A CNMF representa a concretização do princípio da nãodiscriminação, uma das bases da OMC. No exercício desta importante função, a CNMF dispõe que todas as vantagens e privilégios acordados a um Membro da OMC devem ser estendidos a todos os demais Membros da organização, imediatamente e sem imposição de condições. Entretanto, tendo sido criada dentro de um contexto que agrega parceiros com características econômicas, sociais e políticas bastante díspares e temas nem sempre passíveis de um tratamento multilateral, como os investimentos estrangeiros e os temas não-comerciais, a aplicação absoluta da CNMF e o estabelecimento de um tratamento igualitário nem sempre é possível, tendo que admitir exceções, refletindo um viés ora de flexibilidade, ora de rigidez. Todavia, não se pode afirmar que a importância e o papel da CNMF dentro do sistema OMC diminuiu. O que deve ser considerado é que diante do inevitável fenômeno de proliferação do uso de acordos bilaterais no estabelecimento de trocas comerciais internacionais, restou a esta organização o importante desafio de ajuste de seus dispositivos. Enfim, o que se verifica é um sistema mundial de trocas antagônico e ao mesmo tempo harmonioso, agregando instrumentos que, apesar de possuírem lógicas contrárias, não necessariamente se excluem.

Toma-se a dicotomia Norte-Sul como ponto de partida. Tendo em vista que o estudo se concentra na história, percebe-se que, aos menos nas primeiras cinco décadas de operação do GATT, outras conformações antagônicas detêm maior influência sobre o regime do comércio internacional de produtos agrícolas. O embate entre Estados Unidos e Comunidade Européia na década de oitenta é fundamental para entender a sistemática do Acordo Agrícola em vigência. Com o aumento do interesse de países em desenvolvimento, o cenário muda nas negociações da Rodada Doha. O uso mais freqüente de elementos como tratamento preferencial, não reciprocidade e discriminação positiva em benefício de países de baixa renda torna o diálogo Norte-Sul mais relevante ao se analisar o regime do comércio internacional de produtos agrícolas. No entanto, reconhece-se que a tensão entre economias centrais continua exercendo um papel fundamental nesse tocante.

A dissertação estuda a figura das indicações geográficas (IGs) com foco em sua pregressa e atual regulamentação nacional e internacional, nas discussões nos foros multilaterais, bem como na situação brasileira de reconhecimento das indicações geográficas, evidenciandose as potencialidades que se oferecem ao país por meio dos esforços para reconhecimento nacional e internacional de seus nomes geográficos. A dissertação inicia-se com a apresentação dos conceitos gerais e das funções da figura estudada, bem como da distinção entre as IGs e demais sinais distintivos. Na segunda parte, é analisada a regulamentação das indicações geográficas nos principais acordos internacionais (Convenção de Paris, Acordo de Madri, Acordo de Lisboa), com especial atenção ao seu tratamento no âmbito do Acordo TRIPS/OMC, bem como às propostas apresentadas por seus Membros. Com o intuito de analisar a experiência bem sucedida de países que ultrapassaram os níveis de proteção definidos nos foros multilaterais, o terceiro capítulo será consagrado ao estudo da normatização da União Européia e da organização administrativa francesa sobre a matéria. A última parte é dedicada à análise da regulamentação nacional em matéria de indicações geográficas (Lei nº 9.279/96) e da estrutura organizacional criada para o reconhecimento e proteção de tal figura, sendo expostas as experiências brasileiras no tocante ao reconhecimento das indicações geográficas, as tentativas em curso e os setores que ainda poderão ser beneficiados. Analisa-se, ao final, a compatibilidade do regime brasileiro com os compromissos assumidos internacionalmente pelo país e as possibilidades existentes para o país explorar a figura como meio de agregar valor às suas transações comerciais e aproveitar-se dos benefícios de tal exploração. / The dissertation examine the geographical indications (GIs) with focus on its past and present national and international regulation, the discussions in multilateral forums as well as the recognition of geographical indications by Brazil, demonstrating the possibilities that are offered to the country through the efforts for national and international recognition of its geographical names. The dissertation begins with the presentation of general concepts and functions of the GIs, as well as the distinction between the GIs and other distinctive signs. In the second part, it is presented a study on the major international agreements regarding GIs (Paris Convention, Madrid Agreement, and Lisbon Agreement), with special attention to the treatment under the TRIPS / WTO and the proposals made by its Members In order to analyze the successful experience of countries that have surpassed the levels of protection set out in multilateral forums, the third chapter will study European Union regulation and French administrative organization on the subject. The last part is devoted to a review of national legislation on geographical indications (Law 9279/96) and the organizational structure created for the recognition and protection of such a figure, being exposed the Brazilian experiences with regard to the recognition of geographical indications, ongoing attempts and sectors that can still benefit. At the end, it will be analyzed the compatibility of the Brazilian system with the international commitments signed by the country and the possibilities for the country to explore the figure as a means of adding value to their business transactions and taking advantage of the benefits of such exploitation.

O objetivo desta dissertação consiste em analisar a atuação da coalizão G-20, no âmbito da Rodada Doha, da OMC, tendo como foco principal o entendimento das posições brasileiras na coalizão. Procuramos compreender a receptividade da política externa brasileira às pressões domésticas, no caso da atuação do país, no G-20, bem como a influência dos atores domésticos, governamentais e não governamentais, no processo de formulação e de implementação da estratégia brasileira na coalizão. Argumentaremos que a forma como o Brasil atua, no G-20, relaciona-se, tanto com o processo interno de construção da posição negociadora do país, quanto com os limites que a própria lógica das negociações estabelece. A unidade de decisão que estrutura a posição brasileira é uma variável importante para o entendimento da postura do país e para manutenção da coalizão. / The objective of this text is to analyze the performance of the G-20 at Doha Round in the WTO, having as main focus the brazilian position in the coalition. We will try to comprehend the receptiveness of the brazilian foreign policy to the domestic pressures considering the countries positions in the coalition. We argue that the brazilian positions, in the G-20, are related to the domestic decision making structure, as well as to the limits of the negotiations logic. The decision unit that structures the country position is an important variable to understand brazilian positions and the maintenance of the coalition.

L'indication Géographique, signe distinctif particulièrement spécifique, a connu au XIXème et XXème siècle, par, notamment des législations nationales éparses, des accords bilatéraux ou des conventions multilatérales, voire même l'utilisation contentieuse des moyens juridiques de lutte contre la concurrence déloyale, différents types de protection utiles mais limités. Ces derniers, appuyés par l'intervention de la Communauté Européenne, ont, néanmoins, eu le grand avantage de rendre possible l'émergence internationale, dans l'Accord ADPIC, d'une section spécifique dédiée. Ce texte issu des Accords de Marrakech instituant, en 1994, l'Organisation Mondiale du Commerce (OMC) reconnaît, en effet, l'Indication Géographique comme l'objet d'un droit autonome de Propriété Intellectuelle. Il lui permet de disposer d'une définition et d'un régime juridique, et surtout oblige les différents Membres de l'OMC, à le reconnaître et à le protéger. En posant un principe de liberté dans la mise en œuvre de ce dispositif nouveau qui, contrairement aux autres Droits de Propriété Intellectuelle, et en particulier aux marques, ne s'applique pas à un système préexistant, cet Accord a eu pour conséquence non pas une uniformisation, mais une certaine hétérogénéité des situations nationales. Celles-ci ont pu conduire, dans certains cas, à un métissage ou à une substitution des concepts, notamment à cause de l'intégration des Indications Géographiques dans des systèmes préexistants de Propriété Intellectuelle, comme celui des marques de certification / Geographical Indication, a particularly specific distinguishing sign, experienced throughout the XIXth and XXth centuries, under specially scattered national legislations, joint conventions or bilateral agreements, even under the contentious use of legal means to combat unfair competition, different types of useful but limited protection. These latter, supported by the intervention of the European Community, had however the advantage of contributing to make a specific dedicated section emergence possible in the Trip's agreement. This text coming from the Marrakech Agreements which established in 1994 the World Trade Organization (WTO), recognizes in fact the Geographical Indications as an independent law of Intellectual Property. It allows them to rely on a definition and a legal system, and bind the different members of the WTO to their recognition and protection. In asserting a principle of liberty in the implementation of this new system which, contrary to the other rights of Intellectual Property, and particularly of marks, does not apply to a preexisting system, this Agreement has not resulted in a uniform effect but heterogeneity of national situations. In special cases, these situations may have led to a knowledgeable mix or substitution of concepts, particularly because of the Geographical Indications integration into preexisting systems of Intellectual Property such as certification marks. Beyond the recognition of the Geographical Indication definition in these texts, the existence of two types of protection, simple and additional, has also practical consequences on these different integrations

De nos jours, le multilatéralisme et le libre échange sont le fondement du système économique. La participation de la Thaïlande à l’OMC et au FMI joue un rôle incontournable dans les stratégies de développement du pays. En tant que pays en développement et malgré certaines dispositions particulières en sa faveur, l’influence qu’elle exerce au sein de chaque institution reste limitée. Ce qui l’a conduite à chercher des alliances en regroupant avec les pays qui partagent les mêmes positions pour mieux se faire entendre.Grâce à cette participation, le gouvernement thaïlandais dispose d’une source de financement en cas de crise économique et financière. Il peut mieux mener les politiques commerciales dont l’accent a été mis sur la promotion des exportations et avoir un mécanisme de règlement des différends qui lui permettent de défendre les intérêts de ses producteurs de manière plus efficace surtout lorsqu’il s’agit d’un différend avec des pays développés. Mais face à des limites du système multilatéral à vocation universelle (impasse du Cycle de Doha, problème de la conditionnalité de l’aide et de l’efficacité des mesures prévues par le FMI), la Thaïlande est retournée plus vers le bilatéralisme et le régionalisme afin de protéger les intérêts du pays. / In this day and age, multilateralism and free trade are the foundations of theeconomic system. The participation of Thailand in the World Trade Organization (WTO) andthe International Monetary Fund (IMF) plays an essential role in the development strategies ofthe country. As a developing country and despite some specific provisions in its favour,Thailand’s influence within each institution is limited. A greater voice, by gathering withcountries that share the same positions, prompted Thailand to seek such alliances. Throughthis participation, the Thai government has a funding source in the event of economic andfinancial crisis. They can improve trade policies that focus on export promotion and have adispute settlement mechanism that allows them to better defend the interests of its producers,especially when these disputes involve developed countries. But the limits of the multilateralsystem (Doha round impasse, the issue of conditionality and effectiveness of the IMF’smeasures) incite Thailand to turn more towards bilateralism and regionalism for protecting thecountry’s interests.

Le droit de l’omc et l’agriculture : analyse critique et prospective du système de régulation des subventions agricoles / The WTO law and agriculture : critical and prospective analysis of the regulation system of farm subsidies

Du GATT de 1947 à l’OMC, l’encadrement juridique de l’agriculture demeure un processus difficile et laborieux tant dans ses aspects processuels, normatifs qu’institutionnels. Le cadre décisionnel de l’OMC marqué du sceau du « consensus », peine à instituer un cadre normatif satisfaisant. De plus, la conclusion d’un Accord global sur les politiques agricoles est retardée par des stratégies de blocage ou des coalitions de circonstance lors des négociations multilatérales successives. La question agricole se retrouve donc coincée entre des enjeux nationaux et des logiques d’économie politique que ni le droit positif de l’OMC, ni les processus décisionnels en vigueur à l’Organisation Mondiale du Commerce ne parviennent à résorber. Par ailleurs, le processus de démantèlement des barrières tarifaires a laissé place à des politiques nationales de subventionnement massif que les accords sur l’agriculture et celui sur les subventions et mesures compensatoires tentent en vain d’endiguer. Cette thèse jette donc un regard critique sur ce phénomène à travers une réflexion approfondie du statut juridique de l’agriculture en général et du traitement particulier des subventions agricoles. De cette analyse, il ressort que l’impasse de Doha relève d’une triple carence du système de régulation des subventions agricoles. D’abord, une carence du cadre normatif découlant du « péché originel » de l’exception agricole largement décrite dans la première partie de la thèse. Ensuite, et telles que décrites dans la deuxième partie de la thèse, une carence institutionnelle relevant de l’inadaptation de l’architecture de l’OMC, principalement le processus décisionnel face au phénomène du subventionnement agricole et une carence structurelle liée au déroulement des négociations multilatérales. La thèse démontre donc que cette triple carence explique pourquoi il demeure difficile au processus de Doha de déboucher sur des engagements contraignants en terme d’élimination des subventions agricoles et en terme de politiques de développement favorables aux PED et PMA. La thèse démontre aussi que l’impuissance du « système OMC » face aux divergences agricoles animées notamment par les États-Unis, l’UE, le groupe de Cairns et le groupe africain sur le coton découle de cette triple carence. Prospectivement, il s’est donc avéré nécessaire de formuler des alternatives nouvelles reposant sur l’introduction des logiques d’efficacité lors de l’élaboration et de l’application des mesures anti-subvention ainsi que dans les techniques de négociations commerciales multilatérales. / From GATT 1947 to WTO, the legal framework of agriculture remains a difficult and laborious process in its procedural aspects as well as in its normative and institutional ones. The decision framework of the WTO is marked by the seal of "consensus" and hardly allows to establish a satisfactory regulatory framework. A comprehensive agreement on agricultural policy has been postponed by blocking strategies or ad hoc coalitions at the critical times of the successive multilateral negotiations. Therefore, the agricultural question is being smothered by national issues and the logic of political economy which neither positive law of the WTO, nor the decision-making processes in force at the World Trade Organization have been able to resorb. The process of dismantling trade barriers has given way to national policies of massive subsidizing that the agreements on Agriculture and on Subsidies and Countervailing Measures have tried to stem in vain. This thesis reviews this phenomenon with a critical eye through an extensive consideration of the legal status of agriculture in general and the special treatment of agricultural subsidies. This analysis shows that the dead-end situation in the Doha negotiations result from a triple deficiency of the regulatory system on agricultural subsidies: (1) a deficiency of the regulatory framework resulting from the "original sin" of the agricultural exception, (2) an institutional deficiency coming from the inadequacy of the architecture of the WTO, mainly the decision-making process in relation to the phenomenon of agricultural subsidies and (3) a structural deficiency related to the conduct of the multilateral negotiations. This thesis demonstrates that these three deficiencies explain why it remains difficult for the process of Doha to bring binding commitments on the elimination of agricultural subsidies and development policies which would favour of developing countries and LDCs. The thesis also reveals that the inability of the "WTO system" to cope with diverging views over agriculture mainly livened up by the United States, the EU, the Cairns Group and the African Group on cotton results from those three deficiencies. A prospective analysis leads to the formulation of new alternative solutions based on the introduction of logics of efficiency in the elaboration and application of anti subsidy measures altogether with multilateral trade negotiation techniques.

L'union européenne et les obtacles non tarifaires : analyse de la pratique conventionnelle européenne à l'aune du droit de l'OMC / The European Union and Non-tariff Barriers : analysis of European Conventional Practice in the Light of WTO Law

La baisse généralisée des tarifs douaniers, combinée au développement fulgurant du mouvement delibéralisation à l’échelle mondiale, a entraîné un foisonnement extraordinaire des obstacles nontarifaires. Cette tendance s’explique par la volonté des Etats souverains de limiter l’emprise du libreéchangesur leurs politiques publiques. Ils pratiquent, par le truchement des obstacles non tarifaires, unprotectionnisme qui, au demeurant, est doublement appréhendé. Dans un sens, ce protectionnisme estéconomique. Il vise à protéger les opérateurs économiques nationaux de la concurrence étrangère, leurassurant ainsi des parts de marché au détriment d’autres opérateurs internationaux. Il est dès lors illicite.Dans un autre, le protectionnisme se veut licite dans la mesure où les obstacles non tarifaires sont érigésafin de parer à la négation d’objectifs non économiques légitimes. En dépit du fait qu’elle soitpromotrice du libéralisme, l’Union européenne, conformément à ses traités constitutifs, se veutprotectrice d’un certain nombre de valeurs non marchandes dont elle a du mal à imposer le respect dansle cadre multilatéral de l’OMC. L’atteinte de ce double objectif est recherchée au travers de la pratiqueconventionnelle européenne. Celle-ci est marquée par la conclusion d’accords bilatéraux avecdifférentes régions du monde, dans le cadre d’une entreprise de « maîtrise de la mondialisation ». Sur leplan strictement juridique, trois ordres s’interpénètrent dans l’explication de la pratique conventionnelleeuropéenne des obstacles non tarifaires : l’ordre constitué par les « accords externes », celui del’ « Union européenne » et enfin l’ « ordre multilatéral ». / The generalized decline of tariffs, combined to the dazzling development of liberalism around theworld, led to an extraordinary expansion of non-tariff barriers. This trend is explained by the desire ofsovereign States to restrict the hold of free trade on their internal policies. By using non-tariff barriers,they implement protectionism which is of two kinds. On the one hand, this protectionism is economic. Itaims to protect national economic operators from foreign competition, assuring them market shares atthe expense of other international operators. This protectionism is unlawful. In another hand, theprotectionism must be licit because non-tariff barriers are erected in order to avoid the negation oflegitimate non-economic objectives. Despite the fact that it promotes liberalism, the European Union, inaccordance with constituent treaties, protects non-market values which are hardly defended in WTO.Achieving this double objective is sought through european conventional practice. The latter isdominated by the conclusion of bilateral agreements with different regions through the world. The coreobjective is to « manage globalization ». In this context, three legal orders interact in the explanation ofthe european conventional practice of non-tariff barriers : the « order of bilateral agreements », the oneof « European Union » and the last of « WTO ».

L’impact de l’asymétrie des pouvoirs sur le mécanisme de règlement des différends de l’OMC : vers une justice pragmatique?

Le passage du GATT à l’OMC a été voulu comme le passage d’un système basé sur le pouvoir à un système basé sur le droit. Pourtant, une analyse approfondie du contentieux de l’OMC révèle une image plus nuancée d’un mécanisme juridictionnel qui n’a pas pleinement réussi à évincer l’influence du pouvoir politique. Dans les faits, le mécanisme de règlement des différends de l’OMC apparaît comme un organe qui opère dans un contexte d’indépendance limitée en ce qu’il interagit avec les éléments politiques du système à différents égards. Dans cette perspective, et malgré un bilan généralement positif, de nombreux auteurs affirment la nécessité de renforcer le mécanisme. Ils invoquent certains différends qui n’ont pas été résolus suite à l’épuisement de la procédure contentieuse. À cet égard, et bien que la mise en œuvre des engagements étatiques joue assurément un rôle essentiel dans l’atteinte de la justice dans le contentieux de l’OMC, nous avons tenté de démontrer dans le cadre de cette thèse que la justice que dispense ce mécanisme va au-delà de l’idée répandue selon laquelle le système est essentiellement un instrument de mise en œuvre du droit. La thèse démontre que différentes formes de justice dispensées par le mécanisme peuvent inclure notamment une forme pragmatique de justice, qui ne se limite pas aux règles et aux procédures, mais qui consiste également à délivrer le meilleur résultat dans un différend spécifique. C’est cette justice pragmatique qui se manifeste particulièrement dans les différends mettant en jeu une asymétrie de pouvoir que nous avons cherché à analyser selon le cadre théorique du pragmatisme juridique. Il est donc question dans cette thèse de l’étude des moyens par lesquels les acteurs du mécanisme, à savoir les membres des groupes spéciaux et de l’Organe d’appel mais aussi les États, adaptent l’application des règles de droit selon le contexte spécifique de chaque différend. Les résultats obtenus peuvent à certains égards susciter des interrogations quant à leurs fondements juridiques mais ils mènent certes à contenir les effets du pouvoir politique qui demeure une réalité dans le cadre du processus de règlement des différends à l’OMC. / The transition from the GATT to the WTO was intended as the transition from a power-based system to a rule-based system. Yet an in-depth analysis of WTO litigation reveals a more nuanced picture of a jurisdictional mechanism that has not fully succeeded in crowding out the influence of political power. In fact, the dispute settlement mechanism of the WTO appears as a body operating in a context of limited independence in that it interacts with the political elements of the system in different ways. In this perspective, and despite a generally positive assessment, many authors affirm the need to strengthen the mechanism by pointing to different instances of non-compliance that have persisted long after the exhaustion of the litigation procedure. In this respect, and while the implementation of State commitments certainly plays a key role in achieving justice in WTO litigation, this thesis aims to demonstrate that the WTO dispute settlement is not only an instrument of law implementation. The thesis will demonstrate that different forms of justice dispensed by the mechanism may include a pragmatic form of justice, which is not limited to rules and procedures, but which helps deliver the best result in a specific dispute so as to reflect the interests of the parties.. It is this pragmatic justice that manifests itself particularly in disputes involving an asymmetry of power and that we seek to explore through the theoretical framework of legal pragmatism. This goal will be achieved by studying the means through which the actors of the mechanism, namely the panelists but also the States, adapt the application of WTO rules according to the specific context of each dispute.
