Knowledge-sharing practices of legal professionals at the Gauteng justice centres of the legal aid board.

The purpose of the research was to investigate the knowledge-sharing practices of legal professionals at the Gauteng Justice Centres of the Legal Aid Board (LAB). The rationale for the study was based on the premise that since the LAB is a knowledge-intensive organization, it is well suited to the implementation of knowledge management. Any successful knowledge management implementation plan, is founded upon the knowledge-sharing culture of the organization, hence the motivation for the research. Self-administered questionnaires were used to survey the views of the legal professionals regarding their knowledge-sharing practices. Three hundred and twenty-five (325) questionnaires were distributed, of which 143 were returned. The data received was presented in the form of tables and figures. Percentages and content analysis was used to analyze the data collected. The findings from the survey revealed that while knowledge-sharing and knowledge management took place at the LAB, it was not guided by a strategy of the organization. The findings also revealed that the knowledge-sharing and knowledge management which did take place did so on an ad hoc basis and was woven into the daily activities of the respondents. The researcher drew conclusions based on the analysis of the data and in the context of related literature and proposed a way forward for the implementation of knowledge management and knowledge-sharing practices at the LAB. The researcher recommended that the LAB employ a knowledge officer, who should be responsible for driving the knowledge management process. A contextual study of the information literacy of aspirant barristers in Nigeria.

This study investigated the information literacy of aspirant barristers in Nigeria and examined the steps undertaken to restructure the legal education system in Nigeria. It explored the connection between contextual influences and professional development, particularly with respect to the concept of legal information literacy and the value of acquired educational skills in the context of legal practice in Nigeria. The theoretical framework that underpinned the study was derived from the application of Kuhlthau’s (1993) Information Search Process (ISP) and Byström’s (1999) theory of Information Activity in Work. Kuhlthau’s model was relevant for investigating issues of uncertainty in the information seeking behaviour of the aspirant barristers and further confirmed the empirical validity of the model in the educational and workplace contexts. Byström’s theory was also valuable in analysing problems of task complexity experienced by the aspirant barristers in information use. The study employed a case study method; the data collection process involved the administration of questionnaires to the aspirant barristers and law firms to which they were assigned for vocational training. A mixed method approach was used to provide complementary insights to the findings of the study. Key findings from the study were supportive of the importance of information literacy as being central to the development of professional competence of the aspirant barristers which can be achieved through re-structuring the teaching methods and curricula of the Nigerian Law School. Outcomes from the study also pointed to a need for greater collaboration between the legal education system and the legal profession in narrowing the gap between the teaching and practice of law in Nigeria. Collaboration with academic librarians and legal information specialists is also necessary with respect to the role that these two groups can play in the design and implementation of an information literacy framework for the legal education system in Nigeria. The study makes recommendations for the adoption and integration of information literacy as a conceptual framework into the curriculum of the Nigerian Law School. In this way skills training can be enhanced. A Q study of public relations professionals' and corporate attorneys' perception of each other

Archaeological fieldwork at the William Conner House Site, home of an early 19th century entrepreneur, was performed in 1990 by Ball State University. The house, listed in the National Register, was built in 1823, occupied until ca. 1916, restored in 1934, and has since functioned as a house museum. Although restoration disturbed portions of the site, substantial undisturbed remains were found to exist on-site. Archaeological testing yielded 26,000+ archaeological specimens and revealed 22 features, including a possible outbuilding, cobble walk, brick pad, fire pit, small refuse pit, and post holes/molds. Herein, the Conner House is described and the history of its usage is recounted. The archaeological research design and methods are explained. Results of investigation are presented. Socioeconomic status theory and indicators are identified, and the site is compared to other 19th century residential sites, socioeconomically. Conclusions are stated. Analyse des pratiques informationnelles dans le champ juridique au Bénin / Information behavior in law field

Comprendre, décrire et documenter les comportements informationnels des juristes béninois tant dans le champ académique que professionnel. C’est le principal objectif de cette thèse qui a choisi le positionnement des pratiques informationnelles en sciences de l’information notamment dans l’étude des usagers en contexte. Ce travail a mobilisé à la fois des études théoriques qu’empiriques. Quatre études théoriques ont été menées pour comprendre le contexte du droit et de la justice au Bénin, les évolutions induites par les technologies de l’information et de la communication (Tic) dans le secteur juridique et judiciaire, les pratiques informationnelles en termes de modèles et les théories spécifiques dans le champ du droit. Ces approches théoriques ont été confrontées à quatre études empiriques dont deux quantitatives et deux qualitatives. En ce qui concerne l’approche quantitative, 375 étudiants et 60 enseignants-chercheurs des facultés de droit des universités du Bénin ont été interrogés. Quant aux études qualitatives, elles sont faites d’entretiens semi-directifs à l’endroit de 35 magistrats des tribunaux et cours de la partie méridionale du pays et 15 avocats à Cotonou. Au terme de ces études, il est clair que les juristes béninois dans le cadre de leurs activités professionnelles recourent à l’information. Ils le font pour régler des problèmes juridiques. Ils se réfèrent en premier lieu aux sources imprimées que sont les livres et ouvrages juridiques ; ensuite aux sources électroniques en l’occurrence Internet et enfin consultent leurs collègues, confères ou camarades. Les critères qui gouvernent ces sources d’information sont d’abord l’accessibilité-disponibilité de l’information, la pertinence-utilité de l’information et le contenu de l’information. L’ensemble des juristes interrogés partagent l’information mais font face à plusieurs obstacles pour accéder à l’information. Au nombre de ces obstacles, on peut citer : le coût excessif de certains ouvrages juridiques, l’instabilité de l’énergie électrique, la coupure de la connexion à Internet, la vétusté de certains documents. / Understand, describe and document the information behavior of beninese lawyers in both the academic and professional fields. It is the main objective of this thesis that has chosen the positioning of informational practices in the information sciences especially in the study of users in context. This work has mobilized both theoretical and empirical studies. Four theoretical studies have been conducted to understand the legal and justice context in Benin, developments in information and communication technologies (TIC) in the legal and judicial sector, information practices in terms of models and the specific theories in the field of law. These theoretical approaches were confronted with four empirical studies, two quantitative and two qualitative. Regarding the quantitative approach, 375 students and 60 teacher-researchers from the law faculties of the universities of Benin were interviewed. As for qualitative studies, they are made up of semi-directive interviews with 35 magistrates of courts and courts in the southern part of the country and 15 lawyers in Cotonou. At the end of these studies, it is clear that Beninese lawyers in the course of their professional activities make use of information. They do it to solve legal problems. They refer in the first place to printed sources, namely books and legal works; Then to electronic sources, in this case the Internet, and finally consult their colleagues, confreres or comrades. The criteria governing these sources of information are primarily the accessibility-availability of information, the relevance-usefulness of information and the content of information. All lawyers surveyed share information but face several barriers to accessing information. Examples of such obstacles include the excessive cost of certain legal works, the instability of electric power, the breakdown of the Internet connection, the obsolete nature of certain documents.

Entre o direito e a política : a trajetória de advogados e a causa dos direitos humanos (Rio Grande do Sul/1964-1982)

A pesquisa busca analisar a trajetória dos advogados gaúchos Eloar Guazzelli, Werner Becker e Omar Ferri durante a ditadura civil-militar brasileira relacionando-as com a emergência da causa dos direitos humanos. Estes advogados ficaram reconhecidos pela sua atuação na defesa de presos políticos e por suas atividades como criminalistas. Devido ao seu trabalho, durante a ditadura eles surgiram no espaço público denunciando e atacando as violências e o arbítrio cometidos pelo Estado, o que fez com que eles ganhassem notoriedade na cena política, relacionando sua atuação com a causa dos direitos humanos. Este reconhecimento levou-os a iniciarem uma carreira política e candidatarem-se a cargos eletivos, o que aconteceu na eleição de 1982: Guazzelli e Ferri lançaram candidatura à deputado federal e Becker à vereador em Porto Alegre. Isto foi auxiliado pela atuação destes advogados dentro de entidades classistas, como o Instituto dos Advogados do Rio Grande do Sul (IARGS) e a seccional gaúcha da Ordem dos Advogados do Brasil (OAB/RS), que, ao longo da ditadura, passaram a criticar publicamente o regime. Desta forma, o trabalho procura mostrar os diferentes meios nos quais os personagens transitaram com o intuito de reconstruir o processo no qual conquistaram seu reconhecimento como advogados e militantes de esquerda. / The research seeks to analyze the trajectory of the lawyers Eloar Guazzelli, Werner Becker and Omar Ferri during the Brazilian civil-military dictatorship, relating them to the emergence of the cause of human rights. These lawyers were recognized for their role in the defense of political prisoners and for their activities as criminalists. Due to their work, during the dictatorship they appeared in the public scene denouncing and attacking the violence and arbitration committed by the State, which caused them to gain notoriety in the political scene, relating their action to the cause of human rights. This recognition led them to start a political career and to stand for elected positions, which happened in the 1982 election: Guazzelli and Ferri launched candidacy for the federal deputy and Becker to the councilor in Porto Alegre. This was aided by the work of these lawyers within class entities, such as the Rio Grande do Sul Lawyers Institute (IARGS) and the Rio Grande do Sul branch of the Brazilian Bar Association (OAB / RS), which, throughout the dictatorship, publicly criticize the regime. In this way, the research tries to show the different means in which the characters have transited with the intention to reconstruct the process in which they have gained their recognition as advocates and militants of the left.

Essa querela também teve seus reflexos na Província do Espírito Santo, tendo esta, como objeto de investigação. No fim dos anos de 1860, o movimento emancipacionista começava a ser delineado pelas elites política e intelectual a nível nacional e local. No ano de 1867, a Fala do Trono trouxe à tona questões significativas a respeito do problema servil e os possíveis caminhos a serem seguidos a favor da libertação dos escravos. As décadas de 1870 e 1880 foram períodos de intenso debate acerca da campanha emancipacionista e abolicionista brasileira. Especialmente na década de 1870 com a promulgação da Lei do Ventre Livre em 1871 teve-se um número significativo de ações de arbitramento de escravos na Província do Espírito Santo, especialmente na cidade da Vitória e em suas freguesias. O intento deste trabalho é identificar como ocorreu o desenrolar do processo emancipacionista na Província do Espírito Santo, a partir do entendimento da cultura política daquela sociedade, tendo como fonte de estudo os debates proferidos no espaço da Assembleia legislativa provincial, concomitante às ações de liberdade de escravos e dois importantes periódicos: O Jornal da Victoria e A Província do Espírito Santo, pois, seus redatores e proprietários permeavam os espaços políticos e intelectuais da cidade de Vitória Oitocentista. Têm-se como marcos temporal os anos de 1869 a 1888, pois, aquele ano foi promulgada a primeira lei provincial de caráter emancipador e o último marco refere-se a extinção plena e total de uma das instituições mais duradouras na História do Brasil. / Several debates about the servile issue were seen during the nineteenth century. This squabble was also reflected in the Espírito Santo province, having this as object of investigation. By the end of the years 1860 the emancipacionist movement started to be sketchy by the political and intelectual elites at nacional and local levels. In the year of 1867 the Speech from the Throne brought up significant questions about the servile problem and the possible ways to be taken in favor of the slaves freedom. The decades of 1860 and 1870 were periods of intense debate towards the emancipacionist and abolitionist Brazilian campaign. Especially in the decade of 1870, with the promulgation of the Ventre Livre law in 1871, there was a significant number of slave arbitration lawsuits in the Espírito Santo province, especially in the city of Vitória and its parishes. The intent of this research is to identify how the emancipationist process development in the Espírito Santo province happened from the understanding of the political culture of that society, having as study sources the debates pronounced in the space of the Provincial Chamber, concomitant to the slaves freedom lawsuits and two important periodicals: O Jornal de Vitória and A Província do Espírito Santo, because their editors and owners permeated the political and intelectual spaces of the nineteenth Vitória City. The period from 1869 to 1888 was considered as timeframe, mainly because in 1869 the first provincial law of emancipatory feature was promulgated, and the last mark refers to the plain and total extinction of one of the longer lasting institutions in the History of Brazil.

Para os advogados, em especial, a informação, tanto jurídica quanto de outras áreas do conhecimento, é um recurso imprescindível. Diante do exposto, objetivou-se em âmbito mais geral: identificar as características do comportamento informacional de advogados relacionadas ao desenvolvimento de suas atividades de trabalho. Em um contexto mais específico, objetivouse: a) verificar as fontes de informação utilizadas pelos advogados para identificar e obter informação; b) identificar as fontes de informação utilizadas pelos advogados; c) determinar os fatores positivos e negativos que influenciam o comportamento de busca de informação dos advogados. Para tanto, foi analisada uma amostra composta por 10 advogados que atuam na cidade de Marília e região, os quais totalizam, aproximadamente, 1000 profissionais. A coleta de dados foi realizada por meio de entrevista semi-estruturada e os dados coletados foram analisados qualitativamente. Os resultados demonstraram que as fontes de informação mais utilizadas para identificar informação são os livros; a fonte de informação mais utilizada para obter informação é o contato com colegas de profissão (conversa informal para troca de informações) e com profissionais de outras áreas; dentre as fontes de informação disponíveis em seus escritórios, a Internet é a mais utilizada e considerada a mais importante; as fontes formais de informação (Internet e livros) são as mais utilizadas para localizar informação; a maioria sente dificuldade para localizar e ter acesso à informação, principalmente quando se depara com algum assunto inovador ou desafiador; pedir auxílio nas... / In the present globalized society, which is in constantly changing, updated and reliable information access is essentially important to several professionals who need such input to be successful in their activities. Especially for lawyers, information, both legal and from other areas of knowledge is an essential resource. In this sense, it is intended in a general scope: to identify the informational behavior characteristics of lawyers related to their daily work. In a more specific context, the goals were: a) verify the sources of information used by lawyers to identify and obtain information; b) identify the sources of information used by lawyers; c) determine the positive and negative aspects that influence the informational behavior of lawyers. For such, a sample made of 10 lawyers who work in Marília and the nearby area was analyzed, representing a total of approximately 1,000 professionals. The data collection was carried out by a semi-structured interview and the collected data were qualitatively analyzed. Results show that the most common mechanism to obtain information is the coworker contact (informal chat for information exchange), and with professionals from other areas; among the sources of information available in their offices, the Internet is the most popular and considered the most important; the formal sources of information (the Internet and books) are the most used; most of the professionals have difficulty to find and access information, mainly when they come across some innovative or challenging subject; ask for help in the activities of information seeking is a very common practice to most of them; several aspects may influence informational behavior, but the one that is positive with the greatest influence is related to people (family and office coworkers).
