The Issue of an Offender's Personality in Criminology In my diploma thesis, I have focused on the offender's personality in Criminology. Even though the personality of each person is individual, it still has some features that are common to more offenders. By describing these characteristics and factors, I tried to find the answer to the question whether a person is predestined to be a killer or whether it depends on our decisions. In connection with this, I was asking myself whether it is possible to know in advance that someone has a predisposition to be a killer or whether murder can be prevented. Can we choose our destiny? The diploma thesis is divided into two parts. After defining the basic concepts, in the second chapter I describe the offender's personality from the point of view of psychology, criminology and criminal law. In the third chapter I provide an overview of criminological theories, formed during the development of criminology, where a divergence from the conception of born criminal is perceptible. The fourth chapter is devoted to individual types of offenders and is complemented by chapter five that deals with factors that affect criminal behaviour. Magistro baigiamajame darbe analizuojama ir vertinama kaltininko asmenybės įtaka baudžiamajai atsakomybei Lietuvos ir užsienio šalių baudžiamojoje teisėje. Darbo tikslas - remiantis sukauptomis teorinėmis ir praktinėmis žiniomis nustatyti esamus kaltininko asmenybės vertinimo trūkumus ir privalumus nacionalinėje teisėje bei įvertinus užsienio šalių patirtį nagrinėjamu klausimu, padaryti išvadas, pateikti pasiūlymus. Pirmiausia, darbe nagrinėtas atskirų užsienio valstybių (Prancūzijos, Olandijos, Vokietijos, Anglijos ir Velso, JAV, Rusijos, Kanados) kaltininko asmenybės baudžiamasis teisinis vertinimas. Toliau darbe kritiniu požiūriu pažvelgta į kaltininko asmenybės baudžiamąjį teisinį vertinimą nacionalinėje teismų praktikoje. Darbe analizuojamos įvairių instancijų atskirų Lietuvos teismų baudžiamosios bylos, teismų nuosprendžiai ir nutartys. Siekiama nustatyti, kokių pasitaiko teismų praktikos nevienodumų bei trūkumų vertinant kaltininko asmenybę baudžiamosios atsakomybės ir bausmės individualizavimo procese, kodėl pasitaiko, kad baudžiamojo įstatymo nuostatos traktuojamos nevienodai. Nagrinėjant Lietuvos teismų praktiką bausmių praktinio pritaikymo aspektu pastebėta, kad bausmių taikymui būdingas nedarnumas, nenuoseklumas ir subjektyvumas vertinant kaltininko asmenybę. Darbe pateikiami teoriniai siūlymai įstatymų leidėjui ir teismų praktikai sprendžiant kaltininko asmenybės baudžiamojo teisinio vertinimo problemas. [toliau žr. visą tekstą] / The author of this scientific work analyses personality of an offender and its influence on criminal liability in Lithuanian and foreign countries criminal law. The aim of the study is by sustaining the accumulative theoretical and practical information to identify the merits and demerits of the offenders estimation in the national criminal law and while evaluating foreign countries experience to make the conclusions and suggestions for the national doctrine. First of all, the author analyses foreign countries (such as France, Netherlands, Germany, England and Wales, USA, Russia, Canada) experience in valuing personality of an offender and its influence on criminal liability. Then, there is given a critical look at the personality of an offender and its criminal evaluation in the national criminal law further in this scientific work. The study concentrates on the analysis of judicial practise of the decisions and sentences of various courts. The investigation of Lithuanian case law in practical aspects showed us that the application of sanctions considering the personality of an offender is not consistent and represents value judgement. The author attempts to make theoretical suggestions for the lawmaker and the courts how to solve the problem. At the end of the study the author suggests to regulate general principles of determining sentence in more detail way and to determine the influence of personality of an offender on criminal liability.

Efektivní zacházení s pachateli násilných trestných činů s poruchami osobnosti v podmínkách penitenciární péče / Effective Treatment of Violent Offenders with Personality Disorder wihin the Penitentiary Custody

This paper addresses the question of whether individual delinquent behaviour, or criminogenic risks that lead to it, can be reduced for convicted violence offenders with personality disorder, using the newly developed offence-oriented therapeutic program TERČ ("TARGET"). If so, how will these changes manifest in the recidivism rate, and how they will reflect the personality characteristics of inmates. TARGET was first systematically applied within a special treatment unit for prisoners with mental and behavioral disorders in Liberec Remand Prison in 2008. It is based on selected elements of the Ambulant intensive program (AIP) from Switzerland. A total of 100 convicts were entered TARGET from 2008 to 2015. 65 individuals completed the program successfully, and 57 were released again. The already released graduates of TARGET re-offended within 12 months in 10.4%. Of all admitted TARGET participants, a total of 30.2% either relapsed or failed during the program since 2009. Graduates showed positive, statistically significant changes in the monitored areas of life satisfaction, emotional stability, insight, self-control and aggression, while on scales representing personality disorder no positive, statistically significant effect was observed. Définie à l’origine comme l’aptitude à la sanction, la capacité pénale peut s’entendre plus largement comme résumant l’ensemble des aptitudes subjectives, c’est-à-dire propres au délinquant, indispensables à l’engagement et à la sanction de sa responsabilité pénale. Ces aptitudes sont de deux ordres. L’aptitude à l’infraction et l’aptitude à l’imputation de cette infraction conditionnent le jugement de responsabilité et contribuent à en assurer la dimension morale. L’aptitude à la sanction ou capacité pénitentiaire joue un rôle plus original puisqu’elle apparaît comme le fondement de la personnalisation de la peine, permettant d’adapter la sanction pénale à la personnalité et aux besoins de celui qui doit la subir. / Originally defined as the capacity to be punished, criminal capacity can be understood more widely as summarizing mental abilities that are required for criminal responsibility. Some are needed to commit the offense, others for criminal responsibility but both ensure the moral meaning of criminal law. Applied to the penalty, criminal capacity can be used to adapt the sentence to the personality and needs of those who must endure it.
