1990; Cooper, Higgot and Nossal, 1990), and that powerful coalitions are more successful than weaker ones (Narlikar, 2003). Alternatively, we suggest that the greater the degree of trade openness - ((exports+imports)/GDP) - the greater the chance that they will succeed in the GATT/WTO negotiations. We use a mix-method approach (qualitative and quantitative) to conduct our research. We will analyze a medium-N (from 28 to 39) cases of international coalitions to find out the main causes of coalitions\' successes and failures. We will code our dependent variable (success versus failure) according to cases studies conducted by independent researchers. Our categorical independent variable (issue-based versus broad-based coalitions) will be measured adopting the same procedure. Finally, aggregate GDP - our measure of power -, aggregate trade openness and mean aggregate trade openness of the coalitions - our measures of trade openness - were collected in the Penn World Table 6.2. To the best of our knowledge, this is the first statistical analysis on the subject.

<p>Трговина спада у најстарије привредне активности на основу којих се врши размјена добара са циљем остварења профита. Она није само у функцији међународне размјене роба, него представља један од најзначајнијих фактора развоја друштва. Она је истовремено и творац норми које се баштине у најстарије изворе људске цивилизације. На овај начин она је директно учествовала на настанак права и правне науке. Велику улогу у&nbsp; развоју трговине, нарочито у периоду глобализације међународних економских односа и међународног тржишта су имале међународне организације од којих посебно мјесто припада Свјетској трговинској организацији.<br />Националне привреде различитих држава се међусобно повезују кроз међународне трговинске односе, а правна регулатива представља незаобилазну претпоставку њихове реализације.<br />Руководна идеја СТО је оличена у читавом правном систему норми које прије свега почивају на слободи трговине и прокламацији система недискриминације и једнакости свих учесника на тржишту.<br />У функцији остварења ове&nbsp; идеје постоји читав низ начела од којих централно мјесто заузимају слобода међународне трговине, системи најповлашћеније нације и националног третмана, монопол, принцип преференцијалног третмана, начело недискриминације, начело заштите националног тржишта, начело пропорционалности и многа друга, а без њиховог постојања би било немогуће замислити организовану слободну трговину.<br />Стандард једнаког третмана представља средство реализације једнаке конкурентске шансе свим субјектима на свјетском тржишту, а забрана дискриминације оличена у систему најповлашћеније нације и националног третмана представља камен темељац за реализацију система изједначења субјеката спољнотрговинског пословања, успостављања и даљег развоја међународних трговинских односа.<br />Особине стандарда једнаког третмана у праву СТО, данас, ваља посматрати у контексту заштите интереса очекивања као општег правног постулата реализације односа и сарадње њених чланица. Овакав &bdquo;интерес очекивања&ldquo; &ndash; &bdquo;expectation interest&ldquo;, заслужује правну заштиту, а њу&nbsp; обезбјеђује право СТО, активирањем механизма рјешавања спорова. Veliku ulogu u&nbsp; razvoju trgovine, naročito u periodu globalizacije međunarodnih ekonomskih odnosa i međunarodnog tržišta su imale međunarodne organizacije od kojih posebno mjesto pripada Svjetskoj trgovinskoj organizaciji.<br />Nacionalne privrede različitih država se međusobno povezuju kroz međunarodne trgovinske odnose, a pravna regulativa predstavlja nezaobilaznu pretpostavku njihove realizacije.<br />Rukovodna ideja STO je oličena u čitavom pravnom sistemu normi koje prije svega počivaju na slobodi trgovine i proklamaciji sistema nediskriminacije i jednakosti svih učesnika na tržištu.<br />U funkciji ostvarenja ove&nbsp; ideje postoji čitav niz načela od kojih centralno mjesto zauzimaju sloboda međunarodne trgovine, sistemi najpovlašćenije nacije i nacionalnog tretmana, monopol, princip preferencijalnog tretmana, načelo nediskriminacije, načelo zaštite nacionalnog tržišta, načelo proporcionalnosti i mnoga druga, a bez njihovog postojanja bi bilo nemoguće zamisliti organizovanu slobodnu trgovinu.<br />Standard jednakog tretmana predstavlja sredstvo realizacije jednake konkurentske šanse svim subjektima na svjetskom tržištu, a zabrana diskriminacije oličena u sistemu najpovlašćenije nacije i nacionalnog tretmana predstavlja kamen temeljac za realizaciju sistema izjednačenja subjekata spoljnotrgovinskog poslovanja, uspostavljanja i daljeg razvoja međunarodnih trgovinskih odnosa.<br />Osobine standarda jednakog tretmana u pravu STO, danas, valja posmatrati u kontekstu zaštite interesa očekivanja kao opšteg pravnog postulata realizacije odnosa i saradnje njenih članica. Ovakav &bdquo;interes očekivanja&ldquo; &ndash; &bdquo;expectation interest&ldquo;, zaslužuje pravnu zaštitu, a nju&nbsp; obezbjeđuje pravo STO, aktiviranjem mehanizma rješavanja sporova. Ovi mehanizmi istovremeno predstavljaju i ključni kamen temeljac očuvanja STO, bez koje ne bi bilo moguće zamisliti odvijanje međunarodne trgovine.</p> / <p>Trade is one of the oldest economic activities of exchange of goods with the aim to gain profit.Its main purpose is not only international exchange of goods, but is also one of the most important factors of social development.It is also a designer of norms which are believed to be the oldest sources of human civilization. Thus, it has directly influenced the creation of law and legal science.In the development of trade, especially in the period of globalization of international economic relations and international trade, an important role has been played by international organisations, especially World Trade Organisation.<br />National economies of different countries are interrelated through international trade, and legal jurisprudence represents inevitable assumption for their realisation.<br />The leading idea of WTO is reflected in the entire legal system of norms which are primarily based on free trade and non-discrimination system and equality of all market holders.<br />The realization of the idea is supported by a number of principles where the central place is held by free international trade, most- favoured nation systems and national treatment, monopole, preference treatment principle, non-discrimination principle, protection of national market principle, proportionality principle and many others, and without their existence it would be impossible to imagine an organized free trade.<br />The equal treatment standard represents the means of realization of equal competition opportunities for all subjects at the world market, and ban on discrimination reflected in the most-favoured nation system and national treatment represents a foundation stone for the realization of the foreign trade subject equation system, establishment and further development of international trade relations.<br />The characteristics of equal treatment standard in WTO law today should be viewed in the context of expectation interest protection as a general legal principle of realization of relations and co-operation of its members.Such &bdquo;expectation interest&ldquo;deserves legal protection, provided by WTO, by activating the dispute resolution mechanisms.These mechanisms also represent a key stepping stone of the preservation of WTO, without which it would be impossible to imagine the international trade activities.</p>

從法規透明化比較兩岸貿易便捷化之發展 / The cross-strait development of trade facilitation in respect of transparency

國際貿易是經濟發展的重要手段之一,然而無論在開發中或已開發國家,貿易商皆面臨貿易流程的繁文縟節。隨著各國的關稅逐漸降低,業者進行國際貿易時的貿易成本甚至已超過關稅成本。因此,有望透過貿易便捷化來簡化貿易程序,降低貿易成本。  近年來,兩岸貿易依存度日益提高,中國大陸更成為台灣最大的出口市場。兩岸各自推動的貿易便捷化皆獲得相當成效,然法規不透明為目前中國大陸對台最嚴重之非關稅障礙,而法規透明化又是貿易便捷化工作的其中一環,因此法規透明化為當前亟需進行之貿易便捷化工作。 由於兩岸皆為世界貿易組織會員,且貿易便捷化已納入WTO的談判架構,而GATT 1994第十條(貿易法令之公布與施行)亦揭示法規透明化乃世界貿易組織協定重要原則,因此本文檢視兩岸的法規公布、措施通知、提供草案評論、回覆諮詢、正當程序和司法救濟等透明化之世界貿易組織義務,作為兩岸法規透明化程度的衡量指標。 透明化雖然是內部即可進行之工作,但由於透明化的重要性不受中國大陸重視,因此其透明化成效有限。為解決此問題,有待建立法規透明化的兩岸合作機制,而該機制之完善將使兩岸業者受惠,雙方政府基於互惠立場,會使兩岸業者獲得更大幅公開的政府資訊,所適用行政程序中的相關權利更受到保障。 / International trade is important to economics, while there are plenty of red tape still existing in moving goods across borders, whether in developing or development countries. Following the decreasing of tariff barriers, trade costs to traders are much more than tariff costs. Therefore, it is necessary to cut down the trade cost by trade facilitation. Recently, cross-strait trade relationship is closer and Mainland China has become the biggest trade partner of Taiwan. The cross-strait development of trade facilitation is significant, but the greatest trade barrier between is non-transparency. Since transparency of trade policy is part of trade facilitation programs, the authorities have to improve the transparency of trade policies. China and Taiwan are the members of the WTO, and WTO Members agreed to launch negotiations on trade facilitation several years ago. Besides, Article X of the GATT 1994 provides that transparency is also the principle of the WTO Agreements. Transparency obligations in WTO include publication of trade policies, notification on measures, providing the opportunity for prior comments, responding to requests for information, due process of administrative procedures and ensuring the right of review and appeal. This article aims at assessing the compliance of China and Taiwan with WTO obligations in transparency. Because the importance of transparency, which can be improved unilaterally, is neglected by China, efforts paid to this transparency issue limited. To solve this problem, it is necessary to establish a cross-strait cooperation mechanism that benefits the traders in both China and Taiwan. Accordingly, the authorities would take reciprocal actions on opening information of the government and ensuring the rights of administrative procedures in a larger extent.

L'émergence d'un principe de justice distributive en droit international économique : analyse de l'évolution du traitement spécial et différencié du GATT à l'OMC

La libéralisation des échanges a fait augmenter les richesses, mais en réalité, elles se sont concentrées dans les pays développés. La question de la distribution plus équitable des richesses s'est rapidement posée. Le système GATT/OMC a joué un rôle décisif dans la libéralisation des échanges et dans l'articulation des rapports entre les pays développés et les pays en développement (PED). L'émergence et l'incarnation juridique dans le système GATT/OMC d'un principe de justice distributive passe par l'évolution du traitement spécial et différencié (TSD). Sous le GATT, le TSD s'est d'abord manifesté par l'article XVIII et la Partie IV du GATT de 1947, la Clause d'habilitation et le Système de préférences de 1971. Le TSD ainsi proposé appartenait essentiellement à la sof law et a échoué dans sa tentative d'intégrer les PED au système SCM. Sous l'OMC, le TSD a changé de paradigme et de mandat. Le TSD est passé d'un outil voué à mettre au développement des PED à un mécanisme employé à aider les PED à mettre en œuvre les nouvelles politiques de libéralisation découlant des accords de l'OMC. Les dispositions TSD seront alors dispersées dans l'ensemble des accords de l'OMC, mais sans jamais transcender la forme «soft law» qui les caractérisait sous le GATT. L'échec de la Conférence de Seattle, en 1999, engendrera le «Programme de Doha pour le développement», en 2001. La Déclaration de Doha était alors perçue comme l'incarnation de la transformation de l'OMC en organisation qui se préoccupe désormais de justice distributive. En observant de près le texte de la Déclaration de Doha et en analysant sa valeur juridique, on ne constate pas de progrès significatifs. Encore une fois, les mesures proposées le sont sous forme de déclarations d'intention et de promesses, voire d'engagement à négocier. Actuellement, le Cycle de Doha tarde à aboutir et tout nous porte à croire que l'avènement de l'OMC n'a pas concrétisé la volonté des PED d'une répartition plus équitable des richesses. / Developed Countries are the main beneficiaries of Economic liberalism and reductions of tariffs. The GATT/WTO System played a key role in the global economic growth and in the re1ationship between Deve10ping Countries and Developed Countries. In the GATT/WOT System, the legal translation of Distributive Justice is represented by Special and Differential Treatment (SDT) in favour of Developing Countries. During the GATT (1947-1994), the most important SDT provisions were Article XVIII and Part IV of the 1947 GATT, the Enabling Clause and the Generalized Preferential System of 1971. Notwithstanding the GATT'S efforts, the STD was not efficient enough to he1p the situation of Developing Countries and was mostly considered as Soft Law. Under the WTO, the STD evolved and his mandate was modified. In fact, the STD became a tool to he1p Deve10ping Countries adopted the new WTO obligations, rather than being a tool for deve1opment. It is true that STD Measures during the Uruguay Round were spread through all of the Uruguay Round's Acts, but they never succeeded in coming out of the Soft Law stage. Following the Seattle Conference held in 1999, the WTO Members adopted the Doha Declaration and named the new Round of negotiation the «Doha Deve10pment Round». Initially, the Doha Declaration was perceived as a transformation of the WTO in a Distributive Organization. Rapidly, after studying the Round's Texts, it became obvious that, although the WTO had shown some openness towards Developing Countries' preoccupations and Distributive Justice, the Doha Declaration was in the direct continuity of the GATT. The SDT dispositions at Doha were still part of Soft Law and were mostly undertakings to negotiate in the future. At the present time, the Doha Program for Development is indefinite1y suspended. So far, the Doha Round did not meet the Deve10ping Countries' Expectations.

Juridicização das relações internacionais e solução de controvérsias: análise do sistema multilateral de comércio / Juridicization of international relations and dispute settlement : analysis of the multilateral trade system

Este trabalho teve por objetivo analisar o processo de juridicização do sistema multilateral de comércio, por meio da aplicação do modelo teórico de K. W. Abbott et aI (2000) e contraposição dos resultados obtidos à análise do recurso a elementos normativos para justificação das decisões emanadas do sistema em procedimentos de solução de controvérsias em que foi suscitado o artigo XX(g) do GATT para defesa da medida questionada. Observou-se que, apesar do nível de juridicidade tenha permanecido praticamente o mesmo da passagem do GATT-1947 para a OMC, o recurso a elementos normativos para motivação das decisões foi incrementado. A hipótese demonstrada pelos resultados desta pesquisa é que o enfoque restrito no processo de institucionalização por meio de tratados não permite que sejam refletidas, no processo de juridicização, as alterações ocasionadas por outros elementos, como foi o caso, na presente pesquisa, das regras relativas à conformação dos órgãos auxiliares, à interpretação e à tomada de decisão - sejam elas originadas em tratados, costumes ou princípios. / This research aims at analyzing the legalization of the multilateral trade system, applying the theory developed by K. W. ABBOTT et al (2000) and confronting the results with the leveI of recourse to normative elements to justify the decisions issued on disputes where Article XX(g) of GA TT was used in defense of the challenged measure. Notwithstanding the fact that the legalization of the system did not alter from the GATT-1947 to WTO, more normative elements are used for motivation of the decisions taken by WTO. The research shows that excessive focus on the process institutionalization by treaties does not reflected the changes brought about by other elements, such as the configuration of the auxiliary organs - panels and Appellate Body - and the rules related to interpretation and decision making - be them customary international law or principIes.

Toma-se a dicotomia Norte-Sul como ponto de partida. Tendo em vista que o estudo se concentra na história, percebe-se que, aos menos nas primeiras cinco décadas de operação do GATT, outras conformações antagônicas detêm maior influência sobre o regime do comércio internacional de produtos agrícolas. O embate entre Estados Unidos e Comunidade Européia na década de oitenta é fundamental para entender a sistemática do Acordo Agrícola em vigência. Com o aumento do interesse de países em desenvolvimento, o cenário muda nas negociações da Rodada Doha. O uso mais freqüente de elementos como tratamento preferencial, não reciprocidade e discriminação positiva em benefício de países de baixa renda torna o diálogo Norte-Sul mais relevante ao se analisar o regime do comércio internacional de produtos agrícolas. No entanto, reconhece-se que a tensão entre economias centrais continua exercendo um papel fundamental nesse tocante.

Das "alte" Allgemeine Zoll- und Handelsabkommen (GATT) von 1947 hatte Fragen des Umweltschutzes noch keine Beachtung geschenkt. Seit den 70er Jahren geriet aber auch Ökologie als potentielles Handelshemmnis ins Blickfeld des Welthandelsrechts. Angesichts der Errichtung der WTO beleuchtet der Beitrag nach einer Skizze der Entwicklungen an der Schnittstelle von Umwelt und Wirtschaft die Möglichkeiten und Grenzen einer stärker umweltorientierten Auslegung von Art. XX GATT.

Toma-se a dicotomia Norte-Sul como ponto de partida. Tendo em vista que o estudo se concentra na história, percebe-se que, aos menos nas primeiras cinco décadas de operação do GATT, outras conformações antagônicas detêm maior influência sobre o regime do comércio internacional de produtos agrícolas. O embate entre Estados Unidos e Comunidade Européia na década de oitenta é fundamental para entender a sistemática do Acordo Agrícola em vigência. Com o aumento do interesse de países em desenvolvimento, o cenário muda nas negociações da Rodada Doha. O uso mais freqüente de elementos como tratamento preferencial, não reciprocidade e discriminação positiva em benefício de países de baixa renda torna o diálogo Norte-Sul mais relevante ao se analisar o regime do comércio internacional de produtos agrícolas. No entanto, reconhece-se que a tensão entre economias centrais continua exercendo um papel fundamental nesse tocante.
