Do geographical indications promote sustainable rural development? : two UK case studies and implications for New Zealand rural development policyWilliams, Rachael M. January 2007 (has links)
Geographical indications (GIs) are one form of protective labelling used to indicate the origin of food and alcohol products. The role of protected geographical indicators as a promising sustainable rural development tool is the basis for this research. The protection of geographical indications is a rather controversial subject and much research is still required for both sides of the debate. The research method employed for this study is qualitative critical social science. Two Case studies are used to investigate the benefits brought to rural areas through the protection of GIs. The case studies include the GIs Jersey Royal and Welsh Lamb both from the United Kingdom a member of the European Union (the EU is in favour of extended protection of GIs for all agro-food products under the 1994 WTO/TRIPS agreement on geographical indications). Twenty-five indepth interviews were conducted for this study the duration of the interviews was approximately one hour. The study identifies predominantly indirect links between GIs and sustainable rural development, through economic and social benefits bought to rural areas by the GIs investigated - less of a connection was found to ecological elements. No considerable cost for GI protection was discovered. This finding suggests that GIs are worthwhile for implementation in New Zealand as a rural development tool.

The benefits and barriers to GIS for MāoriPacey, H. A. January 2005 (has links)
A Geographic Information System visually communicates both spatial and temporal analyses and has been available for at least twenty years in New Zealand. Using a Kaupapa Māori Research framework, this research investigates the benefits and barriers for Māori if they were to adopt GIS to assist their development outcomes. Internationally, indigenous peoples who have adopted GIS have reported they have derived significant cultural development benefits, including the preservation and continuity of traditional knowledge and culture. As Māori development continues to expand in an increasing array of corporate, scientific, management and cultural arenas, the level of intensity required to keep abreast of developments has also expanded. GIS has been used by some roopū to assist their contemporary Māori development opportunities; has been suggested as a cost effective method for spatial research for Waitangi Tribunal claims; has supported and facilitated complex textual and oral evidence, and has also been used to assist negotiation and empowerment at both central and local government level. While many successful uses are attributed to GIS projects, there are also precautionary calls made from practitioners regarding the obstacles they have encountered. Overall, whilst traditional knowledge and contemporary technology has been beneficially fused together, in some instances hidden or unforeseen consequences have impeded or imperilled seamless uptake of this new technology. Challenges to the establishment of a GIS range from the theoretical (mapping cultural heritage) to the practical (access to data) to the pragmatic (costs and resources). The multiple issues inherent in mapping cultural heritage, indigenous cartography and, in particular, the current lack of intellectual property rights protection measures, are also potential barriers to successful, long-term integration of GIS into the tribal development matrix. The key impediments to GIS establishment identified by surveyed roopū were lack of information and human resources, and prioritisation over more critical factors affecting tangata whenua. Respondents also indicated they would utilise GIS if the infrastructure was in place and the cost of establishment decreased. Given the large amount of resources to be invested into GIS, and the opportunity to establish safe practices to ensure continuity of the GIS, it is prudent to make informed decisions prior to investment. As an applied piece of Kaupapa Māori research, a tangible outcome in the form of an establishment Guide is presented. Written in a deliberately novice-friendly manner, the Guide traverses fundamental issues surrounding the establishment of a GIS including investment costs and establishment processes.

This thesis discusses the global regime complex concerning the management of plant genetic resources for food and agriculture, and how different regimes concerning these resources cooperate or stand in opposition to each other. Because of changes in US patent law and the establishment of TRIPS, patent claims over plant genetic resources has increased dramatically globally. This, amongst other things, in turn has lead to the development of CBD which in turn lead to the creation of access and benefit laws in many countries. To create a free flow of genetic resources for food and agriculture the ITPGRFA, with its multilateral system, were negotiated. The aim of this thesis is to investigate which consequences the regime complex concerning plant genetic resources for food and agriculture can have on the rights of small farmers, agricultural research and food security in the global South. The thesis shows how patents and strict access laws creates a situation where more and more actors has exclusive rights which excludes others from using these, for the global food security, essential resources. Further it is shown that there also are processes going on within the UPOV that risk to take away farmers right to save seeds, and thereby make them dependent on the more and more monopolistic global seed markets dominated by a few multinational corporations. It is established that ITPGRFAs multilateral system is an opening in this hyperownership of plant genetic resources for food and agriculture; but that the international community at the same time has to see to that the patent claims on plant genetic resources not violate farmers’ rights to their resources. / Denna uppsats behandlar det globala regimkomplexet för förvaltningen av växtgenetiska resurser för livsmedel och jordbruk, samt hur avtalen rörande dessa resurser samverkar eller står i motsättning till varandra. I och med förändringar i amerikansk patentlagstiftning och upprättandet av TRIPS har patentanspråk på växtgenetiska resurser ökat dramatiskt, vilket i sin tur påverkade tillkomsten av CBD vilken innefattar upprättandet av lagstiftning rörande tillträde till och den rättvisa fördelningen av nyttor härstammande från, genetiska resurser. För att möjliggöra ett relativt fritt flöde av växtgenetiska resurser har ITPGRFA med dess multilaterala system fram förhandlats. Syftet med denna uppsats är att undersöka vilka konsekvenser den nuvarande globala förvaltningen av växtgenetiska resurser för livsmedel och jordbruk kan få för jordbruksforskning, småbönders rättigheter och matsäkerhet i Syd. Uppsatsen visar på hur patent och tillträdeslagstiftningar skapar en situation där fler och fler parter innehar rättigheter att utestänga andra från att nyttja dessa, för den globala matsäkerheten, essentiella resurser. Vidare visas på hur det samtidigt pågår processer inom UPOV som riskerar att undanta bönder rätten att spara utsäde och därmed göra dem beroende av de i allt högre grad monopolartade frömarknaderna, vilka domineras av att fåtal multinationella företag. Här konstateras även att ITPGRFAs multilaterala system är en öppning i detta hyperägande, men att det internationella samfundet samtidigt måste försäkra att patentanspråk inte kränker bönders rättigheter till sina resurser.

「設計」應該是一種創造高附加價值的觀念,不過很可惜的是,在台灣的環境之下,很多的設計業者卻不得不和現實妥協、低頭,放棄當初投入設計的理想和初衷,來從事設計代工或接單(B TO B)等高度競爭的工作,儘管台灣的設計,在國際比賽中,贏得非常多的大獎,擁有很強的設計能力,和受到國際高度的肯定。不過,設計業者在環境的限制之下,仍然沒有辦法利用「設計」來創作高附加價值的作品,或賺取超額的收益及名聲。以拿下美國2009年Gen Art時裝大獎的設計師古又文曾經感慨得說:「我是被台灣這個產業,逼著我一定得出走,因為在這個環境中,如果我想要做我自己,想要做一個有創意,而不是拷貝人家創意的設計師,那幾乎是不可能的 。」
台灣的設計產業究竟出了什麼問題?智慧財產權的制度,又扮演著什麼樣的角色呢?本研究將從設計產業、智慧財產權以及集體管理組織的概念,來討論台灣設計產業所遭遇到的問題與困難,並試圖找尋出一個解決的方案。
在經過一連串的分析以及資料的統整之後,本研究認為台灣設計產業最大的問題有3項,第一,台灣的設計產業以中小型企業為主,競爭激烈,缺乏資金和資源,也無力拓展海外市場和經營品牌;第二,在台灣的設計產業之中,創新的價值,很難轉換到品牌或者商標之上,因此消費者不易分辨原創作品與仿冒商品之差異;第三,市場上缺乏穩健而且可靠的通路系統,設計業者很難將創作商品,在市場上換取收益,並獲得充足的資金來支持其後續的開發和創作。
本研究提出「設計品牌經紀商」的概念,希望能夠解決目前設計產業面臨的交易成本過高,以及中小型設計業者面臨「心有餘而力不足」的問題,如果依照智慧財產權整合的概念,這種類似集體管理團體的組織在達到一定的規模後,可以發揮類似保險公司分散風險的經濟模式,同時也具備了提高談判和議價能力,以及達到降低買賣雙方搜尋成本的好處。 / Design should be a concept of creating value added. However, in Taiwan, many designers are forced to compromise with the reality, doing high competitive jobs like B to B(business-to-business) instead of following their aspirations. Despite the fact that Taiwanese designers have won many international prizes and that their designing abilities have been highly recognized in the world, they are still unable to use “design” to create high value added works, make profits, and gain popularity out of it. Ku Yu-Wen, the designer who won the 2009 Gen Art Prize in the U.S., once said, “I was forced to leave because of this industry in Taiwan. In this environment, it’s almost impossible to be myself, be a creative designer who doesn’t copy.”
What problems are we facing in Taiwan’s design industry? What role should the IP policy take? In this research, we will go through the concepts of design industry, intellectual property and collective management organizations, discuss the problems and difficulties faced in Taiwan, and work on a possible solution.
After a series of data analysis, the research concludes that Taiwan’s design industry are facing three main problems: First, Taiwan’s design industry is composed of small companies, which are constantly competitive, lack capital and resources, and are unable to expand markets oversea or invest in brand management. Second, in Taiwan’s design industry, it’s difficult to transfer the value of innovation into the brand or the trade mark; therefore, customers are often unable to distinguish the genuine products from the couterfeits. Third, the market lacks stable and reliable marketing channels. It’s difficult for designers to make profits from their works and gain sufficient capital to support their following works.
To solve these problems, the research proposes the concept of “designer brands broker” in hopes of lowering the transaction cost and helping those willing but unable designers. Like the integration of intellectual property, when reaching a certain scale, this kind of collective management organizations can help to diversification risk like an insurance company. Furthermore, it can help to increase designers’ negotiating ability and decrease the search cost for both the seller and the buyer.

Thesis (MA)--University of Stellenbosch, 2002. / ENGLISH ABSTRACT: In October 1999 South Africa and the European Union (EU) signed a free
trade agreement, the Trade Development and Co-operation Agreement
(TDCA), which came into effect on 1 January 2000. The TDCA was
developed to enhance bilateral trade, economic-, political- and social cooperation
and consists of three components - the creation of a Free Trade
Area between South-Africa and the EU, EU financial aid to South Africa
through the European Programme for Reconstruction and Development
(EPRD), and project aid. However, the EU, in an effort to secure the best
possible deal for itself, often behave in its own interests (through the
manipulation of the Wine and Spirits Agreement) during the negotiations for
the TDCA.
The goal of this study was to establish what exactly trademarks are, and what
implications the EU's protection of intellectual property rights on wine and
spirits trademarks will have on i) the South African wine industry, ii) whether
South Africa could have exercised another option, iii) whether this action has
created a precedent with which the EU can, in future, again force South Africa
or any of its other developing trade partners to make concessions, and iv)
who gains the most from the TDCA.
The concludes that the EU, through the manipulation of the Wine and Spirits
Agreement, left South Africa with no choice by to concede the use of the
contested trademarks - something that has already taken its toll on the South
African wine industry - in order to save the TDCA. This action created a
precedent that the EU will, in future, again be in a position to threaten
developing countries with the termination of an agreement should they fail to
comply with its demands. Finally, the conclusion is made that even though the
TDCA was created to assist South Africa with its reintegration into the world
market, it will ultimately be the EU that benefits most from the agreement. / AFRIKAANSE OPSOMMING: Suid-Afrika en die Europese Unie (EU) het in Oktober 1999 In
vryehandelsooreenkoms, die Trade Development and Co-operation

The dissertation consists of three empirical papers in institutional microeconomics. The first paper examines the role of institutional quality in international trade, the second paper focuses on unintended consequences of intellectual property rights for social welfare, and the last one addresses the impact of banking on corporate financing and investment. An introductory chapter puts these three papers into perspective. In the first paper I analyze the role of institutions in price dispersion among cities in the European region in the 1996-2009 period. Using a number of institutional quality measures I find that the better the institutions, the lower the predicted dispersion. The result is robust to different specifications of the regression model and is consistent with a hypothesis that arbitrage, as an entrepreneurial activity and the main power behind the law of one price, is influenced by institutional quality. In the second paper I use a large data set of U.S. patents applied for between 1980 and 2007 by 22 large technology companies to study development of strategic patenting over time and across industries. Using two complementary methods I reveal strong evidence against the hypothesis of more strategic patenting after 1995. Contrary to the expectations, aerospace patents appear to be on average...

The compliance with intellectual property laws and their enforcement in Jordan : a post-WTO review & analysisNesheiwat, Ferris K. January 2012 (has links)
This thesis examines the implementation, enforcement and evolution of IP laws and regulations in the Hashemite Kingdom of Jordan. The period of interest includes the last decade of the twentieth century and the first decade of the twenty first century, with emphasis on the role played by Free Trade Agreements struck between Jordan and the United States, the European Union, and Jordan’s accession to the World Trade Organization. This thesis also examines the enforcement of the current set of IP laws in Jordan, and looks at their social and economic compatibility with the Jordanian societal norms and economic realities. This thesis argues that Jordanian IP laws lack a meaningful social and economic texture, and have failed to be evenly enforced in Jordan, essentially because they do not fit the Jordanian culture and are not compatible with Jordan’s economic stage of development. Additionally, the thesis argues that IP laws have had insignificant economic impact on the Jordanian economy as the majority of technologies used in Jordan, and the majority of foreign direct investments attracted to Jordan, are not IP related. Finally, the thesis argues that the current Jordanian enforcement model, which is built on coercion by donor countries, is serving the interests of foreign companies to the exclusion of the local citizens, and will not, in the long run, produce an enforcement model based on self-regulation by Jordanians, themselves. The laws, therefore, are unable to produce tangible results for the Jordanian people, or help meet their economic interests. The last part of the thesis deals with recommendations and suggestions aimed at creating an integrated approach to the adoption of IP policies.

"The implementation of the TRIPS Agreement, within the wider context of globalisation, has brought about a conflict between the obligation of states to promote and protect health and the achievement of economic goals pursued under the WTO regime. Since trade is the driving engine of globalisation, it is imperative that, at the very least, rules governing it do not violate human rights but rather promote them. The problem of IP and the right to health therefore lies in ensuring that the integration of economic rules and institutional operations in relation to IPRs coincide with states’ obligations to promote and protect public health. ...
This study centres on the specific debate about health and IPRs in the context of the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the WTO rules on IP protection. In terms of a human rights approach to the TRIPS Agreement, the ICESCR has been chosen for several reasons. First, the ICESCR specifically recognises both the right to health and the right to the protection of inventions in clearer terms than any other human rights instrument. Secondly, at least 111 of the state parties to the ICESCR are also members of the WTO including a large number of developing countries. Thirdly, if one sees the ICESCR as a vehicle for the fulfilment of the obligation to promote and protect human rights under the United Nations Organisation’s (UN) Charter, it can be argued that in line with article 103, the implementation and interpretation of TRIPS by all UN members states must take into account basic human rights. However, even with primary focus being on the ICESCR, most of the discussion on practical issues will focus on the experiences in Sub-Saharan Africa because the inequalities and problems of access to health care are most dramatically played out in this part of the world.

Access to medicines under the World Trade Organisation TRIPS Agreement : a comparative study of select SADC countriesNdlovu, Lonias 14 October 2014 (has links)
Despite the adoption of the Doha Declaration on the TRIPS Agreement and Public Health in 2001, which unequivocally affirmed WTO members’ rights to use compulsory licences and other TRIPS flexibilities to access medicines, thirteen years on, developing countries and least developed countries are still grappling with access to medicines issues and a high disease burden. Despite some well researched and eloquent arguments to the contrary, it is a trite fact that patents remain an impediment to access to medicines by encouraging monopoly prices. The WTO TRIPS Agreement gives members room to legislate in a manner that is sympathetic to access to affordable medicines by providing for exceptions to patentability and the use of patents without the authorisation of the patent holder (TRIPS flexibilities).
This study focuses on access to medicines under the TRIPS Agreement from a SADC comparative perspective by interrogating the extent of the domestication of TRIPS provisions promoting access to medicines in the SADC region with specific reference to Botswana, South Africa and Zimbabwe. After establishing that all SADC members, including Seychelles which is yet to be a WTO member have intellectual property (IP) laws in their statute books, this study confirms that while most of the IP provisions may be used to override patents, they are currently not being used by SADC members due to non-IP reasons such as lack of knowledge and political will. The study also engages in comparative discussions of topical occurrences in the context of access to medicines litigation in India, Thailand and Kenya and extracts useful thematic lessons for the SADC region. The study’s overall approach is to extract useful lessons for regional access to medicines from the good experiences of SADC members and other developing country jurisdictions in the context of a south-south bias.
The study draws conclusions and recommendations which if implemented will in all likelihood lead to improved access to medicines for SADC citizens, while at the same time respecting the sanctity of patent rights. The study recommends the adoption of a rights-based approach, which will ultimately elevate patient rights over patent rights and urges the region to consider using its LDCs status to issue compulsory licences in the context of TRIPS Article 31 bis while exploring the possibility of local pharmaceutical manufacturing to produce generics, inspired by the experiences of Zimbabwe and current goings on in Mozambique and the use of pooled procurement for the region. The study embraces the rewards theory of patents which should be used to spur innovation and research into diseases of the poor in the SADC region. Civil society activity in the region is also identified as a potential vehicle to drive the move towards access to affordable medicines for all in the SADC region. / Mercantile Law / LL.D.
