Sociální situace obyvatel sociálně vyloučené lokality v Náchodě / Social Situation in Selected Social Precluded Locality of Náchod

Socially excluded localities are found all over the Czech Republic. They are whole neighbourhoods, houses or streets, usually situated on the outskirts of towns, threatened by a symbolic, territorial, cultural, economic and social exclusion. The inhabitants of the socially excluded localities usually have debts with the town, which is the reason why they were moved to this locality. Problems that frequently occur in the socially excluded localities include insufficient education, high unemployment rate, financial problems and a high occurrence of socially pathological phenomena. Drawing on the facts obtained, it is possible to recommend social services that missing here at present. At the same time, the results of this thesis may serve to social workers as a detailed survey of the social situation of the locality in question.

The objects of study are two subsidiaries of a multinational enterprise in emergency and first-aid services area. One of them is Portuguese and the other is a Brazilian one. This exploratory research has used a sectional way with a longitudinal perspective, since it has considered a specific verified data referring to 2004 and 2005 years, beyond the deeper interviews with actual managers to an evaluation of these studied perception and its authentication. Our indicators identification sources were principally the individual and social rights and duties broaching and the fundamental guarantees disposed in the Brazilian and Portuguese Constitutions as such as the European Constitution project. The results appoint to great differences of management between both subsidiaries, being the Brazilian one closer to our research proposes, as such as suggest us that the human resource areas, still acting in an instrumentalist way, establish a great barrier to better practices in social inclusion and they would be unprepared for a management with the focus in the employees. Although our study has been realized in a specific activity enterprise, we believe that our results can stimulate the realization of other investigations with the same objectives. In this way, we contribute to a better comprehension of the social exclusion causes and the organizations participations in this process. / O presente estudo de caso investiga, empiricamente, a existência de indicadores que sugiram a preocupação com a exclusão social a partir das organizações, com o foco em gestão estratégica de pessoas. Os objetos de estudos são duas subsidiárias de uma empresa multinacional da área de serviços de assistência emergencial, uma portuguesa e uma brasileira. Tal pesquisa exploratória utilizou um corte seccional com perspectiva longitudinal, já que considerou dados levantados referentes aos anos de 2004 e 2005, além de entrevistas de profundidade com gestores atuais, para a avaliação da percepção do tema em estudo e respectiva validação. Utilizaram-se como fonte de identificação dos indicadores principalmente as abordagens sobre os direitos e deveres individuais e sociais, e direitos e garantias fundamentais dispostas nas constituições brasileira e portuguesa, assim como no projeto de constituição européia. Os resultados apontam para diferenças de gestão entre ambas as subsidiárias, estando a brasileira mais alinhada às propostas da pesquisa, assim como sugerem que as áreas de recursos humanos das empresas, ainda agindo de uma forma instrumentalista, constituem uma grande barreira para as melhores práticas da inclusão social, e que estariam despreparadas para uma gestão com o foco nos funcionários. Embora tal estudo tenha sido realizado em uma empresa de uma área de atividade muito específica, acreditamos que seus resultados possam servir de estímulo para que outras pesquisas com os mesmos objetivos possam ser realizadas, de forma a contribuir para uma melhor compreensão das causas da exclusão social e da participação das organizações neste processo.

The considered assumption is that the process of creation of laws about sanction management in Brazil is recurrent the selection of prisons sentences, and the management way created by LEP (Law of Penal Execution) is subject of few proposals of legislative reform. This study includes an empirical research of legislative proposals presented to National Congress between 1984 and 2011 related to the enforcement of criminal sanction. The second chapter of the dissertation contains a quantitative analysis of these proposals, through the systematization of general data (type of proposition, length of the procedure for approval, federal state of origin and author) to identify, when possible, the increase or decrease trend of social exclusion through the use of more or less frequence of imprisonment. The qualitative analysis focus on the concepts of management of criminal sanction and individualization of punishment. The third chapter introduces the concept of management of criminal sanction, review of legislative historical creation of legal degree to accomplishment of sanction until the creation of LEP in 1984, and reinforces a qualitative study of task divisions about accomplishment of sanction from an empirical material. The fourth chapter introduces the idea of individualization of sanction, as approached in a judicial activity, which interacts in a dynamic and constant way with legislative and administrative activities, especially while the accomplishment of prison sentencing. From this concept, new legislative proposals present a new arrangement of distribution of tasks among the three powers regarding enforcement of criminal sanction. The conclusion of this dissertation is that the creation process of criminal laws in Brazil recognizes the use of freedom private sanction, considering the extension of minimum prison quorum or the extinction of subjective rights, in a situation that the judge has no many possibilities to actuate in case. / A presente dissertação tem por objetivo compreender a atividade legislativa e a articulação entre os Poderes Legislativo, Judiciário e Executivo no momento de cumprimento da pena pelo condenado. Parte-se da hipótese de que no processo de criação de leis sobre gestão da sanção no Brasil é recorrente a seleção de penas prisionais e que a atividade de determinação da quantidade e da qualidade da pena no caso concreto é objeto de disputa entre legislador, juiz e administrador penitenciário. Para investigar esta hipótese, a pesquisa comporta um levantamento empírico de proposições legislativas apresentadas no Congresso Nacional entre 1984 e 2011 relacionadas ao cumprimento da sanção criminal. O segundo capítulo da dissertação contém uma análise quantitativa destas proposições, por meio da sistematização dos dados gerais (tipo de proposição, tramitação, estado de origem e autor) e identifica, quando possível, as medidas tendentes a ampliar ou reduzir a exclusão social por meio do uso mais ou menos frequente da pena de prisão. O terceiro capítulo introduz o conceito de gestão da sanção, revisa o histórico legislativo de criação de um diploma legal voltado ao cumprimento da pena até a criação da LEP (1984) e empreende um estudo qualitativo sobre a divisão de tarefas sobre cumprimento da pena a partir do material empírico. O quarto capítulo apresenta a ideia de individualização da pena, conceito abordado da perspectiva de uma atividade judicial que interage de forma dinâmica e constante com as atividades legislativas e administrativas, especialmente durante o cumprimento da pena de prisão. A partir deste conceito são retomadas proposições legislativas que, em alguma medida, abordam o arranjo ou o rearranjo da divisão de tarefas entre os três poderes. Ao final, conclui-se que o processo de elaboração de normas penais no Brasil valoriza o uso da pena de privativa de liberdade, por meio da ampliação das frações mínimas prisionais ou da vedação de direitos subjetivos, situação na qual o juiz tem pouco espaço para atuar no caso concreto.

The socio-economic impacts of displacement : gentrification in the Point precinct, Durban

In South Africa, gentrification has a huge impact on the makeup of city spaces where it has been used as a redevelopment tool in order to restore and enhance these spaces. However, socio-economic turmoil is created when development benefits mainly the elite minority whilst marginalising the poor majority, which occurs in many instances of gentrification. In the worst cases, gentrification creates a trickle-up affect whereby the benefits of such a process are felt predominantly by the urban elite. This is evident in this study, where gentrification at the Point Precinct in Durban led to the marginalisation of residents of the Ark, a Christian-run homeless shelter that was forced to shut down as its residents no longer fitted in with the image-conscious ideals of the redeveloping area. These residents were displaced and ultimately relocated to a severely under-developed area known as Welbedacht approximately 30km away. This study aimed to explore the negative socio-economic impacts of displacement as a result of this gentrification and found that these impacts are vast, severe and long-lasting, including the social implications of isolation and exclusion coupled with the economic loss of living along the periphery. The implications of displacement are severe primarily due to the following reasons: the community’s displacement from the core to the urban periphery, the lack of social justice in the area, and the high levels of social exclusion. Furthermore, the implications of the gentrification process itself has resulted in a cycle of impoverishment in which Welbedacht has become entrenched. Due to the neo-liberal policies favoured by developers and policy makers, the urban poor are pushed out of the core and into the periphery with little support from local government, thereby resulting in the further marginalisation of a vulnerable community. Developers and policy makers should therefore strive for development that is equitable for all parties. Furthermore, facilities such as homeless shelters which provide countless services to the urban poor should not be shut down, but rather local government should strive to either redevelop such facilities or relocate them to an area that offers the same characteristics for the continued successful socio-economic development of the urban poor. / Geography / M. Martina Mikeszová : PHD DISSERTATION - HOUSING MARKET AND RISK OF HOMELESSNESS IN THE CZECH REPUBLIC. ABSTRACT The PhD dissertation focuses on the theme of loss of permanent housing together with the problematic of housing affordability in the Czech Republic. In the first part, the objective is to identify the types of households potentially at risk of being unable to afford housing since 2000, and to trace the development of regional differences in the percentage of at-risk households in the Czech Republic. In the regard to the end of deregulation process in recent years, the analysis of housing (un)affordability of "market" rent housing shows the possible social consequences of the process. Owing to the absence of useful aggregate data on incomes and expenditures for different household types in the regions of the Czech Republic, the alternative data sources and the simulation methodology for measuring housing affordability which combines available regional wage statistics and data on market rents were used. The results indicate that the general risk of being unable to afford rental housing and regional differences in housing affordability are both decreasing. Surviving social exclusion : Zimbabwean migrants in Johannesburg, South Africa

The thesis analyses forms and levels of social exclusion of Zimbabwean migrants in the South African labour market and society. The research reveals that migrants face social exclusion through unruly practices of public officials and institutional bias. At community and individual level migrants are devalued and stigmatised by the local South Africans and other Zimbabwean migrants. To some extent Zimbabwean migrants participate in their own exclusion as they are divided along regional and ethnic lines. The thesis proposes an analytical framework for understanding the social exclusion of Zimbabwean migrants emphasising on how devaluation of migrant identity narrows the existing structure of opportunity, leading to various coping mechanisms some of which are deviant. The thesis proposes a moral and pragmatic view in understanding the social exclusion of migrants from a cosmopolitan perspective where migrants are citizens of a global world. Using a qualitative methodology the research provides an in-depth analysis of the life histories of fifty eight (58) ‘documented’ and ‘undocumented’ Zimbabwean men and women in Kempton Park and Tembisa. The research was carried out in 2012. Migrants respond to social exclusion by using social capital in the form of family/kinship, ethnic and church networks. Zimbabweans mainly rely on bonding rather than bridging social capital. To a greater extent, migrant networks help them to ‘get by’ and simply survive. The few that have managed to ‘get ahead’, have made use of networks with South African residents and other individuals outside their migrant network systems. These have facilitated acquisition of fake identity documents, jobs and other necessities. Family networks are beginning to repel migrants because of the economic pressures they face leading to the weakening of ties among Zimbabwean migrant family members. / Sociology / D. Litt. et Phil. The purpose was to incorporate graduates? experience from retraining courses, depending on the need to strengthen the integration of people at risk of social exclusion or socially excluded. The focus of the program is aimed at the priority axis "Active labor market policies" and "Social integration and equal opportunity." The content of individual activities is to increase competence in business, accounting, tax, and total financial and computer literacy, to improve opportunities in the labor market. The base of the request for financial support was drawing up the cost proposal for the training center project.

Special focus is given to Romany people and to psychological aspects of their social exclusion. This paper also focuses on social field work and its issues in psychological sense. Results of work of Social integration agency in largest social excluded locality in the region of Český Krumlov, Větřní, are presented at the end of this thesis.

Le handicap psychique est une expression française qui s’est imposée récemment, mais qui fait l’objet de diverses acceptions. Nous le situons dans le contexte très large des vulnérabilités et dans celui plus restreint des situations de handicap. Alors qu’il est communément admis que le handicap psychique est une conséquence sociale d’une maladie mentale, nous montrons que des personnes sont en situation de handicap d’origine psychique (shop) alors qu’elles n’ont aucune pathologie mentale avérée et qu’elles ne suivent aucun traitement psychiatrique. Pour cela, nous nous appuyons sur l’expérience d’un dispositif appelé Médiation logement ; dans ce contexte, des psychologues cliniciens vont au-devant de personnes recluses dans leur logement, ou qui manifestent des troubles du comportement ou du voisinage, et qui n’ont aucun antécédent psychiatrique. Nous montrons qu’il s’agit bien de personnes en situation de handicap d’origine psychique (peshop). Cela nous conduit à donner une nouvelle définition du handicap psychique. Puis nous proposons une grille de lecture clinique qui permettrait qu’une équipe mobile puisse faire un diagnostic précoce d’un syndrome incapacitant discret d’origine psychique (sidop) qui se révèle chez une personne ayant une fragilité singulière au moment où elle est confrontée à un évènement traumatique personnel et/ou social. / The handicap psychique (psychological handicap) is a French expression which has imposed itself recently. It is the subject of various meanings. We place it in the very broad context of vulnerabilities and in the more restricted situations of handicap. While it is commonly accepted that psychological handicap is a social consequence of a mental disease, we show that people with handicap of psychological origin (HOPO) have no proven mental disorder and do not undergo any psychiatric treatment. We rely on the experience of a plan called Médiation logement. In this “Housing mediation” clinical psychologists meet people who are reclusive in their homes, or who exhibit behaviour or neighbourhood disturbances. Those people have no psychiatric history and we show that they share a common feature: a discrete incapacitating syndrome of psychological origin (DISOPO). This leads us to give a new definition of psychological handicap. Then we propose a clinical reading tool that would allow a team to make an early diagnosis of this DISOPO that appears in a person with a singular fragility when faced with personal and / or social traumatic of stressful event.
