No-matter : theories and practices of the ephemeral in architecture

The architectural theorist and practitioner Bernard Tschumi asserts that enquiring and working at the limits of a discipline expands our knowledge and experience. Within this thesis I examine the limits of architecture as they relate to the non-material and the nonvisible elements of space. As Mark Wigley observes in his essay on atmosphere, architects, at different times, have sought to understand, capture and control the otherwise ungraspable aspects of space. The elusive nature of such ephemeral architectural aspects and elements makes them hard to manage and map. Their examination provides a challenging exercise within architectural research. Atmosphere is such an elusive element; as Zizek would call it, it is that which remains always as a backdrop to daily life. It seems to vanish when subjected to conscious scrutiny. Non-visual sensations such as sounds, smell, textures, temperature, clearly constitute invisible elements that are notoriously difficult to represent. As a further example, event, the way in which a space is or could be deployed or inhabited over time, provides another unpredictable and ambiguous design consideration. Spaces relate to performance. The performance of a place constitutes its nature, character, function and meaning. However, the complexity, changeability, and potentiality of spatial performance render it as something abstract and non-representable. As Steven Connor, and Jonathan Hill, amongst other theorists, observe, new media, electromagnetic fields, and digital gadgets, also constitute invisible elements of space. They create invisible fields, territories, links and boundaries, affecting everyday spaces and relationships. So a typology of the elusive and ephemeral characteristics of space would include: non-conventional materials, elements changing over time, electromagnetic fields, electronic equipment, nonvisually representable sensations, situations, processes and events. Attending closely to these themes reveals some key questions. Why do these themes appear (or re-appear) now, at this particular moment in history? How are they related to contemporary thought, practice, and to current shifts in society, culture and technological development? New technology, new means of representation, and emerging design media change both the way in which we inhabit space, and also the way in which we understand and represent it. Digital media allow us to record and represent time and duration. Hence, events and situations occurring over time can be documented and studied. Subsequently, new media can also function as a new tool to think about space, and for designing accordingly. As Marshall McLuhan claimed in the 1960s, the emergence of new digital media has caused a ‘shift in the sensorium’ and has readdressed the significance and role of experiencing and sensing other than through the visual sense. In this thesis I discuss in turn a series of limits and the qualities of the spaces that they reveal. Each chapter title is based on a binary and a theme that indicates its transgression: (a) the visual versus the non-visible – the sensuous (chapter 2), (b) the discourse about the formal versus the material – the performative (chapter 3), (c) the physical versus the digital – the hybrid (chapter 4). In order to examine these themes and explore the design potential they entail, I review relevant literature in parallel with the conduct of a series of design experiments. The experimental processes deployed are of three kinds: (1) mapping and documentation of sensory situations, (2) design experiments that challenge the issues discussed and (3) real-scale interventions that test some of the design ideas at a 1:1 scale and in an actual place. The latter includes a major installation at the 2009 Venice Biennale on the theme of Athens by Sound initiated and designed by a team involving the author.

This support provides a reflective study and poetic about the different processes of construction of the work, scoring its relationship with traditional and digital technologies, and poetic thinking about the limits of the field. Initially this study focused on the production in the engraving workshop, which was held in a freedom technical and conceptual in the process of creation. The variations of matrices allowed then concentrate production in two opposite techniques: one is the extraction of material (plastic), and the other in collage of material. With the development of these two techniques deployed, the process experimental restricted itself, producing poetic reflections, conceptual searches and increased volume of production. The technique and the concept of engraving developed the work, the processes and considerations involving the manufacture of objects from / matrices until your impressions or final proposals. As path poetic, was questioned the transparency of the object / matrix being immaterial, missing, and their behaviour in steps of the production process, printing and reflection. This supports research on the work of artist Regina Silveira, in times that discusses the immaterial being, under the aspect of the concepts and ways of doing and understand the engraving. So its work built on the line of poetic visual, the daily the artist is a member of thinking and construction of the work, so as to the document which it uses referring to the process of creation. This research presents technical and conceptual axis as the engraving, which promotes reflection on the presence of transparent as a representation missing. / Esta pesquisa compreende tecnicamente a produção, digitalização/entitamento e impressão de objetos/matrizes confeccionados em plástico polietileno transparente. Este suporte proporciona um estudo reflexivo e poético acerca dos diferentes processos de construção da obra, pontuando sua relação com as tecnologias tradicionais e digitais, e o pensamento poético acerca dos limites da matéria. Inicialmente o presente estudo concentrou-se na produção em ateliê de gravura, em que foi exercida uma liberdade técnica e conceitual no processo de criação.As variações de matrizes permitiram, posteriormente, concentrar a produção em duas técnicas opostas: uma consiste na extração de material(plástico), e a outra, em colagem de material. Com o desenvolvimento destas duas técnicas destacadas, o processo experimental afunilou-se, produzindo reflexões poéticas, pesquisas conceituais e maior volume de produção.A técnica e o conceito de gravura orquestraram os fazeres, os processos e as reflexões que abrangeram desde a confecção de objetos/matrizes até suas impressões ou propostas finais.Como trajeto poético, foi questionada a transparência do objeto/ matriz ser imaterial, ausente, bem como o seu comportamento nas etapas do processo de produção, impressão e reflexão.Esta investigação apóia-se no trabalho da artista Regina Silveira, nos momentos em que discute a imaterialidade, sob a vertente dos conceitos e modos de fazer e entender a gravura.Por tratar-se de um trabalho construído na linha de poéticas visuais, o diário de artista apresenta-se como membro do pensamento e construção da obra, portanto, como documento ao qual se recorre referendando o processo de criação. Esta pesquisa apresenta como eixo técnico e conceitual a gravura, que promove a reflexão sobre o transparente como presença de uma representação ausente.

Le patrimoine immatériel des collectivités territoriales : Protection et réservation / Immaterial property of local authorities : protection and reservation

Le patrimoine immatériel des collectivités territoriales pose des questions particulières, qui ne sauraient se réduire à celles qui se posent pour le patrimoine immatériel de l’Etat. Il oblige à s’interroger sur la redéfinition de certains concepts centraux du droit administratif des biens, que la doctrine croyait acquis et que tout le monde pensait connaître. Par exemple, la notion d’actif immatériel révèle très clairement les limites matérielles de la propriété publique. Mais plus encore, l’approche immatérielle révèle aussi les limites de la notion de patrimoine public elle-même. Ce patrimoine, n’est plus simplement composé de ce que possèdent les collectivités territoriales, mais aussi de ce qui les constitue. Dès lors, il accueille en son sein des thèmes liés au nom des collectivités, ou encore, à la protection de leurs savoir-faire. Très vite se pose à leur sujet la question des mécanismes de réservation : la propriété publique suffit-elle à cette réservation ? Avec des problématiques liées au patrimoine linguistique ou culturel, le sujet invite à se placer sur un terrain encore inconnu en droit public qui va bien au-delà du seul aspect patrimonial. S’il semble encore trop tôt pour parler en la matière d’approche extrapatrimoniale, force est de constater qu’une réflexion sur des mécanismes de réservation en dehors de la propriété publique s’impose. Par conséquent, avec l’évolution du droit de propriété publique vers l’immatériel et la question sous-jacente d’un « droit public de la propriété intellectuelle », de même qu’avec la question d’un droit des personnes publiques, sommes-nous en train d’assister à la construction discrète et encore hésitante d’un droit de l’immatériel public ? / The immaterial property of local authorities is specific and cannot be reduce to the immaterial property of the State. Some notions of public property law of goods must be define again, whereas the doctrine thought about it, that everything is acquired, and everybody thought to know. For instance, the notion of immaterial good reveals limitations of public property law. Furthermore, immaterial approach reveals also the limitations of the notion of property itself. This property is not simply made anymore that local authorities have, but also, which identify them. Immaterial property understands immaterial goods like local authorities’ name or their know-how. Therefore, the question of the reservation of these “goods” must be asked: property law is it adapted? With the “linguistic or cultural property”, the subject reveals unknown difficulties in public law, beyond of only question of property. If it seems to be too early to talk about an approach apart from property, it is clear that a reflection about the process of reservation without property is necessary. In consequence, with the evolution of public property law to an immaterial approach, and the underlying question of a “public intellectual property law”, in the same way, the question of a law about public authorities, are we attending to a prudent and reserved construction of public immaterial property law?

Immaterial harm in civil law - Abstract My thesis is focused on immaterial harm in civil law. It is a topic nowadays broadly discussed because its creation is most often associated with interference in the personal rights and its consequences are very severe. The aim of my thesis is to provide a comprehensive overview of the possibilities of creation immaterial harm and the ways of remedying its consequences. The work deals with the effective legislation, meaning mainly the Act No. 89/2012 Coll. Civil Code (hereinafter "the new Civil Code"). In some parts of my work is pointed towards now uneffective legislation of Act No. 40/1964 Coll. Civil Code from the year 1964 which is siginificantly different from the new Civil Code. The first chapter defines the basic terms associated with the topic of immaterial harm. The following chapter discusses the development of creation of immaterial harm in our area and describes the reasons for the necessity of protecting the personal rights and also creation of obligation to compensate for losses by unlawful encroachments. The third chapter deals with individual partial values of human personality and evaluates its regulation and protection method. The mediated closeness experienced by social media users is built on the ongoing accumulation of personal information by corporate owned social media platforms. Each user’s digital footprint becomes more intricate as this collection continues across their life’s procession, leaving something behind after they die. Social media platforms have become intimately insinuated into life and finally, into death. These haphazard archives were never created with death or grief in mind. But users die, and their friends and family use social media to grieve; death isn’t something a platform or its users can avoid. This thesis examines the ways that death and grief are experienced and how social media is facilitating and changing that process. The study approaches social media and death historically, discursively, and economically. It discusses the history of mediated death, the experience of grief over social media, and the political economy of the socially mediated dead.

Captura à vida de alto executivo : dispositivos em cenas cotidianas

Vida Líquida na Sociedade Líquido-Moderna, Trabalho Imaterial e a noção de Dispositivo conformaram a base teórica do presente estudo, alicerçada, em especial, em Bauman (2001, 2005, 2007a, 2007b, 2008a, 2008b), Gorz (2005) e Agamben (2009), respectivamente. A partir dela, buscou-se apresentar como se caracteriza a vida de alto executivo e que dispositivos a sustentam. Para tanto, empreendeu-se uma pesquisa exploratória qualitativa que, por meio de entrevistas semiestruturadas, contou com a participação de altos executivos de empresas de médio/grande porte localizadas no Brasil. Alcançados por meio da análise de conteúdo, os resultados permitiram caracterizar a vida de alto executivo como vida estimulada e como vida vedada. Condizentes com os ditames organizacionais, os dispositivos assim se apresentaram: o dom, dispositivo de engajamento; a bajulação, dispositivo de sedução; a glamourização, dispositivo de captura; e a produtividade, dispositivo de poder. / Liquid Life in the liquid-modern society, Immaterial Labour and the notion of Dispositive, formed the theoretical basis of the current study, based, especially, on Bauman (2001, 2005, 2007a, 2007b, 2008a, 2008b), Gorz (2005) e Agamben (2009), respectively . Starting from it, this research aimed to understand how is characterized the life of a high executive and which dispositives sustain it. In order to do so, a qualitative exploratory research was conducted, and, through semi structured interviews, reached the participation of high executives from medium and major Brazilian companies. Obtained from the content analysis, the results allow the featuring of the executive life as a stimulated and hidden life. Aligned with the organizational dictates, the dispositives are presented as: the gift, the engagement dispositive; the adulation, the seduction dispositive, the glamorization, the capture dispositive, and the productivity, the power dispositive.

The Organizations of Immaterial Labour: Knowledge Worker Resistance in Post-Fordism

Liberal-democratic theories of knowledge work suggest that labour and capital are no longer at odds in the information society. This dissertation critiques such a position, proposing that knowledge worker professions, or ones it describes as involving forms of immaterial labour, are subject to new regimes of exploitation and emergent modes of resistance within post-Fordism. The study begins by surveying competing theoretical perspectives on knowledge work, and moves on to consider the ethical questions, epistemological foundations, and methodological choices involved in carrying out engaged inquiries into collective organization by immaterial labourers. The dissertation’s empirical contribution is comprised of three case studies of labour organization by knowledge workers. The first is the Washington Alliance of Technology Workers, an “open-source” union formed in 1998 by contract workers at Microsoft. The second is the Aliant clerical/call-centre workers in Moncton, New Brunswick, who certified a bargaining unit through the Communication, Energy and Paperworkers Union in 2001. The third is the Collettivo PrecariAtesia, a self-organized group of Roman workers formed at Atesia, Europe’s largest call centre, in 2004. Drawing on these and other contemporary examples, the dissertation suggests that, in its most promising articulations, the organization of immaterial labour is occurring at the intersection of spontaneous struggles by workers and a process of union renewal underway within certain sectors of the established labour movement. These cases also point to the potential of collective organizing occurring around precarity, or the increasing financial and existential insecurity arising from the flexibilization of labour. Procura mostrar o impacto das novas tecnologias de comunicação e informação entre os que vivenciam o hip-hop, seja produzindo, baixando músicas, participando das redes temáticas, etc... Como as novas tecnologias fazem parte da história e da vida do hip-hop, aliadas ao trabalho cooperativo e colaborativo dos produtores dessa arte, é algo pensado com base nas teorias do trabalho imaterial / This work intends - in a very personal way of participative research to design a genealogy of hip hop in Rio de Janeiro, emphasizing the approach of rap music. It tries to show the impact of the new technologies of information and communication over those who produce, consume and live on the hip hop nets. The presence of NICs as well as the cooperative and collaborative ways of hip hop production are approached with the theoretical basis of immaterial work.

“Raciocina - mas obedece!” : poder e desejo nas relações de trabalho

O objetivo principal desta dissertação é identificar alguns efeitos do exercício do poder e suas relações com o desejo, nos sujeitos que ocupam cargos gerenciais em empresas públicas. A partir da contextualização da ordem econômica dominante, identificamos o trabalho imaterial como forma hegemônica de trabalho na contemporaneidade. Evidenciamos que a ênfase em habilidades relacionais e comunicacionais neste tipo de trabalho, desloca a prescrição das tarefas, característica do trabalho material fordista, para a prescrição da subjetividade. Tomando o conceito de atividade a partir da Clínica da Atividade proposta por Yves Clot, concebemos o ato de trabalhar como resultante da linha de tensão que se estabelece entre o trabalho prescrito e o trabalho real. Determinamos nosso foco de análise na atividade de gestão e mostramos que, no trabalho pós moderno, a gestão emerge como forma de comando e principal veículo de legitimação da ordem capitalista. Utilizando o conceito de poder em Michel Foucault concebemos o exercício do poder gerencialista como uma tecnologia política cuja racionalidade instrumental se ancora em dispositivos de poder-saber, os quais, em nossa pesquisa, aparecem representados pelos programas de gestão e de qualidade total. A partir do conceito de mal estar em Freud, problematizamos o enlace do sujeito com a cultura e as modalidades de laço social nas relações intersubjetivas de trabalho. Identificamos que a racionalidade instrumental no trabalho pós-moderno, sob o signo do poder gerencialista, favorece modalidades perversas nas relações de trabalho. A individualização se intensifica e enseja o enfraquecimento dos laços coletivos, ao mesmo tempo em que a lógica da privatização se alastra reduzindo o espaço público e desvalorizando o papel da política na construção dos laços sociais. A partir do apontamento da diminuição da esfera pública presente na obra de Hannah Arendt, e da utilização do conceito de poder constituinte em Antonio Negri, apontamos o intímo elo entre poder e política e sua importância no exercício de um poder que questione a ordem dominante, produza rupturas e pontos de esgarçamento, onde o desejo dos sujeitos possam operar como resistência ao poder instituído. Tomando o conceito de utopia em sua vertente inconoclasta, problematizamos a importância da função utópica, não só no exercício do poder e do desejo nas relações de trabalho, mas também enquanto necessidade ética na busca de um outro mundo a partir da crítica do presente. / The main objective of this dissertation is to identify some effects of the exercise of power and its relations with the desire, in subjects who occupy management positions in public companies. From the context of the prevailing economic order, we identified the immaterial labor as the hegemonic form of work in contemporary society. We demonstrated that the emphasis on relational and communication skills in this type of work shifts the prescription of tasks, characteristic of Fordist work material for the prescription of subjectivity. Taking the concept of activity from the Clinic of Activity proposed by Yves Clot, we conceived the act of working as a result of line of tension that is established between prescribed work and real work. We determined our focus of analysis in the management activity and show that, in the postmodern work, management emerges as a primary vehicle for command and legitimation of the capitalist order. Using the Michel Foucault’s concept of power we conceived the exercise of managerial power as a political technology whose instrumental rationality is grounded in systems of power-knowledge, which, in our survey, are represented by programs management and total quality. From the concept of malaise by Freud, we discuss the link with the subject's culture and methods of social ties in intersubjective relations work. We identified that the instrumental rationality in the postmodern work, under the sign of managerial power, favors perverse arrangements in labor relations. The individualization intensifies and brings about the weakening of collective ties, while the logic of privatization spreads by reducing the public space and devalues the role of politics in the construction of social ties. From the appointment of the decline in the public sphere in this work of Hannah Arendt, and the use of the concept of constituent power in Antonio Negri’s work, we pointed out the intimate link between power and politics and its importance in the exercise of a power that challenges the dominant order, produce disruption and laceration points where the subjects' desire can operate as a resistance to established power. Taking the concept of utopia in his iconoclast shed, we discussed the importance of the utopian function not only in the exercise of power and desire in labor relations, but also as an ethical necessity in the quest for another world from the criticism of this one.
