Harmonising the law of sale in the Southern African Development Community (SADC) : an analysis of selected modelsShumba, Tapiwa 04 1900 (has links)
Thesis (LLD)--Stellenbosch University, 2014. / ENGLISH ABSTRACT: It is generally recognised that diversity of laws may act as a barrier to the development of trade, both at international and regional level. In a globalised era, trade is necessary for economic development and ultimately for the alleviation of poverty. Although the WTO has done extensive work towards the removal of tariff barriers, there is also a need to focus on addressing non-tariff barriers which include legal barriers to trade. Institutionalised legal harmonisation at an international level has provided the necessary impetus for the development of harmonised laws in the area of international trade. The creation of regional economic communities within the purview of the WTO has also given rise to the necessity of legal harmonisation to facilitate intra-regional trade. A number of regional economic communities and organisations have noted legal harmonisation as one of their areas of regional cooperation. This study focuses on the need to harmonise the law of international sale within the SADC region in order to facilitate cross-border trade. The study points out that the harmonisation of sales laws in SADC is important for the facilitation of both inter-regional and intra-regional trade with the aim of fostering regional integration, economic development and alleviating poverty. Although the necessity of harmonising sales laws has been identified, no effort to this end exists currently in the SADC region. This study addresses the mechanisms by which such harmonisation could be achieved by analysing three models which have been selected for this purpose, namely the CISG, the OHADA and the proposed CESL. The main issues addressed include whether SADC Member States should adopt the CISG, join OHADA, emulate the CESL or should use any of the other instruments as a model for creating a harmonised sales law for SADC. In conclusion, it is observed that SADC has its own institutional and operational mechanisms that require a process and instrument tailor-made for the unique needs of the region. It is recommended that SADC should create its own common sales law based on the CISG but taking into account lessons learnt from both the OHADA system and the CESL. A number of legislative, institutional and operational transformative and reform mechanisms are recommended to enable the creation of such a community law and ensure its uniform application and interpretation. / AFRIKAANSE OPSOMMING: Dit word algemeen aanvaar dat regsdiversiteit die ontwikkeling van internasionale en regionale handel kan strem. In 'n geglobaliseerde ekonomie is internasionale handel noodsaaklik vir ekonomiese onwikkeling en die uiteindelike verligting van armoede. Alhoewel die Wêreldhandelsorganisasie reeds belangrike werk doen om handelsbeperkinge te verlig, is daar ook 'n behoefte om, afgesien van tariewe, ook ander nie-tarief beperkinge op internasionale handel aan te spreek. Regsdiversiteit is een van hierdie beperkinge. Geïnstitusionaliseerde regsharmonisering op 'n internasionale vlak het reeds elders die nodige stukrag verleen vir die harmonisering van die reg van toepassing op internasionale handel. Die totstandkoming van regionale ekonomiese gemeenskappe binne die raamwerk van die Wêreldhandelsorganisasie noodsaak egter verdere regsharmonisering ten einde inter-regionale handel te kan bevorder. 'n Aantal streeksgemeenskappe en –organisasies hanteer reeds regsharmonisering as een van hul areas van samewerking op streeksvlak. Hierdie studie fokus op die behoefte om die internasionale koopreg binne die SAOG streek te harmoniseer ten einde oorgrenshandel te fasiliteer. Die studie toon aan dat harmonisering van die koopreg in die SAOG belangrik is ten einde beide inter-regionale asook intra-regionale handel te fasiliteer met die oog op die bevordering van streeksintegrasie, ekonomiese ontwikkeling en die verligting van armoede. Alhoewel die noodsaaklikheid van 'n geharmoniseerde koopreg geïdentifiseer is, is daar nog geen poging aangewend om dit binne die SAOG streek te bewerkstellig nie. Die studie spreek die meganismes aan waardeur harmonisering bereik kan word deur drie modelle wat vir hierdie doeleindes gekies is te ondersoek, naamlik die Internasionale Koopkonvensie (CISG), OHADA en die voorgestelde gemeenskaplike koopreg-regime van die Europese Unie (CESL). Van die kwessies wat aangespreek word is of the SAOG lidlande die Internasionale Koopkonvensie moet aanneem, by OHADA moet aansluit, alternatiewelik die Europese koopreg of enige van die ander instrumente as model gebruik vir die skep van ‟n geharmoniseerde SAOG koopreg. Ten slotte word daarop gewys dat die SAOG sy eie institusionele en operasionele meganismes het wat vereis dat die proses en instrument pas gemaak moet word vir die streek se unieke behoeftes. Dit word aanbeveel dat die SAOG sy eie gemeenskaplike koopreg moet skep wat op die CISG geskoei is, maar wat ook die lesse geleer uit die OHADA en die EU in ag neem. Ten einde so 'n gemeenskapsreg te kan skep en die uniforme toepassing en interpretasie daarvan te verseker, word 'n aantal wetgewende, institusionele en operasionele hervormingsmeganismes aan die hand gedoen.

parent-child relationship in private law. Rights of the child seem, on the face of it, to
undermine parental authority and family values. The impression is created that the
state is abdicating its role as protector of the child in favour of unfettered freedom of
the child. The delicate balance between individual freedom and family autonomy
may in the result also be under threat. It was, therefore, necessary to extend the
investigation to include the role of parents and that of the state.
The study is divided into three parts. The first contains a theoretical analysis of the
concept rights of the child. It is clear that the concept is a manifestation of
fundamental human rights. The rights of the child are unique in nature and
accommodate the changing phases of dependence and developing abilities of the
child. Theoretical analysis negates the perception that the recognition of the rights of
the child contributes to erosion of the family: the importance of the commitment of
parents and of the state is apparent.
The second part consists of a comprehensive review of the parent-child relationship in
the South African private law, and an analysis of the public law dimension of the
concept rights of the child. This part of the investigation demonstrates that parental
authority is firmly rooted in legal history and that substantive private law does not
recognise the child as bearer of rights within the context of the family. However, the
Bill of Rights and the 1989 United Nations Convention on the Rights of the Child
unequivocally give public law status to the child as bearer of rights. The study shows
that the private and public law status of a child cannot be isolated from one another
and that adaptations will have to be made to implement the rights of the child.
In the third part of the study an attempt is made to identify the kind of adaptation that
must be made. The impact of the idea of the rights of the child upon the parent-child
relationship in private law is investigated. Australian and Scottish law are examples
of legal systems which endeavour to implement fully the concept of the rights of the
child. Indigenous law places a high value on human dignity. The interaction between
rights and duties in indigenous systems reflect values which are inherent in the idea
of the rights of the child.
The study shows that the impact of the rights of the child on the parent-child
relationship is such that change and adaptation of private law is necessary. Change
and adaptation are required at both theoretical and practical level. A number of
obstacles which may inhibit the process of change are identified. Finally, the kind of
change and adaptation required is illustrated by a number of practical examples of the
impact ofchange on the parent-child relationship. / AFRIKAANSE OPSOMMING: Daar word in hierdie proefskrif gepoog om te bepaal wat die effek van die erkenning
van kinderregte op die ouer-kind verhouding in die privaatreg is. Kinderregte skep op
die oog af die persepsie dat ouerlike gesag en gesinswaardes onderrnyn word en dat
die staat sy rol as beskerrner van 'n kind abdikeer ten gunste van onbeperkte vryhede
aan 'n kind. Die delikate balans tussen individuele vryhede en gesinsoutonomie is in
gedrang en op hierdie wyse word die rol van ouers en die staat ook by die ondersoek
betrek.
Die studie behels 'n drieledige ondersoek. In die eerste plek vind 'n teoretiese
ontleding van die begrip kinderregte plaas. Hierdie ondersoek toon aan dat

publiekregtelike dimensie van die begrip kinderregte. Hierdie deel van die ondersoek
bewys dat ouerlike gesag regshistories sterk fundeer is en dat die substantiewe
privaatreg nie die kind as draer van regte binne gesinsverband erken nie. Daarteenoor
verleen die Handves van Regte en die Verenigde Nasies se Konvensie op die Regte
van die kind 1989 'n duidelike publiekregtelike status aan die kind as draer van regte.
Die ondersoek toon aan dat die privaatregtelike en publiekregtelike status van 'n kind

Thesis (LLM)--University of Stellenbosch, 2001. / ENGLISH ABSTRACT: Section 197 of the Labour Relations Act 66 of 1995 ensures the transfer of a contract of
employment from an old employer to a new employer on the transfer of a business as a
gomg concern.
Although section 197 is mostly based on European and British statutes and regulations,
one should not rely on foreign provisions when interpreting section 197 without careful
consideration. It is only when we understand the inherent limitations of applying these
provisions, that they can be of any help to formulate definitions for the terms "transfer",
"business" and "going concern".
The two most important effects that section 197 has, is that it ensures the transfer of the
contract of employment and that it protects the terms and conditions of employment
when such a transfer takes place. Unfortunately, this section does not regulate
dismissal on the transfer of a business. Section 197 also does not deal satisfactorily
with the transfer of contracts of employment on the transfer of an insolvent business.
As a result of the above-mentioned and other shortcomings of the current section 197, it
was decided to amend the Act. The Labour Relations Amendment Bill 2000 relies
heavily on precedents from foreign law, but unfortunately it does not adequately address
all the current problems. / AFRIKAANSE OPSOMMING: Artikel 197 van die Wet op Arbeidsverhoudinge 66 van 1995 verseker die oordrag van
'n dienskontrak van 'n ou werkgewer na 'n nuwe werkgewer by die oordrag van 'n
besigheid as 'n lopende onderneming.
Alhoewel artikel 197 gebaseer is op Europese en Britse wetgewing en regulasies, moet
die leser versigtig wees om sulke bepalings sonder skroom aan te wend by die
interpretrasie van artikel 197. Wanneer ons die inherente beperkings daarvan begryp,
mag die bepalings van hulp wees om definisies te vorm van die begrippe "oordrag",
"besigheid" en "lopende onderneming".

The trade, development and cooperation agreement between the Republic of South Africa and the European Union : an analysis with special regard to the negotiating process, the contents of the agreement, the applicability of WTO law and the Port and Sherry AgreementVolz, Eckehard 12 1900 (has links)
Thesis (LLM)--University of Stellenbosch, 1999. / ENGLISH ABSTRACT: This thesis deals with the Trade, Development and Cooperation Agreement (TDCA)
between the European Union and the Republic of South Africa, which was concluded
in October 1999. In particular, the agreement is analysed in the light of the
negotiating process between the parties, the contents of the agreement, the
applicability of WTO law and the compatibility of the agreement with it and the Port
and Sherry Agreement.
Since the EU emphasised its aim to commence economic and development
cooperation with other African, Caribbean and Pacific (ACP) countries on a reciprocal
basis during the negotiations for a successor of the Lomé Convention, the TDCA
between the EU and South Africa had to be seen as a "pilot project" for future
cooperation agreements between countries at different levels of development. The
TDCA between the EU and South Africa is therefore not only very important for the
two concerned parties, but could serve as an example for further negotiations
between the EU and other ACP countries. Thus the purpose of this thesis is to
examine the TDCA between the EU and South Africa from a wider global
perspective.
The thesis is divided into six Chapters:
The first Chapter provides an introduction to the circumstances under which the
negotiations between the EU and South Africa commenced. It deals briefly with the
economic situation in South Africa during the apartheid era and presents reasons
why the parties wanted to enter into bilateral negotiations. The introductory part
furthermore presents an overview of the contents of the thesis.
The second chapter contains a detailed description of the negotiating process that
took place between the parties and shows why it took 43 months and 21 rounds of
negotiations to reach a deal. South Africa's partial accession to the Lomé Convention
and the conclusion of separate agreements such as the Wine and Spirits Agreement,
are also analysed. Chapter three presents the various components of the TOCA and illustrates what the
negotiators achieved. This chapter on the TOCA concludes with an evaluation of the
Agreement and shows the potential benefits to South Africa and the EU.
Since the Agreement had to satisfy international rules, the provisions of the General
Agreement on Tariffs and TradelWorld Trade Organisation (GATTIWTO) were of
major importance. The EC Treaty, however, does not contain any provision that
indicates whether, or how, an international agreement like the GATTIWTO penetrates
the Community legal order. In Chapter four, accordingly, questions are raised
regarding the extent to which the bilateral agreement between South Africa and the
EU was influenced by the GATTIWTO provisions and how these rules were
incorporated into the agreement. Furthermore, since the parties agreed on the
establishment of a free trade area, this chapter deals with the question of in how far
the TOCA is in line with Article XXIV GATT.
In addition to the GATT provisions, the TOCA is also affected by the Agreement on
Trade Related Aspects of Intellectual Property Rights (TRIPs). Therefore Chapter five
deals with TRIPs in connection with the TOCA. The use of the terms "Port" and
"Sherry" as the major stumbling block to the conclusion of the TOCA is analysed
more closely.
The final part, namely Chapter six, provides a summary of the results of the
investigation. Furthermore, a conclusion is provided with regard to the question of
whether the TOeA can be seen as an example for further trade relations between the
EU and other ACP countries. / AFRIKAANSE OPSOMMING: Hierdie tesis is gerig op die Handels-, Ontwikkelings- en Samewerkingsooreenkoms
(TDGA) tussen die Europese Unie (EU) en die Republiek van Suid Afrika wat in
Oktober 1999 gesluit is. Die ooreenkoms word veral in die lig van die
onderhandelingsproses tussen die partye, die inhoud van die ooreenkoms, die
toepaslikheid van Wêreldhandelsorganisasiereg en die versoenbaarheid daarvan
met die ooreenkoms en die Port en Sjerrie-ooreenkoms ontleed.
Aangesien die EU sy oogmerk van wederkerige ekonomiese en ontwikkelings-gerigte
samewerking met ander lande in Afrika en die Karibiese en Stille Oseaan-Eilande
gedurende die onderhandelings vir 'n opvolger van die Lomé Konvensie beklemtoon

Thesis (LLM (Private Law))--University of Stellenbosch, 2006. / End of life decisions regarding defective babies raise several controversial questions. The root of the problem in withdrawing or withholding life-sustaining treatment from defective babies lies in the conflict between human emotions, technological advancements and legal considerations.
As a result of advances in medical science and neonatal technology, the lives of defective babies can often be saved or indefinitely prolonged. The question has become not whether we can treat these babies, but rather whether we should. Whether or not a defective baby’s life must be prolonged raises serious moral and ethical issues. A life compromised by severe physical and mental handicaps is weighed against an early and painless death.
The best interest of the baby is the primary consideration from a legal point of view. Various factors must be taken into account to give content to this concept. Another central question is to determine who the decision maker(s) should be and what weight should be given to their opinions. Due to the fact that defective babies can not participate in this decision making process or communicate their wishes and preferences, surrogate decision makers must decide on their behalf.
In sharp contrast to England, America and Canada, there is hardly any literature and no reported case law in South Africa to demonstrate the complexity of end of life decisions regarding defective babies. Selective non-treatment of defective babies have received little attention in the South African law. The Bill of Rights, inspired by regional and international Conventions determine the framework from a juristic perspective wherein decisions must be made and justified. This framework requires that the focus must be on the most vulnerable and dependant, namely the defective baby.

A critical analysis of the financial and social obligations imposed on sectional owners in sectional title schemes, as well as their enforcementBooysen, Juann 04 1900 (has links)
Thesis (LLD)--Stellenbosch University, 2012 / ENGLISH ABSTRACT: Over the years sectional ownership satisfied the psychological need of many South
Africans to acquire home-ownership and it is currently estimated that there are more
than 780 000 sectional title units throughout South Africa. The concept of sectional
ownership consists of three elements, namely individual ownership of a section
(residential or commercial); joint ownership of the common parts of the sectional title
scheme and membership of the body corporate which governs the sectional title
community. Sectional ownership is therefore a unique statutory institution with its
own characteristics.
An imperative of every sectional title scheme is to strive for financial stability,
happiness and harmony in an intensified, diverse community where the objects of
ownership, the individual units, are physically interdependent. The Sectional Titles
Act 95 of 1986, as amended, therefore imposes numerous financial and social
obligations on sectional owners. These obligations require each owner to give up a
certain degree of freedom that he might otherwise enjoy in separate, privately owned
property. Ultimately the success of a sectional title scheme will depend upon the
necessary co-operation and support of its members for compliance with these
obligations. Since non-compliance can destroy the financial stability and social
harmony in a sectional title scheme, effective procedures for the enforcement of
these financial and social obligations are essential. Accordingly, effective sanctions
are a sine qua non for a financially viable and socially successful sectional title
scheme.
This thesis provides a critical analysis of the various financial and social obligations
that are imposed on sectional owners, as well as the measures available for their
enforcement. It will become evident that the sanctions in the South African sectional
title legislation for non-compliance with these obligations are conspicuously few and
far between. It is generally accepted that the Sectional Titles Act 95 of 1986 does
not have sharp enough „teeth‟ to deal effectively with the non-compliance of these
obligations. Consequently, the thesis will also focus on sanctions that are used in
foreign jurisdictions to enforce sectional owners‟ financial and social obligations, with the aim to identify sanctions that may be adopted in the South African context to
render the enforcement of these obligations more efficient and effective. In
conclusion it will be recommended that the only manner in which financial stability
and social harmony can be restored in a troubled sectional title scheme is to

the sectional owners‟ community with him or her temporarily from this community. / AFRIKAANSE OPSOMMING: Met die verloop van tyd sedert die eerste deeltitelwetgewing in 1971 in Suid Afrika
ingevoer is, het deeleiendom die droom van menige Suid-Afrikaners verwesenlik om
eiendomsreg van „n eie woning te verkry. Huidige statistieke dui daarop dat daar
meer as 780 000 deeltiteleenhede in Suid Afrika is. Drie elemente word in die begrip
„deeleiendom‟ saamgevat, naamlik individuele eiendomsreg van „n deel (residensiëel
of kommersiëel), mede-eindomsreg van die gemeenskaplike gedeeltes van „n skema
en lidmaatskap van „n regspersoon. Deeleiendom is dus „n unieke statutêre
instelling met sy eie ongewone karaktertrekke.
Die belangrikste doelwit van elke deeltitelskema is om finansiële stabiliteit, geluk en
harmonie in „n geϊntensifeerde, diverse gemeenskap waar individuele
eiendomseenhede, fisies interafhanklik is, te bewerkstellig. Die Wet op Deeltitels 95
van 1986, soos gewysig, onderwerp deeleienaars daarom aan verskeie finansiële en
sosiale verpligtinge wat meebring dat elke deeleienaar „n sekere mate van vryheid
moet prys gee wat hy andersins sou geniet het as hy eienaar was van „n huis op „n
private erf. Die uiteindelike sukses van „n deeltitelskema is grotendeels afhanklik
van die samewerking en ondersteuning van sy lede wat betref die nakoming van
hierdie verpligtinge. Omdat nie-nakoming die finansiële stabiliteit en sosiale
harmonie kan versteur word doeltreffende maatreëls vereis vir die afdwinging van
hierdie finansiële en sosiale verpligtinge. „n Deeltitelskema kan slegs met sukses
bestuur word indien op doeltreffende sanksies gesteun kan word.
Hierdie tesis fokus op „n kritiese analise van die verskeie finansiële en sosiale
verpligtinge waaraan deeleienaars onderhewig is, en die maatreëls wat aangewend
kan word om hierdie verpligtinge af te dwing. Daar sal aangetoon word dat die
sanksies in die Suid-Afrikaanse deeltitelwetgewing vir die nie-nakoming van hierdie
verpligtinge gans te min, en boonop uiters ondoeltreffend is. Daarom word
algemeen aanvaar dat die „tande‟ van die Wet op Deeltitels 95 van 1986 nie skerp
genoeg is om die nie-nakoming van hierdie verpligtinge doeltreffend te straf nie.
Gevolglik sal die tesis ook fokus op sanksies wat in buitelandse regstelsels
aangewend word om die finansiële en sosiale verpligtinge van deeleienaars af te dwing. Die oogmerk hiermee is om buitelandse sanksies te identifiseer wat met vrug
in die Suid-Afrikaanse konteks aangewend kan word ten einde die nie-nakoming van
hierdie verpligtinge doeltreffend hok te slaan. Ter afsluiting sal voorgestel word dat
finansiële stabiliteit en sosiale harmonie in „n erg ontwrigte deeltitelskema slegs
herstel kan word indien wetgewing aangeneem word wat die regspersoon toelaat om
„n deeleienaar wat ondanks waarskuwings dit vir mede-deeleienaars onmoontlik
maak om saam met hom of haar in dieselfde deeleiendomsgemeenskap te leef
tydelik van die skema te verwyder.

The justification of expropriation for economic developmentSlade, Bradley Virgill 12 1900 (has links)
Thesis (LLD)--Stellenbosch University, 2012. / ENGLISH ABSTRACT: Section 25(2) of the 1996 Constitution states that property may only be expropriated for a public purpose or in the public interest and compensation must be paid. This dissertation analyses the public purpose and public interest requirement in light of recent court decisions, especially with regard to third party transfer of expropriated property for economic development purposes.
The public purpose requirement is explained in terms of pre-constitutional case law to create a context in which to understand the public purpose and public interest in terms of the 1996 Constitution. This leads to a discussion of whether third party transfers for economic development purposes are generally for a public purpose or in the public interest. The legitimacy of the purpose of both the expropriation and the transfer of property to third parties in order to realise the purpose is considered. Conclusions from a discussion of foreign case law dealing with the same question are used to analyse the South African cases where third party transfers for economic development have been addressed. Based on the overview of foreign case law and the critical analysis of South African cases, the dissertation sets out guidelines that should be taken into account when this question comes up again in future.
The dissertation also considers whether an expropriation can be set aside if alternative means, other than expropriating the property, are available that would also promote the purpose for which the property was expropriated. Recent decisions suggest that alternative and less invasive measures are irrelevant when the expropriation is clearly for a public purpose. However, the dissertation argues that less invasive means should be considered in cases where it is not immediately clear that the expropriation is for a valid public purpose or in the public interest, such as in the case of a third party transfer for economic development.
The role of the public purpose post-expropriation is considered with reference to purposes that are not realised or are abandoned and subsequently changed. In this regard the dissertation considers whether the state is allowed to change the purpose for which the property was expropriated, and also under which circumstances the previous owner would be entitled to reclaim the expropriated property when the public purpose that justifies the expropriation falls away. It is contended that the purpose can be changed, but that the new purpose must also comply with the constitutional requirements. / AFRIKAANSE OPSOMMING: Artikel 25(2) van die Grondwet van 1996 vereis dat `n onteining slegs vir `n openbare doel of in die openbare belang mag plaasvind, en dat vergoeding betaalbaar is. In die proefskrif word die openbare doel en openbare belang geanaliseer in die lig van onlangse regspraak wat veral verband hou met die onteining van grond wat oorgedra word aan derde partye vir doeleindes van ekonomiese ontwikkeling.
Die openbare doel vereiste word geanaliseer in die lig van respraak voor die aanvang van die grondwetlike bedeling om beide die openbare doel en openbare belang in terme van die Grondwet van 1996 te verstaan. Op grond van hierdie bespreking word die vraag ondersoek of die onteiening van grond vir ekonomiese ontwikkeling en die oordrag daarvan aan derde partye vir `n openbare doel of in die openbare belang is. Daar word hier aangevoer dat die beskikbaarheid van alternatiewe metodes in ag geneem behoort te word in gevalle waar dit onduidelik is of die onteining vir `n openbare doel of in die openbare belang geskied, soos in die geval van oordrag van grond aan derde partye vir ekonomiese ontwikkelingsdoeleindes.
Ter aansluiting by die vraag of die onteining van grond vir oordrag aan derdes vir ekonomiese ontwikkeling geldig is, word die funksie van die openbare doel na onteiening ook ondersoek. Die vraag is of die staat geregtig is om die doel waarvoor die eiendom onteien is na afloop van die onteiening te verander. Die vraag in watter gevalle die vorige eienaar van die grond teruggawe van die grond kan eis word ook aangespreek. A delicate balance : equality, non-discrimination and affirmative action in Namibian constitutional law, as compared to South African and U.S. constitutional lawCassidy, Elizabeth Ann Kandravy 12 1900 (has links)
Thesis (LLM)--University of Stellenbosch, 2002. / ENGLISH ABSTRACT: This thesis examines the constitutional law of equality, non-discrimination and
affirmative action in Namibia, and compares it to that of South Africa and the United
States. Namibian judicial interpretation in these areas seeks to balance the need to
safeguard the internationally recognized human rights that the Namibian Constitution
guarantees with the need to ensure that Namibian constitutional law is seen as
grounded in Namibia's historical experience and culture. This latter imperative
derives from the Namibian Constitution's origins in an international negotiation
process, which has led to some popular criticism of the Constitution as foreign and
imposed. As a result, Namibian courts have been careful to ensure that reliance on
foreign precedent (where there is no local authority) does not diminish the
Constitution's unique character and its suitability to the Namibian situation. To that
end, the Namibian courts have given great weight to the role of current Namibian
societal values in constitutional interpretation. In the areas of equality, nondiscrimination
and affirmative action, Namibian courts have generally followed the
South African approach, except with respect to discrimination on the basis of sexual
orientation. The author concludes that the adoption of the South African approach
generally makes sense for Namibia, and specifically criticizes the Namibian courts'
approach to sexual orientation discrimination.
The statutes enacted in Namibia to carry out the Constitution's equality and nondiscrimination
guarantees, including in the area of affirmative action, are also
considered. While these statutes have not yet been subject to judicial interpretation, it
seems likely that future cases presenting issues arising under these statutes will
necessitate the same balancing referred to above.
The thesis begins with an overview of each Constitution's textual treatment of
equality, non-discrimination and affirmative action, and a discussion comparing the
background and basic structure of the three Constitutions. It then focuses on the
judicial and legislative interpretation of the concepts of equality and nondiscrimination
in Namibia, as compared to that in South Africa and the US.
Following that, the author discusses the judicial and legislative interpretation of the
concept of affirmative action in Namibia, also as compared to that in South Africa and
the United States. The thesis ends with the author's conclusions and some predictions
as to how the Namibian courts might rule on certain issues that seem likely to arise in
