Oddlužení jako způsob řešení úpadku dlužníka / Discharge as a mode of resolving bankruptcy of a debtor

Discharge from debts represents one of modes of resolving bankruptcy of a debtor. It is a legal institute, which is very often used by debtors. Its aim is not only to satisfy creditors at least in the law guaranteed amount but also to protect the debtor, who is released of all his previous debts after successful discharge and he can start new life without debts and never-ending executions. The purpose of this thesis is to characterize an institute of discharge, to put it into the system of insolvency law, to describe insolvency procedure and some problematic areas of discharge, which cause difficulties in practice. During writing this thesis I tried to interconnect effective laws with case law of higher courts, reference literature and articles. The thesis is composed of 5 chapters. In the first one I briefly characterize basic terms of insolvency law (insolvency proceeding, bankruptcy, procedural entities) and modes of resolving bankruptcy of a debtor. Second chapter focuses on insolvency proceeding from insolvency petition to permission of discharge. Last part of the chapter describes alternatives of discharge, these are converting debtor's property into money, payment schedule or combination of both. Právní úprava patentů a užitných vzorů - srovnání ve vybraných zemích / Law of patents and utility models - a comparison in selected countries

The diploma thesis deals with the law of patents and utility models in selected countries. In the first part of this work patents and utility models are characterized in terms of their legislation in the Czech Republic. The main differences and similarities in the laws of patents and utility models in Germany and the United States of America to the czech law are analyzed in the next parts of this work. The aim of this work is to determine, how the issue of patents and utility models is implemented into law in 3 selected countries, the Czech Republic, Germany and the United States of America, with the emphasis on the analysis of differences between the proceedings of patent's grant and proceedings of the utility model's registration into the registers in above mentioned countries. The part of this aim is to find out what tools which support inventions and innovations are being used in these countries and which one is the most effective one. The issue regarding differences in implementing patents and utility models into law is resolved in this diploma thesis -- a special focus was given to the length and complexity of each proceeding as well as the costs needed to gain and keep the rights in force.

Dessaisir ou ne pas dessaisir, telle est la question intéressant la situation du débiteur en liquidation judiciaire. À l’ouverture de la procédure, le débiteur perd l’exercice de ses droits et actions ayant une incidence patrimoniale au bénéfice de la qualité pour agir du liquidateur. Omniprésente, la notion de dessaisissement n’en demeure pas moins incertaine. D’abord, la nature et le régime juridique de la mesure ne peuvent se concevoir de manière autonome. En effet, seule l’étude du gage commun des créanciers permet la compréhension du dessaisissement. Le lien établi entre les deux notions permet d’affirmer qu’au morcellement du gage commun s’en suit un affaiblissement corrélatif du dessaisissement. Ensuite, si le dessaisissement est objectivement dépendant des fluctuations de l’effet réel de la procédure, ce sont, en outre, les droits conservés par le débiteur qui atteignent la consistance de la mesure. Le respect des droits fondamentaux du chef d’entreprise restreint le domaine du dessaisissement au bénéfice des droits propres procéduraux du débiteur. Ces considérations participent à la mise en œuvre des exigences européennes en la matière et plus particulièrement celle du droit au rebond du débiteur en difficulté. Dans ces conditions, la pérennité du dessaisissement devient source d’interrogations. Entre un anachronisme prononcé de la mesure ou une simple nécessité d’évolution de la notion ; dessaisir ou ne pas dessaisir telle ne pourrait plus être l’exacte question. / Dispossessing a debtor in liquidation proceedings, that is the interesting question which naturally appears in such situations. At the start of the proceedings, the debtor must hand over the ability to exercise his rights and take actions over his assets to the liquidator. Even though the notion of dispossession is omnipresent, it remains an unclear notion nonetheless. Firstly, the type of procedure and the governing legal regime are not mutually exclusive. Secondly, it is indeed only the analysis of the creditor’s common pledge that allows us to understand dispossession. The link established between the two notions asserts that the fragmentation of the common pledge leads to a correlative weakening of the dispossession. If the dispossession is objectively dependent on the fluctuations of the real effect of the proceeding, it is furthermore the rights retained by the debtor that will have an impact on the substance of the measure. Respecting the entrepreneur’s fundamental rights restricts the effect of dispossession on the debtor’s procedural rights. These considerations contribute to the implementation of the European requirements in this area, and more specifically, the debtor’s right to a fresh start. In such conditions, the longevity of the dispossession raises other questions. We must decided between a pronounced anachronism of dispossession or the necessary evolution of the notion – to dispossess or not to dispossess, that is the heart of the question under study.

Defence lawyer in the criminal proceedings Abstract The defending lawyer is an important institution in criminal law. With this institution a basic principal can be guaranteed, the right of defense. This master's degree thesis is about the defending lawyer in criminal trials in the Czech Republic and Switzerland, its similarities and differences. It consists of an introduction, a body consisting of 7 chapters and a conclusion. The first chapter deals with the historical development of this institution on Czech territory from the 18th century until the present time. It especially emphasizes the effect of historical events on modifications and on the practical observance of written law. The next chapter defines the term defending lawyer under Czech law and explains how someone can become a defending lawyer. It specifies how a defending lawyer should conduct the defense case and explains the differences between elected and nominated lawyers. The following chapters analyse the rights and obligations of lawyers and methods of legal defense. Furthermore, they try to examine the importance and necessity of a defending lawyer in a criminal trial. On the other hand, they show the limitations of defense lawyers and their tactics. 1 Proceeding on administrative offences of legal persons in first instance Abstract: The administrative law represents wide and significantly fragmented area of the law system. There is no doubt the part of administrative law are also rules of administrative punishment including the corresponding procedural regulation. This thesis provides the basic analyses of selected aspects of the legal regulation of the proceeding on administrative offences of legal persons in first instance affective in Czech Republic. The basic source of law in this area is Act no. 250/2016 Coll., on the responsibility for administrative offences and on procedure on it, as amended (in this thesis also referred only as "act on administrative offences"). However, that act is not the only on regulation governing the proceeding on administrative offences. The special partial regulation of proceeding on administrative offences may be basically found in all acts within the area of administrative law which rule the administrative offences. Plant Wilting Estimation And Field-Based Plot Extraction

<p dir="ltr">Plant phenotyping is the process of characterization and quantification of physical traits<br>of plants such as height, leaf area, biomass, wilting degree, or flowering time. Many plants<br>become limp or droop through heat, loss of water, or disease. This is also known as wilting.<br>In this thesis, we propose multiple quantifiable wilting metrics that will be useful in studying<br>bacterial wilt and identifying resistance genes. In order to obtain the wilting metrics, we use<br>machine learning methods to identify the center of the stem. We also propose a fast ground<br>truthing method to speed up training data generation. We test our metrics on both tomato<br>plants and soybean plants with wilting caused by either bacteria or drought. We successfully<br>demonstrated that our metrics are effective at estimating wilting in plants.</p><p dir="ltr"><br>Field experiments often comprise thousands of plants. For many Unmanned Aerial Vehi-<br>cles (UAVs) image-based plant phenotyping analyses, we need to examine smaller groups of<br>plants known as ”plots”. We propose a method to extract plots from images acquired from<br>UAVs. In addition, we proposed a system that will allow us to combine our plot extraction<br>results with field data such as plant ID, plant genotype, and experiment type provided by<br>the planters. We also developed a method to generate synthetic plant center location data.</p>

Nesse sentido, a pesquisa, realizada na Penitenciária Professor Ariosvaldo de Campos Pires, em Juiz de Fora, trata das especificidades das condutas adotadas pelos detentos convertidos à religiosidade evangélica, sua influência na dinâmica social do cárcere e no cotidiano das relações que ali se desenvolvem. Para tanto, utilizo dois conceitos principais: o de “proceder” – que designa um complexo número de regras criadas por e seguidas ou não pelos detentos – conforme elaboração de Marques (2009) - e o de “conversão religiosa”, utilizado no sentido de mudança de visão de mundo do fiel. Constatei que, a partir da conversão, o detento passaria por uma reforma moral subjetiva que se reflete em sua interação com o coletivo e, assim, daria seguimento aos preceitos e valores cristãos em forma de uma conduta moralmente aceitável, resultando o “proceder evangélico”, ou seja, espécie de código de condutas seguido por presos religiosos. Os detentos que aderem a tal “proceder” sofrem intensa vigilância (tanto por parte dos próprios detentos, como pelos funcionários em geral) como forma de teste de sua fé, de modo que não podem cometer nenhuma contravenção, o que nos leva à compreensão de que há certa noção de moralidade religiosa que norteia tanto quem vigia quanto quem é vigiado. Assim, o “proceder” religioso consistiria numa prática ou conduta que se orienta pela moralidade – palavra – cristã. A pesquisa foi realizada na Penitenciária Professor Ariosvaldo de Campos Pires, Juiz de Fora. / The present research deals with the discussion about Christian religiosity in prison, as a possibility of guiding discourse of individual and collective conduct. The presence of religious of Christian confessions in penal institutions demonstrates the importance of this segment in the social dynamics of prison and clearly evidences the differences between the behavior of non-religious detainees and those who profess Christian religiosity, especially evangelical. In this sense, the research, carried out at Professor Ariovasdo de Campos Pires Penitentiary, in Juiz de Fora, deals with the specificities of the conduct adopted by detainees converted to evangelical religiosity, its influence on the social dynamics of the prison and the daily life of the relationships that are developed there. For this purpose, I use two main concepts: that of "proceeding" - which designates a complex number of rules created by and followed or not by detainees - as elaborated by Marques (2009) - and that of "religious conversion", used in the sense of worldview change of the faithful. I observed that, from the conversion, the detainee would go through a subjective moral reform that reflects in his interaction with the collective and, thus, would follow up Christian precepts and values in form of a morally acceptable conduct, resulting in "evangelical conduct", in other words, a kind of code of conduct followed by religious prisoners. Detainees who adhere to such "proceeding" are subjected to intense vigilance (both by detainees themselves and by officials in general) as a way of testing their faith, so that they cannot commit any contravention, which leads us to a comprehension that there is a certain notion of religious morality that guides both those who watch and those who are watched. Thus, religious "proceeding" would consist of a practice or conduct that is oriented by morality – Christian word. Diploma thesis "Planning Permission Procedure" deals with one of the key sectors of special public law, the valid legal regulation of planning permission procedure, a part of the legal regulation of building law. Planning permission procedure is a special type of administrative procedure and can be possibly seen as a main connection between zoning and building permission. A planning permission can result in most influential and interventional changes in the territory. During this proceedings, personal and public interests usually clash. The thesis analyses decisions of the Supreme Administrative Court, a court with key impact on some parts of the planning permission procedure. These decisions include both older key decisions as well as new ones, like the one dealing with Planning Consent. The thesis focuses on different types of planning permission procedure in order to facilitate orientation in this complex topic; it analyses various forms of permissions such as Planning Consent or Public Contract. The work has an ambition to put the terms of planning permission proceeding into historical context. Priverstinis turto realizavimas vykdymo procese yra viena iš priemonių greitai ir efektyviai įvykdyti išieškojimą, o priverstinai turtą realizuoja antstolis, surašydamas priverstinio turto realizavimo aktus, kurie turi būti patvirtinti teismo. Tačiau priverstinis turto realizavimas turi būti atliktas pagal griežtai nustatytas taisykles, kad nebūtų pažeistos vykdymo proceso dalyvių ir trečiųjų asmenų teisės. Dėl šios priežasties šiame magistro baigiamajame darbe stengiamasi nustatyti, kurie turto realizavimo taisyklių pažeidimai gali būti pripažinti esminiais ir tapti pagrindu teismui netvirtinti turto realizavimo akto, o patvirtintą – pripažinti negaliojančiu. Vykdymo proceso esmė yra surasti skolininko turtą, jį areštuoti, realizuoti ir, gavus pinigus, atsiskaityti su skolininko kreditoriais. Skolininko turtą dažniausiai realizuoja antstolis parduodamas jį iš varžytynių ar skolininko pasiūlytam pirkėjui arba perduodamas turtą išieškotojui. Realizuodamas turtą antstolis surašo priverstinio turto realizavimo aktą, kuris patvirtintas teismo tampa nuosavybės teisę patvirtinančiu dokumentu. Tačiau priverstinai realizuojant turtą vykdymo procese nėra skolininko valios savo daiktą perleisti, o pardavimo procesą organizuoja ne turto savininkas, o antstolis. Todėl neretai kyla klausimas dėl priverstinio turto realizavimo akto negaliojimo. Iki šiol Lietuvoje nėra atliktas priverstinio turto realizavimo aktų negaliojimo vykdymo procese išsamus teorinis tyrimas. Todėl šiame darbe... [toliau žr. visą tekstą] / Property realization in enforcement proceeding is one of the fastest and most effective means to implement recovery, and debtor’s property is realized by bailiff, who writes the property realization act, which must be validated by court. But debtor’s property realization in enforcement proceeding must not violate determined rules and proceeding parties or third parties rights. That is the reason why, in this work the author tries to determine what violation of property realization rules may be considered as basis of property realization in enforcement proceeding acts annulment. The purpose of enforcement proceeding is to find debtor‘s property, to arrest it, to realize it and to give an account to debtor‘s creditors. Usually debtor’s property is realized by bailiff in three ways: at public auction, by releasing debtor’s property to creditor, or by selling property to debtor’s proposed buyer. While realizing debtor’s property, bailiff must write the property realization act. If the act is validated by court, it becomes the document approving buyer’s right to property. But in compulsory debtor’s property realization debtor’s wish to sell his property do not exist, and the sale process is organized not by owner of the property, but by bailiff. Usually that is the purpose why, the question of property realization in enforcement proceeding acts annulment is raised. Consequently, Class Proceeding Law may permit, in a conclusive way, that Justice can be effectively reached by citizens, through the defeat of individualistic dogmas that take place between Brazilian Civil Procedure Law and enhance social unequality. / O direito processual civil tradicional, de vocação eminentemente individualista, não tem conseguido oferecer respostas satisfatórias às demandas coletivas que se multiplicam na sociedade de massa em que vivemos. Diante disso, mostra-se necessário o estudo da tutela jurisdicional coletiva, que permite um tratamento mais racionalizado e menos formalista dos conflitos de grupos, classes ou categorias de pessoas, característicos dos direitos transindividuais. Por conseguinte, a coletivização do processo civil pode influir, decisivamente, no efetivo acesso dos cidadãos à Justiça, por intermédio da derrubada dos dogmas individualistas que permeiam o Processo Civil Brasileiro e acentuam as desigualdades sociais.
