Efficaciousness of the construction process for the most part depends on how clear and comprehensible the construction contract and legal acts define rights and obligations of the parties and divide between them risk and liability for an improper execution of the obligations. Baigiamajame magistro darbe analizuojama statybos įmonių darbuotojų motyvavimo problema. Darbo tikslas yra sudaryti ir pagrįsti statybos įmonės darbuotojų motyvavimo sistemą, pateikiant ją kaip universalų modelį. Darbe nagrinėjami darbuotojų motyvaciją lemiantys veiksniai; atsižvelgus į statybos įmonių ypatumus, analizuojami motyvavimo būdai. Atliktus anketinį tyrimą, nustatyti poreikiai, motyvavimo veiksniai ir metodai, kurie sukelia statybos darbuotojų pasitenkinimą arba nepasitenkinimą darbu. Darbe yra įvadas, trys skyriai, išvados ir pasiūlymai. Pirmajame skyriuje atlikta užsienio ir Lietuvos autorių darbų darbuotojų motyvavimo klausimais apžvalga. The aim of the thesis is to establish and justify the motivation system of employees of construction companies, and present it as a universal model. The thesis analyses the factors, influencing the motivation of employees; with regard to peculiarities of construction companies the motivation techniques are analysed. After a survey research, the needs, motivation factors and methods were determined, which influence the satisfaction or dissatisfaction of construction employees with their work. Statybai, kaip vienai iš žmogaus ūkinės veiklos šakų, sparčiai keičiančiai gyvenamąją aplinką kiekybiniu ir kokybiniu požiūriais, skiriamas išskirtinis dėmesys. Statyba šiame darbe vertinama atsižvelgiant į darnumo principus. Norint sėkmingai integruotis į Europos Sąjungą, reikalingi infrastruktūros planavimo ir plėtros pokyčiai, būtina gerinti gyvenimo ir aplinkos kokybę. Šalies politika, taip pat ir darnios statybos klausimais, turi būti adekvati Europos valstybėms. Pastaraisiais metais darniai statybai, tame tarpe ir presuotų šiaudų panaudojimui, skiriamas didelis dėmesys ne tik populiarioje literatūroje: laikraščiuose, žurnaluose, bet ir mokslinėje literatūroje. Rašomi ne tik straipsniai, bet ir knygos. Atsinaujinančių statybinių medžiagų panaudojimo klausimais atliekami užsakomieji moksliniai tyrimai, ruošiamos disertacijos. Atsižvelgiant į tai galima teigti, kad ir Lietuvoje bus suformuota valstybinė darnaus vystymosi kriterijais paremta statybos politika. In this work construction is evaluated by taking into consideration principles of sustainability. In order to successfully integrate into the European Union changes of infrastructure planning and development are required, it is necessary to improve the quality of life and environment. Country policy, as well as sustainable construction issues, must be adequate to the European countries. In recent years the great attention is paid for the sustainable construction including the use of compressed straw not only in the popular literature: newspapers, magazines, but also in the scientific literature. Not only articles are written, but books as well. Scientific researches are performed in the issues of renewable construction material use as well as the dissertations are prepared. Taking this into consideration it can be stated that Lithuania will establish a state construction policy based on sustainable development criteria. Disertacijoje nagrinėjamos statybos projekto valdymas, jame dalyvaujan-čios ir savo tikslus siekiančios įgyvendinti suinteresuotos grupės bei valdymą veikianti išorinė makro- ir mikroaplinka. Norint sukurti ir pasiekti efektyvų statybos projektų valdymą, reikia atlikti kompleksinę jo etapų analizę. Be to, reikia atsižvelgti į projekto, organizacinės ir išorinės aplinkos veiksnių poveikį. Nagrinėjamas statybos projektų valdymo efektyvumo didinimas, panaudojant daugia¬kriterinės analizės sprendimų paramos metodus ir informacines techno-logijas. Darbo tikslas – įvertinti ir pagerinti statybos projektų valdymo efektyvu-mą, naudojant sukurtą Integruoto projektų valdymo modelį. Naudojant šį mo-delį buvo sukurta Daugiakriterinė statybos projektų valdymo sprendimų para-mos sistema, pagrįsta sudėtingų sistemų teorija ir daugiakriterinės analizės bei variantinio projektavimo metodais. Aiming for efficient design and construction project management an integrated analysis of the process stages is needed. Šiame darbe nagrinėjama įmonių verslo plėtros galimybės koncentruojantis į gamyboje naudojamų įrengimų atnaujinimą, naujų pažangių technologijų įsigijimo savinimą, Kokybės valdymo ir aplinkosaugos sistemų įsisavinimą. Tyrimui naudota mokslinės literatūros, ūkinės patirties ir statistinių duomenų analizė. Ekonominiai duomenys analizuoti matematinės statistinės analizės metodais, santykinių dydžių skaičiavimo, palyginimo, vidutinių dydžių skaičiavimo, grafinės išraiškos ir kitais. Analitinėje dalyje analizuota įmonės gamybinės bei ekonominės veiklos raida, valdymo organizacinė struktūra bei jos tobulinimas, vadovaujantis UAB „Plungės lagūna“ finansinės atskaitomybės duomenimis. Taip pat nagrinėta, kokią turės įtaką pelningumui bei konkurencingumui gamybos modernizavimas. Pagrindinis tyrimo tikslas – pasiūlyti analizės metodus, skirtus statybos eksporto žiniomis grįstai sprendimų paramos sistemai kurti. •Įvertinti statybos eksporto efektyvumą daugiakriterinės analizės metodais. •Pritaikyti ekspertinius metodus, kuriant statybos eksporto galimybių analizės ir geriausios patirties žinių bazės sistemą; atlikti užsienio šalių statybos eksporto sektoriaus analizę, pasitelkiant naujausias informacines ir telekomunikacines technologijas. •Analizuoti pasaulinio interneto tinklo, kaip užsienio statybos pramonės rinkos tyrimų įrankio taikymą. •Pateikti pasiūlymus, kaip naudojant naujausias informacines technologijas ir žinių sistemas sumažinti eksporto sąnaudas, padidinti efektyvumą. / The main aim of the research: to offer analysis methods for development of a knowledge-based decision support system in the sphere of construction export: to evaluate the effectiveness of construction export using methods of multiple criteria analysis; to make use of expert methods when developing the system of feasibility study of construction export and the knowledge base of best experience; to describe application of internet as a tool in analysis of foreign markets and provide offers to exporters of the Lithuanian construction branch on how to use Internet in their activities thus granting improvement of export effectiveness; to provide offers on how to reduce export cost and improve effectiveness and quality by using the newest IT and knowledge systems.

This Master thesis analyzes diversification strategies, diversification possibilities establishment and realization theoretical aspects with reference to Lithuanian and foreign sources. Having applied the method of structurized poll in writing, the behaviour of construction and maintenance services consumers was evaluated, the factors which influence it were determined, the level of construction and maintenance services consumers satisfaction was determined, demands and expectations of unsatisfied consumers were ascertained. With a regard to the situation in the market and its changing tendencies and the results of consumers poll, the diversification possibilities of construction and maintenance services enterprises were estimated, the diversification alternatives prospects of construction and maintenance services enterprises were evaluated. The results of empirical research confirmed a hypothesis and allowed a statement that not fully satisfied demands of consumers, existing in the market, show diversification possibilities of construction services enterprises.

Tyrimo tikslas – išanalizuoti statybos darbų organizavimo vadybinius – techninius aspektus ir pateikti argumentuotas, pagrįstas priemones darbo organizavimo gerinimui. Išnagrinėta literatūra šia tema, ištirti statybos įmonių vadybiniai – techniniai aspektai bei jų svarba statybos įmonėms. Norint sužinoti, kokie vadybiniai – techniniai aspektai yra svarbiausi statybos įmonėms buvo atliktas kiekybinis tyrimas. Tyrime dalyvavo 133 respondentai iš dviejų statybos įmonių: 68 respondentai iš UAB „Šiaulių ranga“ ir 65 respondentai iš UAB „Rotonda“. Mokslinės literatūros analizė atskleidė, kad šiuolaikinei statybai būdinga kokybė, sparta ir ekonomiškumas. To pasiekiama didinant statybos darbų mechanizavimo lygį, racionaliai naudojant našias ir technologiškas statybos mašinas, mechanizmus ir mechanizavimo priemones. Nedidelėms statybos įmonėms savas mašinas naudoti neracionalu. Priešingai, didelėms ypač specializuotoms, įmonėms (kelių tiesybos, komunikacijų klojimo, betonavimo ir pan.) savas mašinas, mechanizmus naudoti apsimoka. Atlikta statybos įmonių darbuotojų apklausa padėjo nustatyti, vadovavimo svarbą įmonėje, komandinio darbo ypatumus, darbo našumo ir kokybės įtaką įmonių pasiekimams. Ištirta, kokią statybų techniką įmonės nuomojasi ir kokią turi ir kokie veiksniai įtakoja pasirinkimus. Empirinio tyrimo rezultatai atskleidė, kad statybos įmonės techniką nuomojasi. [toliau žr. visą tekstą] / The aim of the research is to analyse the management-technical aspects of construction works organization and present the reasoned and sound means for improvement of the work organization. We have analysed the literature on this topic, explored the management- technical aspects and their importance for construction companies. In pursuance of establishment, which management-technical aspects are the most important for construction companies, we have done a quantitative analysis. 133 respondents from two construction companies: 68 respondents from UAN “Siauliu ranga” and 65 respondents from UAB “Rotonda” participated in the research. The analysis of the scientific literature revealed that quality, rapidity, and economy are characteristic of modern construction. That is achieved by increasing the level of construction works mechanization, using rationally productive and technological building machinery, mechanisms and mechanical means. It is irrational for small construction companies to use own machinery. Conversely, it is worth to use own machinery and mechanisms to big, and especially specialised, companies (road-building, building of communication means, concrete pouring and etc.). Magistro darbe analizuojamos neteisėtos statybos padarinių šalinimo instituto pozityviosios teisės normos, jų taikymas teismų praktikoje. Analizuojami neteisėtos statybos civiliniai teisiniai padariniai. Ypač didelis dėmesys yra skiriamas šio instituto teisės normų atitikimui teisės principams, įskaitant proporcingumo bei sąžiningumo. Atlikus teisinį tyrimą, prieinama prie išvados, jog esamos šio instituto teisės normos prieštarauja šiems teisės principams. Darbe taip pat analizuojama trečiųjų sąžiningų asmenų, įgijusių nuosavybės teisę į statinius arba kitas daiktines teises į juos, padėtis tuo atveju, jei tokių statinių statyba yra pripažįstama neteisėta. Prieinama išvada, kad atsižvelgiant į sąžiningumo ir kitus teisės principus, ginant trečiųjų asmenų interesus būtų pagrįsta pagal analogiją taikyti CK 4.96 str. įtvirtintą sąžiningo įgijėjo apsaugos institutą. Tokią išvadą sustiprina ir Europos Žmogaus Teisių Teismo jurisprudencijos analizė. Visgi, tuo atveju, jei būtų atisakyta pripažinti nuosavybės teises ir statinys būtų griaunamas, šiame darbe analizuojama galimybė prisiteisti patirtus nuostolius iš valstybės valdymo ir savivaldos institucijų už šių institucijų pareigūnų priimtus neteisėtus teisės aktus. / The thesis provides the analysis of laws, regulations and the case law concerning the elimination of the results of the illegal constructions as well as the analysis of the civil legal consequences of the illegal construction. Thesis focuses on the conformity of laws and regulations with fundamental legal principles such as proportionality and bona fide. Thesis also puts emphasis on the conformity of the interpretation concerning remedies for illegal constructions with the latter principles. The analysis is followed by the conclusion that there is the incompatibility between laws, regulations and the interpretation concerning remedies for illegal constructions and the fundamental legal principles. The issues of the protection of bona fide purchaser and other bona fide holders of other rights in rem, such as mortgage creditor, are also analyze in the thesis. The discussion is followed by the conclusion that Article 4.96 of Civil Code of the Republic of Lithuania that the grants protection for bona fide purchaser should be applied on the basis of analogy to the bona fide purchaser of the illegal construction. Such conclusion is reinforced by the analysis of the legal protection entrenched in the European Convention on Human Rights and the interpretation of it by the European Court of Human Rights. However, despite such conclusion the discussion in the thesis reveals that in case the decision of demolition is passed, the issue of public tort liability has to be analyzed.

Santrauka Statybų teisėtumas kaip nuosavybės teisės į statinį įgijimo sąlyga. Jos nesilaikymo civiliniai teisiniai padariniai Darbe aptariama teisėtumo sąlygos reikšmė įgyjant nuosavybės teisę į statinį, kuris sukuriamas statybos proceso metu. Taip pat analizuojami teisėtumo sąlygos nesilaikymo civiliniai teisiniai padariniai. Pirmame darbo skyriuje yra analizuojama nuosavybės teisės (jos turinį sudarančių teisių) į statinį, kuris sukuriamas statybos proceso metu, įgijimo sąlygos ir momentas. Antrame ir trečiame darbo skyriuose apibrėžiamas teisėtumo sąlygos statybos procese tikslas, nurodomi teisėtumą užtikrinantys subjektai, apibrėžiamas statybos procesas laiko atžvilgiu, pateikiamas statybos proceso procedūros aprašymas. Statybos proceso procedūros analizė padeda nustatyti atsakovus, kai dėl teisėtumo sąlygos pažeidimo atsiranda materialinė žala. Likusioje darbo dalyje analizuojama, kokie civiliniai teisiniai padariniai atsiranda, kai yra nesilaikoma teisėtumo sąlygos reikalavimo statybos procese. Išsamiai analizuojamas dabartinis neteisėtų statybų padarinių šalinimo reglamentavimas, taip pat lyginama su iki 2006 m. spalio 17 d. buvusiu reglamentavimu. Aptariamas dabartinio teisinio reglamentavimo atitikimas teisingumo, proporcingumo principams. Kalbama apie materialinių nuostolių, kurie atsiranda dėl teisėtumo sąlygos pažeidimo statybos procese, atlyginimą. / Summary Lawfulness of a Construction as a Precondition for Acquiring Property Rights to the Building, Civil Legal Consequences of its Breach Construction law regulate the public relations field merge public and private interests. Therefore, they can not be considered as falling into one of the right branch of the regulatory range. It necessary to both the public law and private law in the analysis. Construction process consists of many steps that are performed one after the other. For arising property law are very important moment, when the opportunity to note that the construction work using the construction products is designed building (albeit incomplete). When come the possibility of building legal registration in the Real Property Register it means that owner get ownership. However, at this stage owner may use only one of property rights – the right of management. Building registration in the Real Property Register, gives to the owner the right to dispose it. Recognition of the proper use of the building and registration in the Real Property Register allows to use all property rights (manage, use, dispose of). Ownership can be acquired only if the construction process is a legitimate. Persons involved in the construction process has to ensure the legitimacy. When the construction process is illegal, can not be acquired property rights. The court may decide to transform the building, or demolish it.
