Free movement of goods, persons, services and capital within the European Union : jurisprudential adjudications by the Court of Justice

The published work which forms the basis of this submission by the applicant for the Degree of Doctor of Philosophy represents an extensive research which has extended the boundaries of knowledge and understanding in relation to the jurisprudential adjudications by the Court of Justice concerning the application of the TFEU freedoms of goods, persons, services and capital to national measures. The publications maintain thematic analytical focus on the jurisprudential employment of the EU principles of non discrimination, market access and the rule relating to the 'selling arrangement' that are used as the modus operandi in the acquisition of Treaty free movement rights. The thread is law making; the published work evidences inconsistencies, complexities and confusions in the application by the Court of Justice of the modus operandi used to ensure acquisition of Treaty free movement rights. The research depicts a goods, persons, services and capital jurisprudence which displays a want of thematically consistent underpinning and some doctrinal diversity. It is the purpose of this Submission to exhibit the cohesiveness of the published work under review in the context of the contribution made to the knowledge and understanding of the jurisprudence of goods, persons, services and capital in European Union law.

Psykosocial arbetsmiljö : Upplevelser av den psykosociala arbetsmiljön beroende på anställningsform och kön / Psychosocial work environment : Experiences of psychosocial work environment depending on employment and sex

Syftet med föreliggande studie var att undersöka upplevelsen av den psykosociala arbetsmiljön beroende av anställningsform och kön. Datainsamlig genomfördes med ett nyutvecklat frågeformulär (EPA), som är baserat på de senaste föreskrifterna gällande organisatorisk och social arbetsmiljö. EPA bestod av sju moduler; arbetsbelastning, arbetsorganisation, handlingsutrymme, kunskap och utveckling, ledarskap, stöd samt återhämtning. I studien deltog 80 personer, 40 personer hade reglerad arbetstid som jämfördes med 38 personer som hade oreglerad arbetstid,  35 var män och 45 var kvinnor. Resultatet visade att de med oreglerad arbetstid upplevde den psykosociala arbetsmiljön något bättre men det var inte statistiskt signifikant. Männen upplevde den psykosociala arbetsmiljön bättre än kvinnorna men det fanns ingen statistisk signifikant skillnad.  För modul ledarskap fanns en statistiskt signifikant skillnad mellan könen, där männen upplevde ledarskapet bättre. Vidare förelåg inga skillnader i arbetsmiljön beroende på anställningsform eller kön. / The aim with the present study was to study the psychosocial work environment depending on employment and sex with a newly developed questionnaire (EPA), which was based on the latest regulations regarding organizational and social work environment. The questionnaire consisted of seven modules; workload, work organization, margin of action, leadership, support, knowledge and development and recuperation. In this study 80 persons participated, 40 of them had regulated working hours and 38 had unregulated working hours, 35 were men and 45 were women. The results of the study showed that persons with unregulated working hours experienced the work environment slightly better, but the result was not statistic significant. Men experienced the work environment better then women, but the result was not statistic significant. There was a statistic significant difference though, in module leadership, showing that men had a better experience of leadership. Further, the result showed that there was no diffrences in the workenvironment depending on employment and sex.

Analysis of the Housing Status of the Elderly

Quality of housing was examined in relation to living arrangement, race, socioeconomic status, age, gender, income, health, and renter-owner status. There appeared to be differences in housing quality for those of younger ages, females, and owners. White subjects occupied good quality housing while Blacks occupied fair quality housing. Proportion of income allocated to housing was examined by renter-owner status, race, gender and living arrangement. Renters allocated an average of 34 per cent compared to 17 per cent for owners. Females living alone occupied good quality housing, committed the highest proportion of income to housing, and one-third had incomes below the poverty threshold while two-thirds were near poverty. Subjects allocated more for utilities than others over sixty-five, nationally.

Au sortir de cette première décennie des années 2000, face aux bouleversements socioculturels, économiques et politiques au sein de la société ivoirienne post-crise en renouvellement, alors que les champs culturels sont traversés dans leur ensemble par toute une série de mutations économiques et sociales, esthétiques et anthropologiques, institutionnelles et politiques, le constat est profondément criant : les politiques publiques de la culture en Côte d’Ivoire et en Afrique en général sont en crise, elles sont dans l’impasse. Pour autant, quarante ans d’intervention et d’engagement des puissances publiques, des acteurs privés et des organisations non gouvernementales ont créé des synergies au service des arts et de la culture africaine. Aujourd’hui, même s’ils sont embryonnaires et souffrent de nombreuses carences, on ne peut nullement occulter l’importance, du point de vue économique et sociale, que recèlent les secteurs de la culture et des arts en Côte d’Ivoire. / In this first decade of the 21st century, the socio-cultural, economic and political turmoil in the post-crisis Ivory Coast society is affected by a series of transformations: economic and social, aesthetic and anthropologic, institutional and political. The assessment is clear: public cultural politicies in Ivory Coast and Africa in general are in a crisis. However, after 40 years of intervention and engagement by public authorities, private entities and non-governmental organizations, they have started to jointly work to serve African arts and culture. Despite these amenities still being in their infancy and with several deficiencies we can no longer neglect the importance, both in terms of economic and social impacts, of arts and culture in Ivory Coast.

Modern popular music is worldwide spread and it is developing rapidly. Therefore it is important for the music teachers to react to this fact. They should offer students the possibility to find their bearings in the great amount of newly developing popular music and also in the new expressive means of music. Of course, this can be done through lectures and suited listening, but I argue that both these activities should be accompanied by learning-by-doing musical activity, because it gives the students the opportunity of practicing the new information and of understanding it in context. My thesis therefore focuses on this issue. It deals with the possibilities of implementing group music performance using the expressive means of modern popular music in music education. It could also be used as a set of practical advices for creating suitable music arrangements for students. The author defines key terms, most important of which are undoubtedly the concept of modern popular music and defining the group of students. The second chapter lists suitable instruments and their description. It focuses on instruments suitable for participating in the rhythmic section. Srovnání sovereign ratingu a rizikové kategorizace zemí a jejich změny po finanční krizi / The Comparison of Sovereign Ratings and Country Risk Classification according to the Arrangement on Officially Supported Export Credits and its Development after Financial Crisis

In the first chapter the paper is focused on sovereign rating, it describes the history and explains the basic characteristics in the context of its usual usage. In the second chapter the basics behind the Arrangement on Officially Supported Export Credits are explained. Because the main purpose of this paper is to compare sovereign rating and the country risk classification based on the Arrangement, the chapter focuses especially on the Knaepen Package that introduced country risk classification to the Arrangement. In the chapter there is also the introduction to the Malzkuhn-Drysdale Package. In the third and fourth chapter sovereign ratings and county risk classifications are compared on theoretical basis. There were used several different criteria, e.g. methodology of rating/classifying, time necessary for adjustment and criteria for evaluation. The fifth chapter is focused on Basel I-III, the connection between Basel capital adequacy and both credit risk evaluation systems is explained. In the following chapter, the question of guilt of rating agencies and their role in the outbreak of financial crisis is discussed. The last chapter is based on the case study that describes the difference between development of financial crisis in Italy and Greece and its impact on rating grades and country risk classification.

[pt] Este trabalho possui o intuito de desmistificar a dificuldade encontrada por professores e alunos no ensino e aprendizagem do tópico análise combinatória. A razão que motivou este trabalho foi o fato de que boa parte dos professores de matemática do ensino médio e últimas séries do ensino fundamental consideram a Análise Combinatória como algo complicado de ser ensinado; além da questão das dificuldades de entendimento por parte dos alunos que são induzidos à memorização de fórmulas e a aplicação das mesmas à resolução dos exercícios para compreenderem tal conteúdo. Inicialmente apresentaremos alguns conceitos que servirão como auxílio para que o professor possa trabalhar nas atividades propostas a serem desenvolvidas juntamente com os alunos. E ao longo do trabalho iremos falar de alguns tópicos abordados pela análise combinatória sem, inicialmente, mencionarmos fórmulas que servem apenas para serem memorizadas. O mais importante é fazer o aluno trabalhar um problema sugerido através do roteiro e dos conceitos que serão propostos e ao final de alguns exercícios, quando tal aluno tiver entendido tal conceito, ser anunciado a ele que acabou de aprender e entender o conceito em questão, ao invés de memorizar um determinado exercício ou outro, pois sabemos que desta forma, quando o aluno deparar-se com um novo problema, não será capaz de solucioná-lo. Dessa maneira, elaborou-se um roteiro na solução dos exercícios, ou seja, uma forma do professor trabalhar qualquer atividade proposta que envolva problemas de contagem em sala de aula. Enfim, buscou-se com esse trabalho, apresentar aos docentes, estratégias eficientes que podem ser utilizadas para o ensino de combinatória e ajudar os alunos a compreenderem melhor os problemas de contagem utilizando o raciocínio lógico e de contagem. / [en] This work has the intent to explain the difficulties found by teachers and student on teaching and learning combinatorics. The motivation of this work was the fact that most of the Mathematics Teachers of High School consider combinatorics as something complicated to be taught; contributing as well the fact that students are led to memorize the formulas and apply it on exercises so they can understand the subject. Initially we will show some concepts that will help the Teachers to work together with the students on the proposed activities. During the work, we will talk about Combinatorics topics without mentioning formulas that needs memorization only. The most important thing is to make the student work on a suggested problem following a guide and concepts shown and after finishing a few exercises, when the student will show the understanding of the concepts, the Teacher will tell him that he learned that concept, instead of memorizing a specific exercise. Because we know that not doing this, when this student faces a new problem, he will not be able to solve it. Thus it was elaborated a guide to solve exercises and that means a way that the Teacher can work with any proposed activity that has counting in it. Finally, it was sought with this work to show the scholars some efficient strategies that can be used on teaching Combinatorics and help the students to understand better the problems about counting, using logical reasoning and logical counting.

As práticas de reelaboração musical / The Practices of musical re-elaboration

Este trabalho tem como principal objetivo realizar um estudo das práticas de reelaboração musical relacionadas aqui como: transcrição, orquestração, redução, arranjo, adaptação e paráfrase, promovendo um resgate de sua valorização e estimulando sua expansão. Para isso, serão abordadas questões teóricas, históricas e estéticas acerca dessas práticas discutindo sua importância e utilização, buscando também um suporte teórico em outras áreas como a literatura. Além disso, serão feitas observações no sentido de perceber como se procedem estas práticas que são abordadas teoricamente, de maneira geral, como sinônimas, mas que na prática apontam para a possibilidade de existir procedimentos diferentes classificando os diversos termos em categorias distintas. O trabalho ainda traz como proposta, a realização de uma reelaboração, (orquestração do Choros 5 de H. Villa-Lobos) observando de que forma poderiam ser aplicados na prática os procedimentos observados anteriormente. / The main goal of this Doctoral Thesis is to carry out a study of different musical practices listed here as re-elaboration: Transcription, orchestration, reduction, arrangement, adaptation and paraphrase. As a secondary goal we aim at promoting the recovery of these practices and at encouraging their expansion. For this, we shall raise theoretical, histhorical and aesthetic issues about re-elaboration in music, discussing their importance and usage, seeking for theoretical support in other areas such as literature. Although such practices are often treated as synonyms, our research points to different procedures that can lead to their classification in specific categories. This work also bring the realization of re-elaboration, (the orchestration of, Heitor Villa-Lobos, Choros 5)in which we apply the theoretical procedures previously investigated.

O presente trabalho estuda as novas formas de associação de empresas de pequeno porte, denominadas pela literatura consagrada de Micros, Pequenas e Médias Empresas (MPME). A revisão teórica privilegia o estudo dos instrumentos de promoção do desenvolvimento via implantação de políticas públicas em cenários contemporâneos, bem como as ações nesta área de atuação, tanto como ação primordial de governo quanto como formação de redes de organizações diversas, constituídas para tanto. Especificamente, o esforço de pesquisa focou a experiência recente de implantação de Arranjos Produtivos Locais (APL) no Estado de São Paulo, com base na metodologia conveniada entre a Federação das Indústrias do Estado de São Paulo (FIESP) e o Ministério de Desenvolvimento, Indústria e Comércio Exterior (MDIC). A pesquisa de campo, neste contexto, escolheu o APL da Cerâmica Vermelha em Vargem Grande do Sul / SP para avaliar os conceitos e a pertinência da política de implantação, destacando o histórico de esforços e as recentes ações de revisão e incremento no processo de consolidação deste Arranjo específico. Para tanto, adotou-se metodologia qualitativa, particularmente as orientações epistemológicas e os instrumentos de coleta de campo da Pesquisa-Ação (THIOLLENT, 1997 e 2005), mais adequados às características do objeto e das circunstâncias da pesquisa, atentando para o fato de o pesquisador ser o agente facilitador da metodologia do convênio FIESP/MDIC no APL da Cerâmica Vermelha em Vargem Grande do Sul, no período de janeiro a novembro de 2007. Os resultados obtidos apontam para as virtudes dos instrumentos formais de implantação de políticas de desenvolvimento para estes casos, revelando, todavia, a necessidade de ajustes, especificamente quanto às realidades locais e, principalmente, quanto à escolha, capacitação e envolvimento dos agentes locais na articulação da política de desenvolvimento, tanto interna quanto externa aos APL. / This paper examines the new forms of association for small companies, called by the literature of Micro, Small and Medium Enterprises (MSME). The theoretical review focuses the study of the instruments to promote the development through public policies in contemporary scenarios as well as the actions in this area, both as a primary government action as well as formation of networks of various organizations, established for this aim. Specifically, the research effort focused the recent experience of settling Local Productive Arrangements (APL) in the State of Sao Paulo, based on the sharing methodology between the Federation of Industries of the State of Sao Paulo (FIESP) and the Ministry of Development, Industry and Foreign Trade (MDIC). The field research, in this context, chose the Red Ceramic APL in Vargem Grande do Sul / SP to evaluate the settling policy concepts and relevance, highlighting the history of efforts and the recent revision and increase actions in consolidation process of this specific arrangement. Thus, a qualitative methodology was adopted, particularly the epistemological guidelines and the of field collecting instruments of Research-Action (THIOLLENT, 1997 and 2005), more suited to the object characteristics and the research circumstances, paying attention to the fact that the researcher is the facilitator agent of the methodology of the agreement FIESP / MDIC in Red Ceramic APL in Vargem Grande do Sul, in the period from January to November 2007. The results point to the virtues of formal instruments of development policies implementation in these cases revealing, however, the need for adjustments, specifically on local realities and, in particular, on the selection, training and involvement of local players in concurrence of policy development, both internal as external to the APL.

A poesia de João Cabral de Melo Neto sofre por sua indefinição de lugar. Este trabalho, então, vai à busca da especificação do lugar social que ocupa o eu poético na obra do autor e, a partir disso, da definição de seu projeto estético, pautado pela aproximação das formas populares e, ao mesmo tempo, por seu oposto as mais sofisticadas formas de arte de seu tempo, constituídas pela racionalidade e não pela tradição. Trata-se de pensar as duas faces de sua poesia, durante tanto tempo compreendidas como duas vertentes incomunicáveis de sua poética, como definições que se articulam em dependência. O vértice comum teria origem na consciência do poeta acerca do subdesenvolvimento, como condição do país. É a partir disso que Cabral, primeiro, intenta a aproximação com a cultura popular, buscando nela a redução da distância entre as classes sociais no país. Para em seguida, incluir no poema as formas da modernização através das quais o país se transformava, tentando fazer do poema gesto de intervenção rigorosa sobre a matéria local. A racionalidade, por isso, será apresentada em sua poesia como nova alternativa ao subdesenvolvimento. / The poetry of João Cabral de Melo Neto suffers from a lack of definition of place. Therefore, this study seeks to specify the social place occupied by the lyric self in the authors work and, from this, define his aesthetic plan, guided by the contrasting of popular forms and their opposite the most sophisticated art forms of his time, representing rationality instead of tradition. The two faces of his poetry, which for so long time were understood as two independent branches of his poetics, are seen as definitions that articulate dependently. The common vertex originates in the poets awareness of Brazils condition as an underdeveloped country. Cabral first attempts to incorporate popular culture, seeking to reduce the gap between the countrys social classes. Then he includes in the poem the forms of modernization through which the country was being transformed, trying to make the poem a gesture of rigorous intervention on the local material. Rationality, therefore, is presented in his poetry as a new alternative to underdevelopment.
