“Raciocina - mas obedece!” : poder e desejo nas relações de trabalho

Coelho, Rosana de Souza January 2011 (has links)
The main objective of this dissertation is to identify some effects of the exercise of power and its relations with the desire, in subjects who occupy management positions in public companies. From the context of the prevailing economic order, we identified the immaterial labor as the hegemonic form of work in contemporary society. We demonstrated that the emphasis on relational and communication skills in this type of work shifts the prescription of tasks, characteristic of Fordist work material for the prescription of subjectivity. Taking the concept of activity from the Clinic of Activity proposed by Yves Clot, we conceived the act of working as a result of line of tension that is established between prescribed work and real work. We determined our focus of analysis in the management activity and show that, in the postmodern work, management emerges as a primary vehicle for command and legitimation of the capitalist order. Using the Michel Foucault’s concept of power we conceived the exercise of managerial power as a political technology whose instrumental rationality is grounded in systems of power-knowledge, which, in our survey, are represented by programs management and total quality. From the concept of malaise by Freud, we discuss the link with the subject's culture and methods of social ties in intersubjective relations work. We identified that the instrumental rationality in the postmodern work, under the sign of managerial power, favors perverse arrangements in labor relations. The individualization intensifies and brings about the weakening of collective ties, while the logic of privatization spreads by reducing the public space and devalues the role of politics in the construction of social ties. From the appointment of the decline in the public sphere in this work of Hannah Arendt, and the use of the concept of constituent power in Antonio Negri’s work, we pointed out the intimate link between power and politics and its importance in the exercise of a power that challenges the dominant order, produce disruption and laceration points where the subjects' desire can operate as a resistance to established power. Taking the concept of utopia in his iconoclast shed, we discussed the importance of the utopian function not only in the exercise of power and desire in labor relations, but also as an ethical necessity in the quest for another world from the criticism of this one.

Olbermann, Junia Vogel January 2017 (has links)
Liquid Life in the liquid-modern society, Immaterial Labour and the notion of Dispositive, formed the theoretical basis of the current study, based, especially, on Bauman (2001, 2005, 2007a, 2007b, 2008a, 2008b), Gorz (2005) e Agamben (2009), respectively . Starting from it, this research aimed to understand how is characterized the life of a high executive and which dispositives sustain it. In order to do so, a qualitative exploratory research was conducted, and, through semi structured interviews, reached the participation of high executives from medium and major Brazilian companies. Obtained from the content analysis, the results allow the featuring of the executive life as a stimulated and hidden life. Aligned with the organizational dictates, the dispositives are presented as: the gift, the engagement dispositive; the adulation, the seduction dispositive, the glamorization, the capture dispositive, and the productivity, the power dispositive.

League of Legends: Players and Esports / The Work of Professional Players in League of Legends Esports

Agha, Brandon 11 1900 (has links)
Esports gaming is a new subject within various fields of research. Typically, research explores the relationships between games and its players or the developers. By contrast this thesis examines the highest level of play within gaming, professional players. To do so, it utilizes the example of League of Legends. Created in 2009, League of Legends has rapidly grown to become one of the largest online multiplayer games with a massive Esports scene that matches or exceeds that of traditional sports such as Basketball or Baseball. But what factors contribute to this sudden rise in League of Legends Esports popularity and how have professional players adjusted over the years? This thesis explores these questions and the overall evolution of professional teams and League of Legends over the course of its Esports growth. It finds that League of Legends is unique in its use of the immaterial labour and digital labour of professional players. Through a concept called the “Meta”, League of Legends is able to mimic traditional sports and maintain interest in its game. Further for professional players the existence and evolution of the “Meta” sharply influences the need for organizational restructuring over the years. Players and teams become complex organizations in which players’ transition from gamers to become workers in Esports. Exploring the League of Legends Esports setting uncovers a unique combination of sport and work within a new digital context. / Thesis / Master of Philosophy (MA) / The goal of this work is to explore the lives and labour of League of Legends professional players. Created in 2009, League of Legends rapidly grew to be one of the most played and watched Esport game in the world. Professional players are often heralded as celebrities and their decisions impact the larger League of Legends and Esports community. This work examines the realities of Esports for professional players. It further analyzes the structure and organization of play and work in the League of Legends Esports setting. For the developer, Riot Games, Esports serves a variety of purposes and this thesis explores this and the contributions of Esports professionals to the development of the game.

Imateriální újma v občanském právu / Immaterial harm in civil law

Pincová, Vendula January 2018 (has links)
This thesis deals with the legal regulation of immaterial harm (non-pecuniary loss) in civil law with a necessary extension to other spheres of private and public law. Immaterial harm reflects the personal loss caused by the infringement of human personal rights or other natural rights protected by law. There is no possibility of objective pecuniary evaluation in comparison to the material harm (damage) and so there is no potentiality to recover damages easily. The main goal of the thesis is to compose crucial issues regarding immaterial harm. The thesis uses mainly analysis of primary and secondary sources such as legal regulation, professional literature and judicial decisions. The immaterial harm is linked to the two main areas of law: 1) tort law and 2) the protection of person and personal rights. So the thesis is divided into two parts for that important reason. The first part of the thesis deals with the common regulation of the immaterial loss. Legal provisions encompassing immaterial harm are regulated in the first chapter. Next chapter explains tort law: a wide area including immaterial harm. The third chapter focuses on concept of civil tort; there is an important issue in connection with recodification. The fourth chapter deals with liability in general: this term was replaced by...

The Constitutional Property Clause and Immaterial Property Interests

Kellerman, Mikhalien 03 1900 (has links)
Thesis (LLD)--University of Stellenbosch, 2011. / ENGLISH ABSTRACT: The question that this dissertation addresses is which immaterial property interests may be recognised and protected under the constitutional property clause and if so, under which circumstances. The question originated in the First Certification case 1 where the court held that the constitutional property clause is wide enough to include property interests that require protection according to international norms. The traditional immaterial property interests or intellectual property rights (patents, copyright, designs and trademarks) are protected as property in private law on a sui generis basis. Since it is generally accepted that the property concept in constitutional law includes at least property rights protected in private law, it is relatively unproblematic to include intellectual property rights under the constitutional property clause. In Laugh It Off v SAB International,2 the Constitutional Court explicitly balanced the right to a trademark with the right to freedom of expression, which is accepted as authority that at least trademarks may be recognised and protected as constitutional property. The other intellectual property rights may most likely be recognised and protected by analogy. Foreign law as well as international law also indicates that intellectual property should be recognised and protected as constitutional property. However, there are other, unconventional immaterial property interests that are not protected as property in private law. Some are protected in private law, but not as property; others originate in public law; and yet others are not protected yet at all. In terms of the Constitution, South African courts may consider foreign law, but must consider international law. This dissertation determines when these interests may be protected as constitutional property by reference to foreign cases from German, American, Australian and Irish law; regional international law, namely European Union cases; and international law. The conclusion is that unconventional immaterial property interests may generally be protected if they are vested and acquired in terms of normal law, have patrimonial value and serve the general purpose of constitutional property protection. Property theories are also useful to determine when immaterial property interests deserve constitutional protection, although other theories may be more useful for some of the unconventional interests. The German scaling approach and the balancing of competing interests is a useful approach for South African courts to help determine the appropriate level of protection for specific immaterial property interests without excluding some at the outset.

Peněžité zadostiučinění jako právní prostředek ochrany osobnosti v občanském právu / Monetary satisfaction as a legal tool for the protection of personal rights under civil law

Kameníková, Hana January 2011 (has links)
1 Abstract: The subject of this paper is the issue of the pecuniary satisfaction as a legal instrument of protection of the personality in civil law. It is obvious that the main object of this work is the question of personal rights and its protection, which has its part in constitutional laws. This paper also analyses the definition of law on protection of personality, an entitlements to sue and to be sued relating to protection of personality. This essay is divided into five chapters with relatively separated thesis. In the first part the issue of conception of personality is analysed. What is personality in the terms of law? There are two different views - in first personality is identical with human existence, in second view personality is only role assignated to human by system of law. This part of the work analyses especially socialistic view of person and its protection and iusnaturalistic conception of personality. Both of them have practical impacts on legislation in Czechoslovakia and in Czech Republic as well. Anthropological conception respects new proposal of Civil code, while socialistic view and its basics exerts influence up recent Civil Code nr. 40/1964. Second part of this work analyses generally personality rights and sources of laws of personality and monistic and dualistic theory. In...

No. of bitstreams: 1 SONILDA APARECIDA DE FATIMA SILVA.pdf: 2309355 bytes, checksum: 5d08cad540b57ff4317a34037855c6e6 (MD5) Previous issue date: 2006-11-06 / This work analyses the immaterial legacy of the miners of the town of Campos Verdes, as a cultural patrimony, historically contextualizing the town from the discovery of the mine until nowadays. It also aims to evidence the miner s knowledge, contextualizing the idea of patrimony as a local identity category, establishing a relation with Choay (2001), when he shows that the new means offered by science and by technique generate a tendency to enrichment without worrying about preserving the cultural assets, either material or immaterial, as in Campos Verdes. Getting to know how the emeralds were discovered, how the town was settled and emancipated, will be important to understand its historical context, which is on the mind of the inhabitants of Campos Verdes, and that will also help those citizens, who are part of that history, feel that they belong to the cultural inheritance of those mines. In order to have this work done some methodological procedures were used, such as: ethnographic research; analysis of documents; bibliographic research; polls and oral testimonies about the local history. These procedures aimed to investigate the historical context of the town of Campos Verdes, women s life at the mines, and the knowledge of the miners.
