Právní předpisy na území Toskánska v Trecentu: Dlouhá cesta od latiny k volgare / Legislation in the Tuscany Region in the Trecento: A Long Way from Latin to Volgare

The subject of this diploma thesis is legislation in today's Tuscnay region in the Trecento. Its introductary part focuses on the general political and administrative legal situation in the determined area, the historical excursion also deals with sources of law in the Trecento. The second part focuses on the evolution of the tuscan dialect in the Duecento and Trecento, taking into account legal language as well. The third part is dedicated to legal language itself, to its specifics and peculiarities regarding the lexicon and also morphology and syntax. The final chapter is dedicated to a practical analysis of a legal document from the fourteenth century, Statuti dell'Opera di San Jacopo di Pistoia.

Kategorie determinace: strategie překladu španělských administrativně-právních textů do češtiny. / Category of Determination: Translation strategy of Spanish administrative-and-law texts into Czech.

The main theme of this thesis is the category of determination in the Spanish language. Considering that this category is very large in spanish language we have focused in detail on the article, especially the indefinite article. This work is devided into two parts, the theoretic and the practical part. The theoretic part has been devoted to definitions and main characterization of the article, primarily the indefinite article. This issue is looked upon from the point of different publications that discuss it more or less thoroughly. Considering that the category of determination itself does not exist in the Czech language we briefly draw other mediums to express this phenomenon, especially the word order. For the practical part the qualitative methods were used.In this part the use of determinants was analyzed in administrative and legal texts, specifically in two texts from the web page www.Eur-Lex.eu, in one text from Boletín Oficial del Estado and in one law of the Czech Ministry of Education.

Este trabalho realizado na Área de Estudos Linguísticos, Literários e Tradutológicos de Francês do Departamento de Letras Modernas da FFLCH/USP se situa na intersecção do Direito e das Ciências da Linguagem, numa perspectiva multi e interdisciplinar, do discurso jurídico. O corpus, formado por textos jurídicos em língua francesa e portuguesa (brasileira), tem como objeto de estudo o discurso jurídico. Nele conceitos de direito foram, ao longo do tempo, modificados e integrados às práticas sociais. O método comparativo foi o escolhido para melhor examinar as transformações. No primeiro texto, escolhido pela sua importância histórica, a Declaração de Direitos do Homem e do Cidadão (França, 1789), surgem os conceitos de homem, igualdade e liberdade. Esses mesmos conceitos reaparecem na Declaração Universal dos Direitos do Homem (ONU, 1948), em que direitos mais explicitados conferem maior proteção ao homem. O terceiro documento, a Constituição da República Federativa do Brasil (Brasil, 1988) detalha no seu artigo 5° todos os direitos conferidos ao homem do século XX, conceitos que ressurgem implícitos na lei sobre a Informatização dos Processos Judiciais (Brasil, lei 11.419/2006). A partir da observação desses documentos levanta-se a hipótese de que os conceitos apresentados de homem, liberdade, igualdade e de justiça não são os mesmos presentes no primeiro documento, o que evidencia uma evolução sócio-histórico-linguístico-discursiva. A reformulação ocasiona, inclusive, um apagamento de conceito. Dessa forma o liame que une os documentos é resultante de um processo. As noções de polifonia e de dialogismo emprestados da Análise do Discurso são desenvolvidos a partir dos estudos bakhtinianos e dos procedimentos argumentativos da retórica renovada por Perelman, bem como das reformulações discursivas implicadas. 8 No primeiro capítulo os documentos são contextualizados historicamente, a fim de que se possa entender seu surgimento. O segundo, teórico, verifica a presença da Teoria da Enunciação e dos conceitos de auditório, ethos e logos, integrantes da Teoria da Argumentação. Do ponto de vista linguístico-discursivo o que se valoriza são as reformulações como ferramentas dessas alterações. Ressalta-se que tais transformações tecem-se a partir das relações entre a Língua e o Direito. Os conceitos de transplant, circulation juridique e empréstimo propostos pelo Direito Comparado consideram as diferenças entre as línguas e as culturas francesa e brasileira. O terceiro capítulo trata do discurso jurídico e de uma proposta de classificação dos diferentes textos em subgêneros a partir de seu objetivo e local de produção. O resultado das análises revela que o decurso do tempo provoca a evolução dos conceitos de homem, liberdade, igualdade e justiça, a ponto de sua existência material no texto escrito permitir seu apagamento, passando de concreta à abstrata, já que implicitamente é o conteúdo que justifica a proposição e a publicação da lei Informatização dos Processos Judiciais. / This following thesis, developed in the French Linguistic, Literary and Translation area of the Modern Language Department FFLCH / USP lies in the intersection of Law and Language Sciences. The corpus composed of legal texts in French and Portuguese (Brazilian) has as its object of study of the legal discourse in which the concepts of law, over time, have been modified and integrated with social practices. The comparative method was chosen to better examine these transformations. The first text, chosen for its historical significance, the Declaration of Rights of Man and of the Citizen (1789, France), bring to the light the concepts of \"man\", \"equality\" and \"freedom\". These same concepts reappear in the Universal Declaration of Human Rights (UN, 1948), in which most rights specified give greater protection to the man. The third document, the Constitution of the Federative Republic of Brazil (Brazil, 1988) explains, in its 5th article, all rights granted to man of the 20th century, concepts which reappear implicit in the Law on the Informatized System of the Judicial Process (Brazil, law 11,419/2006). The observation of these documents raises the hypothesis that the concepts presented \"man\", \"freedom\", \"equality\" and \"justice\" are not the same in the first document, which highlights a socio-historical-linguistic evolution-discursive. The reformulation causes, also, an erase of concept. In this way the link that connects the documents is the result of a process. The concepts of polyphony and dialogism borrowed from Discourse Analysis are developed from Bakthins studies and procedures of argumentative renewed Rhetoric by Perelman, as well as discursives involved. In the first chapter documents are historically contextualized in order to permit their understanding and emergence. In the second chapter, theoretical, the Enunciation Theory and the concepts of dialogism and polyphony are noted in texts as well as the concepts of the Auditorium, ethos and logos from the 10 Theory of Argumentation. In the aspect of Linguistically-discursive cases the reformulations are the tools of these changes. It should be noted that such transformations weave from relations between the Languag and the Law. The concepts of \"transplant\", \"circulation juridique\" and \"borrowing\" proposed by the Comparative Law consider the differences between the French and Brazilian languages and cultures. The third chapter treat the legal discourse and propose a classification for texts in different sub-genres from its goal and production site. The result of the analysis prove that the course of time causes the evolution of the concepts of \"man\", \"freedom\", \"equality\" and \"justice\", to the point that it may even result in the erasure of his material existence in the written text, ranging from concret to abstract, since its content appears implicitly in the proposition and the publication of Law on the Informatized System of the Judicial Process.

This thesis deals with verb-noun predicate with a light verb which occur in the European legislative texts. The first, theoretical part is divided into two chapters. The first one focuses on the predicate and the other covers the linguistic particularities of the legal documents. The other, research part is focused on the detailed analysis of selected verb-noun predicates which are found in the corpus of the European Union legislative texts. In conclusion, a small French-Czech dictionary of the investigated verb-noun predicates is attached.

Traduction en arabe des textes juridiques à vocation internationale : le cas de la Charte des Nations Unies / Translation into Arabic of international legal texts : the case of the Charter of the United Nations

Au XXème siècle, les puissances mondiales sorties victorieuses de la Seconde guerre mondiale ont établi une nouvelle institution internationale, l’ONU. La Charte des Nations Unies, texte constitutif de l’ONU, a été signée à San Francisco le 26 juin 1945, à la fin de la Conférence des Nations Unies pour l’institution internationale, et est entrée en vigueur le 24octobre 1945.Suite à l’adoption de la résolution 3190 (XXVIII) de l’Assemblée générale le 18décembre 1973 faisant de l’arabe une langue officielle, la traduction de la Charte des Nations Unies en arabe a été effectuée. Traduire le message de la langue-culture source (quelle qu’elle soit) vers la langue-culture cible arabe se dit ta‘rīb.L’internationalisation du droit a accentué le besoin de ta‘rīb au sein de l’ONU. Ta‘rīb devient un instrument important pour la communication internationale. La traductologie, discipline mère de la traductologie juridique, est appelée à rendre compte des traits spécifiques de la traduction institutionnelle, notamment ta‘rīb de la Charte des Nations Unies entre deux espaces culturels différents que sont : la langue-culture source exprimée en anglais et en français et la langue-culture cible exprimée en arabe. Cela nous a amené à la question centrale de notre problématique qui est à savoir :Comment traduire vers l’arabe, ta‘rīb, la Charte des Nations Unies entre deux espaces culturels différents ?Dans cette recherche, nous réfléchirons à la spécificité de la traduction dans le cadre d’institution internationale et éluciderons les enjeux de ta‘rīb au sein de ce type d’institution.En premier lieu, notre questionnement nous pousse à remettre en cause la traduction en arabe sur lequel se fonde la conception de ta‘rīb des textes juridiques internationaux, en ouvrant une pensée à la pratique de la traduction en arabe au sein de l’institution. En deuxième lieu, nous démontrons comment la Charte des Nations Unies a été traduite en arabe au sein de l’ONU. En troisième lieu, nous exposons les outils nécessaires pour un traducteur en arabe, mu‘arrib, au sein des institutions internationales afin d’améliorer la qualité de ta‘rīb des textes juridiques internationaux dans les institutions internationales telles que l’ONU, pour enfin explorer de nouvelles solutions pour ta‘rīb des textes juridiques internationaux, notamment ta‘rīb de la Charte des Nations Unies. / In the 20th century, the world powers that came out victorious from the Second World Warhave established a new international institution : the United Nations. The Charter of the United Nations, the constitutive text of the United Nations, was signed in the end of the United Nations Conference and took effect on the 24th of October 1945.Following the adoption of the General Assembly Resolution 3190 (XXVIII) on the 18th of December 1973, Arabic became an official language of the United Nations. The UN Charterwas translated into Arabic, that is there was a process of ta’rib of the Charter (the process of translating any language-culture source into Arabic is called ta‘rīb). The internationalisation of the law have greatly increased the need to ta‘rīb in the United Nations, and ta‘rīb is becoming an important instrument in international communication. Translation studies, the principal field of legal translation, is called to account for specific features of institutionaltranslation, particularly ta‘rīb of the United Nations Charter between two different cultural spaces linked to the language-culture source expressed in English and French and the language-culture target, Arabic. We can thus formulate our central question : How to ta‘rīb(translate into Arabic) the Charter of the United Nations between two different cultural spaces ? In this research we will discuss specific features of institutional translation by especially focusing on ta‘rīb in United Nations. This will first bring us to question the process of translation into Arabic on which the conception of ta‘rīb of international legal texts is based, which will lead to the the practice of translating into Arabic in the institution. We willthen show how the United Nations Charter is translated into Arabic in the United Nations,which will then allow us, in a third moment, to highlight the necessary tools for a translator into arabic, mu‘arrib, in the international institution in order to improve the quality of ta‘rībof international legal texts in the United Nations. And, finally, we will explore new solutions for ta‘rīb of international legal texts, particularly ta‘rīb of the Charter of the United Nations.

[pt] As decisões interpretativas, no caso a interpretação conforme a constituição, inconstitucionalidade parcial sem redução de texto (decisão manipulativa redutiva), decisão manipulativa aditiva, decisão manipulativa substitutiva estão presentes no controle de constitucionalidade brasileiro. Elas são tratadas indistintamente e um aspecto disto é linguístico: a diferença entre identificar uma regra (interpretação(1)) e seguir uma regra (interpretação(2)). As abordagens semânticas permitem esse tipo de diferenciação, mas abordagens pragmáticas parecem têm maiores dificuldades. Dentro do direito, isso pode ser traduzido como a oposição entre a identificação do significado literal, significado ordinário e a identificação do significado intencional, significado finalístico dos documentos normativos. Quanto a seguir regras jurídicas, três modelos são possíveis: o formalismo forte, o formalismo presumido e o particularismo sensível às regras. Dentre esses, os últimos dois são mais compatíveis com a jurisdição constitucional. Contudo, críticas à falta de critérios presentes nesses dois atingem também o controle de constitucionalidade e especialmente as decisões interpretativas, por faltarem parâmetros precisos para justificar uma decisão interpretativa em detrimento da declaração de (in)constitucionalidade simples. Ademais, a diferenciação entre interpretação(1) e interpretação(2) também é útil à aplicação da cláusula de reserva de plenário, diferenciando quando órgão fracionário está apenas identificando o que a lei diz, usando a constituição como referência, e quando a lei diz algo inconstitucional. / [en] The interpretative decisions - interpretation according to the constitution, partial unconstitutionality (reductive manipulative decision), additive manipulative decision, substitutive manipulative decision - are present in brazilian judicial review. They are treated indiscriminately and one aspect of it is linguistic: the difference between identifying a rule (interpretation(1)) and following a rule (interpretation(2)). Semantic approaches allow this kind of differentiation, but pragmatic approaches seem to have greater difficulties. Within the law, this can be translated as the opposition between the identification of the literal meaning, the ordinary meaning and the identification of the intentional meaning, the purposivism meaning of legal texts. As for following legal rules, three models are possible: strong formalism, presumptive formalism, and rulesensitive particularism. Of these, the latter two are more compatible with judicial review. However, criticisms of the lack of criteria present in these reach judicial review and especially the interpretative decisions because they lack precise parameters to justify why an interpretative decision should trump the simple declaration of (un)constitutionality. In addition, the distinction between interpretation(1) and interpretation(2) is also useful in applying the full bench clause because it allow us to differentiate when the fractional body is only identifying what the legal text says using the constitution as a reference and when the legal text says something unconstitutional.

Prophetic Scribalism: A Semantic, Textual and Hypertextual Study of the Serek Texts

This thesis challenges the position that the serek texts are primarily prescriptive and legal, as they have been customarily defined. It argues that the term serek should be reconceptualized according to descriptive analysis, with the purpose of creating what C. Newsom terms a ‘Gestalt structure.’ In order to achieve this, four serek texts (M, S, Sa, and D) will be analyzed at three literary levels—semantic, textual and hypertextual—explaining how the elements at these levels interact as cohesive wholes, thus serving to create a more complete picture of this group of texts as a literary unity. Thus, while the separate, constituent semantic, textual and hypertextual parts must be analysed as separate elements, the fundamental questions posed regarding these elements will be different in a Gestalt paradigm as compared to a traditional, definitional analysis. Going from the micro to the macro, the first chapter will look at the serek texts through the ‘microscope’ of close philological analysis, examining how the term serek functions atomistically within the Dead Sea Scrolls. Building upon these results, the second chapter will more broadly analyse the structure, themes and narrative apparent in the serek texts, thus creating a fuller understanding of how the serek texts relate to one another and respond to circumstances in community life. Finally, the last chapter seeks yet more broadly to understand the serek texts in the wider literary milieu of the Second Temple Period. Here, a scribal technique present in the serek texts will be compared to a similar technique used in the Book of Isaiah—arguably the most important prophetic work for the Qumran sectarians.

[pt] Tomando como base a perspectiva teórica da Linguística Cognitiva, que interpreta o significado na língua em uso e entende metáfora e metonímia como fenômenos da linguagem cotidiana, esta pesquisa examina a metáfora e a metonímia no texto jurídico. O objetivo do estudo é investigar o uso da língua na produção textual jurídica da petição inicial a fim de avaliar em que medida a proposta de metáfora e metonímia conceptual e a metodologia de análise correspondente se sustentam. Para a investigação, selecionam-se dois segmentos de petições iniciais e analisam-se 200 unidades lexicais de conteúdo. Na análise, aplica-se, de forma adaptada, o Procedimento para Identificação de Metáforas da Universidade Livre de Amsterdã (MIPVU), para identificar e classificar metáforas e metonímias na língua em uso. Com o auxílio de dicionários, apresentamos os significados contextual e básico de cada unidade lexical e estabelecemos as relações construídas. Os resultados evidenciam a relevância do uso para a apreensão do significado, a necessidade de uma metodologia de análise mais abrangente e o predomínio de metáforas convencionais e indiretas, assim como de metonímias por nominalização, em detrimento de usos de caráter deliberado, o que se mostra coerente com a literatura da Linguística Cognitiva e com as especificidades na forma, no conteúdo e no estilo da petição inicial. / [en] Assuming the theoretical perspective of Cognitive Linguistics, which is concerned with meaning in the language in use and considers metaphor and metonymy as phenomena of everyday language, this research examines metaphor and metonymy in legal texts. The aim of this work is to investigate the use of language in the legal textual production of the initial petition to understand the extent to which the proposal of conceptual metaphor and metonymy and the corresponding analysis methodology apply. In the investigation, two segments of initial petitions are selected, and 200 lexical units of content are analyzed. In the analysis, an adaptation of the Metaphor Identification Procedure - Vrije Universiteit (MIPVU) is applied to identify and classify metaphors and metonymies in the texts. We refer to dictionaries to present the contextual and basic meanings of each lexical unit and then establish the relationships built. The results show the relevance of use for establishing meaning, the need for a more comprehensive analysis methodology, and the prevalence of conventional and indirect metaphors, as well as metonymies by nominalization rather than deliberate uses, which is consistent with the literature in Cognitive Linguistics and with the specifics in the form, content, and style of the initial petition.
