Essai sur l'adoption du droit du service public français en droit administratif coréenJeon, Joo Yeol 23 February 2013 (has links)
Le droit administratif coréen se trouve caractérisé depuis peu par une tentative d'adoption du droit du service public. Cette tentative signifie un mouvement pour faire évoluer le droit administratif par le dépasse-ment de ses fondements classiques en provenance du droit allemand, notamment des doctrines fondamentales élaborées à la fin du 19ème siècle. La tentative se manifeste par l'introduction de règles générales pour les activités du service public. Cependant, la mise en œuvre de ces règles novatrices pour le droit coréen ne sera cohérente que lorsque certaines conditions seront satisfaites, notamment des conditions procédurales telle que l'élargissement de la recevabilité du contentieux administratif. Nous avons relevé des éléments dont on doit tenir compte pour le changement du droit administratif coréen par l'adoption du droit du service public français afin que l'adoption soit opérationnelle. Cette démarche est fondée sur l'analyse de l'état actuel du droit coréen concernant l'idée de service public et les juridictions publiques / Korean administrative law is characterized recently by an attempt to adopt the law of public service. This means a movement attempting to change the administrative law by exceeding its classical foundations from German law, including fundamental doctrines developed in the late 19th century. The attempt is mani-fested by the introduction of general rules for public service activities. However, the implementation of these innovative rules for Korean law will be consistent only when certain conditions are met, including procedu-ral requirements such as enlargement of the admissibility of administrative litigation. We identified elements that must be considered for change of Korean administrative law by adoption of the French law of public ser-vice se that it could be operational. This approach is based on the analysis of the current state of Korean law regarding the idea of public service and public jurisdictions

Framtagning av spännviddstabell för ribbdäcksbjälklagSamsvik, Jonas, Norén, Adam January 2019 (has links)
Examensarbetets syfte är att finna en beräkningsgång för ribbdäcksbjälklag så att en spännviddstabell kan skapas. Ett ribbdäcksbjälklag består av stående limträbalkar med en liggande KL-träskiva ovan som fungerar som golv. I detta examenarbete är KL-träskivan 2,4 meter bred och vilar på två limträbalkar. Full samverkan mellan de olika materialen råder. Idag finns det några aktörer på marknaden som levererar liknande typer av bjälklag men det finns ingen beräkningsgång preciserad i Eurokod. Förstudien till examensarbetet har visat på att tillvägagångssättet för att lösa den mest problematiska beräkningen har varit densamma för de företagen vi har kollat på. Svårigheten är att beräkna den effektiva bredden för tvärsnittet. Det finns även olika standarder som gäller för hur stor nedböjningen får vara för ett bjälklag. I examensarbetet utförs beräkningar för att uppfylla de krav som gäller i Sverige samt de krav som gäller i Österrike. Detta görs för att dalamissivträ misstänker att kraven på de österrikiska bjälklagen är högre ställda med avseende på svikt, de vill kunna erbjuda ett styvare bjälklag. I tabellen ska dimensioner anges för att respektive krav ska uppfyllas. De österrikiska kraven har visat sig vara hårdare ställda jämfört med de svenska och kommer därför att kräva en balk av större dimension i de lägre lastfallen. I fallen med större laster kommer balkdimensionerna mellan de olika lastfallen inte att skilja sig. Där har det visast sig att branddimensioneringen varit helt dimensionerande. Tabellen ska vara ett hjälpmedel för företaget Dala massivträ att lättare nå ut till beställare. Beräkningsgången har gjorts i Mathcad, där okända parametrar har lösts ut och beräknats fram. Vissa parametrar har varit fasta utifrån Dala massivträs önskemål, så som KL-träskivans tjocklek och ingående komponenters materialegenskaper. När beräkningarna har gjorts har de kontrollerats så att momentkapacitet och tvärkraftskapacitet är tillräcklig i respektive last fall och spännvidd. Nedböjningen har kontrollerats liksom branddimensioneringen. Har bjälklaget inte uppfyllt hållfastighetsdimensionering eller kraven för svenskstandard alternativt österrikiskstandard har en högre dimension valts på limträbalken. Limträbalk har valts utifrån Setra trävarors standardsortiment. Resultatet av beräkningarna har förts in i en spännviddstabell som byggts upp för att enkelt kunna välja balk utifrån tänkt last fall. Beräknings exempel finns redovisat i en bilaga där ett lastfall och en spännvidd redovisas. Resultatet leder till att varje spännvidd och lastfall får två dimensioner, en för att klara svensk standard och en för att klara österrikiskstandard. I diskussionen diskuteras eventuella felkällor, effekten av tätare placering med limträbalkar och orsaken till en differens i jämförelsen mellan Mathcad och Calculatis. Även resultatet i spännviddstabellen diskuteras. / The purpose of the degree project is to find a calculation path for ribbed deck joists so that a span width table can be created. A ribbed deck joists consists of standing glulam beams with a lying cross laminated timber slab above which functions as a floor. In this thesis, the cross laminated timber board is 2.4 meters wide and rests on two glulam beams. Full cooperation between the different materials prevails. Today, there are some players in the market that deliver these types of floor but there is no calculation rate specified in Eurocode. The preliminary study for the degree project has shown that the approach to solving the most problematic calculation has been the same for the companies we have looked at. The difficulty is to calculate the effective width of the cross section. There are also different standards that apply to how large the deflection may be for a beam. In the thesis work, calculations are performed to meet the requirements that apply in Sweden and the requirements that apply in Austria. Dimensions must be specified in the table for fulfilling the respective requirements. The Austrian requirements have proved to be harder compared to the Swedish ones and will therefore require a beam of greater dimension in the lower load cases. In case with the larger loads, the beam dimensions between the different loads will not differ because it has been shown that the fire has been dimensional. The table should be a tool for the company Dala massivträ to reach the customer more easily. The calculation path has been made in Mathcad, where unknown parameters has been solved and calculated. Some parameters have been fixed based on Dala massivträ´s wishes, such as the thickness of the cross laminated timber board and the material properties of the component parts. Once the calculations have been made, they have been checked so that torque capacity and transverse power capacity are sufficient in the respective load cases and span. The deflection has been checked as well as the fire dimensioning. The flooring has not fulfilled the dimensioning or the requirements for Swedish standard alt. Austrian standard has a higher dimension selected on the glulam beam. Glulam beam has been selected based on Setra's wood products standard range. The result of the calculations has been entered into a span table which has been built up in order to be able to easily select the beam from outside the intended load case. The calculation example is presented in an annex where a load case and a span are reported. The result is that each span and load fall get two dimensions, one to meet the Swedish standard and one to cope with the Austrian standard. In the discussion, is discussed possible sources of error, the effect of denser placement with glulam beams and the cause of a difference in the comparison between Mathcad and Calculatis. The result in the span table is also discussed.

Methodological investigations into design inspiration and fixation experimentsLeite de Vasconcelos, Luis Arthur January 2017 (has links)
Designers often look for inspiration in their environment when exploring possible solutions to a given problem. However, many studies have reported that external stimuli may constrain designers’ imagination and limit their exploration to similar solutions, a phenomenon described as design fixation. Inspiration and fixation effects are traditionally studied with a similar experimental paradigm, which has produced a complex web of findings and explanations. Yet, when analysing the experiments and their findings closely, it becomes clear that there is considerable variation in how studies are conducted and the results they produce. Such variation makes it difficult to formulate a general view of how external stimuli affect the design process, and to translate the research findings into education and practice. Moreover, it raises questions about the reliability and effectiveness of the traditional experimental method. This thesis reports on a collection of studies that examine how design inspiration and fixation research is done and how it can be improved. It explores the research area by reviewing the literature and analysing data from a workshop; describes the research method by scrutinising experiments and their procedures; and explains the variation in research findings by testing experimental procedures empirically and suggesting new interpretations. My main findings are that: abstract stimuli can inspire or fixate designers to different degrees depending on how explicitly the stimuli are represented; external stimuli can inhibit the exploration of ideas that would otherwise be explored; the effect of experimental instructions varies depending on how encouraging the instructions are; and the way participants represent and elaborate ideas can moderate fixation results. Whilst this thesis offers insights into design practice and education, its main contribution is to design research, where it represents a fundamental material for those who are new to inspiration and fixation research, and for those who are already expert.

Depuis le projet d’origine, l’Union européenne a étendu ses frontières, intégré de nouveaux territoires, de nouvelles traditions politiques et pris une nouvelle forme géographique. Ses frontières « non définies » se sont déplacées, le territoire cédant la place à un espace ouvert. Mais cette évolution n’a pas modifié la nature des interrogations sur son identité, sur l’existence d’une société européenne, sur l’identification des « peuples » européens à leur nouvelle communauté politique et sur l’émergence d’un espace public européen.La problématique de l'identité européenne est que malgré tous les moyens déployés par les institutions supranationales (processus d’harmonisation, d’homogénéisation et de convergence), celle-ci demeure un concept abstrait dont l’expression et l’enracinement dans le tissu social sont encore superficiels. L’Union européenne est une communauté de citoyens, les droits sont codifiés par les traités successifs, mais elle reste une communauté dont l’identité est encore incertaine.Bien que l’identité européenne concerne toute une série de questions qui doivent être saisies concurremment - élargissement, questions des frontières, hybridité politico- institutionnelle, nous l'analyserons notamment à travers le prisme de la citoyenneté européenne et de la Charte des droits fondamentaux de l'Union européenne. La question suivante sera ainsi posée : la citoyenneté européenne et la Charte européenne contribuent-elles à faire émerger, voire à consolider, une identité européenne? / Since the original project, the European Union has extended its borders, integrated new territories, new political traditions and has taken a new geographic form. Its borders "undefined" moved, the area giving way to an open space. But this evolution did not alter the nature of questions relating to its identity, the existence of a European society, the identification of "peoples" to their new European political Community and the emergence of a european public space.The issue of the European identity is that despite all measures deployed by supranational institutions (harmonization process, homogenization and convergence), it remains an abstract concept whose expression and rooting in the social sphere are still superficial. The European Union is indeed a community of citizens, the rights are codified by successive treaties, but it remains a community whose identity is still uncertain.Although the European identity concerns a range of questions that must be considered concurrently - enlargement, border issues, political-institutional hybridity, we will analyze it mainly through the prism of European citizenship and the Charter of Fundamental Rights. The following question will therefore be asked : European citizenship and the Charter of Fundamental Rights will they contribute to emerge or even consolidate a European identity?

Writing the speculative fiction novel, Birthright, and this accompanying exegesis, led me to challenge the validity of the disclaimer usually found in the front matter of most novels that the story is purely imaginary, bears no relationship to reality, with the characters not being inspired by anyone known or unknown to the author. For the first time in my career, I began to consider how writers including myself might frequently revisit themes and ideas which resonate with our lived experiences. I call this restorying, an unconscious process whereby aspects of one's life history are rewritten through one's creative work to achieve a more satisfactory result. Through personal contact, studying authors' accounts of their creative practices, and surveying current literature on narrative therapy, a case is made that, far from being generated purely from imagination, writers' creative choices are driven by an unconscious need to restory ourselves.

This thesis examines the transmission of the idea of crusade to Poland and the subsequent Polish response to the idea of crusade in the twelfth century. It determines the key mechanisms by which the idea of crusade was transmitted to Poland and through an analysis of primary contemporary sources the thesis provides compelling evidence that the Polish elites were highly familiar with, and receptive to, the idea of crusade. Moreover, this thesis argues that the Poles were conscious participants in the crusades and undertook various crusading activities during the twelfth century. These findings are contrary to the established position in Polish historiography, and bring many sources to an English-speaking audience for the first time. / Through an examination of narrative sources this thesis demonstrates that the Polish elites were enthusiastic supporters of the idea of crusade within a decade of the First Crusade. This thesis shows that under the leadership of the Piast dynasty the Poles engaged in Christian holy war (proto-crusading): the conquest of Pomerania (1102–1128), contributed armies to three theatres of the Second Crusade (1147–1148), and launched major expeditions against the Prussian apostates (1166 and 1192). / This thesis identifies the influence of the idea of crusade on the actions of the Piasts and in particular, Boleslaw III’s sons (the Piast Juniors), and the importance of family traditions. The thesis presents new propositions in regards to the crusades in Prussia and key Polish crusader participants: the involvement of the Polish crusader army under the command of Mieszko III in the Wendish Crusade (July–August 1147); previously unreported in English historiography, the first known example of crusading in Prussia led by Boleslaw IV (November–December 1147); and Henry of Sandomierz’s leadership of the Polish crusader contingent to the Holy Land (1147–1148).

Students who study through the medium of a second language often have reading/listening
comprehension and general study problems. This study focuses on particular aspects of these
problems only, namely, identification of main ideas, summarisation and note-taking. The aim
of this study was w determine the effect of teaching L2 students a combination of
metacognitive and cognitive strategies for reading and listening comprehension (the main
idea, summarising and note-taking by means of dictation). An intervention programme was
designed in order to teach students these skills. There were ten students in both the
experimental and the control groups. Both groups were assessed before and after the
intervention programme. The findings reveal that the intervention was successful, with the
experimental group showing greater improvement than the control group. The findings of this
study have implications for second language tertiary learning and teaching theory and

Creativity and innovation have a role to play in the change process. Organisational culture has an influence on the degree to which creativity and innovation are stimulated in an organisation. A preliminary model which is based on the literature, has shown that strategy, organisational structure, support mechanisms, innovation behaviour and communication are the organisational culture determinants that influence creativity and innovation in organisations. In the empirical study, existing data which were collected to describe the organisational culture of a university library, were used to test the preliminary model. A factor analysis showed that strategy, purposefulness,
trust relationship, innovation behaviour, work environment, customer orientation and management support influence the degree to which creativity and innovation are stimulated and promoted in the university library. / Information Science / M.Inf.

A curriculum perspective for special needs learners : a case study focusing on empowering special needs learnersMoosa, Zuliakha 12 1900 (has links)
Currently, South African special need schools that cater for intellectually disabled learners are implementing the continuous assessment policy statement (CAPS). This study explored the CAPS curriculum which is used in special needs schools, in order to determine whether or not it can develop disabled learners intellectually. In other words, can the curriculum be used to ensure that disabled learners are also prepared for future employment opportunities? Disabled learners also have a constitutional right to be lead through education to independent adulthood.
This study looks at the characteristics of the intellectually disabled. It mentions some of the official South African documents in this regard and then discusses the theory of Paolo Freire. The researcher addresses two programmes that she feels could improve the curriculum quality of learners with special needs in special needs schools. A few negative aspects, as well as the time frame for South Africa to completely implement inclusive education, according to the White Paper, contributed to this research. Comparisons are drawn between two international policies and acts and South African policies and programmes, in order to determine the effectiveness and standard of South African inclusive education.
This research was conducted in a special needs school in a suburb of Laudium in the Gauteng Province South Africa. It was a qualitative study and adopted a case study design.
The researcher collected data from the principal, HOD, occupational therapist, two teachers and an administrative staff member, who were the participants in the study, using a questionnaire as an instrument for data collection. Inclusive analysis was used to narrate and explain the data. The researcher found that the CAPS curriculum does not equip, prepare or develop learners who are intellectually disabled. The teachers and staff members feel that they need more training and development to support learners with special educational needs, together with a suitable curriculum to ensure effective teaching and learning. / Inclusive Education / M. The Mborayu also embraces the Aywu (the word) that nominates and organizes a comprehensions of Ñeem (term-idea), the spirit of things, that is not the reality (ete), because the ultimate reality (opa wa erã) belongs to Ñemi guaxu (the great mistery).
