En esta tesis, las autoras, sobre la base de la pirámide de Braithwaite, proponen
la utilización de las herramientas de Enforcement con las que cuenta el OSIPTEL
durante la supervisión, fiscalización, sanción y post evaluación del cumplimiento
regulatorio en el sector de las telecomunicaciones, en un esquema piramidal de
aplicación, bajo el enfoque de Responsive Regulation.
Dichas herramientas están consignadas desde las menos intrusivas y
persuasivas, hasta aquellas otras que se sustentan en la no cooperación de los
regulados, frente a lo cual se requiere el empleo de mecanismos de disuasión.
Además, a fin de obtener un enfoque de Responsive Regulation, de forma integral,
precisan que es necesario considerar diversas mejoras en la normativa del
OSIPTEL, así como en el ejercicio de sus funciones, las cuales han sido
desarrolladas en este documento.

En el marco de la liberalización de los mercados de los años 90, en el Perú se creó el
Organismo Supervisor de Inversión Privada en Telecomunicaciones (OSIPTEL), como
entidad autónoma encargada de promover la competencia y garantizar estándares
mínimos de calidad en la prestación de los servicios de telecomunicaciones en el país. Al
respecto, el presente estudio tiene como objetivo evaluar el tipo de impacto generado por
un conjunto de políticas ejecutadas por el OSIPTEL en el periodo de 2010 a 2018, las
cuales tenían como fin promover un entorno más competitivo en el mercado del servicio
de telefonía móvil para alcanzar precios asequibles y un mayor nivel de bienestar de los
usuarios. Ante ello se plantea la hipótesis de que la implementación oportuna de estas
políticas generó un escenario propicio para una mayor competencia, a través de la
reducción de las barreras a la entrada y de los costos de cambio entre operadores móviles.
Por lo cual, se evalúan los periodos ex ante y ex post de la implementación de dichas
políticas. Para ello, se utiliza el método propuesto por Berry, Levinsohn y Pakes,
encontrándose que, para el periodo ex post, la variable precio adquiere una mayor
importancia en la toma de decisiones del agente representativo, lo cual fue aprovechado
por los operadores entrantes para poder lanzar ofertas disruptivas en el mercado, que
motivaron la respuesta comercial de los operadores móviles establecidos. Esto ha
favorecido una mayor competencia, que se ha reflejado en menores precios y en el
incremento de las elasticidades precio propias y cruzadas.

El presente informe jurídico analiza el procedimiento de eliminación de barreras
burocráticas, el cual resuelve la denuncia interpuesta por la empresa ENERGIGAS
S.A.C. contra el Organismo Supervisor de la Inversión en Energía y Minería por la
presunta imposición de dos barreras burocráticas ilegales y carentes de razonabilidad,
materializadas en los párrafos segundo, así como tercer y cuarto del artículo 17A del
Anexo 1 de la Resolución de Consejo Directivo N° 191-2011-OS/CD.
El análisis desarrollado en el presente informe tiene como objetivo dar respuesta a tres
problemas jurídicos que consisten, en primer lugar, en determinar si las barreras
burocráticas materia de cuestionamiento son ilegales dentro de aspectos establecidos
en la Ley de Prevención y Eliminación de Barreras Burocráticas. En segundo lugar, se
tiene el problema jurídico de si correspondía o no que la Comisión de Eliminación de
Barreras Burocráticas del Indecopi analice la razonabilidad de la primera barrera
burocrática, materializada en el segundo párrafo del artículo 17A. Por último, el tercer y
último problema jurídico consiste en establecer si la primera barrera burocrática carecía
o no de razonabilidad.
Para dar respuesta a los problemas jurídicos antes mencionados, se analizará el
cumplimiento de la normativa aplicable en Derecho Administrativo, en lo referente a
actos administrativos, requisitos que puede solicitar la Administración Pública, así como
normativa transversal a todo el ordenamiento jurídico como es la aplicación de la
normativa en el tiempo. De igual manera, se consideran criterios de interpretación
jurídica como el criterio teleológico y el método de interpretación sistemática, así como
los principios que sustentan fundamentalmente el procedimiento administrativo. Todo
ello, tomando en consideración la realidad y los efectos que tiene en la práctica la
regulación en los agentes que desarrollan actividades de hidrocarburos.

La conveniencia de aplicar un enfoque responsivo para el cumplimiento de obligaciones en materia de servicios públicos de telecomunicacionesHuamán Sánchez, Jorge Luis 20 January 2018 (has links)
La presente investigación identifica que la estrategia dominante para el cumplimiento de las normas (Enforcement) aplicada por el organismo regulador de las telecomunicaciones del Perú (OSIPTEL) es la disuasiva (Deterrent approach), estrategia que tiene como principal proposición que el castigo es lo más efectivo para lograr un cambio de conducta del infractor. En este contexto es que nos preguntamos si cabe la posibilidad de optar por estrategias conjuntas (sin dejar de lado el ejercicio de la potestad sancionadora del regulador cuando corresponda) que permita la apertura del Regulador a solucionar los incumplimientos desde un esquema gradual, partiendo desde una posición persuasiva para que cuando sea necesario ejercer el poder punitivo, se ejerza fuertemente, aunque sólo en los casos en que se hayan sido vencido otros mecanismos de entendimiento. Consideramos en esa línea que lo importante no es tener una cantidad elevada de supervisiones que deriven en expedientes de sanción, sino que los expedientes que existan sean de gran impacto para la sociedad y el mercado de las telecomunicaciones. La causa es que no debe perderse de vista la relevancia de resolver oportunamente un caso en materia de
servicios públicos. Entiéndase resolver no como sinónimo de sancionar, sino como sinónimo de reparar, corregir o regenerar. Si el único camino que se tiene es el de sancionar, entonces es mejor, a nuestro entender, fijarse en aquellos procesos en los cuales se cuente con la mayor cantidad de pruebas (certeza indubitable, si se quiere), generada principalmente a partir de investigaciones minuciosas y sistemáticas, y aquellas nacidas del estilo de los juegos repetidos; y que generen un gran impacto en la industria. Desde nuestro punto de vista, a través de la aplicación de una Regulación Responsiva (Responsive Regulation), el Regulador puede alcanzar eficiencia en términos económicos (ahorro en el inicio de procedimientos administrativos sancionadores), eficacia en cuanto al cumplimiento de las
obligaciones a las que se sujetan las empresas operadoras (en lo sucesivo, Agentes Regulados) dentro de un contexto oportuno (los problemas que afectan el servicio público se solucionan en el menor tiempo posible); de este modo el Regulador se enfoca en que el Agente Regulado asegure la provisión de los servicios brindados dentro de los términos en que se encuentra obligado, en un tiempo esperado,
otorgando un conjunto de oportunidades graduales al agente presuntamente infractor de modo que corrija, resarza o remedie su incumplimiento, ello, aplicando las vigentes reglas del Texto Único Ordenado de la Ley del Procedimiento Administrativo General y las normas vigentes del sector. Para ello se propone una pirámide que inicia con la implementación de mecanismos persuasivos, como mesas de diálogo y transacciones, y culmina, en el vértice, con el retiro de la concesión o la disminución de años en su renovación, según sea el caso. Asimismo, se propone una pirámide inversa, en donde cada conducta positiva de la empresa, le otorga ventajas regulatorias en el mercado de las telecomunicaciones. / This research identifies that the dominant Enforcement strategy applied by the Peruvian Telecommunications Regulatory Agency (OSIPTEL) is deterrent (Deterrent approach), a strategy that has as its main characteristic that punishment is the most effective way to achieve a change of the offender’s behavior. In this context, the stitches fit into the possibility of opting for strategies (without neglecting the exercise of the regulator's sanitary energy when appropriate) that allow the opening of the regulator that solves noncompliance from a gradual scheme, starting from A persuasive position so that when it is necessary to exercise punitive power, it is strongly exercised, but only in cases where other mechanisms of understanding
have been overcome. We consider in this line that the important thing is not to have a high amount of supervisions that result in sanction records, but that the existing files are of great impact for the society and the market of the telecommunications. The reason is that the importance of timely resolving a case regarding public services should not be lost sight of. El presente informe jurídico tiene como finalidad determinar si la Administración
Pública, específica la entidad reguladora Osinergmin, tiene competencia para
aplicar mecanismos de ejecución forzosa para asegurar el cumplimiento de las
resoluciones emitidas en el marco de un procedimiento administrativo trilateral.
En este contexto, se analizará el caso contencioso-administrativo contenido en
el expediente judicial 18478-2008-0-1801-JR-CA-05, con especial énfasis en la
Resolución N° 19 – Sentencia de Vista, que cambió el enfoque de la Sala al
determinar erróneamente que el organismo regulador tiene la facultad de
imponer multas coercitivas en procedimientos trilaterales.
Ante esto, se remitirá a la normativa vigente durante la aplicación de las multas
coercitivas contra la empresa concesionaria de electricidad Electronoroeste S.A.,
así como a la doctrina especializada, para demostrar que Osinergmin no actuó
conforme a la ley. Para demostrarlo, primero se probará que aunque el
organismo regulador contaba con la facultad de imponer multas coercitivas, la
ley limita esta facultad a casos donde las obligaciones contenidas en las
resoluciones beneficien a la entidad. Asimismo, se precisará que el
procedimiento de reclamos de usuarios es efectivamente de carácter trilateral
cuando se presenta el recurso de apelación. Finalmente, se reflexionará sobre
la falta de vías administrativas en las cuales la Administración puede ejercer su
potestad de autotutela; sin embargo, esto no significa que no deba actuar
conforme a la ley. / The purpose of this legal report is to determine whether the Public Administration,
specifically the regulatory entity Osinergmin, has the authority to apply
enforcement mechanisms to ensure compliance with resolutions issued within
the framework of a trilateral administrative procedure. In this context, the
contentious-administrative case contained in judicial file 18478-2008-0-1801-JRCA-
05 will be analyzed, with particular emphasis on Resolution N° 19 - Judgment
of Appeal, which changed the focus of the Court by erroneously determining that
the regulatory body has the power to impose coercive fines in trilateral
proceedings.
In response to this, reference will be made to the current regulations governing
the application of coercive fines against the electricity concessionaire
Electronoroeste S.A., as well as specialized doctrine, to demonstrate that
Osinergmin did not act in accordance with the law. To prove this, it will first be
established that although the regulatory body had the authority to impose
coercive fines, the law limits this authority to cases where the obligations
contained in the resolutions benefit the entity. Additionally, it will be clarified that
the procedure for user claims is indeed trilateral when an appeal is filed. Finally,
there will be a reflection on the lack of administrative avenues through which the
Administration can exercise its power of self-guardianship; however, this does
not imply that it should not act in accordance with the law.

The purpose of this research study was to assess the control function of social work managers. The basic focus of the study is on how they perceive this management function of control as they exercise it, as well as how it is exercised to them.
Out of two research methods that one can choose from, namely quantitative and qualitative, the quantitative was chosen as the relevant one to use because of the specific close-ended questions that were to be answered by respondents regarding the exercise of control as a management function. Out of twenty five (25) questionnaires, an analysis of data was done on twenty (N = 20), because that was the original target and the five were just distributed in case some could not answer for whatever reason.
The findings and responses from the respondents were analysed and interpreted to meet the main objectives of the study. / Die doel van hierdie studie was om vas te stel wat die kontrole funksie van ’n maatskaplikewerk-bestuurder is. Hierdie studie is gefokus op hoe die bestuursfunksie beleef word soos dit beoefen word.
Van die twee navorsingsmetodes waaruit gekies kan word, naamlik kwalitatief en kwantitatief, is daar besluit dat die kwantitatiewe metode meer relevant sal wees omdat dit spesifieke geslote vrae vra wat ingestel is op die bestuursfunksie van kontrole.
Uit die 25 vraelyste is die data van 20 (N = 20) vraelyste ontleed, aangesien dit die aanvanklike teiken was. Daar is 5 ekstra uitgedeel net ingeval daar persone sou wees wat nie die vraelys kon voltooi nie.

Frågeställning: Hur kan en offentlig organisation arbeta effektivt med retention av sin kompetens i konkurrensen om den mänskliga resursen med andra organisationer? Syfte: Studien skapar även en grund för att Västerås Stad ska utveckla en förståelse för hur förvaltningarna och cheferna kan arbeta mer proaktivt med deras retention av personal och hur detta i sin tur kan attrahera fler medarbetare eller i andra fall återinföra förlorad kompetens. Metod: En kvalitativ forskning har gjorts genom en fallstudie på två förvaltningar inom Västerås Stad. Det förberedande arbetet har skapades genom att gå igenom en böcker och vetenskapligt granskade artiklar för detta forskningsområde. Empirisk data har samlats genom personliga semi-strukturerade intervjuer förutom en telefonintervju som hölls p.g.a. tidsbrist i respondentens schema. Slutsats: För att arbeta effektivt att behålla medarbetare och kompetens i en offentlig organisation måste det finnas förutsättningar för personligt engagemang (PE). PE kan delas upp i 5 delar som är uppdelade på inre motivationer: Public Service Motivation (PSM), Utvecklingsmöjligheter och Handledarstöd samt yttre faktorer: Arbetsmiljö och Belöning. De yttre faktorerna ligger till grund för tillfredsställelse på arbetsplatsen och uppfylls dessa ökar den inre motivationen och i sin tur det personliga engagemanget. Medarbetare värderar den inre motivationen och då har en offentlig organisation fördelen att arbete med PSM som en del av retentionsstrategin med styrkan i samhällsnyttan av medarbetarnas roll. Förväntningarna vid anställning skapar motivation och oförmåga att uppfylla förväntningar skapar risk för avgång. Om organisationen kan skapa en miljö som möjliggör re-retention, kan medarbetare som lämnat sin tjänst attraheras tillbaka vilket kan tillföra värdefullt perspektiv i nya arbetssätt samt tillfredsställa deras personliga utveckling. / Research questions: How can a public organization work more effective with retention of competence in the competition for human resources with other organizations? Purpose: The purpose with this study is to clarify why employees choose to work within their unit in Västerås Stad through an organisational perspective. The study lays the foundation for Västerås Stad to develop an understanding for how the units and managers can continue to work more proactive with their retention of employees and how this in turn can attract future employees or in some cases reintroduce lost competence. Method: A qualitative research was done through a case study on two units in Västerås Stad. The preparatory work for this research was created through books and scientific articles for this research area. The empirical data has been gathered through personal semi-structured interviews expect one telephone interview due to a lack of time for personal interview in the respondent’s schedule. Conclusion: To work effectively to retain employees and competence in a public organization there must be prerequisites for personal commitment (PC). PC can be divided into 5 parts that is split up into intrinsic motivations: Public Service Motivation (PSM), Development possibilities, Supervisor Support and external factors: Work Environment and Rewards. The extrinsic factors are the basis for satisfaction in the work place and when met the intrinsic motivation will increase and as a result the personal commitment will also increase. The employees value intrinsic motivation and as a public organization they have the advantage to work with PSM as a part of their retention strategy, with strength in community benefit as a part of the employees’ roles. Expectations when hired creates motivation and an inability to fulfil them creates a risk of resignation. If the organization can create an environment that enables re-retention, employees that have resigned could be attracted back to the organization and add valuable insight in new ways of working and satisfying their need for personal development.
