[pt] O objetivo desse trabalho é refletir sobre o lugar do psicólogo nas práticas restaurativas da Justiça a partir das perspectivas das descobertas da neurociência, especialmente a teoria polivagal de sutorregulação do sistema nervoso autônomo (SNA), elaborada pelo neurocientista Stephen Porges. Especificamente, o trabalho pretende avaliar em que medida a teoria polivagal explica os bons resultados dos processos restaurativos da Justiça Restaurativa de Porto Alegre com adolescentes em conflito com a lei. A teoria polivagal apresenta uma nova psicofisiologia dos comportamentos violentos e desafia a psicologia a criar novas abordagens de reparação de danos e prevenção da violência. A idéia é avaliar a possível contribuição que a psicologia poderia oferecer aos novos paradigmas de resolução de conflitos da Justiça e da cultura da paz. / [en] The aim of this work is to reflect on the place of the psychologist in restorative practices of Justice from the perspectives of the discoveries of neuroscience, especially the theory of polivagal sub regulation of autonomic nervous system (ANS), developed by neuroscientist Stephen Porges. Specifically, the study aims to evaluate the extent the theory polivagal explains the goods results of the restorative process of Restorative Justice in Porto Alegre with adolescents in conflict with the law. The theory polivagal presents psychophysiology of violent behavior and challenges the psychology to create new approaches to repair of damage and violence prevention. The whole idea is to evaluate the possible contribution that psychology could offer to new paradigms of resolution of the conflicts of Justice and the culture of peace.

This work attempts to the comprehension the of transformation possibilities in the adolescent author of infracional acts social laces who has experienced the practical of Restorative Justice. The inquiry of this subject is important to enable and to subsidize the work with adolescents, and to question and dicuss the binomial adolescence-violence. This is a practical work where the psychoanalys was used as subsidy for conception of adolescence and analysis of the interviews. The analysis was made from the psychoanalytic listenings of the attests and interviews, and it was made through the speeches that produce and reveal social laces. It was observed inside the Restorative Justice proposal the importance of the adolescent as not the only depositary of some many ways of the conflicts causes and solutions . Another consideration is that the structure in which he is inserted creats a coherent that contributes for the resolution and prevention of conflicts and infractional acts. The social laces the adolescent establishes is changeable and this different constitution of laces allude to the speech individual speech and social speech. The possibility of the word circulation brought from listening is essential, since it contains the transformation possibility of the social laces established by the adolescent / Justiça Restaurativa e o adolescente autor de ato infracional combinamse, nesta dissertação, de forma levantar elementos para compreender qual é a concepção do adolescente autor de ato infracional acerca do círculo restaurativo (enquanto prática da justiça restaurativa), o que esta experiência provocou no adolescente, bem como de que forma se deu a implicação pessoal do adolescente neste processo. Procurou-se compreender quais são as possibilidades de transformação no laço social do adolescente autor de ato infracional que experiencia a prática da Justiça Restaurativa. A investigação deste tema é importante para capacitar e subsidiar o trabalho com adolescentes, e para questionar/problematizar o binômio adolescênciaviolência. Este é um trabalho prático em que a psicanálise foi utilizada como subsídio para concepção de adolescência e para análise das entrevistas. A partir da escuta psicanalítica de depoimentos e entrevistas, a análise foi feita através dos discursos, que produzem e revelam formas de laços sociais. Dentro da proposta da justiça restaurativa, percebeu-se como imprescindível que o adolescente não seja o depositário único tanto das causas quanto das soluções dos conflitos e que a estrutura na qual ele está inserido forme um todo coerente que contribua para a resolução e prevenção de conflitos e atos infracionais. O laço social que o adolescente estabelece é mutável e as formas como este laço se dá estão referenciadas ao discurso discurso do sujeito e discurso social. In this research we have considered (acrescentei e mudei o tempo verbal) these practices inside the community of the city of São Caetano do Sul SP. Particularly, ponder about the place given to the youth and their participation in the restorative circle. The theoretical framework and the methodology is psychodrama, with a specific focus on the Theory of Roles and in the concepts of Social Role and Character. The research data refers to the monitoring of restorative circles and the interviews with facilitators, who lead the restorative circles. All the conflicts, that we accompanied, occurred in the school context. The data was processed through scenes or pieces of scenes, which took place in the actual context of the restorative circle or in the context in which the conflicts occurred. The social roles that are involved in the conflict are bound to stereotyped characters, which are attributed to young people. In the restorative circles these characters become evident and they make the dialogue between the parties involved difficult or impossible. Therefore, youth participation in restorative circles is compromised. Moreover, in most cases, it is impossible to change the relationships that is in conflict and experience a character less conserved / As práticas restaurativas são consideradas, em relação ao Sistema de Justiça Tradicional, uma nova alternativa para a resolução de conflitos e a restauração das relações que foram afetadas. Nesse trabalho investigamos estas práticas no contexto comunitário do município de São Caetano do Sul, SP, e, em específico, o lugar atribuído ao jovem e à sua participação no contexto do círculo restaurativo. O aporte teórico e metodológico é o Psicodrama, com foco na Teoria de Papéis e nos conceitos de Papel Social e Personagem. Os dados desta pesquisa referem-se ao acompanhamento dos círculos restaurativos e realização de entrevistas com facilitadores, que conduzem os círculos restaurativos. Todas as situações de conflito que acompanhamos ocorreram no contexto escolar. Os dados foram tratados por meio de cenas, ou passagens de cenas, ocorridas no próprio contexto do círculo restaurativo ou nos contextos onde ocorreram e se desdobraram os conflitos. Os papéis sociais que identificamos no contexto do conflito são vinculados a Personagens estereotipados, que são atribuídos aos jovens. Nos círculos restaurativos, esses Personagens se evidenciam e dificultam ou impossibilitam o diálogo entre as partes do conflito. Dessa forma, a participação dos jovens nos círculos restaurativos é comprometida e, na maioria dos casos, compromete, também, a mudança da relação que está em conflito e a vivência de Personagens menos conservado

[pt] O presente trabalho tem por objetivo analisar as potencialidades da justiça restaurativa no ordenamento jurídico brasileiro. Partindo do pressuposto de que o sistema criminal está em crise de legitimidade, pelo foco na manutenção do viés punitivo-repressivo e pelo discurso deste paradigma. Neste sentido, indaga-se se a proposta restaurativa pode representar um caminho mais humanizador e apto à resolução de conflitos na seara criminal. Para tanto, buscou-se inicialmente, entender a crise do sistema penal, para posteriormente, desvendar as origens do paradigma restaurativo, como movimento internacional, comparando-o na oportunidade, com o paradigma retributivo. Buscou-se analisar ainda o surgimento da justiça restaurativa no ordenamento jurídico brasileiro, estabelecendo-se um panorama geral de aplicação, a fim de que fossem evidenciadas as condições de seu desenvolvimento. Por fim, demonstrou-se através de pesquisas viabilizadas pelo Conselho Nacional de Justiça, as particularidades dos projetos pioneiros de Justiça Restaurativa, bem como, verificou-se o estado da arte do movimento restaurativo no sistema judicial, com suas potencialidades e desafios na construção da brasilidade restaurativa, que demonstra um déficit democrático atrelado a uma cultura jurídica brasileira de expansionismo da rede de controle penal. / [en] The present work aims to analyze the potential of restorative justice in the Brazilian legal system. Assuming that the criminal system is in crisis of legitimacy, due to the focus on maintaining the punitive-repressive bias and the discourse of this paradigm. In this sense, it is questioned whether the restorative proposal can represent a more humanizing and apt path to conflict resolution in the criminal field. Therefore, we initially sought to understand the crisis of the penal system, and later, to unveil the origins of the restorative paradigm, as an international movement, comparing it at the opportunity, with the retributive paradigm. It was also sought to analyze the emergence of restorative justice in the Brazilian legal system, establishing an overview of its application, so that the conditions of its development were evidenced. Finally, it was demonstrated through research made possible by the National Council of Justice, the particularities of the pioneering projects of Restorative Justice, as well as, the state of the art of the restorative movement in the judicial system, with its potentialities and challenges in the construction of the restorative Brazilianity, which demonstrates a democratic deficit linked to a Brazilian legal culture of expansionism of the penal control network.
