Taika suteikia galimybę užtikrinti santykių darną, abipusį supratimą, kiekvienam bendrų ir visiems skirtingų poreikių patenkinimą. Taikos siekimas reikalauja įtempto darbo ir didelių pastangų: siekiant taikos, einama lygybės, kompromiso ir abipusės (daugiašalės) satisfakcijos kryptimi. Tik pačios konfliktuojančios šalys žino, koks rezultatas joms būtų priimtinas, patenkinantis jų interesus, teikiantis pasitenkinimą konkrečioje situacijoje ir užkertantis kelią atsinaujinantiems nesutarimams dėl to paties dalyko. Civilinių teisinių santykių subjektų ginčas efektyviai gali būti išsprendžiamas taikos sutartimi. Šio teisinio instrumento panaudojimas ginčo sureguliavimui įgalina pasiekti bendrą sprendimą, dažniausiai šalis įpareigojantį ir vykdomą dėl jo priimtinumo susitariantiesiems. Magistrinio darbo tikslas – išanalizuoti Lietuvos Respublikos teismams pateikiamų tvirtinti civilinius teisinius santykius reglamentuojančių taikos sutarčių turinio ypatumus. The pursuit of peace requires hard work and huge efforts: in the process of striving for peace, the course of equality, compromise and mutual (multilateral) satisfaction has to be set. It is only the conflicting parties know what the result would be acceptable to them to fit their interests, satisfying in a given situation and preventing from renewable disagreements on the same issue. Legal relations in civil litigation can be effectively resolved with the settled contract. The application of this legal instrument allows resolving the dispute and arriving to common decision, usually binding and thus enforceable due to its acceptability for both contracting parties. The aim of this masters’ theses is to analyze the specific features of the content of settlements of civil legal relations submitted for approval to the courts of the Republic of Lithuania. The paper briefly analyzes the concept of settled contracts embedded in Lithuanian and foreign sources and national legislation, identifies the content and format requirements; an overview of specific features of settled contracts in resolved conflicts are presented, problems of practical applications of settled contracts are determined, the quality assessment of the content of settled contracts approved in courts is considered. Truth Commissions: Did the South African Truth and Reconciliation Commission serve the purpose for which it was established?

<p>Since the 1980&rsquo / s, many dictatorships around the world have been replaced by new democracies. These old dictatorships were notorious for their human rights abuses. Many people were killed and tortured / and many others were disappeared. When the new governments came into power, they had to confront these injustices that were perpetrated under the predecessor regime. This was necessary to create a culture of human rights / promote a respect for the law and access to justice. Many confronted these injustices in different ways, some granted amnesty, some prosecuted and others instituted truth commissions. This research paper focuses on truth commissions. The research focuses particularly on the study of the South African Truth Commission. The mandate of the South African Truth Commission is analysed and the investigation into whether the commission served the purpose for which it had been established is discussed.</p>

An investigation into adoption of multiskilling by the South African manufacturing industry : a case study of Hulett Aluminium.

There are a number of challenges that are facing the South African manufacturing industry today. Companies within this sector are trying all they can to ensure the optimal utilisation of physical and human resources and the maximisation of profit, all this at a very minimal possible cost. Each company within the industry is struggling for a competitive edge and bigger market share compared to other companies manufacturing the same product. Haas et al. (2005: 1) suggest that the manufacturing companies need more flexible labour strategies, like multiskilling, as a way of dealing with these challenges. Hulett Aluminium (Pty) Ltd, South Africa's largest aluminium producer and based in Pietermaritzburg, was used by the researcher as a case study. The company was founded in 1946 as a subsidiary of the international Alcan Aluminium Group. It is South Africa's largest manufacturer of semi-fabricated and finished aluminium products. The company introduced multiskilling in 2000, the main objective being to equip the employees with a variety of skills for the benefit of both the company and the employees themselves. This research study was undertaken to establish the extent to which Hulett Aluminium (Pty) Ltd has taken advantage of the theoretical benefits associated with multiskilling. To achieve this the following issues were investigated: preparation of a suitable environment for the application of multiskilling, effects of new, advanced technology on multiskilling, effects of absenteeism due to workshops, training programmes and personal matters, productivity levels, labour turnover, labour costs, trend towards selfmanaged groups, job satisfaction , employee motivation and industrial conflicts. This study first discussed the theoretical perspectives on multiskilling. This is followed by the description of Hulett Aluminium (Pty) Ltd, with specific description of the company's profile, the organisational structure, the aluminium supply chain and the company's core business . The description of the company is followed by the methodology used for the collection of data as well as the outline of the interpretation procedures followed. Research findings and discussion are also given. The key findings of this study are that both managers and shop floor employees at Hulett Aluminium agree that multiskilling contributes to increased organisational labour productivity, reduced organisational overall costs, and reduced industrial conflicts. Other areas of agreement include the fact that multiskilled employees need appropriate resources for the application of their skills; training is an essential tool for multiskilling and that rewards for a multiskilled workforce are a motivating factor for in the workplace. The final conclusion drawn is that much as Hulett Aluminium (Pty) Ltd has embraced multiskilling, there is still a lot the company needs to do or improve on, so that it could enjoy the benefits of the programme. Based on the findings of this study, some of the recommendations made for Hulett Aluminium are: • A detailed planning process for proper implementation ofmuItiskilling • All the relevant stakeholders within the company should be part and parcel of the implementation of the programme • Benchmarking with other manufacturing companies which have implemented multiskilling • Training of new recruits so that they could be at equal par with the old employees and also contribute positively to increased organisational productivity. 11 / Thesis (MBA)-University of KwaZulu-Natal, Pietermaritzburg, 2006.

While the study of emotions is of universal interest because of its central role in the social sciences and humanities, emotions are of special interest for South Africa for both theoretical and applied reasons. South Africa, with its eleven official languages, is a true multicultural society with extreme differences in terms of culture, acculturation, and socio-economic status. Cultural frameworks differ substantially between ethno-cultural groups, and clarification of the differences between cultural frameworks can counter interpretation biases that could result in daily frictions and major conflicts. Additional fundamental cross-cultural research on emotional differences between cultural groups, together with the generation of a mutual understanding of the different cultural frameworks, makes these frameworks explicit and facilitates the incorporation of these frameworks into daily communication and interaction processes. The objectives of this research were to determine what the emotion structure of the Sepedi, Xitsonga and Tshivenda languages groups within a sample of Sepedi-, Xitsonga- and Tshivenda-speaking participants is, and how it compares with the European Emotion Structure. Furthermore this research aimed to establish the emotion structure and the relevant and representative features for each emotion component (such as appraisals, action tendencies, and subjective experiences) that have been encoded in a sample of Sepedi-, Xitsonga- and Tshivenda-speaking participants. Like\vise it was deemed necessary to verify (a) the extent to which the emotion words refer to specific positions on each of the emotion features of these language groups and (b) the extent of similarity or dissimilarity between emotion experiences of the Sepedi, Xitsonga and Tshivenda groups in the SAPS, as well as to compare the meaning structure between a "bottom-up" and a "top-down" (as conducted in Nicholls' research in 2008) approach between Sepedi-, Xitsonga- and Tshivenda-speaking participants. A survey design with convenience sampling was used to achieve the research objectives. The study population (n=390) consisted of Sepedi-, Xitsonga- and Tshivenda-speaking entry-level police applicants from the South African Police Service (SAPS). The Sepedi, Xitsonga and Tshivenda GRlD questionnaires were administered. Statistical methods and procedures (multidimensional scaling and descriptive statistics) were used and Cronbachrs alpha coefficients were determined to analyse the results. Results of this study on the Sepedi, Xitsonga and Tshivenda cultural groups indicated the extraction of a two-factor model within the Sepedi group. Due to the extremely low reliability analyses of the Xitsonga and Tshivenda language groups' data, a reliable scale analysis and the meaning structures of these two groups could not be determined. The low reliabilities could be attributed to the direct language translation of the questionnaire and the assessment may not have captured the full understanding of the items in the GRlD instrument. Results of this study for the Sepedi language group corresponded well with the results found in the study for the Sepedi group conducted by Nicholls (2008) on the emotion lexicon on the Sepedi, Xitsonga and Tshivenda language groups in South Africa. The Nicholls study (2008) indicated the extraction of a three-dimensional structure (evaluation, arousal, dominance) and a four-factor loading (positive emotion, sadness, fear, anger) for the Sepedi-speaking language group. Two essays of the market friction effects on asset prices: evidence from syndicated loan and futures markets

Two essays are comprised in this dissertation to explore how market friction affects the processes of price formation. The first essay investigates on both theoretical and empirical bases how segmentation of communication amongst potential lenders can influence loan contracts. Two cases are considered. The first one assumes that potential lenders can freely communicate with each other; the second one assumes that each potential lender can only observe the decisions of its predecessors. I show theoretically that the ex post observed interest rate will be higher and the probability of syndication failure will be lower if the potential lenders cannot communicate freely with each other. These predictions are confirmed by my empirical work. Using a novel proxy, relational distance, for the segmentation of communication, I show that the larger the relational distance, the higher is the loan spread and the lower is the probability of syndication failure. In addition, the relational distance is positively correlated with the probability of the existence of non-price contract terms, such as the requirement for collateral and guarantees. My conclusions are found to be robust to endogeneity issues, potentially omitted variables and alternative model specifications. The second essay focuses on the informational effects between futures market and its spot market. Intraday data are used to investigate the lead-lag relationship between the TX returns, the TX trading activity and the TAIEX stock index returns. I focus on the transmission direction and the source of information and find that there are specific lead-lag relationships between futures returns and spot returns, in addition to the contemporaneous relationship predicted by carry-cost theory and efficient market theory. The results show that futures returns significantly lead spot returns, which suggests that informed trades occur in the futures market and makes information flows from the futures market to the spot market. By distinguishing different types of futures traders and using private information, net open buy, as a proxy for futures trading activity, I found that the major source of informed trades is foreign institutional traders because their trading activity have predictive power for future movements in both spot and futures prices. In contrary, traders in the other categories carry no information about the directional changes in both spot and futures prices.

本論文探討顏色詞「黑/烏」與「白」在台灣華語、台灣客語以及台灣閩南語中語意延伸之比較。黑與白是自然界中最原始的顏色,而在Berlin and Kay (1969) 的顏色發展歷程中處於第一階段。本文觀察顏色詞黑與白背後的認知機制,並藉此將語料分成原始意義、轉喻延伸、隱喻延伸和特殊例子這些類別來詳述。本研究發現有些隱喻延伸普遍地存在三個語言當中,有些則是某個語言特有的,而這些語言特定的顏色詞通常蘊含文化根源、發展成構式或從外語借用而來。 本文還運用Kövecses (2005) 隱喻中的文化因素來審視顏色詞黑與白。研究發現就跨語言層面而言,台灣華語發展出最多的隱喻延伸,台灣閩南語次之,而台灣客語最少。這顯示了台灣華語顏色詞的蓬勃發展跟該語言的文化、經濟或科技等活躍發展密切相關。此外,本文發現顏色詞黑大多為負面意義,而顏色詞白則多為非負面意義。顏色詞黑與白也發展出許多語意延伸的對立,例如神秘與明確、惡與善、違法與合法。 / This thesis explores the similarities and differences regarding color terms of black and white among TM, TH and TSM. Black and white are the two most fundamental colors in the natural world as designated at stage one in Berlin and Kay’s (1969) evolutionary sequence. We classify data into cognitive categories of prototypical meaning, metonymic extensions, metaphorical extensions and idiosyncratic examples, observe their corresponding lexicalization types (Packard 2000) and use Kövecses’ (2005) cultural factors in metaphor to examine them. The three languages all contain abundant data of prototypical meanings which refer to the physiologically visual color, black and white, the representative colors of human conceptual universals about night and day (Wierzbicka 1996, Goddard 1998). Via different ICM mechanisms (Kövecses and Radden 1998), the three languages develop diverse metonymic extensions. Besides, through the general metaphor ABSTRACT QUALITY IS PHYSICAL QUALITY (Goatly 2011), numerous attributes are conceptualized through the visual color black or white in metaphorical extensions. Some metaphorical extensions are universal across the three languages; some are language-specific because of cultural roots, fixed constructions or language borrowing. Idiosyncratic examples include arbitrary items and proverbial expressions. We also use Kövecses’ (2005) cultural factors in metaphor to observe the cross-cultural and within-culture dimensions. For the cross-cultural dimension, in terms of the source domain of color black or white among the three languages, TM develops the most prolific metaphorical extensions of color terms, TH has the least versatile generations, and the development of TSM color terms is in between. The complexity of TM color terms is closely related to the vivacity of cultural, economic or technological developments in that language. From the most primitive opposite of darkness and brightness, color terms of black and white also distinctively contrast with each other. The negative meanings of color terms black are proportionally dominant whereas the meanings of color terms white are mostly non-negative. Furthermore, color terms black and white reveal some evident oppositions in the metaphorical extensions such as mystery and clarity, viciousness and innocence and illegality and legality.

Does Patient-Centered Care Affect Racial Disparities in Health?

This thesis presents a challenge to policy initiatives that presume that patient-centered care will reduce racial disparities in health. Data from the Medical Expenditure Panel Survey were used to test patient assessment of provider behavior defined as patient-centered care according to the National Health Disparities Report of the Agency for Healthcare Research and Quality of the Department of Health and Human Services. Results indicated patient-centered care improves self-rated health status, but blacks still report worse health status than whites experiencing comparable patient-centered care. Further, black-white differences in patient-centered care had no affect on health status. Rival theories of black-white differences in health, including social class and health literacy, provided better explanations of disparities than assessment of provider behaviors. These findings suggest that policies designed to financially incentivize patient-centered care practices by providers should be considered with caution. While patient-centered care is better quality care, financial incentives could have a negative effect on minority health if providers are deterred from practices that serve disproportionate numbers of poor and less literate patients and their families. Measurement of the concept of patient-centered care in future health disparities research was also discussed.
