In many countries, the debates about nation as reality or project were performed in racialist terms. This happened in Brazil, in a very peculiar way, because marked by the long existence of the slavery. Guided by theories of inferior races, many Brazilian thinkers have doubted that a country of mestizos and mulattos would be feasible. This research, exploring the set of the age, aims to emphasize and compare the studies of two authors on national things and themes. We intend to verify the influence of the European doctrine in their reflections and understand the conception that each author has of nation in general and about the possibility of a nation be constituted in this country situated on the tropics. This work has three chapters. In the first, there is a brief account of some of the principal outlooks about nation and, next, we insert the conceptions of Manoel Bomfim e Paulo Prado. In the second chapter, is examined the influence of the notion of race in the Brazil s process of constitution and how it was interpreted by both authors. The culture theme has been receiving, in the last decades, relative attention in the area of organizational studies. Despite the attention received, it is possible to perceive gaps in academic production about the theme on the attention paid to the national context and to the institutions of the public sector, especially on what refers to the Judictiary Power. In this sense, this work has analyzed the national academic production on brazilian organizational culture in the last twenty years and seekes to identify possibilities to utilize the authors of brazilian social thinking in an organizational culture approach that considered the national context. In the data collection stage, were made thirty-seven semi-structured interviews with employees of the TJBA, in the period from february to july of 2013. The data corpus’ analysis was made with the method of content analysis, with the help of the software ATLAS.ti. The data analysis pointed towards possibilities to utilize the ideas of authors of brazilian social thinking in the study of organizational culture, mainly in the identification of the influence of cultural traces in the workers’ values and social practices. The analysis also indicated an absence of elements based on managerialist values in this institution’s organizational culture, seeking to provoke a reflection on the reach and adequation of the reform model adopted by the Judictiary Power. For contribution, this thesis has seeked to realize a mapping of TJBA’s organizational culture, creating an empiric contribution to the deepening of knowledge on the Judictiary Power on the aspect of organizational universe and to the studies that utilize brazilian social thinking, that has mostly been consisting of theoretical essays. / O presente trabalho teve o objetivo de identificar os elementos da cultura organizacional do Tribunal de Justiça do Estado da Bahia (TJBA) à luz das contribuições de autores do pensamento social brasileiro - representados neste estudo por Sergio Buarque de Holanda, Raymundo Faoro, Darcy Ribeiro e Celso Furtado. O tema cultura tem recebido, nas últimas décadas, relativa atenção na área de estudos organizacionais. Apesar da atenção recebida, é possível perceber lacunas na produção acadêmica sobre o tema quanto à atenção dispensada ao contexto nacional e às instituições do setor público, especialmente no que se refere ao Poder Judiciário. Nesse sentido, o presente trabalho analisou a produção acadêmica nacional sobre cultura organizacional brasileira nos últimos vinte anos e buscou identificar possibilidades de utilização dos autores do pensamento social brasileiro numa abordagem de cultura organizacional que considerasse o contexto nacional. Na etapa de coleta de dados, foram realizadas trinta e sete entrevistas semiestruturadas com servidores do TJBA, no período de fevereiro a julho de 2013. A análise do corpus de dados foi feita pelo método de análise de conteúdo, com auxilio do software ATLAS.ti. A análise dos dados apontou para possibilidades de utilização das ideias dos autores do pensamento social brasileiro no estudo da cultura organizacional, principalmente na identificação da influência dos traços culturais nos valores e práticas sociais dos servidores. A análise apontou também para uma ausência de elementos baseados em valores gerencialistas na cultura organizacional desta instituição, buscando provocar uma reflexão sobre o alcance e a adequação do modelo de reforma adotado no Judiciário. Como contribuição, esta tese buscou realizar um mapeamento da cultura organizacional do TJBA, gerando uma contribuição empírica para um aprofundamento do conhecimento do Poder Judiciário sob o aspecto de universo organizacional e para os estudos que utilizam o pensamento social brasileiro, que em sua maioria têm se tratado de ensaios teóricos.

We tried to understand in which dimension these constitutionals texts were under the influences of the political-andcultural ambient, and also in which degree they was taken by then the ideologies under discussions. It is important to keep in mind that both Constitutions shared similar rudiments and none of them fit under the usual theoretical label. As an effort to provide this answer, we studied the Brazilian social thought during the thirties years, and face it with the main ideas that figure in these constitutionals letters. As a result, we tried to take out the essentials aspects of these letters, taking them not as just simples juridical texts, but as legislations produced under the influences of a specific political-and-cultural ambient. / Partindo do contexto histórico dos anos 30 período de falência mundial do liberalismo e de ruptura da política liberal-oligárquica brasileira, - analisamos as Constituições de 1934 e 1937, procurando elucidar a questão de como em um mesmo contexto histórico subsistiram dois modelos de Estado tão divergentes. Com base na averiguação da existência de princípios similares nestas duas Cartas, somada a sua não correspondência totalmente ao rótulo lhes conferido, buscamos observar em que medida esses textos constitucionais derivavam ou não de uma ativa influência do ambiente político-cultural vigente, logo, de sua incorporação, em maior ou menor grau, das ideologias em debate. Para tal, estudamos as correntes do pensamento social brasileiro em voga nos anos 30, confrontando suas idéias com os princípios constitucionais seguidos por cada uma delas. Procurou-se, aí, desvendar a essência destas Constituições, entendendo-as não como meros textos jurídicos, mas como legislações inseridas em um ambiente políticocultural específico.

Do jardim mágico ao mundo laico: racionalização da religião e do direito em Max Weber

Fundação de Amparo a Pesquisa do Estado de Minas Gerais / It is intended, by means of three essays, to analyze the rationalization of the religion and of the law in Max Weber. It will accentuate how the German thinker understood the "disenchantment" of the world as dismagification of the ways of salvation and as scientific transformation of the world in a "causal mechanism". Nevertheless, the two senses are not simultaneous, there is a unique historical turning to western modernity: the own religious ethos, especially by his Calvinist streak, at the enthroning the impersonality of the social relations and to promote the rationalization of the different spheres of action, stripped the world of his sacral mantle and profane it. On the other hand, will highlight the rise, thanks to the "disenchantment" of the world, the modern legal formalism in which the laws lose their magical aura. The laws are to be reviewable, although the technical-abstract content to become unknown to the layman. Finally, the weberian concepts will be read in light of recent interpretations about the religious, moral and legal modernity of Brazil. Between the lines, will appear the weberian "ethics", secular and self-assured. / Pretende-se, por meio de três ensaios, analisar a racionalização da religião e do direito em Max Weber. Acentuar-se-á como o pensador alemão compreendeu o desencantamento do mundo como desmagificação das vias de salvação e como transformação científica do mundo em um mecanismo causal . Entretanto, os dois significantes não são coetâneos, há uma inflexão história singular à modernidade ocidental: o próprio ethos religioso, sobretudo por seu filão calvinista, ao entronizar a impessoalidade das relações sociais e ao promover a racionalização das distintas esferas de ação, despiu o mundo de seu manto sacral, profanando-o. Por outro lado, destacar-se-á o advento, graças ao desencantamento do mundo, do formalismo jurídico moderno, no qual as leis perdem sua aura mágica. As leis passam a ser revisáveis, remodeláveis, embora o seu conteúdo técnico-abstrato passe a ser desconhecido dos leigos. Por fim, as conceituações weberianas serão lidas à luz das recentes interpretações sobre a modernidade religiosa, moral e jurídica do Brasil. [pt] Este estudo analisa a trajetória do intelectual brasileiro Alceu Amoroso Lima (1893-1983), considerado o mais importante líder do laicato nacional do século XX. A discussão tem início na primeira metade dos anos 50, quando toma corpo importante mudança de registro eclesial operada por Amoroso Lima. Transformação que o faz passar de um modelo de catolicismo tridentino, que reagia à modernidade, a outro mais aberto, plural, em diálogo com o século. Processo de mudança já perceptível em dois relatos de viagem que Amoroso Lima realizou neste período. Relatos que, ritualizando a idéia cristã da vida como peregrinação ao Alto, permitiram a seu autor chancelar os câmbios experimentados a partir de um plano teleológico. A discussão segue com a análise de conceito mais abstrato de peregrinação, aquela que conduziria ao interior do homem, tomado como local de encontro entre o fiel e Deus. Transposta ao universo de Amoroso Lima, tal viagem interior permitiu que este forjasse uma auto-disciplina, tributária de elementos clássicos, anteriores ao cristianismo, e também de espiritualidades cristãs variadas. Assim, voltando-se para seu mundo interior, Amoroso Lima buscava, ao mesmo tempo, unir-se ao divino e controlar os riscos decorrentes do processo de transformação que então vivenciava. Exercício de introspecção que marcou profundamente a maneira como Amoroso Lima experimentou a fé no cotidiano, influenciando também sua ação no mundo exterior. E, assim, retorna-se ao mundo exterior: tendo acompanhado a mudança operada por Amoroso Lima em seu modelo de catolicismo, são analisados os reflexos de tal movimento na forma com que este intelectual passou a intervir no século. Intervenção caracterizada, sobretudo, pelas colunas mantidas por Amoroso Lima na grande imprensa e que deram notável projeção a sua voz no cenário político brasileiro, especialmente após o golpe militar de 1964. Assim, procurou-se demonstrar que tais colunas - onde prevalecia o tom crítico com relação ao governo militar - contribuíram para consolidar a imagem de Amoroso Lima como um católico progressista, sintonizado com o aggiornamento que a Igreja realizava a partir dos anos sessenta. Imagem muito diversa daquela do cruzado da neocristandade, associada a Amoroso Lima nas duas primeiras décadas de sua caminhada católica. Transposed to the universe of Loving Rasp, such interior trip allowed that this forged a self-discipline, tax of classic, previous elements to the Christianity, and also of varied Christian espiritualidades. Thus, turning toward its interior world, Loving Rasp it searched, at the same time, to join it the the holy ghost and to control the decurrent risks of the transformation process that then it lived deeply. Exercise of introspection that marked the way deeply as Loving Rasp tried the faith in the daily one, also influencing its action in the exterior world. E, thus, returns it the exterior world: having folloied the change operated for Loving Rasp in its model of catolicismo, the consequences of such movement in the form are analyzed with that this intellectual started to intervine in the century. Characterized intervention, over all, for the columns kept for Loving Rasp in the great press and that they had given to notable projection its voice in the scene Brazilian politician, especially after the military blow of 1964. Cette transformation le fait passer d un modèle de catholicisme suivant la doctrine de Trente, qui réagissait à la modernité, à un autre plus ouvert, pluriel, en dialogue avec le siècle. Il s agissait d un processus de changement déjà perceptible dans deux récits de voyage qu avait fait Amoroso Lima pendant cette période: des récits qui, ritualisant l idée chrétienne de la vie comme un pélerinage vers le Haut, ont permis à leur auteur de sanctionner les transformations expérimentées à partir d un plan téléologique. La discussion poursuit avec l analyse d un concept plus abstrait de pélerinage, celui qui mènerait à l intérieur de l homme pris comme le lieude rencontre du fidèle avec Dieu. Transposé dans l univers d Amoroso Lima, ce voyage intérieur lui a permis de forger une autodiscipline, tributaire d éléments classiques, antérieurs au christianisme, de même que de spiritualités chrétiennes diverses. Se tournant ainsi vers son monde intérieur, Amoroso Lima cherchait en même temps à se joindre au divin et à contrôler les risques provenant du processus de transformation qu il vivait alors. Cet exercice d instropection a profondément marqué la façon dont Amoroso Lima a éprouvé la foi dans la vie quotidienne et a également influencé son action dans le monde extérieur. Nous retournons ainsi au monde extérieur : ayant accompagné le changement opéré par Amoroso Lima dans son modèle de catholicisme, nous analysons les conséquences d un tel mouvement sur la façon dont cet intellectuel s est mis, dès lors, à intervenir dans le siècle. Cetteintervention se caractérise surtout par sa participation dans la presse, ce qui a projeté sa voix de façon remarquable dans la scène politique brésilienne, surtout après le coup militaire de 1964. Nous avons cherché ainsi à démontrer que cette participation journalistique - où prévalait le ton critique à l égard du gouvernement militaire - a contribué à la consolidation de l image d Amoroso Lima comme un catholique progressiste, en accord avec l aggiornamento que l Église a réalisé à partir des années 1960. Cette image se distinguait profondément de celle du croisé de la néochrétienté qui lui était associée dans les deux premières décennies de son parcours catholique.
