L'objectif de ce travail est de réunir deux concepts dont il n’est pas courant de le faire communiquer : l’émancipation qui remonte aux débuts de la réflexion philosophique et dont il est le cœur actif ; et la communication qui renvoie à notre présent historique et dont il est l’emblème le plus répondu.Le projet philosophique de Habermas peut être lu en tant qu’actualisation du projet de la Théorie critique et en tant que lieu de repenser le concept de l’émancipation dans les sociétés complexes du capitalisme avancé à travers la communication. C’est dans le cadre du tournant pragmatique que Habermas reconstruit le paradigme communicationnel, ce qui permet d’articuler le tournant linguistique avec la théorie de l’action dans le cadre d’une théorie de la société. La présente recherche enquête sur l’argument philosophique de Habermas qui peut justifier la thèse que face à une colonisation de plus en plus violente du monde vécu par les impératifs systémique, il nous est encore possible d’organiser une émancipation réelle, collectif et effective. Assumant les contraintes multiformes de ce travail théorique faillible Habermas défend l'idée selon laquelle une politique délibérative fondée sur le principe de discussion (l’implication politique de la pragmatique universelle) peut être la condition de cette émancipation. La délibération active le rôle de la communication intacte et exempte de violence pour retrouver un accord rationnellement fondé, mais faillible. Tournée vers la vie concrète des hommes de la société actuelle, la délibération ira jusqu’à légitimer et même légaliser la désobéissance civile. / The objective of this work is to bring together two concepts which it is not common to do communicate: the emancipation that goes back to the beginnings of philosophical reflection and of which he is the active heart; and communication that refers to our historical present and of which he is the symbol most replied. Habermas's philosophical project can be read as the actualization of the project of Critical Theory and as a place to rethink the concept of emancipation in complex societies of advanced capitalism through communication. It is in the pragmatic turn that Habermas reconstructs the communication paradigm, allowing articulating the linguistic turn to the theory of action in the framework of a theory of society. This research investigates the philosophical argument of Habermas which may justify the thesis that the colonization increasingly violent of life-world by the systemic imperatives, we can still organize a real emancipation, collective and effective. Assuming the multifaceted constraints of this theoretical work Habermas argues that deliberative policy based on the principle of discussion (political involvement of universal pragmatics) may be the condition of this emancipation. The deliberation active the role of communication (free of violence) in order to find a rationally founded agreement. Facing the concrete life of men of modern society, deliberation will even legitimize and legalize the civil disobedience.

Work and Family Identities in Regulatory Rulemaking: A Rhetorical Analysis of the Family and Medical Leave Act Regulatory Rulemaking ProcessJanuary 2012 (has links)
abstract: This dissertation explores the discursive construction of work and family identities in the Family and Medical Leave Act (FMLA) regulatory rulemaking process. It uses dramatism and public sphere theory along with the critical legal rhetoric perspective to analyze official FMLA legal texts as well as over 4,600 public comments submitted in response to the United States Department of Labor's 2008 notice of proposed rulemaking that ultimately amended the existing FMLA administrative regulations. The analysis in this dissertation concludes that when official and vernacular discourses intersect in a rulemaking process facilitated by the state, the facilitated public that emerges in that discourse is bounded by official discourses and appropriated language. But individuals in the process are able to convey and contest a range of work and family identities that include characteristics of public, private, abuse, accountability, sacrifice, and struggle. It further demonstrates that different circumferences for crafting work and family identities exist in the regulatory rulemaking process, including national, international, and time-bounded circumferences. Because the law is a discourse that has far-reaching rhetorical implications and the intersect between vernacular discourses and legal discourses is an underexplored area in both communication and legal studies, this dissertation offers a contribution to the ongoing work of scholars thinking about work and family identities, the material consequences of the intersect of work and family, and the rhetorical implications of legal discourse. / Dissertation/Thesis / Ph.D. Communication 2012

Las teorías de la comunicación ofrecen un horizonte prometedor en el debate contemporáneo sobre la posibilidad de fundamentación del conocimiento y un pluralismo metodológico que no se reduzca a la fragmentación. En su reinterpretación de la teoría y práctica psicoanalíticas, Jürgen Habermas recupera el potencial emancipador del conocimiento comprendido como construcción comunicativa, el cual se realiza en la terapia como la restitución de las capacidades comunicativas del paciente. Desde una perspectiva fenomenológica, argumentamos que las aclaraciones teoréticas y las orientaciones prácticas de la crítica habermasiana permiten ampliar la autocomprensión y las posibilidades de aplicación de la actividad terapéutica a escenarios más amplios de intervención comunicacional. Se explicita así la responsabilidad que hace posible la praxis de toda investigación teórica y la necesidad de profundizar en la dimensión estética de las interacciones comunicativas en las que se constituye la realidad como experiencia del mundo, de los otros y de la persona.

Desde sua origem na sociedade burguesa, o ideal de espaço discursivo e deliberativo, em que todos podem participar, fazendo uso de uma razão esclarecida, exercendo influência sobre o sistema político, é fundamental para a democracia. Mas há grupos excluídos, e a mídia de massa, que exerce influência sobre a opinião pública, com freqüência atende a interesses privados, provenientes de grupos, partidos políticos, e pessoas com poder econômico e de influência. Na sociedade contemporânea, essas questões críticas permanecem e a democracia precisa de seus fundamentos básicos. Em vista disso, Habermas pretende reabilitar o conceito de esfera pública, na complexa sociedade. Ele nunca abandona a questão do caráter normativo da comunicação pública esclarecida em relação à integração social e ao controle das ações políticas. As teorias da ação comunicativa e da ética do discurso, em Habermas, valorizam a racionalidade comunicativa, inerente à esfera pública. Essa racionalidade tem potencial normativo para a auto-regulação dos sujeitos e também para a manutenção da ordem social, porque as leis são fundamentadas através do discurso argumentativo. Habermas teoriza sobre a relação entre a normatividade da comunicação intersubjetiva e o sistema de direitos, do Estado democrático, que exerce controle sobre a sociedade civil e o Estado. A política democrática deliberativa surge dessa relação, e configura, na sociedade contemporânea, o ideal de esfera pública. / Salvador
