As every breach of a contract not only conditions destabilization of business relations, but also causes a social conflict, and an aggrieved party must be compensated for damage incurred in connection with non-performance or defective performance of obligations under the contract. A breach of a private interest as a result of non-performance or defective performance of a contract gives grounds for contractual civil liability to arise. As the compensatory function is the main function of civil liability, only proper implementation of it can guarantee protection of the breached interests of the parties and restore the stability of business relations. Thus, in order to restore the balance of legal relations, it is necessary to have a good knowledge of the legal regulation of damages in contractual relations. This research work gives a comprehensive analysis of legal regulation of damages in contractual relations in the Republic of Lithuania, as well as peculiarities and problems of regulation of this institution. Civilinės atsakomybės esmę nusako jos tikslai. Autorius darbe nagrinėja visas civilinės atsakomybės funkcijas, jų sudedamuosius elementus, pasireiškimą nacionalinėje ir užsienio valstybių doktrinoje ir praktikoje, probleminius klausimus. Atlikus tyrimą autorius daro išvadą, kad pagrindinės civilinės atsakomybės funkcijos yra kompensacija ir prevencija, nors pastaroji yra mažesnės reikšmės. Civilinės atsakomybės pobūdis lemia kompensacinės funkcijos neginčijamą svarbą žalos atlyginimo procese. Šios funkcijos esmę išreiškia visiško nuostolių atlyginimo principas. Visiškai atlyginti nuostolius – tai grąžinti nukentėjusįjį į tokią turtinę padėtį, kokia būtų nepadarius žalos. Kartu šis principas reiškia, kad iš žalos padariusio asmens negalima išieškoti daugiau, nei nukentėjusysis patyrė žalos, nes tai reikštų nepagrįstą nukentėjusiojo praturtėjimą. Darbe autorius taip pat aprašo, kaip kompensavimo funkcija pasireiškia Lietuvos teisinėje sistemoje ir koks funkcijos pasireiškimo būdas yra dažniausiai pasitaikantis praktikoje. Darbe analizuojama ir pabaigoje padaroma išvada, kad visiško nuostolių atlyginimo principas negali būti absoliutus. Visa apimtimi civilinės atsakomybės kompensavimo funkcija negali pasireikšti atlyginant neturtinę žalą, esant ribotai civilinei atsakomybei, o taip pat atsižvelgiant į būtinumą taikyti sąžiningumo, protingumo ir teisingumo principus. The paper deals with the functions of the civil liability, theirs constitutive elements, their manifestation in national and foreign countries doctrine and practise, problem issues. At the end of the research the author makes conclusion that the main functions of the civil liability is the compensation and the prevention though the last is of a secondary importance. The nature of the civil liability determines undisputable significance of the compensatory function in the loss indemnifying process. The essence of the compensatory function is expressing by the principle of the compensation of damages in full. To compensate damages in full – is return the aggrieved person in such property state that would be if there are not occurred damages. Together with above mentioned such principle means that from the person by whom the damage was caused can not be recover more than the aggrieved person has incurred losses because otherwise the aggrieved person shall be considered as in the position of the unjust enrichment. Baigiamajame magistro darbe išnagrinėti STR ir EC 2 betono fizikinių ir mechaninių rodiklių nustatymo metodai bei šiose normose pateiktų įtempių nuostolių skaičiavimo modeliai. Aprašytas tikimybinis įtempių nuostolių vertinimo modelis. Atlikta atskirųjų ir suminių įtempių nuostolių analizė pagal STR ir EC 2 modelius, aprašyti šių modelių skirtumai. Išnagrinėta atskirų fizikinių faktorių lemiančių įtempių nuostolius įtaka. Atlikta iš anksto įtemptos gelžbetoninės sijos tikimybinė suminių įtempių nuostolių analizė. Darbe pateiktas kiaurymėtųjų perdangos plokščių suminių įtempių nuostolių skaičiavimo rezultatų pagal EC 2 ir STR modelius ir eksperimentinių įtempių nuostolių palyginimas. / Evaluation of different physical and mechanical factors of concrete according to STR and EC 2 models is considered in this master thesis. Probabilistic model for prestress loss determination is presented in this paper. The analysis of separate and total losses according to STR and EC 2 models was carried out. Some differencies of these models were described. The influence of several factors to the value of separate prestress loss has been studied in this thesis. The probabilistic analysis of long-term losses of post-tensioned RC beam has been carried out. The comparison of total prestress loss values of hollow core slabs according to EC 2, STR and experimental results is subjected in this master thesis.

Magistro darbe tiriama kiek medienos ruošos nuostolių lieka biržėse po medienos ruošos rangovo darbų pridavimo. Darbo objektas – VĮ Alytaus miškų urėdija. Darbo tikslas - įvertinti, išanalizuoti ir apibendrinti stiebų medienos nuostolius, kurie susidaro ruošos metu eglynų pagrindinių ir ugdomųjų kirtimų biržėse. Darbo metodai – mokslinės ir normatyvinės literatūros šaltinių analizė, leidinių analizės metodas, instrumentinis metodas, statistinė duomenų analizė, loginis analitinis metodas, Darbo rezultatai. Tyrime pateikiama medienos ruošos nuostolių įvertinimo analizė, kertant plynų pagrindinių ir ugdomųjų kirtimų biržes eglynuose. Iš viso tyrimui medienos ruošos nuostoliai buvo matuojami 21-oje biržėje. Iš jų 9-iose plynų pagrindinių kirtimų biržėse, 6-iose einamųjų ugdomųjų kirtimų biržėse ir 6-iose retinimų ugdomųjų kirtimų biržėse. Kertant plynais pagrindiniais kirtimais eglynus vidutiniškai sumatuotas atliekų tūris randamas vienoje biržėje siekia 2,4 % nuo ištrauktos likvidinės medienos kiekio. Kertant einamaisiais ugdomaisiais kirtimais eglynus vidutiniškas atliekų tūris iš vienos biržės siekia 1,7 % nuo ištrauktos likvidinės medienos kiekio. [toliau žr. visą tekstą] / In master thesis work we were doing research of timber losses in stands after contractor work. The object of research: Alytaus Forest Enterprice. Estimation methods: scientific and normative literary analysis, instrumental method, statistical data analysis, logical analytical method. Work results. We were doing estimation of timber losses during cuttings in spruce stands. Results of timber looses during cutting on 21 stands are estimated, in 9 clear cutting stands, in 6 last thinning stands and 6 before last thinning stands. After clear cuttings was found approximately 2,4 % timber losses in spruce stand. After last thinning was found approximately 1,7 % timber losses in spruce stand. After before last thinning was found approximately 2,2 % timber losses in spruce stand. An average looses in spruce stands on investigated site types and cutting methods are 2,1 % of merchantable timber.

Magistro darbe tiriama kiek medienos ruošos nuostolių lieka beržynų biržėse po medienos ruošos rangovo darbų pridavimo žiemos metu. Darbo objektas – Beržynų plynų ir einamųjų žiemą kirtimo biržių, stiebų medienos nuostoliai. Darbo tikslas - Įvertinti, išanalizuoti ir apibendrinti stiebų medienos nuostolius, kurie susidaro ruošos metu beržynų pagrindinių ir ugdomųjų kirtimų biržėse žiemos metu. Darbo metodai: 1. Tiriant miškų ūkio sistemą ir jos teisinio reglamentavimo ypatumus buvo naudojamas mokslinės ir normatyvinės literatūros šaltinių analizės metodas, leidinių analizės metodas. 2. Instrumentinio metodo pagalba, naudojant žergles ir juostą, turinčia 1 mm gradaciją, buvo atlikti stiebo atliekų vidurio skersmenų matavimai ir nustatytas tiriamojo barelio plotas. 3. Statistinės duomenų analizės metodas, naudojant MS OFFICE 2003 EXCEL ir Statistica V9 programas, pasitelktas susisteminti ir apipavidalinti tyrimo metu gautus rezultatus. 4. Loginis analitinis metodas Darbo rezultatai. Nuostoliai buvo skaičiuojami beržynų biržėse žiemos metu, kuriuose kirtimai buvo vykdomi L hidrotopo c trofotopo ir L hidrotopo d trofotopo augavietėse. Išviso duomenų buvo surinkta iš 21 biržių, kurias sudarė 13 plyno kirtimo biržės ir 8 einamojo kirtimo biržės. Paskaičiavus kirtimo atliekas absoliutiniais dydžiais gauname, kad L hidrotope d trofotope gaunamas didžiausias atliekų kiekis. The object of the research: Birch bare and winter crossing of the current stock, stem the loss of timber. The aim of the research: Assess, analyze and summarize the stem wood loss that will occur during the logging main birch and educational cuttings in stands during the winter. Estimation methods: 1. Study forestry system and its peculiarities of legal regulation has been used in the scientific literature and normative analysis method, the method of analysis of publications. 2. Instrumental approach to aid, and the calipers are using a bar having a 1 mm graduation, it was a mid-stem diameter measurements of the waste and the test plot. 3. Statistical data analysis method, using MS Office 2003 Excel and Statistica v9 programs invoked to structure and finishes the test results. 4. Logical analytical approach Work results. Losses were calculated in birch stands during the winter, where cuttings were made hidrotope L c and L trofotope hidrotope on trofotope sites. Joje naudojami parametriniai šviesos generatoriai bei harmonikų generatoriai, kaupinami nanosekundinės trukmės impulsais, ir apibendrinami sklaidos tyrimai, atlikti įvairių tipų optinėse dangose ir netiesiniuose optiniuose kristaluose, naudojant derinamojo bangos ilgio lazerinius impulsus. Pirmą kartą buvo ištirti naujų netiesinėje optikoje perspektyvių LiInS2 ir LiInSe2 kristalų sklaidos nuostoliai infraraudonojoje srityje. Taip pat parodyta, kad koherentinės sklaidos tomografijos metodas, anksčiau taikytas puslaidininkinių kristalų tūriniams defektams tirti, yra tinkamas ir netiesinėje optikoje naudojamų kristalų kokybės tyrimams. / This work describes the system for the light scattering measurements in a wide spectral range, which uses the light parametric oscillators and harmonic generators pumped with a nanosecond pulses and summarizes the research in various types of coatings on optical components and inside nonlinear optical crystals. The total scattering losses for the first time were characterized in the infrared region for a new promising in nonlinear optics LiInS2 and LiInSe2 crystals. It was shown that the laser scattering tomography, previously used for investigation of volume defects in semiconductor crystals, can be applied in the nonlinear optical quality control.

The analysis of the cuttings age influence for the economical results in Pagramantis regional park in this thesis is analyzed. Subject of study – the forests of the II – III group in Pagramantis regional park. Purpose of study - evaluate the losing in the II-III group forests of Pagramantis regional park due to the bigger cutting age. Study metods – the metods of data sort and selection, analysis and synthesis, comparison and graphical display were used in this survey. Study results. The rip II – III group forests (accoding to the economic forests cutting age) in Pagramantis regional park seize 1007 ha. Their volume – 277 856 m3. The losing due to the bigger cutting age in these forests is 3,27 mln. Lt. The biggest part of losing devolves for the state forest andit is 3,00 mln. Lt. (91,7 %). In the private forests and it is 0,27 mln. Lt. (8,3 %) . The base part of the losing is sustained in the II forest group ( 3,16 mln. Lt.) and among the tree spices – in the pine and spruce forests.

In the work there is the data presented, that show the condition of automobile road network and road safety problems in Lithuania. The road network and its conditions are analyzed, as well as the means allocated for road building, repairement and supervision. The possibility to realize measures for improving road safety and analysis of compliance of the Lithuanian road safety legislation with that of the European Union.The work consists of four parts.The first part analysis the today’s road safety situation in Lithuania.The second part analyses the road safety factors, the measures for improving road safety.The third part describes the purposes and peculiarities of European Union, relation between Lithuania and EU. There is an analyses Lithuanian and Europe Union road safety legislation.The fourth part analyses the methods for calculating losses at accidents and economic evaluation of the road safety measures. In the research part of the work there is given analysis of the benefit – cost for the road safety improvement measures.

Sveikata yra viena svarbiausių teisės saugomų vertybių. Ji taip pat yra civilinės teisės objektas. Todėl ją pažeidusiam asmeniui gali kilti civilinė atsakomybė. Magistrinio darbo pirmojoje dalyje analizuojamos sąlygos, būtinos civilinei atsakomybei dėl žalos, padarytos fizinio asmens sveikatai, taikyti. Tai yra neteisėti veiksmai, žala, priežastinis ryšys, kaltė. Taip pat aptariami kiti civilinės atsakomybės taikymui svarbūs klausimai: ieškinio senaties terminų taikymas, baudžiamojoje byloje priimto nuosprendžio reikšmė nagrinėjant civilinę bylą dėl tų pačių asmens veiksmų teisinių padarinių. Kadangi civilinės atsakomybės svarbiausias tikslas yra atlyginti nukentėjusiojo patirtą žalą, tai antrojoje dalyje remiantis teismų praktika nagrinėjami būtent žalos atlyginimo taikant civilinę atsakomybę už sveikatos sužalojimą klausimai: tiesioginių išlaidų atlyginimui būtinos sąlygos, negautų pajamų skaičiavimas pagal 1964 m. bei 2000 m. CK, ypač tais atvejais, kai sužalojamas 14 metų neturintis ar pensinio amžiaus sulaukęs asmuo, taip pat besimokantis ar studijuojantis asmuo, galimybė mažinti atlygintinų turtinių nuostolių dydį, neturtinės žalos atlyginimas sveiktos sužalojimo atveju, ypač jos atlyginimo galimybė galiojant 1964 m. CK, neturtinės žalos dydžiui nustatyti reikšmingi kriterijai, trečiųjų asmenų teisė reikalauti neturtinės žalos atlyginimo, socialinio draudimo išmokų įskaitymas. Sie ist auch das geschützte Objekt des Zivilrechts, deshalb haftet jener, der die Gesundheit eines Menschen verletzt hat. Im ersten Teil der Arbeit werden die Voraussetzungen betrachtet, die obligatorisch für die Anwendung der Haftung sind: rechtswidrige Handlung, Schaden, Kausalzusammenhang zwischen der rechtswidrigen Handlung und dem Schaden, Schuld. Man wird auch folgende Fragen erörtert: Klageverjährung u. s. w. Das wichtigste Ziel der Haftung ist der Ausgleich der Personenschaden, deshalb werden im zweiten Teil der Arbeit die Fragen bearbeitet, die meistens problematisch in der Jurisprudenz sind: die zu ersätzenden Schäden, Ersatz der Heilungskosten, Zahlung der Einkommensverluste gemäss dem Zivilgesetzbuch des Jahres 1964 und des Jahres 2000 (besonders auf Fällen, wenn der Verletzte jünger als 14 Jahre, ein Rentner oder Student ist), Schadensersetzberechnung, Ersatz des immateriellen Schaden, für dessen Bemessung wichtige Kriterien, Anspruchsberechtigte Dritte. Im dritten Teil der Arbeit wird die Kfz-Haftpflichtversicherung als Mittel des Schadensersatzes betrachtet. Bei manchen Fragen wird vorgewiesen, wie sie in Deutschland eingestellt und von den Gerichten erklärt werden. Am Ende der Arbeit werden die Schlussfolgerungen vorgelegt.
