Heranças perigosas : arqueogenealogia da "periculosidade" na legislação penal brasileira

Esta dissertação investiga a emergência da noção de periculosidade na legislação penal brasileira através da reconstrução das discussões formuladas no âmbito da medicina e do direito. Adotando uma abordagem arqueogenealógica de pesquisa, inspirada na obra de Michel Foucault, busca reconstituir as diferentes problematizações que foram formuladas no Brasil a respeito da imputabilidade penal e seu entorno. Esta dissertação enfoca assimilação das discussões sobre crime e loucura dos autores europeus nos escritos brasileiros das disciplinas da criminologia, medicina legal e psiquiatria realizados desde o período que antecede a aprovação do Código Penal de 1890, passando pelos debates penais centrados na “questão racial” e na “questão social”, até as discussões alimentadas em torno da “defesa social” e seus reflexos no Código Penal de 1940. Conclui que as propostas tanto da criminologia quanto da medicina legal e da psiquiatria para a adoção de uma legislação penal baseada nos princípios da “defesa social” não foram incorporadas neste Código na extensão almejada por seus defensores. / This dissertation investigates the emergency of the periculosity notion in the Brazilian penal legislation throughout the disputations formulated in the ambit of medicine and right. Adopting an archeogenealogical approach of research, inspired on the Michel Foucault’s work, this enquire search to reconstitute the different problematizations formulated in Brazil among the penal responsibility and his nearness. This dissertation focuses the assimilation of the disputations about crime and madness of the European authors in the brazilian writers of the disciplines of criminology, legal medicine and psychiatry realized since the period before the approbation of the Penal Code of 1890, undergoing the penal debates centered in the “racial question” and in the “social question”, up to the disputations nourished among the “social defense” and his reflexes in the Penal Code of 1940. The conclusion of this work is that the propositions as far of the criminology as of the legal medicine and of the psychiatry for the adoption of a penal legislation founder in the principles of the “social defense” were not incorporated in the extension desired by his sponsors.

Foi possível, por meio da análise dessa documentação, acompanhar o percurso da produção do vadio enquanto indivíduo passível de conhecimento do saber/poder. Refletiu-se ainda sobre a produção do Código Criminal de 1830, base para o nascimento legal do poder disciplinar no Brasil. Com essa nova estrutura jurídica, a polícia ganhou embasamento legal para agir no cotidiano dos indivíduos pobres livres, seu alvo preferencial. Esse novo tipo de controle e punição de comportamentos indesejáveis irá perpassar e irradiar-se por todo o corpo social em forma de rede, levando finalmente as informações até o Imperador. Portanto, este estudo analisou as formas de poder que nortearam o período imperial brasileiro de 1824 a 1889 e se constituíram em instrumentos utilizados pela elite agrária para inserir os pobres livres no modelo de nação pretensamente liberal e moderna. / This dissertation broached the penal juridical thought in Brazil and its historical process during the 19th century focusing on the writing of discourse in processual documents, the so-called termos de bem viver (the propriety of conduct law), one of the documentary sources of the research at issue. By means of an analysis of such papers, one could trace the course of the expression idler as someone subject to the knowledge of the keepers of the law. One also pondered upon the working up of the disciplinary power in Brazil. Due to the new juridical framework the police attained legal power to act on the everyday life of the free poor, their preferred target. The new kind of control and punishment of undesired behavior will affect and spread about the whole social body like a network which eventually puts the information up to the emperor. Therefore, this dissertation analyzed the new ways of power which guided the Brazilian imperial period from 1824 to 1889 and which became a device used by the imperial agrarian elite meant to insert the free poor into an alleged liberal and modern nation model.

This thesis aims to define the differences between the concept of self-defense under the criminal law of the Czech Republic and the United States of America, to assess their practical implications and propose possible recommendations de lege ferenda for the Czech legislation. Within the United States, the thesis further distinguishes between the concept of self-defense under the common law and the so-called Model Criminal Code, which together with the common law represents one of the most important sources of US criminal law. The thesis first compares the differences between the Continental and Anglo-American legal system, from which the respective national legal systems derive. Next part of the thesis further characterizes the Czech and American legal system, especially with regard to the status of criminal law and the role of jurisprudence within it. Particular attention is paid to the division of US legal system into federal and state, and the related issues of the organization of the judiciary and the system of precedents between various judicial bodies. This part then further introduces the aforementioned Model Criminal Code, which presents a compilation of the views of high-profile experts in the field of criminal law regarding the ideal form of criminal substantive law in the United States....

<p>Abstract</p><p>This study will shed light on the meaning of article 301 of the Turkish Penal Code and its</p><p>inconformity with fundamental principles of the European Union and fundamental human</p><p>rights. The trial of Nobel Prize winner, Mr Orhan Pamuk and the killing of Mr Hrant Dink in</p><p>January 2007 have both put focus on the notorious article 301 of the Turkish Penal Code.</p><p>The purpose of the study is to answer the main question; In what way does article 301 of the</p><p>Turkish Penal Code infringe the freedom of expression outlined in article 10 of the European</p><p>Convention on Human Rights and what should the European Union do about it?</p><p>The conclusion is that article 301 of the Turkish Penal Code infringes the right to freedom of</p><p>expression stated in article 10 of the European Convention on Human Rights. It does</p><p>undermine the essence of the right by invoking a wide range of self-censorship, by its</p><p>ambiguous language and by the way it is applied. The restrictions are interpreted broadly and</p><p>leave nothing but an arbitrary article left to apply for the courts. The European Union holds</p><p>the power to influence Turkey and can therefore enforce an abolition of article 301 of the</p><p>Turkish Penal Code. Time will tell if Turkey will fully safeguard freedom of expression as it</p><p>is stated in article 10 of the European Convention of Human Rights and in the praxis of the</p><p>European Court of Human rights and the European Court of Justice.</p>

Insanity: Comparison of Czech and American legal concept Abstract The aim of this thesis is to capture the essence of the institute of insanity from the substantive point of view according to the Czech and American legislation and to deduce any differences from them. First, the continental legal system on which the Czech legal order is based is compared with the Anglo-American legal system from which the American legislation is derived. Subsequently, the basic pillars of the Czech legal order including the position of criminal law are defined. Attention is also paid to the political system of the United States, because, as a result of federalism, there are two levels of law that have a significant impact on national legislations. Hereupon, the structure of criminal liability according to Czech law is analyzed. Since the prerequisite of criminal liability is the commission of a criminal offense, this is also defined. For the purposes of comparison, circumstances excluding punishability as well as circumstances excluding liability are outlined. Due to the fact that US law is based on common law, criminal liability is defined both from the perspective of common law and the Model Penal Code, which are of the basic sources of US criminal law.
