Harmonizace soukromého a pracovního života / The harmonization of private and professional life

This master thesis deals with the harmonization of private and professional life. The aim of this thesis is to find effective ways of harmonizing family and work focusing on the female population of working age, especially on women with young children in the preschool age, their position on the labour market and the possibility of reintegration into the workforce with minimal impact on the family and children. The thesis is also interested in the issue of corporate kindergartens and their role in the issue of women's employment. Theory includes the topic of gender, women on labour market, a combination and conflict of work and family and ways of balance work and family. The practical part is divided into two case studies. The first deals with the company kindergarten as one of the possible solutions, from the point of view of management and employees. The second part deals with some concrete examples of solution how women harmonize private life and work.

A harmonia entre consumidores e fornecedores à luz do art. 4º, inciso III, do Código de Defesa do Consumidor

The motto of the above mentioned legal provision is to ensure the development of the country, as provided by the Brazilian Constitution of 1988, which is socially oriented and addresses the effectiveness of individual and collective rights. Therefore, this study aims at enabling students and law enforcers to understand the origin of this legal provision, contextualizing it in the growth and consolidation of the Consumer Society and the State arrangement in effect. Thus, the first chapter provides the reader with a historical overview of the origination of the Consumer Society focusing on factors that led to imbalance in the suppliers‟ market performance, the milestones that led to the birth of a consumer law in the world and in Brazil, besides allocating this right alongside constitutional guarantees of human dignity, as set forth in modern constitutions. The next chapter explores the transition from the Liberal State to the Welfare State, focusing on the existence of the State interventionism (i) firstly, to validate the liberal model itself, which resulted in the stimulation of the imbalance between suppliers and consumers, and (ii) further, for the consolidation of social rights, which not only guaranteed consumer rights but also originated a duty of the State to foster it. Hence, the constitutional principles involved in such protection become demonstrated. Finally, in the third chapter, the paper seeks to precisely demonstrate that Article 4, item III of CDC acts as a balancing rule that must be applied to ensure consumer law in society, so that it is imperative (i) to achieve the stability of CDC concepts, (ii) an actual State action aimed at the implementation of the PNDC, (iii) as well as an effective change of attitude by suppliers so that their performance aligns with the ethical primacy that supports the existence of the society itself / O artigo 4º, III, do CDC se apresenta como regra de harmonização entre os interesses de fornecedores e consumidores em uma sociedade de consumo que clama, atualmente, pelo reequilíbrio na atuação desses dois agentes de extrema relevância para a ordem econômica nacional. O mote da previsão legal em referência é assegurar o desenvolvimento do país atendendo-se ao espírito da CF88, de cunho social e efetivador de direitos individuais e coletivos. O objetivo central desse trabalho, portanto, é permitir que estudantes e aplicadores do direito possam compreender a origem do dispositivo legal, contextualiza-lo em relação à formação e consolidação da sociedade de consumo e do modelo de Estado atualmente vigente. Assim, no primeiro capítulo o trabalho oferece ao leitor uma descrição histórica do surgimento da sociedade de consumo com foco nos fatores que geraram desequilíbrio na atuação de fornecedores junto ao mercado, os momentos históricos que desencadearam o nascimento de um direito dos consumidores no mundo e no Brasil, além de situar esse direito com a garantia constitucional à proteção da dignidade da pessoa humana existente nas constituições modernas. O capítulo seguinte explora a transição do Estado Liberal para o Estado Social, com enfoque no intervencionismo estatal existente, (i) inicialmente, para validar o próprio modelo liberal, o que resultou em estímulo para o desequilíbrio entre fornecedores e consumidores, e, (ii) na sequência, para efetivação aos direitos sociais, o que permitiu não somente o garantismo ao direito dos consumidores como o dever do próprio Estado em efetivá-lo. Demonstra-se, então, quais os princípios constitucionais que envolvem tal proteção. Finalmente, no terceiro capítulo, busca-se demonstrar justamente que o art. 4º, III, do CDC atua como regra de equilíbrio que deve ser aplicada para efetivação do direito do consumidor na sociedade, sendo imprescindível (i) a estabilidade de conceitos existentes no CDC, (ii) uma real atuação estatal visando a implementação da PNDC, (iii) bem como uma efetiva mudança de postura por parte dos fornecedores para que sua atuação atenda ao primado ético que funda a própria existência da sociedade

Quand le geste technique transforme l'intention : l'évolution de l'accordéon diatonique en Bretagne / When the technical gesture transforms the intention : the evolution of diatonic accordion in Brittany

Ce travail vise à comprendre pourquoi et comment l'accordéon diatonique breton a connu une profonde transformation organologique et stylistique au cours des dernières décennies. L'évolution de l'instrument est ici le témoin des dynamiques historiques et sociales, que l'accordéon présente la particularité d'avoir intégrées dans sa forme-même du fait de sa rare plasticité, et qu'il permet d'éclairer. Statut des musiciens professionnels au sein d'une pratique restée massivement amateur, rôles et mécanismes de l'apprentissage d'un savoir traditionnel initialement basé sur l'oralité, fluctuation des attentes sociales à travers les générations successives, sont quelques-uns des aspects qui se dévoilent au fil de l'étude et qui se relient.À partir du constat d'une mutation organologique progressive, nous chercherons à comprendre les modifications profondes des fonctions sociales jouées par l'instrument. Un retour historique permettra de définir les intentions et le statut des « pionniers » du renouveau de l'accordéon diatonique breton dans les années 1970. En nous appuyant sur ce socle, nous montrerons comment l'accordéon en tant qu'outil est en interaction étroite et permanente avec le geste du musicien et avec son intention (produire des notes – et dans quelle fonction sociale), et combien le passage des générations a renouvelé le contexte d'exposition de l'accordéon et le statut des musiques bretonnes dites « à danser ». Ainsi, nous verrons que la modification progressive de l'intention a conduit à une modification de l'instrument, mais que celle-ci, en retour, fragilise l'efficacité des intentions antérieures. / This work aims to understand why and how the Breton diatonic accordion has undergone a profound organological and stylistic transformation during the last decades. The evolution of the instrument here reflects the historical and social dynamics, that the accordion has integrated into its very form because of its rare plasticity, bringing them into light. The status of professional musicians in a largely amateur context, the roles and mechanisms of learning traditional knowledge initially based on orality, the fluctuation of social expectations through successive generations, are some of the aspects that unfold over the course of the study and connect with one-another.Starting from the observation of a progressive organologic change, we will seek to understand the profound changes of the social functions played by the instrument. A historical overview will allow to define the intentions and the status of the "pioneers" of the revival of the Breton diatonic accordion in the 1970s. Based on this foundation, we will show how the accordion as a tool is in close and permanent interaction with the musician's gesture and with his intention (producing notes – and in what social function), and how much the passage of generations has renewed the context of use of the accordion and the status of Breton music said "to be danced". Thus, we will see that the progressive modification of the intention led to a modification of the instrument, but that this, in turn, weakens the effectiveness of the previous intentions.
