DMPPJ - RICARDO FIOREZE.pdf: 808730 bytes, checksum: 3d079f5f9c9d57d2b2c75cf2d478e9c4 (MD5) / This work analyzes the management of the development of the judicial processes before Labor Courts as an instrument capable of assisting in achieving the effectiveness of the jurisdictional activity and the reasonable duration of the process. The objective is to show how the management fits in the attributions inherent to the function of a judge and the necessity of its adoption in the conduct of the process development. It also identifies moments and acts of the process development when the adoption of management techniques can produce better results and suggest practices that lead to optimizing the available resources and procedural legislation, and to maximizing and, whenever possible, suppressing acts, and to eliminating 'dead stages'. In order to reach such purposes, fundamental theoretical aspects related to the management of organizations and, specifically, to the juridical management at Labor Courts are firstly approached. Secondly, the possibility of managing the (judicial) process itself is stated, aiming at increasing the usefulness of its result, emphasizing the repercussions that this idea causes on the duties inherent to a judge. At last, the proposals of practical application of process management at Labor Courts are expounded, comprising several moments and acts of the process development and its corresponding control. / Por meio deste trabalho, analisa-se a gestão da tramitação dos processos judiciais perante Varas do Trabalho como instrumento capaz de auxiliar no alcance da efetividade da atividade jurisdicional e da razoável duração do processo. Busca-se demonstrar o enquadramento da gestão entre as atribuições inerentes à função do juiz e a necessidade de sua adoção na condução da tramitação processual. Procura-se identificar momentos e atos da tramitação processual em que a adoção de técnicas de gestão pode produzir melhores resultados e sugerir práticas que conduzam à otimização dos recursos e legislação processual disponíveis, à maximização e, quando possível, supressão de atos, e à eliminação de 'etapas mortas'. Para atingir tais propósitos, abordam-se, inicialmente, aspectos teóricos fundamentais relacionados à gestão das organizações e, de modo particular, à gestão judiciária em Varas do Trabalho. Num segundo momento, afirma-se a possibilidade de gestão do próprio processo (judicial), visando à redução do tempo de sua tramitação e à ampliação da utilidade do seu resultado, salientando-se as repercussões que essa ideia provoca sobre os deveres afetos ao juiz. Por fim, expõem-se propostas de aplicação prática de gestão processual em Varas do Trabalho, abrangentes de vários momentos e atos da tramitação processual e do seu correspondente controle.

Les questions de légitimité et de stabilité des systèmes politiques ont longtemps été étudiées séparément des problèmes de mise en oeuvre du droit en sciences économiques. L’objectif de cette thèse est concilier ces différentes approches afin de replacer la mise en oeuvre de la norme juridique au centre du débat institutionnel. Ce travail se décompose en cinq investigations empiriques ou expérimentales portant chacune sur une des étapes du processus politique et judiciaire.Le premier article s’intéresse à l’impact des droits constitutionnels sur les dépenses publiques. La seconde étude explore l’influence des biais d’auto-complaisance sur la demande et l’offre de redistribution. Le troisième travail analyse les décisions rendues par le Conseil Constitutionnel. La quatrième partie examine la réforme de la carte judiciaire des Conseils de Prud’hommes de 2008. Le dernier chapitre étudie la relation entre la composition syndicale des Conseils de Prud’hommes et les issues des litiges qui y sont portés.Nos analyses reposent sur les outils économétriques et expérimentaux. Elles font usage de méthodes d’estimations classiques (OLS, GLS, Probit, Logit, Within OLS), de modèles à sélection (Heckman, Triprobit), des outils destinés aux problèmes d’endogénéité (2SLS)et des techniques d’estimation de systèmes d’équation (3SLS). L’approche expérimentale contient également des tests statistiques communément appliqués (tests de permutation,tests de comparaison de moyenne, tests de proportion) ainsi que de récentes méthodes pour traiter l’hétérogénéité (wild clustering). / The legitimacy and the stability of political systems have very often been studied in economics separate from considerations about legal norms’ enforcement. My objective is to combine these different approaches, and to place the question of the legal enforcement at the heart of the debate about institutions. This work is made of cinq empirical and experimental investigations that deal with each of the stages of the political and legal process.This first paper analyzes the impact of constitutional rights on public expenditures. The second article explores the influence of self-serving biases on the demand and the supplyof redistribution. The third analysis focuses on the decisions of the French Constitutional Council. The fourth work deals with the recent reform of the judiciary map of Frenchlabor courts. The last study investigates the relationship between the composition of the elected jurors in French labor courts and the way cases are terminated.Our investigations rely on econometric and experimental techniques. They use standard estimation methods (OLS, GLS, Probit, Logit, Within OLS), selection models (Heckman,Triprotibt), techniques for endogeneity correction (2SLS), and methods to estimate systems of equations (3SLS). The experimental analysis makes use of standard statistical tests(permutation tests, proportion tests, two-group mean-comparison tests), and more recent methods to solve heterogeneity (wild clustering).

A critical and in-depth discussion of the powers of the labour court to review arbitration awards of the Commission for Conciliation, Mediation and Arbitration, the application of the author's findings relating to common-law, legislation and case law and a critical analysis thereof. Special reference is made to the provisions of sections 145 and 158(1)(g) of the Labour Relations Act 66 of 1995 including, in particular, the alternative application thereof in practice and scope for improvement in order to address potential prejudice to parties occasioned by the compulsory nature of (certain) dispute resolutions. This thesis incorporates a comparative study of the British and German labour law systems with reference to the relevant appeal and/or review procedures (as applied in their tribunals/courts), together with a discussion and application of certain other provisions relevant to South Africa labour law. / Jurisprudence / LL.M

Discourses of silence : judicial responses to industrial action as an archaeolgy of juridificationMischke, Carl 08 1900 (has links)
A study of silences: as a metaphysics of the law, juridification silences the text of the law in order
to enable an allegorical reading of the law. This silencing of the legal text can only be avoided
through a non-metaphysical archaeological reading. Similarly, the programme of comparative
labour law is silent at its most pivotal points, leaving some concerns of the programme
indeterminate and indeterminable.
As context, the dominant discourses of the labour law systems of the Federal Republic of
Germany (Tarifautonomie), Great Britain (collective laizzesfaire) and South Africa (fairness)
are identified and the agents of the jurisprudence (the courts) are briefly outlined. The silence
operating within the phenomenology of the labour judiciary and the concept of a 'court' is also
examined.
The study then proceeds to read, in an archaeological manner, the industrial action jurisprudence
in Germany, Great Britain and South Africa, such readings again yielding silences within the
discourse of the law.
The silences occurring throughout (and the resulting normative breaches in the rationality of the
legal discourse) are the prerequisites for juridification, a process in terms of which the metajuridical
standard is imported into the legal normative system and thereby rendered part of the

The jurisdictional conflict between labour and civil courts in labour matters : a critical discussion on the prevention of forum shoppingMathiba, Marcus Kgomotso 04 February 2013 (has links)
The Labour Relations Act 66 of 1995 provides an elaborate dispute resolution system which seeks to resolve disputes in a speedy and cost-effective manner. However, this system is faced with a number of challenges. The application of common law and administrative law causes tension between the Labour Court and civil courts. It creates uncertainty in the development of our labour law jurisprudence and also leads to the problem of forum shopping. These problems in effect undermine the objectives of the Act.
This dissertation analyzes problems in the LRA and other legislations leading to forum shopping. It also analyses the view of the courts on this problem and further expounds a number of possible solutions.
