A pesquisa se concentrou na consulta de sua produção acadêmica mais importante, objetivando compreender seu pensamento como um sistema em relação ao qual se articulam os elementos. Os resultados foram comparados com a ideologia do Individualismo e com o posicionamento de alguns outros autores brasileiros, visando a estabelecer continuidades e contrastes e, com isso, explicitar melhor os pressupostos e os valores embutidos nos seus julgamentos.

Mas nem por isto é fácil arguir simplesmente que quando fala em tom elogioso da experiência inglesa, por exemplo, o faz com finalidade argumentativa, com vistas a tornar seu discurso informado e palatável. Nada disso. A hipótese a ser explorada aqui é a de que a reflexão teórica de Oliveira Vianna repousa sobre dois recursos à história. Um que formula uma narrativa sobre o passado e põe para frente um objetivo, a solidariedade. E outro ao qual recorre com menos frequência, de forma menos clara, e que guarda relação com uma finalidade mais ampla: a de inscrever o Brasil na rubrica da modernidade. Sim, como quem concebe um movimento certo para a história, mas inscrevendo nele mais de um projetos possíveis. Isto é, se por um lado a Europa moderna é liberal, coisa que o Brasil não pode ser, por outro, a Europa do corporativismo coloca a possibilidade de uma modernidade que, como não é etapa, mas substituto do liberalismo, representaria um caminho mais curto para a realidade pátria. / Oliveira Vianna is clear in his anti-liberalism. However, it is not so easy to simply argue that when he speaks in laudatory tone of the English experience, for example, he makes a merely argumentative point, in order to make his speech informed and palatable. The hypothesis to be explored is that the theoretical work of Oliveira Vianna rests on two appeals to history. A formula in which a narrative about the past helps to place a social and political goal in the future. And another which is used less frequently, less clearly, and that is related with a broader purpose: to enter Brazil in the rubric of modernity. Yes, as one who conceives a correct movement to history, but also the possibility s different projects. That is, on the one hand, modern Europe is liberal, something Brazil can not be; for another, corporativism in Europe raises the possibility of a modernity that is not a step, but replacement of liberalism and that would represent a shorter way between the Brazillian reality and modernity.

Com essas informações, o objetivo central do presente trabalho será avaliar a natureza de permeabilidade da Consolidação das Leis do Trabalho, tendo como ponto de questionamento a existência e atuação das Convenções Coletivas, dotadas ambas de objetivos similares, atuando inicialmente de maneira complementar para, então, após o alcance da preparação social para implantação de institutos corporativos, ter a CLT sua existência relativizada. / This study aims to develop an analysis of the thought of the jurist and sociologist Oliveira Vianna, addressing main ideas defended in his works to then consider the period in which he served as Legal Counselor of the Labor Ministry in the Vargas government, identifying its influence on lab and syndical laws newly developed, also demonstrating the problems faced by Vianna with the employer class and that culminated in his departure from this Ministry. With this information, the central objective of this study is to evaluate the nature of permeability of the Consolidation of Labor Laws, taking as a point of questioning the existence and activity of the Collective Conventions, both endowed with similar objectives, initially acting in a complementary way to then, after reaching social preparation for implementation of corporate institutes, have the CLT their existence relativized.

[pt] O presente estudo de dissertação de mestrado buscou abordar uma leitura sobre o Brasil - em seu passado e presente – circunscrito ao contexto político e social das décadas de 1920 e 1930, período reconhecido como de formação do próprio campo de História do Brasil. No momento em que se definia a História, se ciência ou se arte, e os historiadores, a figura do intelectual engajado, homem público de política e de letras abria um espaço de disputas pela promoção de um discurso. É nesse espaço que se insere Oliveira Vianna, intelectual no sentido mais amplo da palavra que fez da História seu caminho argumentativo para pensar a política e sociedade brasileiras. Por tantos anos personificado sob inúmeras alcunhas, tentou-se aqui resgatar não tanto o próprio Oliveira Vianna, mas o Brasil nascido a partir de seu pensamento e delimitar o real alcance de suas ideias. / [en] This study dissertation sought to address a reading of Brazil - in his past and present - limited to the political and social context of the 1920s and 1930s, recognized as period of formation of the own field of the history of Brazil. The moment that defined the history, whether science or art, and historians, the figure of the committed intellectual, policy and public man of letters opened a dispute space by promoting a speech. It is in this space that is part Oliveira Vianna, intellectual in the broadest sense of the word that made history his argumentative way to think politics and Brazilian society. For so many years personified under numerous monikers, he tried to rescue here not so much own Oliveira Vianna, but Brazil born from his thought and define the actual scope of his ideas.

Este estudo procura levantar as divergências e convergências entre Oliveira Vianna e Raymundo Faoro. Suas teses divergem por serem paradigmáticas de duas linhagens opostas do pensamento político e social brasileiro respectivamente, a do idealismo orgânico e a do idealismo constitucional. Entretanto, ao mesmo tempo existem inúmeros pontos de cruzamentos entre essas linhagens: focalizamos, sobretudo, aqueles relacionados com o fato de Vianna e Faoro estarem vinculados a um debate jurídico sobre os limites do Estado Democrático de Direito, que perpassou a história do Brasil ao longo do século XX. Para tanto, analisamos a participação de Vianna no momento constituinte da década de 1930 e de Faoro na década de 1980 e o fato de ambos terem enfrentado o mesmo oponente, qual seja, a elite dirigente que, na visão dos dois autores, importava instituições políticas estrangeiras e imaginava ser possível mudar o país exclusivamente por meio de leis produzindo, assim, um país legal em descompasso com o país real. / This study explores the differences and similarities between Oliveira Vianna and Raymundo Faoro. Their theses diverge because they are paradigmatic of two opposing lines of the Brazilian political and social thought - respectively, the organic idealism and the constitutional idealism. However, there are numerous points of intersection between the lines mentioned. We emphasize the points of intersection related to the fact that Vianna and Faoro were both engaged in the legal debate about the limits of the democratic state; which pervaded the history of Brazil throughout the 20th century. More precisely, we analyze the participation of Vianna in the period of the constituent assemblies, in the 1930s, and the activities of Faoro in the 1980s, as well as the fact that they both faced the same opponent, that is, the ruling elite. In the opinion of both authors, this elite imported foreign political institutions, and considered it possible to change the country based exclusively on laws then creating a legal country that mismatched with the real country.

In other words, we try to determine which arguments were used by the authors in order to demonstrate that the state is a product of sociabilities, and these, products of specific individuals. / O objetivo deste estudo é o de encontrar, para efeito de comparação, nas obras de Sérgio Buarque de Holanda (1936) e Oliveira Vianna (1949), o raciocínio que procura demonstrar que a singularidade ideacional constitutiva do indivíduo brasileiro, fora capaz de gerar um ethos específico que, por consequência, deveria se cristalizar na institucionalização de um Estado portador de um determinado conjunto de caraterísticas. Em suma, este estudo persegue a argumentação, contida nos dois autores, de que o Estado é consequência de sociabilidades de indivíduos específicos.

O objetivo desta tese é compreender as tensões e metamorfoses existentes na análise social realizada por por alguns do principais autores brasileiros da virada do século XIX para o XX, rocurando demonstrar que, indo além das ideologias racistas presentes em suas obras, eles tentavam compreender e explicar a sociedade e a cultura rasileiras, abrindo, assim, novos caminhos e horizontes para outros estudos. Neste sentido, serão analisadas as obras de Sílvio Romero, Nina Rodrigues, Euclides da Cunha e Oliveira Vianna, tomando a perspectiva analítica de comparar como estes autores, clássicos e fundamentais para a compreensão do Brasil, conseguiram superar o racismo que aparecia inerente em suas obras, mostrando uma abordagem crítica em relação à sociedade brasileira e abordando aspectos culturais e sociais do Brasil, até então inéditos / The objective of this thesis is to understand the existing tensions and metamorphoses in the social analysis carried through by for some of the main Brazilian authors of the turn of century XIX for the XX, looking for to demonstrate that, going beyond the racist ideologies gifts in its workmanships, them they tried to understand and to explain the Brazilian society and the culture, opening, thus, to new ways and perspectives for other studies. In this direction the workmanships of Sílvio will be analyzed Romero, Nina Rodrigues, Euclides of Cunha and Oliveira Vianna, taking the analytical perspective to compare as these authors, basic classics and for the understanding of Brazil, had obtained to surpass the racism that appeared inherent in its workmanships, showing a critical boarding 6 in relation to the Brazilian society and approaching cultural and social aspects of Brazil, until then unknown.
