This thesis deals with the execution of social security benefits. The thesis is divided into six chapters, which are broken down into subsections. It also includes an introduction and a conclusion. The first chapter describes the batch system in the Czech Republic. After defining the concept of social security benefit, the principles are described in the provision of social security benefits and the breakdown of social security benefits. Furthermore, according to the systems of social security rights defined by individual social security benefits. The second section describes the types of executions. First, it discusses the judicial enforcement. In this section we describe two methods of enforcement, which by their nature are possible in execution of social security benefits. It is a payroll deductions and receivables commandments. Other subsections devoted to execution under the Enforcement Regulations, administrative execution, tax execution and parallel execution. The third chapter discusses the execution of health insurance benefits. Herein, the benefits of which can perform execution deductions from wages and benefits that can affect seizures. Further, it discusses the deviations in the implementation of deductions of health insurance benefits from the normal procedure for making payroll deductions....

It is assumed that the plan of benefits, laid down by Federal Law No. 8213 / 91, is not capable of protecting all Brazilian families, given the new social risks generated by postmodernity. With the development of the human species and the evolution of the State, an improvement of the mechanisms of social protection was observed, thus resulting in the shift of responsibility from the family circle (private) to the state one (public). However, the family, which was the initial foundation of social protection, has undergone great transformations in recent times, both with regard to the new forms of arrangement and the role played by its members. This is a point that deserves attention from the current systems of Social protection, among them the Brazilian one, which is organized under the simple distribution system, grounded under the intergenerational pact and that became a social fundamental right after 1988. These considerations will then show the legal, economic and social relevance of this study. Regarding the theoretical-methodological aspects, a bibliographical research was developed, drawing from the main contributions on the topic, as well as documentary research, based on available legal apparatus and jurisprudence. The results show that the current social security benefits of the Social Security System are unsatisfactory and don’t meet the new social risks that Brazilian families are exposed in postmodernity. This is mainly due to the phenomenon of the feminization of the labor market, a situation that can be remedied with the creation of the benefit of parental aid, according to experiences of the alien right / A presente tese de Doutorado tem como objetivo analisar a efetividade dos benefícios previdenciários do Regime Geral de Previdência Social, destinados à proteção das famílias no atual paradigma da pós-modernidade. Parte-se do pressuposto de que o plano de benefícios, previsto a partir da Lei Federal nº8.213/91 não é capaz de proteger todas as famílias brasileiras, diante dos novos riscos sociais. Com o desenvolvimento da espécie humana e a evolução do Estado foi percebido um aprimoramento dos mecanismos de proteção social, ocorrendo um deslocamento de responsabilidade da esfera familiar (privada) para a esfera estatal (pública). Ocorre que a família, que foi o núcleo inicial da proteção social, tem passado por grandes transformações nos últimos tempos, tanto no que diz respeito às novas formas de arranjo familiar como também ao papel desenvolvido pelos seus integrantes, ponto que merece atenção dos atuais sistemas de proteção social, entre eles o brasileiro, alçado à condição de direito fundamental social após 1988, e que é organizado sob o regime de repartição simples e alicerçado sob o pacto intergeracional, o que demonstra a relevância jurídica, econômica e social deste estudo. No que tange aos aspectos teórico-metodológicos, foram realizadas pesquisas bibliográficas, com respaldo nos principais aportes relacionados à temática, pesquisa documental baseada nos dados dos aparatos legais disponíveis e ainda jurisprudência. Os resultados alcançados nos reportam à conclusão de que os atuais benefícios previdenciários do Regime Geral de Previdência Social são insuficientes para atender aos novos riscos sociais a que estão expostos às famílias brasileiras na pós-modernidade, especialmente em razão do fenômeno da feminização do mercado de trabalho, situação esta que pode ser revertida com a criação do benefício de auxílio-parental, conforme experiências do direito alienígena

The impact of some social security benefits is clearly evident in labor relations proving the legal, economic and social relevance of this study, which is based on the attempt to resolve current controversial issues arising in this area where research work is still lacking. Among the hypothesis mentioned, we have found the possibility of suspension, interruption or termination of the work contract, as well as the vesting of tenure rights as a result of receiving certain social security benefits. As to the theoretical-methodological aspects, we collected and studied articles and other doctrine pertaining to this subject, without disregarding the legislation and former court decisions on the matter. The results obtained with the thesis lead us to the conclusion that, the social security benefits granted due to disability cause the suspension of the work contract (after the 16th day of leave of the employee), the benefits granted due to retirement age or period of contribution cause termination of the work contract, and tenure rights are assured in case of workmen s compensation or maternity leave. The effects of the receipt of social security benefits can be observed also during prior notice of dismissal or after termination of the work contract / O presente estudo tem por objetivo geral a análise dos efeitos do recebimento dos benefícios previdenciários no contrato de trabalho. O reflexo de alguns benefícios previdenciários é evidente na relação trabalhista, o que demonstra a relevância jurídica, econômica e social deste estudo baseado na tentativa de resolver questões polêmicas e atuais desta área carecedora de pesquisa. Dentre as hipóteses mencionadas, encontramos a possibilidade de suspensão, interrupção ou extinção do contrato de trabalho, bem como a aquisição de estabilidade em virtude do recebimento de alguns benefícios previdenciários. Com relação aos aspectos teórico-metodológicos foram realizados coleta e estudo de artigos e demais doutrinas pertinentes ao assunto, não deixando de lado a legislação e jurisprudências relacionadas ao tema em análise. Os resultados alcançados com a tese nos reportam à conclusão de que os benefícios previdenciários concedidos por incapacidade suspendem o contrato de trabalho (após o décimo - sexto dia de afastamento do segurado); aqueles decorrentes de idade avançada ou tempo de contribuição, extinguem referido contrato e a estabilidade é garantida em caso de concessão de benefício acidentário ou em decorrência de maternidade. Os efeitos do recebimento dos benefícios previdenciários podem ser observados inclusive durante o aviso prévio ou após o término do contrato de trabalho

Dessa forma, o presente trabalho tem como objetivo investigar as razões de tal diferenciação, de modo a verificar se tais questões de gênero constituem elemento de promoção da igualdade entre os sexos, diante das características de desigualdade existentes no mercado de trabalho. Tal análise busca relacionar a trajetória das legislações brasileiras e das normas de direito internacional com o histórico social de discriminação feminina. Possui como marco teórico os conhecimentos trazidos pelas teorias de gênero, mormente o feminismo, e pela sistemática jurídica fundamentada na teoria dos princípios, de caráter pós-positivista. / The Brazilian Federal Constitution of 1988 and the Social Security Benefit Plan, Law no. 8.213/1991, set out the benefits of the General Regime of Brazilian Social Welfare. In certain benefits, the legislation provides for requirements such as age and minimum contribution period to be granted. However, the provisions concerning maternity benefit, old age pension, retirement pension, and survivors benefits bring more lenient requirements for women to concede this benefits. Thus, this study aims to investigate the reasons for such differentiation, in order to verify if that gender issues are part of the promotion of equality between women and men, given that exists inequality in the characteristics of labor market. This analysis inquires to connect the trajectory of Brazilian legislation and rules of international law with the social historical of discrimination against women. This research has as theoretical framework the knowledge brought by gender theories, especially feminism, and the legal theory grounded in the legal principles, with post-positivist character.

The protection given by the social security is made through the so-called social security benefits. The existent benefits in Brazil, often are not cohesive with the proposal goals, or even are not cohesive with the current legislation in the country. In the country, oftentimes are created some obstacles to the granting of the social security benefits than follows that they are taken by parts of the population that are not entitled to them. Sometimes, the created benefits do not reach their social purposes and in some cases are created limitations that should not exist. According to the Statistical Yearbook of the Social Security, 2008, 99.6% of the allowed benefits to the rural clientele of the INSS is from the order of 01 (one) Minimal Salary. This work had the purpose to show how these benefits are noticed and understood by the rural producers, as well, evaluate the necessity of informations about the topic to be able to permit the improvement of the life conditions of the rural people when they found themselves in situations of productive limitations either due to age or the occurrence of diseases. After conducting research with geo-referenced Producers Rural Region Alfenas-MG, who answered a semi-structured questionnaire and presented doubts about the Social Security Scheme, it was verified that the quality of the received information is the main responsible by the advent of the Rural Producers had to undergo a small monthly income in times of social misfortunes. / A previdência social rural faz parte do sistema de seguridade social e se destina a proteger o cidadão nos momentos em ele que é atingido por algum dos riscos sociais inerentes à vida humana. A proteção dada pela previdência social é feita por meio dos chamados benefícios previdenciários. Os benefícios existentes no Brasil, muitas vezes, não são coerentes com os objetivos a que se propõem, ou mesmo, não são coerentes com a legislação vigente no País. No país, muitas vezes são criadas poucas barreiras para a concessão dos benefícios previdenciários, do que decorre que eles sejam tomados por parcelas da população que a eles não fazem jus. Por vezes, os benefícios criados não atingem seus fins sociais e, em certos casos, são criadas limitações que não deveriam existir. Segundo o Anuário Estatístico da Previdência Social, 2008, 99,6% dos benefícios concedidos à clientela Rural do INSS é da ordem de 01 (um) Salário Mínimo. Objetivou-se demonstrar por meio deste trabalho como tais benefícios são percebidos e compreendidos pelos produtores rurais, bem como, avaliar a necessidade de informação sobre assunto para poder permitir a melhoria da condição de vida das pessoas do meio rural quando se encontrarem em situações de limitações produtivas, seja pela idade ou pela ocorrência de enfermidades. Após a realização de pesquisa geo-referenciada com Produtores Rurais da Região de Alfenas-MG, que responderam a um questionário semiestruturado e apresentaram dúvidas do Regime de Previdência Social, verificou-se que a qualidade da informação recebida é a principal responsável pelo advento dos Produtores Rurais terem que se submeter a uma pequena renda mensal nos momentos de infortúnios sociais.

Social security for women in pregnancy and maternity and the protection of their rights in the Czech Republic and the EU The objective of this diploma thesis is to describe and analyse the topic of protection and social security of pregnant women and mothers in the Czech Republic and the EU. The reason of such protection lies in the fact that during pregnancy and early maternity women and their families are significantly limited in their possibilities of working, which is connected with a decrease in the family income and a certain difficulty in the social life. The main part of the thesis consists of five chapters. The first chapter concerns the family policy, which is a state policy branch that focuses on the support of a family, family life and other related institutes and activities, e. g. marriage, motivation of employers to employ pregnant women and mothers or parents, support of institutions that provide care and education to small children etc. The section dedicated to the social security funding explains possible resources and methods of financing the social protection used within contemporary developed political and economic systems. Labor Law is responsible for protecting labor rights, whereas Social Security Law includes a significant number of provisions, represented by benefits and services available to the employee whenever he/she is faced with the contingencies which this field of law seeks to cover. The ultimate goal of this study is to analyze the impact of social security benefits on the individual work contract. To this end, we provide a brief overview of labor concepts, especially those regarding the work contract itself. Next, we present a few established social security laws in order to allow for a better comprehension of that which is the essence of this paper, that is, the theoretical and practical implications of social security benefits of Regime Geral de Previdência Social (General Social Security System and Special Social Security) RGPS on the work contract. Among all the benefits currently provided by the RGPS, we have not touched on the issue of pension benefit due to death, neither that of the reclusion aid, as they both involve benefits for the dependents of the insured individual, and therefore do not require debates regarding work contracts. Finally, we were able to establish that the social security benefits have a greater or lesser impact on the work contract, depending on each specific benefit, as they guard against different social risks / Direito do Trabalho e Direito Previdenciário representam na atualidade dois ramos autônomos da Ciência Jurídica, e encerram a ideia de proteção à pessoa que trabalha, em especial àquele trabalhador submetido a um contrato de trabalho subordinado. O Direito do Trabalho é responsável pela garantia de direitos trabalhistas, ao passo que o Direito Previdenciário contém um rol expressivo prestações, representadas por benefícios e serviços que estão à disposição do empregado quando este estiver sujeito às contingências que este ramo do direito objetiva amparar. O propósito último desse estudo é analisar o reflexo dos benefícios previdenciários no contrato individual de trabalho. Para tanto, fez-se uma breve exposição de conceitos trabalhistas, sobretudo no que diz respeito ao próprio contrato de trabalho. Em seguida foram descritos alguns institutos do Direito Previdenciário, a fim de permitir uma melhor compressão daquilo que é a essência dessa obra, qual seja, as implicações teóricas e práticas dos benefícios previdenciários do Regime Geral de Previdência Social RGPS no contrato de trabalho. De todos os benefícios que atualmente o RGPS dispõe, não se tratou acerca da pensão por morte, nem tampouco do auxílio-reclusão, por serem benefícios destinados aos dependentes do segurado e, portanto, não demandam debates frente ao contrato de trabalho. Ao final, foi possível constatar que os benefícios previdenciários impactam em maior ou menor medida no contrato de trabalho, a depender de cada benefício em específico, haja vista que tutelam riscos sociais distintos

To understand the experience of social security benefits in the municipalities of Maranhão, is essential to look back on the origins of Social Security, as well as its deployment and evolution in Brazil as a public policy of the State and Society. The reflections of the presence of social security benefits on the local economy maranhenses observed either in the composition of the municipal GDP, as in the composition of household income, both calculated by the IBGE. Maintaining the By-laws of Public Welfare in the Constitution is an important tool in achieving the development and achievement of welfare and social justice for millions of Brazilians. / Os benefícios previdenciários de aposentadorias e pensões do Regime Geral de Previdência Social, pagos conforme os preceitos da Constituição Federal de 1988 à população residente nos municípios do Maranhão, apontam para a sua significativa participação na economia local. Para entender a experiência dos benefícios previdenciários nos municípios do Maranhão é indispensável um olhar retrospectivo sobre a origem da Previdência Social, assim como a sua implantação e evolução no Brasil como uma política pública do Estado e da Sociedade. Os reflexos da presença dos benefícios previdenciárias na economia dos municípios maranhenses podem ser observados tanto na composição do Produto Interno Bruto municipal, como na composição da Renda das famílias, ambos calculados pelo IBGE. Os indicadores sociais como IDH, Índice de Gini e Índice de Desenvolvimento Municipal também refletem a importância dos benefícios previdenciários para o bem estar da população municipal. A adoção de uma política regional de desenvolvimento econômico no território maranhense, articulada com o mundo econômico globalizado, é salutar para a economia municipal e para a Previdência Social. A manutenção dos regramentos da Previdência Social Pública no texto constitucional é uma ferramenta relevante no alcance do desenvolvimento e na conquista do bem-estar e da justiça social para milhões de brasileiros.

Essays on Labor Economics

<p>This dissertation is a collection of three papers, each one being a chapter. In the first chapter, I examine how career interruptions related to child-raising duties affect married women’s labor market trajectory, lifetime earnings, and Social Security retirement benefits. To address this question, I develop and estimate a dynamic life-cycle model of female labor supply, savings, and Social Security benefit claiming. I explicitly model the Social Security benefits system and the federal and payroll tax structure in the United States. The framework, thus, allows me to unravel the complex interdependencies between women’s participation decisions, accumulated work experience, lifetime earnings, and public pension benefits. I estimate the model using the Method of Simulated Moments and match data for the cohort born in 1943-1954. I use the model to simulate labor supply behavior of married women in a revenue-neutral counterfactual scenario where I introduce Social Security caregiver credit that covers the lost earnings during the first 5 child-rearing years through changes in retirement benefits. I find that the model predicts that introducing the provision of earning credits for child care in the Social Security system would reduce participation of married women during the child-rearing years, but the contributory nature of the caregiver credits creates incentive to work in the post-childrearing period.</p> <p><br></p> <p>In the second chapter, I evaluate the implication of introducing Social Security caregiver credit by examining whether and to what extent implementing this child-related policy to the existing Social Security system would help reduce the motherhood earnings penalty over the life cycle. I utilize the dynamic lifecycle model developed in Chapter 1 and conduct revenue-neutral counterfactual policy experiments by introducing caregiver credits in in various settings. First, I analyze the effect of the policy at different generosity levels; and second, I implement the policy in the presence as well as in the absence of the marriage-based noncontributory Social Security benefits (spousal and survivors benefits). Third, I conduct an alternative counterfactual policy experiment where mothers could drop five additional work years from the average career earnings (or equivalently Social Security benefits) calculation. The model predicts that lifetime pre-tax labor earnings of married women increase significantly under when the caregiver credits are introduced in a setting where spousal and survivors benefits are eliminated, and there is a sizeable reduction in gender gap in average career earnings at the Social Security Early Retirement Age. The alternative policy of computing average career earnings based on a mother's 30 years of earnings has significantly smaller impact on offsetting motherhood earnings penalty through retirement benefits compared to the provision of Social Security caregiver credits.</p> <p><br></p> <p>In the third chapter, I examine the effect of Supplemental Nutrition Assistance Program (SNAP) work requirement reinstatement on food insecurity outcomes of able-bodied adults without dependents (ABAWDs). The policy restricts SNAP benefits of ABAWDs to 3 months in a 36 month period if they are not working or participating in any work program for at least 20 hours a week. In the aftermath of the 2008 recession, the American Recovery and Reinvestment Act of 2009 waived work requirements nationwide, and many states reimplemented the work rule at different times beginning in 2011. I employ a difference-in-differences approach utilizing this cross-state variation in the reimplementation of the policy. Using rich information on food affordability and food intake behavior from the Food Security Supplement of the Current Population Survey (CPS-FSS), I find that promoting work for food assistance improved the overall food security status of ABAWDs by reducing disruptions in food intake, anxiety over food affordability and dependency on emergency food receipt. Subsample analyses indicate that effects are stronger for never married and less educated ABAWDs.</p>
