La région de Porto-Novo, territoire culturel hérité au sud du Bénin, en Afrique de l'Ouest, fait partie d'une conurbation en pleine croissance (entre Cotonou et Porto-Novo) présentant un contexte d'urbanisation rapide, d'étalement urbain et de mutations fonctionnelles des espaces. Porto-Novo – capitale politique du Bénin distancée démographiquement et économiquement par sa voisine Cotonou – ainsi que sa région, connaissent parallèlement depuis quelques années, à l'image d'autres territoires africains, une dynamique de patrimonialisation et de revendications identitaires, tandis qu'un mouvement de revalorisation des traditions et dans le même temps d'appui à une gouvernance locale ont été encouragés par les instances internationales et les bailleurs de fonds. La question de la patrimonialisation, à travers son appropriation par les acteurs de la gestion et du développement des territoires, propose surtout un éclairage sur les dynamiques sociales et culturelles à l’œuvre et les enjeux territoriaux de la région porto-novienne. Alors que la décentralisation se met progressivement en place, la ville et sa région sont en outre aujourd’hui au centre de rivalités politiques et identitaires où le patrimoine semble tenir une place stratégique dans le jeu des acteurs. / The Porto Novo region, an inherited cultural territory in the south of Benin, in West Africa, is part of a growing conurbation (between Cotonou and Porto Novo) with rapid urbanization, urban sprawl and functional mutations in the use of space.Porto Novo - the political capital of Benin, outdistanced demographically and economically by its neighbor Cotonou - and the Porto Novo region, like other African territories have, in recent years, both undergone a dynamic of "patrimonialisation" (granting of heritage status) and claiming of identity, while a movement to give new value to its traditions and support local governance has been encouraged by international authorities and sponsors.The question of "patrimonialisation", through its appropriation by the actors involved in the management and development of the territories, first and foremost suggests that light should be thrown on the current social and cultural dynamics at work and what is at stake territorially speaking in the Porto Novo region. While decentralization is increasingly evident, the town and its region are also currently at the centre of rivalries over politics and identity in which the patrimony seems to play a strategic part in the game of the territorial actors.

The thesis deals with procedure of asylum and additional protection granting in the Czech Republic. The thesis focuses on characteristic features of the process; primarily the proceeding the application of protection and asylum granting by official authorities. To a certain extent, the thesis copes with substantive law; it defines terms of refugee and asylum law. It enumerates and characterizes the mentioned terms in connection with the process of the asylum and protection granting in the Czech Republic. Impact of the European Union law on the Czech internal law is also discussed.

Notre planète recèle dans sous-sol des gisements d’hydrocarbure, à l’origine depuis près d’un siècle, de la puissance de l’homme moderne. La présente étude porte sur les modalités juridiques d’extraction et d’appropriation de ces énergies fossiles. A l’état naturel, ces ressources n’ont pas d’existence juridique propre et leurs régimes suivent celui des territoires dans lesquels elles gisent. Aussi, pour que l’extraction des gisements puise avoir lieu, il convient d’abord d’identifier les titulaires des droits sur les territoires pétrolifères et prendre en compte non seulement la diversité de ces territoires mais également la diversité des acteurs et intérêts en présence. Les détenteurs primaires des droits d’accès aux ressources identifiés, pourront alors se déployer des contrats de prospection et d’exploitation des gisements, adaptées à l’ensemble des spécificités du secteur et des particularismes locaux, aux fins notamment d’une optimalisation de l’accès aux ressources fossiles / Our planet contains underground fossil deposits powering the Modern man, since nearly a century. The present study deals with the legal issue regarding the extraction and appropriation of fossil fuels. In their natural state, these resources have no legal existence and their regimes follow the one of the territories in which they lie. Therefore, in order to extract the deposits, it is first necessary to identify the rights owners of the oil regions and to take into account not only the diversity of these territories but also the diversity of the actors and interests at stake. Once the primary access rights owners identified, deposits may be discovered and developed, through specific mining contracts, adapted to all the specific features of the sector and local particularities for the optimization of the access to fossil fuels

A metodologia utilizada foi a revisão bibliográfica, por meio do levantamento de todos os diplomas legislativos em vigor, tanto na esfera federal, como na esfera estadual, que se refiram à gestão de recursos hídricos, assim como a consulta a doutrinas jurídicas e artigos publicados em periódicos da Capes; utilizando como período delimitador os anos de 2013 a 2016. Priorizou-se a consulta aos artigos revisados por pares. Também se verificou a existência de processos administrativos e judiciais na área da pesquisa. E, finalmente, foi realizada coleta de informações “in loco” com agentes públicos acerca dos procedimentos para concessão de outorgas e possível ocorrência de conflitos entre cidadãos. A proposta de análise dos conflitos pela água teve como motivação o quadro crítico que assola o semiárido brasileiro, com grandes períodos de ausência de chuvas e, ainda assim, os usuários (em sentido amplo) continuam desperdiçando o uso da água, sem a consciência de que se trata de um recurso limitado. Como elemento de gestão e recurso limitado, a água traz muitas discussões jurídicas, inclusive, quanto à viabilidade do seu acesso, principalmente, em propriedades privadas, assim como a discussão acerca da efetividade de aplicabilidade dos instrumentos de gestão desse recurso natural. Como resultado, observou-se a necessidade da uma melhor integração do cidadão-usuário da água no sistema de gerenciamento para que conheça as suas fases e procedimentos, a definição dos órgãos públicos e suas funções, para que se possa colaborar mais ativamente com a eficiência da política nacional de recursos hídricos. / This study deals with the analysis of conflicts over the use of water in the Paraiba region of the Piranhas-Açu River basin and its solution form, from the point of view of the management tools and mechanisms for conflict resolution presented in the legal literature. The methodology used was the bibliographical revision, by means of the survey of all the legislative diplomas in force, as much in the federal sphere, as in the state sphere, that they refer to the management of water resources, as well as the consultation to legal doctrines and articles published in periodicals Of Capes, using as a delimiting period the years of 2013 to 2016. Prioritized the consultation of articles peer reviewed. It was also verified the existence of administrative and judicial processes in the research area. A study of trends of consumer credit with a focus on the increase in unsecured lending in South Africa

The objective of this research is to investigate the existence of structural changes in unsecured lending time series data and analyse the impact thereof on trends in consumer demand for unsecured credit spanning the years from 2008 to 2015. This is achieved by identifying dates when structural changes occurred over this period. The identified structural break date is linked to an influential economic event or monetary policy change that took place in South Africa of which the impact on three unsecured credit categories are analysed. Unsecured credit growth in South Africa has been subjected to intensive scrutiny since the inception of the National Credit Act (Act No. 34 of 2005) by various regulatory bodies. In 2012 the National Credit Regulator (NCR) commissioned a research study into examining the impact that the National Credit Act (Act No. 34 of 2005) has had on the consumer credit market. The empirical part of this study involved the gathering of time series data on unsecured loans approved, unsecured credit granted per income category and unsecured credit granted from the National Credit Regulator (NCR) database and performing descriptive and econometric analysis. The Zivot-Andrews (1992) and augmented Dickey-Fuller tests determined the break dates which were linked to a significant economic event while the one sample t-test of means compared average loan values before and after the break date. Results of the study indicate that the break dates determined coincided with economic events and monetary policy changes in South Africa, such as the collapse of African Bank, the implementation of the National Credit Amendment Act, prime interest rate movements and the introduction of a debt counselling program by the government. These events, coupled with stricter lending criteria and no further loans being granted to customers already more than three months in arrears, restrained the uptake of unsecured loans to lower and middle income groups. The introduction of new affordability criteria and increasing interest rates in 2014 further negatively impacted demand for unsecured loans. However, higher income earners had the advantage of being able to apply for higher loan amounts. Findings could be used by monetary policymakers and financial institutions to constantly monitor credit trends, improve credit assessment techniques and review lending criteria. / Business Management / M. Além da aferição do tempo médio de cada uma das etapas previstas na Lei de Recuperação de Empresas (deferimento do processamento da recuperação judicial, concessão da recuperação judicial e encerramento do processo após cumprimento de todas as obrigações previstas no plano que se vencerem até dois anos depois da concessão da recuperação judicial), busco também verificar se, de fato, alguma sociedade requerente conseguiu se recuperar. Para tanto, considerarei recuperada a sociedade que, após o encerramento do processo, estiver cumprindo plenamente o seu plano de recuperação, sem que tenha havido qualquer requerimento posterior de falência. Considerando que a Lei de Recuperação de Empresas já está no seu sétimo ano de vigência, bem como o fato de o legislador ter idealizado o processo para que dure no máximo 3 anos, entendo não haver óbices à adoção do conceito supra, tendo em vista que já haver tempo suficiente para o início e encerramento desse tipo de processo. Diante disso, o presente estudo observou que o tempo médio para cumprimento das etapas ultrapassa o limite do razoável, bem como que nenhuma sociedade conseguiu se recuperar até o desfecho da pesquisa, havendo casos, inclusive, de convolação da recuperação judicial em falência. / This study focus on analyzing the judicial recovery proceedings from its beginning, since The New Business Restructuring and Bankruptcy Law's effectiveness (February of 2005) until June 31st, 2011, when its use started on the enterprise matters court of the State of Rio de Janeiro. The analyzes will be done through all phases predicted on the New Business Restructuring and Bankruptcy Law, such as the acceptance of the process of Judicial Recovery, the granting of the judicial recovery and the closure of the process after fulfillment of all obligations predicted on the recovery plan in the period limit of 2 years after the granting of the judicial recovery plan. This analyzes also confirm if any Company had in fact been able to recover after this process. For this purpose, it shall be considered recovery a Company that has fulfill it plans after the Regarding the 7th anniversary of The New Business Restructuring and Bankruptcy Law closure of the process without a claim of bankruptcy in this period., as well as the Brazilian Legislator planned processing to last no more than three years, from my point of view there are no reasons which can obstruct the referred concept adoption as there is time enough to initiate and conclude the processing. Therefore, this study had observed that average time to conclude all processing stages exceed the reasonable time and there was no company able to recover itself until the closure of this study, having indeed cases of conversion of the Judicial Recovery into bankruptcy.
