With this purpose the recidivism has been collated rationally from a general to private matter. It looks into the recidivism, its classification and related subjects, and evaluate its evolution in the Brazilian Penal Law it also analyses theories that justifies its application, furthermore it lists its penal and procedural effects coming from the recognition of recidivism. The main goal of this paper is to question the recidivism in the current Brazilian Law (Mainly through the Brazilian Federal Constitution/ 1988) due to the failure of the prison penalty to reintegrate the criminal in the society. After verifying how other countries use the recidivism, we suggest changes for it in Brazil according to compared law and the evolution in penal law, making sure the penal law will truly be applied .The crisis of the prison system is highlighted, giving emphasis to the overpopulation of our prisons, no existence of reintegration programs and lack of support to the ex convicts, all these factors leads to high rates of recidivism / Este trabalho analisa a reincidência criminal e seu emprego como circunstância agravante da pena, visando apurar se a atual legislação pátria a trata de forma adequada conforme a evolução do Direito Penal. Para a realização desta dissertação, a reincidência é cotejada por meio de um procedimento racional que transita do geral para o particular. Verifica a origem da recidiva, suas classificações e os institutos afins; examina a evolução da reincidência no direito penal brasileiro e as teorias que justificam sua aplicação, bem como arrola os demais efeitos penais e processuais decorrentes do reconhecimento da reincidência. O objetivo central deste trabalho é questionar a atual disciplina da reincidência na legislação brasileira, principalmente com base na Constituição Federal de 1988 e em razão do fracasso ressocializador da pena privativa de liberdade. Após verificar a utilização da reincidência em outros países, são sugeridas alterações desse instituto, no Brasil, consoante o direito comparado e a evolução do direito penal de garantias, para que seja aplicado o direito penal do fato. É destacada, ainda, a crise do sistema carcerário, com ênfase à superpopulação prisional, à ausência da função ressocializadora da pena de prisão e ao diminuto apoio aos egressos, fatores que contribuem para os elevados índices de reincidência criminal

This research is part of in this field, having a concern to question a binomial normative of the prison policy, whereby the experience in prisons opposes the paths to "reintegration" and "criminal recidivism." Discussing these concepts and opposing to them, the research points to the need to understand the social dynamics that make up the life of prison former inmates, intersecting them with the practices of the prison administration and with the flow and the increasingly more frequent links between the inside and the outside of prisons. Thus, I seek to understand the social processes that mark the paths of former inmates of São Paulo s prison system, subject little explored in the Brazilian literature and whose approach dialogues with recent studies on the social dynamics which have an effect on the lives in prison. It also dialogues with studies that are not focused on the prison, but whose themes this institution presents itself, whether as a differentiation marker of individuals, whether as a dissemination beam of social relations linked to the world of crime. The study takes place around the description of the trajectory of Diego s life, former inmate of São Paulo s prison system, and his interaction, at different times, with the research author. Therefore, São Paulo s prison system own dynamics are described and unofficial processes of shared management of prisons are emphasized between the state administration and the different groups of prisoners currently existing. In this sharing, the education inmate monitor stands out, highlighted position occupied by Diego. / O fenômeno cada vez mais marcante da violência urbana e a expansão da prisão enquanto modo privilegiado de punição nas sociedades contemporâneas têm despertado cada vez mais a atenção de pesquisadores para a descrição e análise dos processos que se desenrolam na prisão e a partir dela. Esta pesquisa se insere neste campo, tendo como preocupação questionar um binômio normativo da política penitenciária, segundo o qual a vivência nas prisões opõe os caminhos da reintegração social e da reincidência criminal . Discutindo estes conceitos e contrapondo-se a eles, a pesquisa aponta para a necessidade de compreender as dinâmicas sociais que perfazem as trajetórias dos egressos prisionais, interseccionado-as com as práticas da administração penitenciária e com o fluxo e os vínculos cada vez mais frequentes entre os lados de dentro e de fora das prisões. Assim, busco compreender os processos sociais que marcam as trajetórias de egressos do sistema prisional paulista, assunto pouco explorado na literatura brasileira e cuja abordagem dialoga com estudos recentes sobre as dinâmicas sociais que marcam as vidas nas prisões. Dialoga também com estudos que não têm como foco a prisão, mas em cujas temáticas esta instituição se apresenta, seja enquanto marcador de diferenciação dos indivíduos, seja enquanto feixe de disseminação de relações sociais ligadas ao mundo do crime. O estudo se desenrola em torno da descrição da trajetória de Diego, egresso do sistema prisional paulista, e de sua interação, em diferentes momentos, com o autor da pesquisa. Para tanto, são descritas dinâmicas próprias do sistema prisional paulista e enfatizados processos extra-oficiais de compartilhamento da gestão das prisões entre a administração estatal e os diferentes coletivos de presos atualmente existentes. Nesta partilha, sobressai o monitor preso de educação, posição ocupada com destaque por Diego.

Levando-se em consideração que hoje no Brasi l não possuímos informações consistentes sobre a reincidência entre egressos penitenciários, que principalmente, sem qualquer fundamentação empírica, é identificada como alta no país, este estudo tem como objetivo central compreender como vêm funcionando os programas laborativos e educacionais no sistema penitenciário brasileiro; qual a percepção dos diversos agentes operadores da execução penal quanto aos programas de ressocialização; e qual o impacto efetivo da educação e do trabalho na ressocialização dos detentos. Pretende-se, com este estudo, perceber se realmente os programas de ressocialização de cunho educacional e laborativo interferem diretamente na reinserção social do apen ado, bem como qual o efetivo impacto na execução penal, além de sugestões de políticas públicas eficientes. / Taking into account that in Brazil we do not have reliable information about prison recidivism among those who left prison, which mainly without any empirical foundation, is identified as high in the country, this study aims at understanding how they come running the educational and industrial programs the Brazilian penitentiary system, the perception of the agents operators about the effective punishment implementation as well as the rehabilitation programs, and what the actual impact of education and work in the rehabilitation of the convicts. Then, this study really aims to perceive if the programs of educational and occupational re-socialization affect directly the social reintegration of the convict and what the effective impact on law enforcement, as well as suggestions for effective public policies.
