In Brazil, it was recently approved by the National Congress the so-called "law of outsourcing," which in practice defines more flexible rules for organizations to outsource their core activity – something that used to be prohibited. This flexibility can lead organizations to obtain competitive advantage due to the costs associated with the outsourcing tending to be lower. However, there are issues relating to the products quality and services that must be taken when the decision is taken by managers. The outsourcing decision is still less explored in the academic environment. The majority of studies related to decision-making tend to analyze institutional and cognitive issues differently. However, there are few studies correlating the two areas, when taking into consideration the behavioral aspects of the individual and the institutional structure of their organizations. The present research aims to validate a research instrument that aims to measure the institutional and behavioral variables that influence outsourcing decision. A survey was performed through a questionnaire composed of 75 questions capable of measuring five major constructs: locus of control, monitoring practices, bandwagon effect for outsourcing, cost and quality dynamics and perception of cost and quality mandate. The instrument was created by Ph.D. David Caleb Hall from Wright State University in the United States. A sample of 204 respondents was collected. Statistical tests were performed to validate the scale, among them, convergent validity tests such as the confirmatory factor analysis (CFA), composite reliability (CR), Cronbach's alpha (CA), average variance extracted (AVE). Also, tests were performed to check the discriminant validity. The general results partially achieved the goal of this work. More than 50% of the questions had to be eliminated, as a result of sampling error, little experience of the participants in the situations described, problems in understanding of the issues, institutional issues, and personality trait of the respondents. 2	Civil Society and Democratic Ideas : A Case Study Based on Sweden’s Young-Muslims, A Court-Verdict Mohamed, Ifrah-Degmo January 2018 (has links) Abstract This thesis explores the role of civil society organizations and the democratic participation of minority groups in Sweden. It is based on an analysis and interpretation of a major court decision that denied government support (MUCF) for a Muslim Youth organization (SUM) in 2016. Based on case study methodology and a close reading of court documents and related reports, the analysis of the empirical material identified nine themes of democratic participation and democratic principles, including: integration, discrimination, multicultural society/diversity, Muslims, Islamism/Muslim brotherhoods in Sweden, human rights. The analysis shows, how the Muslim Youth organization was both included in the democratic process but also excluded. I argue that their exclusion is based on ethnic boundary making processes which construct Muslims as essentially different from the rest of society. The thesis suggests that this exclusion could damage the integration processes of ethnic and religious minorities in Sweden. 3	La responsabilité des centres d'arbitrage / The liability of arbitral instituions Elatafy, Sherif 23 May 2016 (has links) Les litigants sollicitent les centres d’arbitrage pour diriger l’arbitrage dans toutes ses phases afin de donner une garantie supplémentaire qui assure la validité de la sentence arbitrale. Compte tenu du rôle important que les centres d’arbitrage jouent pendant l’instance arbitrale, les litigants mécontents de la sentence arbitrale ou du jugement annulant la sentence tentent d’engager la responsabilité du centre d’arbitrage dès lors qu’il a surveillé, dirigé et participé au rendu de la sentence.De plus en plus la responsabilité des centres d’arbitrage est mise en cause devant les juridictions étatiques différentes, les fonctions et les pouvoirs exercés par les centres d’arbitrage ainsi que le régime de responsabilité leur est applicable font l’objet d’une attention critique de la part de la doctrine dans plusieurs systèmes juridiques. On s’interroge sur l’origine des rapports qui lient les centres d’arbitrage aux autres acteurs de l’arbitrage, sur les obligations et les pouvoirs conférés aux centres d’arbitrage, et sur les fonctions exercées par les centres d’arbitrage pour établir enfin un régime de responsabilité homogène et pertinent à l’égard des fonctions exercées par les centres d’arbitrage qui a une vocation à s’appliquer dans la majorité des systèmes juridiques / Parties to arbitration seek arbitral institutions to administrate their arbitration in order to have an extra guarantee that ensures the validity of the arbitral award. Given the role that arbitral institutions play during the arbitral procedure, parties unsatisfied either by the arbitral award or the annulment of the award tend to claim the liability of arbitral institution for the awards it had supervised, administered and participated in.The more the allegations of liability raise against the arbitral institutions before courts, the more the issue of arbitral institutions’ functions, powers and liability becomes controversial in different jurisdictions. Therefore, the present study tends to clarify the origin of the relationship existing between arbitral institutions and other parties involved in the arbitration at issue, the duties and powers assigned to the arbitral institutions and the functions performed by the arbitral intuitions, which helps eventually in establishing a kind of liability that complies with the functions performed by the arbitral institutions and can be applied in many jurisdictions.
