When workers suffering from work disability are unable to earn income with your work force to support themselves and their families. The State, through the public welfare, contributory and compulsory, has a duty to protect workers in times of misfortune, replacing these income through the provision of social security benefits. Disability the employee has a higher degree of vulnerability, and the granting of disability claims a right sensitive, which can‟t suffer postponements, lest cause legal uncertainty and violating the dignity of the human person. There isn‟t legal definition of disability. The main purpose of the study is the constitutional protection of the worker carrying work disability, seeking to highlight the factors affecting work disability and proposing the use of objective criteria for the grant of social security benefits, because the criteria used are purely medical, based the subjectivity and agency of medical assessor, which hinders the judicial and administrative control of the State. At the time of preparing the expert report, the expert should not consider only tangible aspects, but also social and environmental issues, which contribute to the inability to work and therefore should be considered in granting social security benefits. The granting of social security benefits for incapacity for work is intended to prevent or lessen the impact of individual and social risks in relation to the worker incapacitated, ensuring that the constitutional protection to be effective. The presumed inability, the institute reversing the burden of proof and free conviction motivated are important tools for resolving conflicts between the insured and welfare, finding basis in the insured`s vulnerability, sensitivity and little reliance right at issue in relation to the employee social pension / A seguridade social possui tutela constitucional e engloba as pol?ticas de sa?de, previd?ncia e assist?ncia social, que s?o expressamente reconhecidas como direito social fundamental. Os trabalhadores, quando acometidos de incapacidade laboral, ficam impedidos de auferir renda com a sua for?a laboral para o sustento pr?prio e de seus familiares. O Estado, por meio da previd?ncia social p?blica, contributiva e compuls?ria, tem o dever de amparar os trabalhadores nos momentos de infort?nios, substituindo a renda destes atrav?s da concess?o de benef?cios previdenci?rios. Na incapacidade, o trabalhador apresenta maior grau de vulnerabilidade, sendo a concess?o de benef?cios previdenci?rios por incapacidade um direito sens?vel, o qual n?o pode sofrer posterga??o, sob pena de causar inseguran?a jur?dica e violar a dignidade da pessoa humana. Inexiste defini??o legal de incapacidade. nÃo hà / Este estudo objetiva analisar, comparativamente, o nÃvel de desenvolvimento previdenciÃrio dos Regimes PrÃprios de PrevidÃncia Social (RPPSs) dos municÃpios do Estado do Cearà no perÃodo de 2006 a 2008 que possuem dados disponÃveis na internet. Para esse fim, fez-se uso de pesquisa bibliogrÃfica e coleta de dados. Trata-se de um estudo que envolveu informaÃÃes do Demonstrativo Anual das AvaliaÃÃes Atuariais (DRAA), Demonstrativo PrevidenciÃrio e outros. ApÃs a coleta dos dados, foi realizado o cÃlculo dos indicadores que compÃem o Ãndice de Desenvolvimento PrevidenciÃrio (IDP). SÃo eles: Reservas ConstituÃdas (IRC), Comprometimento da RCL (DPI), Maturidade PrevidenciÃria (IMP), Comprometimento Corrente (ICC), Comprometimento Fiscal com Pessoal (IFP) e Enquadramento Legal (CRP). Os resultados do estudo mostram que as recentes mudanÃas ocorridas na legislaÃÃo estÃo permitindo a construÃÃo e o crescimento de sistemas previdenciÃrios sustentÃveis, pois, dos vinte e nove municÃpios analisados, a maioria apresentou uma evoluÃÃo no nÃvel de desenvolvimento previdenciÃrio no decorrer dos anos 2006 a 2008, bem como sugere a inclusÃo do custo suplementar como mais um indicador de gestÃo do IDP, cuja influÃncia foi demonstrada atravÃs de um modelo economÃtrico. / The study aims to analyze comparatively the level of development of the social security to the public sector (RPPSs - Regimes PrÃprios de PrevidÃncia Social) in cities of the State of Cearà â Brazil, from the period of 2006 to 2008, with available data on the Internet. To this end, it was made use of bibliography and data collection. The study dealt with information taken from the Annual Statement of Actuarial Valuations (DRAA â Demonstrativo Anual das AvaliaÃÃes Atuariais), Social Security Statement and others. After collecting the data, it was performed the calculation of the indicators that construct the Social Security Development Index (IDP â Ãndice de Desenvolvimento PrevidenciÃrio). They are indicators of: 1) incorporated reserves (IRC â Indicador das Reservas ConstituÃdas); 2) impairment of net current revenues (DPI â DÃvida PÃblica ImplÃcita); 3) pension plans maturity (IMP â Indicador de Maturidade PrevidenciÃria); 4) commitment current (ICC â Indicador de Comprometimento Corrente); 5) commitment to personal tax (IFP â Indicador de Comprometimento Fiscal com Pessoal); and 6) legal framework (CRP â Certificado de Regularidade PrevidenciÃria). The results of the study show that recent changes in legislation are allowing the construction and growth of sustainable pension systems, since most of the twenty-nine cities examined showed a change in level of pension plans development in the years 2006 to 2008, and suggests the inclusion of additional cost as another indicator of management of the IDP, whose influence was demonstrated by an econometric model.

Along with these modifications, the labor market has been facing profound changes in its composition and regulation, such as in the labor law, contracts flexibility, higher women participation in the market etc. For being directly articulated with welfare, these factors have been examined nowadays by the European policy makers and the social partners. The main issue for the member countries has been how to deal with the challenges of fighting unemployment at the same time of assuring a modern social security system able to adapt to the regulatory changes in the labor market without harming the welfare of the citizens. La compensation de l'absence ou de la réduction du revenu du travail résultant des risques sociaux auxquels sont exposés les membres de la communauté des Etats UEMOA connaît des limites. Par rapport aux normes de l'Organisation Internationale du Travail, les régimes de sécurité sociale qui s'inspirent de l'ensemble des dispositions législatives, réglementaires et conventionnelles destinées à l'exclusion du chômage à protéger l'individu, sont calqués sur le modèle européen. Le système de sécurité sociale lié au développement du salariat étant le fondement de la norme minima. La convention n°102 ratifiée par deux Etats sur les huit de l'UEMOA, le Niger et le Sénégal, sous le bénéfice de dérogations, l'acceptation d'au moins trois éventualités est malencontreusement reprise du point de vue conceptuel, par la convention CIPRES, censée harmoniser les législations de sécurité sociale d'Etats africains, alors que se développe actuellement une nouvelle notion du travailleur qui ne se limite plus simplement aux salariés, notion qui a une acception juridique plus restreinte. La conséquence est que les droits nationaux, très en deçà des normes internationales deviennent également inadaptés. Du point de vue du champ d'application personnel, le problème de la couverture se pose avec d'autant plus d'acuité que les possibilités d'une extension constituent un obstacle quasi insurmontable. Les Etats pris isolément ne peuvent à eux seuls venir à bout des limites liées à leur niveau de développement. De nombreuses solutions pour l'extension du droit à la sécurité sociale ont été expérimentées à travers le monde. Elles offrent un kaléidoscope de modèles s'organisant autour des institutions de prévoyance et mutuelles sociales ou de l'assistance. Mais la considération du respect de la dignité de la personne qui inspire notamment le droit à une couverture sociale impose de considérer que l'extension de la sécurité sociale à ceux qui en sont dépourvus nécessite l'action concertée des Etats UEMOA qui se fonde sur l'éthique professionnelle non «par le rattrapage industriel», mais par un retour à l'étape brûlée, le secteur primaire, seul à même de pouvoir sous-tendre «un nouveau socle de sécurité sociale». / The compensation of the absence or the reduction of the earned income resulting from social risks to which are exposed the members of the community of States UEMOA knows limits. But the consideration of the respect for the dignity of the person which inspires in particular the right for a social coverage imposes to consider that the extension of the Social Security to those who lack it requires the joint action of States UEMOA which bases itself on the professional ethics not "by the industrial catching up", but by return in the missed stage, the primary, only sector to be able to underlie "a new social protect floor".

An investigation into social exclusion in the implementation of social grants: the case study of the child support grant in the Nkonkobe local municipality (Eastern Cape)

South Africa is faced by a huge problem of inequality, twenty years after the dawn of independence. Such inequalities have been addressed by policy intervention such as the social security and assistance of citizens through various classes of grants. One of the grants targeting children under the age of 18 years is the child support grant. However there are deserving children who have been left-out of mainstream social security through social exclusion. The study sought to investigate the problem of the social exclusion of children from the child support grant in the Nkonkobe municipality. Through the use of the Basic Needs Approach (BNA) to understand the need for any state/government to promote the social welfare of its citizens, the study took a triangulated research paradigm which used both quantitative and qualitative research approaches to collect data from forty respondents by way of a questionnaire survey. The study found out that, inter alia, poverty remains high in the Nkonkobe municipal area, there is rampant social exclusion in the area, the amount paid for the child support grant is little and that the effects of the withdrawal of the grant when the child reaches the age of 18 are unbearable to the child. Some of the recommendations which the study made in line with improved mainstream social security in relation to the child support grant are that, the government needs to improve information dissemination about grants to the populace, there should be mandatory policies to make sure all citizens have identification particulars, the government should be mobile and take services to the people and there should a consideration to review the amount paid for the child support grant upwards. The researcher is quite optimistic that the study will play a part in improving policy implementation.

The protection given by the social security is made through the so-called social security benefits. The existent benefits in Brazil, often are not cohesive with the proposal goals, or even are not cohesive with the current legislation in the country. In the country, oftentimes are created some obstacles to the granting of the social security benefits than follows that they are taken by parts of the population that are not entitled to them. Sometimes, the created benefits do not reach their social purposes and in some cases are created limitations that should not exist. According to the Statistical Yearbook of the Social Security, 2008, 99.6% of the allowed benefits to the rural clientele of the INSS is from the order of 01 (one) Minimal Salary. This work had the purpose to show how these benefits are noticed and understood by the rural producers, as well, evaluate the necessity of informations about the topic to be able to permit the improvement of the life conditions of the rural people when they found themselves in situations of productive limitations either due to age or the occurrence of diseases. After conducting research with geo-referenced Producers Rural Region Alfenas-MG, who answered a semi-structured questionnaire and presented doubts about the Social Security Scheme, it was verified that the quality of the received information is the main responsible by the advent of the Rural Producers had to undergo a small monthly income in times of social misfortunes. / A previdência social rural faz parte do sistema de seguridade social e se destina a proteger o cidadão nos momentos em ele que é atingido por algum dos riscos sociais inerentes à vida humana. A proteção dada pela previdência social é feita por meio dos chamados benefícios previdenciários. Os benefícios existentes no Brasil, muitas vezes, não são coerentes com os objetivos a que se propõem, ou mesmo, não são coerentes com a legislação vigente no País. No país, muitas vezes são criadas poucas barreiras para a concessão dos benefícios previdenciários, do que decorre que eles sejam tomados por parcelas da população que a eles não fazem jus. Por vezes, os benefícios criados não atingem seus fins sociais e, em certos casos, são criadas limitações que não deveriam existir. Segundo o Anuário Estatístico da Previdência Social, 2008, 99,6% dos benefícios concedidos à clientela Rural do INSS é da ordem de 01 (um) Salário Mínimo. Objetivou-se demonstrar por meio deste trabalho como tais benefícios são percebidos e compreendidos pelos produtores rurais, bem como, avaliar a necessidade de informação sobre assunto para poder permitir a melhoria da condição de vida das pessoas do meio rural quando se encontrarem em situações de limitações produtivas, seja pela idade ou pela ocorrência de enfermidades. Após a realização de pesquisa geo-referenciada com Produtores Rurais da Região de Alfenas-MG, que responderam a um questionário semiestruturado e apresentaram dúvidas do Regime de Previdência Social, verificou-se que a qualidade da informação recebida é a principal responsável pelo advento dos Produtores Rurais terem que se submeter a uma pequena renda mensal nos momentos de infortúnios sociais.

In the understanding of the author tax law and social security laws are studied in general separately. The author agrees with many doctrine authors that find it ‘surprising’ as this is a complete and linked issue, that all remote worker even cross-border/frontier workers face. However, it is worth mentioning here, for future reference and for the understanding in the continuity of this paper, is that remote worker and cross-border - frontier worker have usually different rules surrounding them. Additionally it may seem unusual for the reader to link digitalization of the economy and all its development with remote work; tax law and social security but in the eyes of the author it is all in some way linked. Firstly, developments in the digital world and its impact in economy transcendance in mobility of individuals. Which gives principally, the opportunities for employees to work from a remote place. Secondly, again in the eyes of the author, especially after the courses taken during this master year and in concordance with all the research done for this study; tax law and social security law are linked with each other. In conjunction the author finds it useful to study the issue born from the difficulty of tax allocation in regards to remote worker and the lack of compatibility between the social security legal system and the tax legal system. It is the purpose of this thesis to analyse and study these topics separately and then discuss throughout the paper the issues that may affect individuals especially remote workers but also states especially in our post pandemic states.

Child Support Grant is a poverty alleviation mechanism implemented with the aim of exploring new alternative policy options targeting children and families in South Africa. The grant has proven to be successful as it was able to put about 8 million orphans and poor children in the safety net in 2008. However, although the grant has proven to be successful, not all the deserving children receive the grant. Children‟s access to a full measure of security and the basic needs as prescribed in the Bill of Rights remain agitated with problems as the grant‟s extent of coverage due to the limited amount structure does not provide all the basic needs of the children. The study also revealed that majority of participants due to the grant‟s extent of coverage experienced hardships in terms of inflation rate. The participants‟ stressed about the price of goods which is perennially increasing as they are unable to cope with price trends, which led them to adopt the practice of layby. Both quantitative and qualitative methods were utilised which adopted structured questionnaires and in-person interviews to hear the participants‟ perspective on the impact that Child Support Grant has as a poverty alleviation mechanism on the livelihoods of the beneficiaries as well as the challenges of Child Support Grant‟s administrative system. The study recommended that the Child Support Grant despite its limited amount structure enables people to participate on economic activities wherein they are able to engage in farming activities in that during harvest time they are able to sell their produce to the market like Pick „n Pay and Shoprite though its seasonal.
