Le droit à la paresse en droit social / The right to be lazy in social law

La situation des individus situés en dehors du travail interroge sur la perception qu’a le droit des inactifs et sur les protections conférées à ces derniers, notamment la protection de leur dignité sociale. La notion de paresse, qui pourrait être définie comme la propension à ne rien faire, est absente des dictionnaires juridiques et revêt un sens péjoratif dans les rares textes qui en font usage. L’étude se propose de dessiner les contours de ce que pourrait être un droit à la paresse, et plus spécifiquement un droit collectif à la paresse, en étudiant dans l’ordre juridique français à l’aune de l’activité de travail et du droit de la protection sociale, la façon dont les comportements paresseux sont perçus par le droit et s’il est des situations empreintes d’oisiveté qui permettent de conférer à la paresse une forme de licéité. La recherche s’est intéressée à la fonction et la valeur sociale du travail, pour mieux déconstruire les rapports de dépendance à l’activité de travail qui s’établissent au préjudice du développement du temps de vie personnelle des travailleurs. / The situation of individuals outside work questions the perception of the law of the inactive and the protections afforded to them, including the protection of their social dignity. The notion of laziness, which could be defined as the propensity to do nothing, is absent from legal dictionaries and has a pejorative meaning in the few texts that make use of it. The study proposes to draw the outline of what could be a right to laziness, and more specifically a collective right to laziness, by studying in the French legal order in the yard of the work activity and the social welfare law, the manner in which lazy behavior is perceived by law, and the idleness of situations that make laziness a form of lawfulness. Research has focused on the function and social value of work, in order to better deconstruct the relationships of dependence on the work activity that are established to the detriment of the development of the personal life time of workers.

Optimal and heuristic solutions for the single and multiple batch flow shop lot streaming problems with equal sublots

This research is concerned with the development of efficient solutions to various problems that arise in the flow-shop environments which utilize lot-streaming. Lot streaming is a commonly used process of splitting production lots into sublots and, then, of scheduling the sublots in an overlapping fashion on the machines, so as to expedite the progress of orders in production and to improve the overall performance of the production system. The different lot-streaming problems that arise in various flow-shop environments have been divided into two categories, single-lot problems and multiple-lot problems. Further classification of the multiple-lot problems into the lot streaming sequencing problem (LSSP) and the flow-shop lot-streaming (FSLS) problem is made in this work. This classification is motivated by the occurrence of these problems in the industry. Several variants of these problems are addressed in this research. In agreement with numerous practical applications, we assume sublots of equal sizes. It turns out that this restriction paves the way to the relaxation of several typical limitations of current lot-streaming models, such as assumption of negligible transfer and setup times or consideration of only the makespan criterion. For the single-lot problem, a goal programming (GP) approach is utilized to solve the problem for a unified cost objective function comprising of the makespan, the mean flow time, the average work-in-process (WIP), and the setup and handling related costs. A very fast optimal solution algorithm is proposed for finding the optimal number of sublots (and, consequently, the sublot size) for this unified cost objective function in a general m-machine flow shop. For the more complicated multiple-lot problem, a near-optimal heuristic for the solution of the LSSP is developed. This proposed heuristic procedure, referred to as the Bottleneck Minimal Idleness (BMI) heuristic, identifies and employs certain properties of the problem that are irregular in traditional flow-shop problems, particularly the fact that the sublot sizes eminating from the same lot type and their processing times (on the same machines) are identical. The BMI heuristic attempts to maximize the time buffer prior to the bottleneck machine, thereby minimizing potential bottleneck idleness, while also looking-ahead to sequence the lots with large remaining process time earlier in the schedule. A detailed experimental study is performed to show that the BMI heuristic outperforms the Fast Insertion Heuristic (the best known heuristic for flow-shop scheduling), when modified for Lot Streaming (FIHLS) and applied to the problem on hand. For the FSLS problem, several algorithms are developed. For the two-machine FSLS problem with an identical sublot-size for all the lots, an optimal pseudo-polynomial solution algorithm is proposed. For all practical purposes (i.e., even for very large lot sizes), this algorithm is very fast. For the case in which the sublot-sizes are lot-based, optimal and heuristic procedures are developed. The heuristic procedure is developed to reduce the complexity of the optimal solution algorithm. It consists of a construction phase and an improvement phase. In the construction phase, it attempts to find a near-optimal sequence for the lots and then, in the improvement phase, given the sequence, it attempts to optimize the lot-based sublot-sizes of each of the lots. Extensions of the solution procedures are proposed for the general m-machine FSLS problem. A comprehensive simulation study of a flow shop system under lot streaming is conducted to support the validity of the results and to demonstrate the effectiveness of the heuristic procedures. This study clearly indicates that, even in dynamic practical situations, the BMI rule, which is based on the proposed BMI heuristic, outperforms existing WIP rules, commonly used in industry, in scheduling a flow-shop that utilizes lot streaming. With respect to the primary performance measure - cycle time (or MFT) - the BMI rule demonstrates a clear improvement over other WIP rules. It is further shown that it also outperforms other WIP rules with respect to the output variability measure, another important measure in flow-shop systems. The effects of several other factors, namely system randomness, system loading, and bottleneck-related (location and number), in a flow-shop under lot streaming, are also reported. / Ph. D.

This cunning scheme is developed with the school aid that uses the curriculum components, such as physical education, to perpetuate the mercantile greed, by designing a practice focused on obedient fitness bodies, able to fit into a real paradigmatic business. In opposition to this ideology of quantify the results of the educative business (denial of idle state), it was proposed the development of a action-idleness (idle and fun action, lazy and playful, of a human situated in both actions and values genuinely humans) in the Scholar Physical Education (in three Basic Education schools) of two northern (interior) towns of São Paulo State, in the 2nd half of 2012. To understand the educative processes mobilized by this action, objective of this thesis, we used both Phenomenology and Analysis of the Situated Phenomenon as referential and proceedings methodological, because they allow the interpretation of lived experiences, under the person s inner perspective involved in the research process. With how the unveiled experience from the discourses analysis of both students and participants of the project in the Basic Education schools the human relations valuing and the effective participation in the proposed activities were perceived. In the undergraduates discourses, the first assessment was of doubt about the possibility to effective the action in school, however, the teaching praxis insertion had the perception that they were effectively learning it, because they could live positive experiences in relation to go-beyond the established (paradigm of Human Motricity) for the Scholar Physical Education. Within the major considerations stemming with the research, one may highlight: The necessary of being attentive for the educational pessimism both institutionalized and naturalized; the action must not start with a simulated teaching so that the praxis do not be inauthentic; By Being-More, In-Action, it is possible to change from a productive ethics to an ethics where the greatest goods are the feelings and human relationships. / A lógica produtiva invade todas as dimensões da vida, incluindo a educação, e as condicionam com um poder ideológico que falseia realidades e escraviza consciências, em prol de vantagens econômicas. Tal artimanha é desenvolvida com o auxílio escolar que, em componentes curriculares como a Educação Física, perpetuam a cobiça mercantil, a conceber uma prática voltada para a preparação e condicionamento físicos de corpos obedientes, aptos a se encaixarem em um verdadeiro negócio paradigmático. Em oposição a essa ideologia de quantificação de resultados, do negócio (negação do ócio) educativo, foi proposto o desenvolvimento de uma ócio-ação (ação ociosa e lúdica, preguiçosa e brincante, de um ser humano situado em ações e valores genuinamente humanizados) na Educação Física Escolar (em três escolas de Educação Básica) de dois municípios da região norte (interior) do Estado de São Paulo, no 2º semestre de 2012. Para compreender os processos educativos mobilizados por esta ação, objetivo da presente tese, foram utilizadas a Fenomenologia e a Análise do Fenômeno Situado como referencial e procedimento metodológicos, por possibilitarem a interpretação das experiências vividas, sob a perspectiva das próprias pessoas envolvidas no processo de pesquisa. Como realidade experiencial desvelada, a partir da análise dos discursos dos estudantes e dos participantes do projeto nas escolas de Educação Básica, foram percebidas a valorização das relações humanas e a participação efetiva nas atividades propostas. Nos discursos dos licenciandos, a primeira constatação foi de dúvida sobre a possibilidade de efetivação da ação na realidade escolar, porém, com a inserção na práxis docente, houve a percepção de que estavam efetivamente apreendendo-a, pois puderam vivenciar experiências positivadas em relação ao ir-além do estabelecido (paradigma da Motricidade Escolar) para a Educação Física Escolar. Enquanto principais considerações advindas com a pesquisa, destacam-se: é preciso ficar atento ao pessimismo educacional institucionalizado e naturalizado; a ação não deve partir de uma docência simulada para que a práxis não seja inautêntica; Sendo-Mais, Em-Ação, é possível mudar da ética produtiva, para uma ética na qual os bens maiores são os sentimentos e as relações humanas.

Foi possível, por meio da análise dessa documentação, acompanhar o percurso da produção do vadio enquanto indivíduo passível de conhecimento do saber/poder. Refletiu-se ainda sobre a produção do Código Criminal de 1830, base para o nascimento legal do poder disciplinar no Brasil. Com essa nova estrutura jurídica, a polícia ganhou embasamento legal para agir no cotidiano dos indivíduos pobres livres, seu alvo preferencial. Esse novo tipo de controle e punição de comportamentos indesejáveis irá perpassar e irradiar-se por todo o corpo social em forma de rede, levando finalmente as informações até o Imperador. Portanto, este estudo analisou as formas de poder que nortearam o período imperial brasileiro de 1824 a 1889 e se constituíram em instrumentos utilizados pela elite agrária para inserir os pobres livres no modelo de nação pretensamente liberal e moderna. / Abstract: This dissertation broached the penal juridical thought in Brazil and its historical process during the 19th century focusing on the writing of discourse in processual documents, the so-called termos de bem viver (the propriety of conduct law), one of the documentary sources of the research at issue. By means of an analysis of such papers, one could trace the course of the expression idler as someone subject to the knowledge of the keepers of the law. One also pondered upon the working up of the disciplinary power in Brazil. Due to the new juridical framework the police attained legal power to act on the everyday life of the free poor, their preferred target. The new kind of control and punishment of undesired behavior will affect and spread about the whole "social body" like a network which eventually puts the information up to the emperor. Therefore, this dissertation analyzed the new ways of power which guided the Brazilian imperial period from 1824 to 1889 and which became a device used by the imperial agrarian elite meant to insert the free poor into an alleged liberal and modern nation model. / Mestre

Le sommeil profond, distinct du rêve qu’il accompagne, a bien souvent été occulté par ce dernier au sein des études philosophiques et historiques. La présente recherche, consacrée aux figures d’endormis et aux théories du sommeil à la Renaissance, propose de combler en partie cette lacune en partant de l'hypothèse selon laquelle le sommeil profond, bien qu’il échappe à la conscience, n'en demeure pas moins chargé de sens et de valeurs. L’imaginaire bifurque pour créer, en lieu et place d’une absence de connaissance, une source vive de métaphores. Placé au confluent des traditions chrétiennes et païennes, l’art de la Renaissance offre à l’interprétation une multiplicité de figures endormies. Métaphores visuelles, pétries par la littérature de l’époque, nourries de théories qu’elles transforment en retour. À travers elles, dormir constitue bien souvent l’indice du péché, car « l’oisiveté est mère de tous les vices ». Mais, la métaphore change avec la pose du dormeur, son lieu et son environnement également. Selon les œuvres, le sommeil devient l’emblème de l’enfance ou de la vieillesse (premiers et derniers sommeils), une métaphore d’ignorance et d’oubli (sommeil léthéen), la figure du secret et de la foi (repos contemplatif), du désespoir et de la mélancolie (sommeil de tristesse), de l’amour céleste et du ravissement (vacance de l’âme) ou bien du rapt et de la volupté (érotisme léthargique). L’énigme du sommeil donne forme aux questions insolubles qui ne cessent de nous mettre en éveil : images léthargiques de bonheur, d’amour et de mort qui n’en finissent pas de hanter l’imaginaire contemporain, « métaphores absolues » dont l’histoire ne cesse de s’inventer. / Scores of historical and philosophical studies have been devoted to dreams. However, the notion of deep sleep (as opposed to dreams) seems to have been thoroughly neglected. The present study attempts to fill this gap by analyzing representations of sleepers and theories of sleep in the Renaissance. My working hypothesis is that even though deep sleep appears to be located outside of the realm of consciousness, it amounts nonetheless to a heavily determined notion, both semantically and axiologically. Sleep seems to offer a form of imaginative diversion, as the absence of knowledge gives free rein to fanciful metaphors. At the crossroads of Christian and pagan traditions, Renaissance art offers a cornucopia of representations of sleep. They constitute visual metaphors, deeply influenced by the literature and theoretical writings of the period, on which they had in turn a tremendous impact. Thus, sleep is often equated with sin, as « idle hands are the devil's workshop », but its meaning also depends on the sleeper's attitude, location and context. For instance, sleep can be depicted as an emblem of early childhood or old age (first or last sleep), a metaphor for oblivion (Lethean sleep), a figure of ecstasy and faith (contemplative rest), an image of melancholy (sleep of sadness), of spiritual rapture (vacation of the soul) or sensual ravishment (lethargic eroticism). Whichever the case, sleep always remains an enigma, a Protean concept assuming the shape of virtually unanswerable questions : lethargic images of happiness, love and death that are still haunting the contemporary imagination, « absolute metaphors » constantly reinventing themselves and their history.

De la démarche du corps à celle de l'esprit : constellation discursive de la flânerie et du mode flâneur

Ce mémoire de maîtrise est une mise en scène du mode flâneur et une ébauche des articulations de ce qui participe de l'essence de la flânerie en général. Il tente d’établir la constellation du flâneur à partir de textes où ce dernier est représenté et puise son inspiration principale des travaux critiques et des textes de fiction de Walter Benjamin sur le flâneur et la ville. Le flâneur n’est pas son moyen mais sa fin. Ce mémoire est un travail pluridisciplinaire fidèle au modus operandi de Benjamin et se déploie comme représentation de son objet plutôt que description. Il est construit et pensé selon une vision phénoménologique et s’articule autour de certains ensembles traditionnels comme le faire et le non-faire, l’espace et le temps, auxquels s’ajoutent les concepts de Benjamin d’expérience et d’expérience vécue, du proche et du lointain et de la trace et de l’aura. Il est traversé par les problèmes de présentation de la littérature philosophique et s’y dérobe par une présentation elle-même flâneuse. C’est un travail qui concilie la flânerie en soi et la flânerie dans le discours, celle du corps et celle de la pensée, et qui admet que le résultat de celle-ci comme de celle-là est inséparable du chemin y menant. / This M.A. thesis is a mise en scène of the mode flâneur and characterizes the articulations of what pertains to the essence of flânerie en general. It attempts to establish the constellation of the flâneur based on texts in which the term and the notion appear; it draws its main inspiration from Walter Benjamin’s argumentative essays and fictional texts about the flâneur and the city. The flâneur is not the study’s means but its end. This thesis is a multidisciplinary work loyal to Benjamin’s modus operandi and unfolds a representation of its object rather than a description. It is constructed and conceived according to a phenomenological view and revolves around traditional pairs such as doing and non-doing, time and space, to which are added the Benjamin’s concepts of experience (Erfahrung) and lived experience (Erlebnis), of near and far as well as trace and aura. It is preoccupied with questions that concern modes of philosophical presentation itself; it proceeds by adopting a flâneur discourse of analysis. It is a work that reconciles the concept and discourse in two flâneries, one of the body and one of the mind, and that admits that the result of this double flânerie is inseparable from the path leading to it.

Esta dissertação apresenta as ações da municipalidade na regulação e aplicação do Parcelamento, edificação ou utilização compulsórios - PEUC - no Município, com foco no combate a imóveis considerados não utilizados em área central. Faz um panorama da regulação federal do instrumento e uma análise das tentativas incipientes de regulamentação do instrumento no município, no intervalo entre 1988 e 2011, que de modo geral, postergaram sua aplicação. Com a criação do Departamento de Controle da Função Social da Propriedade (2013), a aprovação do Plano Diretor Estratégico (2014), o PEUC começa a ser aplicado. Foram notificados até fevereiro de 2017 1.336 imóveis, 674 imóveis não utilizados nos distritos centrais. Destes, apenas 36 cumpriram a obrigação (o que representa 6,7% dos imóveis notificados), alguns ainda têm prazo para cumprir a notificação e outros já estão pagando IPTU Progressivo no Tempo. Os efeitos urbanísticos desta aplicação ainda são pouco notados, pois não há um número tão significativo de imóveis notificados. No entanto, o processo de implementação do instrumento se mostra inovador e tem um caráter político-pedagógico ao criar procedimentos, conceitos e desenhar institucionalidades (como a criação de um Departamento) para a gestão da aplicação da tríade de instrumentos (PEUC, IPTU Progressivo e Desapropriação). Ainda que tenha sido estratégica a aplicação do PEUC sobre áreas de interesse público, em especial sobre Zonas Especiais de Interesse Social, notou-se que, até este momento,a destinação dos imóveis quando entram no mercado atenderam a outros usos, que não o da habitação de interesse social. A articulação dos imóveis notificados a determinadas políticas setoriais deu-se apenas no debate público sobre a aplicação do Plano de Habitação, que ainda não foi aprovado, apontando para a necessidade de associar esta política a outras políticas públicas setoriais. A análise dos questionamentos dos proprietários notificados como descumpridores da função social da propriedade ilustra uma diversidade de argumentos ainda não suficientes para isentá-los do cumprimento deste princípio constitucional e a persistência de ações voltadas a processos especulativos sobre a terra. / This dissertation presents the actions of the municipality in the regulation and application of the Parcelamento, Edificação e Utilização Compulsórios - PEUC (Compulsory Parceling, Building or Use - CPBU) - in the County with a focus on combating the lack of use of properties in the central area. It provides an overview of the Federal regulation of the instrument and an analysis of the incipient attempts of its Municipal regulation in the years between 1988 and 2011 that delayed its application. The instrument starts to be applied with the creation of the Department of Control of the Social Function of Property (2013) and the approval of the Strategic Municipal Master Plan (2014). Until February 2017 1,336 properties were notified - 674 unused buildings in the central districts of which only 36 fulfilled the obligation (what represents 6.7% of the properties notified), some still have a deadline to comply with the notification and others are already paying a Progressive Property Tax. The urban effects of its application are still little noticed, because there are not too many properties notified. However, the implementation process of the instrument is innovative and has a political-pedagogical character when creating procedures, concepts and designing institutions (such as the creation of a Department) for the application management of the triad of instrument (CPBU, Progressive Property Tax and expropriation. Although the strategic application of the instrument to areas of public interest, especially on Zonas Especiais de Interesse Social (Special Zones of Social Interest), it was noted that, until now, the destination given to the properties is not that of Habitação de Interesse Social (Housing of Social Interest). The articulation of the areas where the proprieties notified are located to certain sectoral policies occurred only in the public debate about the application of the Plano de Habitação (Housing Plan) that has not yet been approved, pointing out the need to associate this policy with other sectoral public policies. The analysis of the inquiries of the owners notified as non-observers of the social function of the property illustrates a diversity of arguments not yet sufficient to exempt them from the fulfillment of this constitutional principle and the persistence of actions directed to speculative processes over the land.

Until February 2017 1,336 properties were notified - 674 unused buildings in the central districts of which only 36 fulfilled the obligation (what represents 6.7% of the properties notified), some still have a deadline to comply with the notification and others are already paying a Progressive Property Tax. The urban effects of its application are still little noticed, because there are not too many properties notified. However, the implementation process of the instrument is innovative and has a political-pedagogical character when creating procedures, concepts and designing institutions (such as the creation of a Department) for the application management of the triad of instrument (CPBU, Progressive Property Tax and expropriation. Although the strategic application of the instrument to areas of public interest, especially on Zonas Especiais de Interesse Social (Special Zones of Social Interest), it was noted that, until now, the destination given to the properties is not that of Habitação de Interesse Social (Housing of Social Interest). The articulation of the areas where the proprieties notified are located to certain sectoral policies occurred only in the public debate about the application of the Plano de Habitação (Housing Plan) that has not yet been approved, pointing out the need to associate this policy with other sectoral public policies. The analysis of the inquiries of the owners notified as non-observers of the social function of the property illustrates a diversity of arguments not yet sufficient to exempt them from the fulfillment of this constitutional principle and the persistence of actions directed to speculative processes over the land.

IL VOLTO DEMOCRATICO DI SOLONE? ANALISI DEL CORPUS DI LEGGI SOLONIANO

Oggetto della tesi è lo studio del “Solone democratico”, di cui si ricostruisce la genesi attraverso le testimonianze degli antichi e le riflessioni dei moderni. Per sottoporre a verifica l’affermazione aristotelica che riconduce a Solone l’origine della democrazia, sono state prese in considerazione primariamente quelle misure che riguardano la costituzione (Eliea, bulé dei Quattrocento, accesso alle cariche), al fine di comprendere se il giudizio degli antichi si basò su una valutazione condivisibile dell’azione del legislatore. Si sono ritenute ugualmente indicative, a questo scopo, alcune leggi ordinarie attribuite a Solone (legge sull’inattività, legislazione funeraria, leggi sulle donne, legislazione assistenziale): di queste leggi si è indagata l’origine soloniana e la compatibilità con il resto della legislazione dell’Ateniese a partire dalla valutazione del loro significato. La tesi è completata da tre appendici che sviluppano alcuni dei temi emersi nel corso dell’indagine e considerati meritevoli di approfondimento: si tratta della questione procedurale nella legge sull’inattività; della datazione e del commento di una legge funeraria concernente alcuni obblighi del demarco; della connessione fra Solone e l’Areopago. / The aim of this thesis is the study of the “democratic Solon”, whose genesis has been reconstructed through the ancients’ accounts and the works of modern scholars. To test the Aristotelian statement that traces the origin of democracy to Solon, we have primarily considered those measures that concern the constitution (Heliaia, boule of the Four Hundred, access to high offices), in order to understand if the ancients’ judgement was based on a shareable assessment of the legislator action. For that purpose some ordinary laws attributed to Solon - on idleness, on women, funerary and welfare laws - have been considered equally indicative. Of these laws it has been investigated the Solonian origin and compatibility with the rest of the Solonian legislation, starting from an assessment of their meaning. To complement the present thesis there are three appendixes which develop some of the themes that arose during the investigation and that have been considered worth to be deepened. It is the case of the procedural question regarding the law on idleness; the dating and comment of a funerary law concerning some duties of the demarch; of the connection between Solon and the Areopagos.
