L'association des avocats de la République populaire de Chine : une approche comparative au regard du droit français / Lawyers' association in People's Republic of China : a comparative study with special reference to the French law

En Chine, une communauté de juristes est en train d'éclore. Celle-ci commence à exercer une influence sur la « conscience juridique » de la société. Or, à la différence de leurs confrères français, les avocats chinois ne possèdent pas encore suffisamment le sentiment d'appartenance à leur corps. Leurs associations ne sont pas autonomes. Si la profession s'est beaucoup inspirée des expériences des pays « déontologiquement plus développés », des principes fondamentaux de la profession ne sont pas enracinés dans l'esprit collectif des avocats. En tant que profession libérale, la profession d'avocat éprouve un besoin inhérent de l'autonomie. Sans cette autonomie, elle ne pourra pas faire entendre sa voix par le public, ni protéger ses membres. De même, les activités des avocats ne pourront être surveillées de manière équitable par une institution ordinale muselée par les pouvoirs publics. L'autonomie de l'association des avocats, que ce soit en Chine ou en France, s'avère être une garantie pour la justice et le justiciable. Cette autonomie ne constitue pas une fin en soi. Elle n'est que le meilleur moyen d'assurer l'indépendance de l'avocat. L'essentiel de l'autonomie de la profession s'explique par sa mise en œuvre dans l'exercice professionnel des avocats. « À l'ongle on connaît le lion ». Cette étude comparative semble pouvoir révéler, au moins en une certaine mesure, le véritable paysage du fonctionnement de la justice, et aider à mieux comprendre la distance qui sépare la République populaire de Chine d'un « État de droit » au sens moderne. / In China, a lawyers' community is being formed. It begins to influence the "legal conscience" of the society. However, unlike their French colleagues, Chinese lawyers do not have yet enough sense of belonging to a common professional group. Their associations are not autonomous. Although the profession is much inspired by the experiences of "ethically more developed" countries, the fundamental principles of the profession are not yet rooted in Chinese lawyers’ collective concept. As a liberal profession, lawyers are experiencing an inherent need for autonomy. Otherwise, they cannot make their voice heard by the public, nor protect their professional rights. Similarly, lawyers' activities cannot be fairly supervised by a professional institution dependent on the public power. The autonomy of lawyers' association, whether in China or in France, should be considered as a guarantee for justice and all persons subject to trial. The autonomy is not an end in itself. It is the best way to ensure the independence of the lawyer. The essence of lawyers' autonomy is explained by its implementation in lawyers’ professional activities. From his foot Hercules. Challenges to gender equality in the legal profession in South Africa : a case for putting gender on the transformation agenda

This study demonstrates the negative effect of stereotypes in the progression of women in the legal profession in South Africa and the laws, policies and measures that reinforce gender and sex stereotypes are discriminatory on the basis of gender and sex. This notwithstanding, it considers whether gender equality can be achieved where the measures adopted for gender transformation are premised on gender or sex stereotypes. The study analyses the Cape Bar Maternity Policy in concluding that this approach is justifiable and necessary to achieve substantive gender equality. In addition, this study provides recommendations for the legal profession to achieve substantive gender equality that include: special measures to ensure that the working environment is cognisant of the lived realities of women; requiring practitioners to confront their individual bias by holding them accountable for habits and attitudes that maintain gender inequality; and linking the career advancement of legal professionals to a demonstrable commitment to gender transformation. / Jurisprudence / LL. Mimosoudní řešení sporů (ADR) se zaměřením na mediaci / Alternative Dispute Resolution focusing on Mediation

This dissertation focuses in particular on a subject matter, that is relatively new in the Czech environment. It is mediation in civil (noncriminal) matters, governed by Act 202/2012 Coll. The author classifies it as one of the several methods of alternative dispute resolution. In the second part of her work she analyzes the med-arb method. In the third part of the dissertation, the author analyzes the mediation process itself, and specifically focuses on its legal aspects. The fourth part of the dissertation includes a comparative study of selected countries, in the field of civil law (Austria, Italy, Netherlands, Germany, France, Belgium, Slovakia) and the Anglo-Saxon law (UK). The fifth part of the dissertation analyzes the Czech legislation. The author suggests adjustments de lege ferenda as well as amendments that do not require any changes of the law, but that can be addressed through the interpretation of individual provisions. The author complements her work with a selection of foreign cases, as the Czech case law has been completely missing so far. The work ends with an analysis of the Code of Conduct for Lawyers-Mediators, which will be currently published for lawyers - registered mediators.

[pt] O acesso à justiça é uma preocupação constante dos juristas, em todo o mundo. No Brasil, a regra geral, com poucas exceções, é a necessidade da assistência de um advogado, na relação entre o litigante e o juiz. Este trabalho tem o objetivo de demonstrar que a atuação compulsória do advogado, no diálogo entre a parte e o Estado julgador, é indevida. Como método, foram utilizadas as técnicas de argumentação jurídica e de exame de proporcionalidade, propostas por Robert Alexy. Inicialmente, foram analisados a semântica das normas que fundamentariam tal imposição, a intenção do legislador, os antecedentes históricos, as exceções à regra, um sistema estrangeiro que não aceita tal imposição, os princípios jurídicos envolvidos no problema, as normas de direito constitucional, de direitos humanos, de direito internacional não-internalizado e de direito internacional internalizado, os conceitos já arraigados na dogmática processual brasileira, a jur isprudência, os dados estatísticos, os argumentos analógicos e razões de índole prática. Em um segundo momento, foram examinadas a legitimidade dos fins escolhidos pelo legislador, a necessidade da imposição do advogado, a adequação de tal medida e a ponderação entre os direitos fundamentais conflitantes. Ao final, concluiu-se pela impossibilidade de manutenção da atuação obrigatória dos advogados, nos processos judiciais. Conseqüentemente, ficou claro existir o direito de litigar sem advogado, de maneira irrestrita. / [en] One of the most important concerns for jurists, worldwide, is access to justice. In Brazil, the general rule, with few exceptions, is the necessity of the assistance of a lawyer, in the relationship between litigant and judge. This work intends to demonstrate that the obligatory presence of a lawyer, in the dialogue between the party and the Judiciary, is uncalled for. The method used was the technique of legal argumentation and examination of proportionality, as proposed by Robert Alexy. Firstly, the semantics of the norms, that would be the grounds for such requirement were analyzed, as well as the legislator´s intention, the historical antecedents, the exceptions to the rule, a foreign system that does not accept such imposition, the legal principles involved in the problem, the principles of constitutional law, of human rights, of non-internalized international law and of internalized international law, the already well-established concepts in brazilian procedural dogmatics, the legal precedents, the statistical data, the analogical arguments and the reasons of a practical nature. Secondly, the legitimacy of the ends chosen by the legislator, the need of the obligatory intervention of a lawyer, the suitability of such measure and the balance between the conflicting basic rights were examined. Finally, a conclusion was reached pointing to the impossibility of the maintenance of the obligatory performance of lawyers, in judicial procedures. Consequently, the right to litigate without a lawyer, in an unrestricted way, became clear.

Discours d’avocats de la défense sur l’utilisation des rapports Impact of Race and Culture Assessments dans les cours criminelles de Toronto

La littérature indique qu’il y a un problème de surreprésentation de personnes noires dans le système de justice criminelle canadien. Ce problème serait notamment la manifestation d’un racisme systémique anti-NoirEs (RSAN) dont les origines remontent aux époques coloniale, esclavagiste et ségrégationniste du pays. Les Impact of Race and Culture Assessments (IRCAs), des rapports présentenciels spécialisés, sont une initiative émergente visant à faire reconnaître les impacts du RSAN afin de mitiger la peine des justiciables noirs au Canada. Ce mémoire a pour objectif de documenter les discours et pratiques autour de l’utilisation des IRCAs. Plus spécifiquement, il vise à (1) détailler le processus de production des IRCAs et leur présentation au tribunal ; (2) mettre en lumière les avantages et les désavantages d'utilisation des IRCAs et (3) faire état de l’impact des IRCAs sur la pratique judiciaire. L’analyse thématique de données d’entretiens semi-dirigés menés entre 2018 et 2022 auprès de 35 avocats-criminalistes de pratique privée et de service oeuvrant à Toronto a permis de constater que les rapports IRCAs sont bien connus et appréciés des avocats torontois. Toutefois, les résultats suggèrent également qu’il reste de nombreux obstacles à pallier afin de faire reconnaître leur valeur auprès du plus grand nombre, d’harmoniser leur utilisation à l’ensemble du pays et de les rendre accessibles à tous ceux qui en ont besoin. Un doute demeure quant à la véritable portée que peut avoir une telle initiative lorsque l’intention ultime est de réformer un système entier. / Literature shows that there is a problem of over-representation of Black people in the Canadian criminal justice system. Among other factors, this issue is linked to systemic antiblack racism (SABR), the causes of which can be traced back to the country's colonial, slavery and segregationist history. Impact of Race and Culture Assessments (IRCAs) are specialized pre-sentence reports and an emerging initiative aimed at recognizing the impacts of SABR in order to mitigate the punishment of Black offenders, in Canada. This masters aims to document the discourse and practices surrounding the use of IRCAs. More specifically, it aims to (1) detail the process of producing an IRCA and presenting it to the court; (2) highlight the advantages and disadvantages of using IRCAs; and (3) report on the impact of IRCAs on court practice. Thematic data analysis of semi-structured interviews conducted between 2018 and 2022 with 35 private practice and duty criminal lawyers working in Toronto found that IRCAs reports are well known and appreciated by Toronto lawyers. However, the results also suggest that there are still many obstacles to overcome in order to ensure that their value is widely recognized, that their use is harmonized across the country, and that they are accessible to all those who need them. Doubts remain as to the true scope of such an initiative when the ultimate intention is to reform an entire system.

Law in 3-Dimensions

This project, overall, involves a theory of law as dimensions. Throughout the history of the study of law, many different theoretical paradigms have emerged proffering different and competing ways to answer the question ‘what is law’? Traditionally, many of these paradigms have been at irreconcilable odds with one another. Notwithstanding this seeming reality, the goal of this project was to attempt to take three of the leading paradigms in legal theory and provide a way to explain how each might fit into a single coherent theory of law. I set out to accomplish this by drawing on the field of theoretical physics and that field’s use of spatial dimensions in explaining various physical phenomena. By engaging in a dimensional analysis of law, I found that I was able to place each paradigm within its own dimension with that dimension being defined by a specific element of time, and in doing so much of the conflict between the paradigms came to be ameliorated. The project has been divided into two main parts. PART I discusses the fundamentals of legal theory (Chapter 1) and the fundamentals of dimensions (Chapter 2). These fundamentals provide a foundation for a dimensional analysis of law which takes place throughout PART II. In Chapter 3, I argue that the three fundamental theses of Positivism coalesce with the 1st-dimension of law, which is defined as law as it exists at any one point in time. From there, I argue in Chapter 4 that the 2nd-dimension of law, being law as it exists between two points in time (i.e. when cases are adjudicated), is characterized by Pragmatism. I then turn, in Chapter 5, to argue that the 3rd-dimension of law, being law as it exists from the very first point in legal time to the ever changing present day, coalesces with the fundamental theses of Naturalism. Ultimately then, I argue that a theory of law as dimensions, through the vantage points of the specific elements of time, provides a more complete account of the nature of law.

The plots of Billy Budd and The Bonfire of the Vanities are organized entirely around a lawsuit. In The Pickwick Papers the trial is only a part, though an important one, of a series of related adventures in which the main characters of the novel participate. In the three novels there is a trial in which the accused is found guilty, although he is actually innocent. In The Posthumous Papers of the Club Pickwick, the author’s main purpose is to present the operation of the legal system, in which the modus operandi of unscrupulous lawyers, who rely only on cheating and deceiving methods, is atthe beginning of and determines the outcome of the lawsuit. In Billy Budd, an innocent is sentenced to death in order to preserve a supposed higher interest: the common good. In The Bonfire of the Vanities, political factors, personal interests, resentments and other worldly elements determine the outcome of the trial. In the three cases, the watchmaking mechanism that a lawsuit appears to be is completely overcome by factors outside it. / Las tramas de Billy Budd y La hoguera de las vanidades están organizadas íntegramente alrededor de un juicio. En Los papeles póstumos del Club Pickwick, el proceso es una parte importante de la obra, pero también existen aventuras relacionadas en las que participan los diversos personajes. En los tres juicios se juzga a un inocente. En Los papeles póstumos del Club Pickwick, el autor busca presentar el funcionamiento real del sistema legal, en el cual el modus operandi de abogados inescrupulosos, quienes emplean únicamente métodos tramposos y fraudulentos, determina el origen y el resultado del proceso. En Billy Budd, un inocente es condenado a muerte para preservar un supuesto interés mayor: el bien común. En La hoguera de las vanidades, factores políticos, intereses personales, resentimientos y otros elementos de carácter mundano determinan el resultado del proceso.
