La protection du tiers dans le contentieux de la passation des marchés publics / The protection of the third party in the public procurement review procedures

Protéiforme, le tiers au marché public se rencontre essentiellement sous deux statuts, selon l’intérêt lésé direct ou indirect qu’il démontrera. Lésé par un manquement aux règles de passation, le tiers est effectivement protégé par le droit, qui instaure à son profit des voies de recours lui permettant tant de contester la légalité du marché que de demander des dommages et intérêts en réparation du préjudice subi. Citoyen, le tiers est défavorisé par sa condition, qui ne lui offre pas toujours les moyens d’actions de nature à satisfaire sa volonté de s’assurer de la légalité des procédures de passation. Il dispose pourtant, au sens du droit européen, d’un intérêt légitime à s’assurer qu’il existe de bonnes procédures de passation. Ce postulat conduira à proposer des solutions juridiques de nature à mettre le droit français en conformité avec ces nouvelles exigences. / The third party in the public procurement essentially meets under two statuses, according to the direct or indirect harmed interest which it will demonstrate. Hurt by a breach on procurement procedure, the third party is actually protected by the law, which establishes in its profit legal remedies allowing him to dispute the legality of the contact as well as asking for compensation for the loss suffered. Citizen, the third party is disadvantaged by its status, which does not always offer him actions likely to satisfy his will to make sure of the legality of the procurement procedure. He has nevertheless, under European law, a legitimate concern to make sure that there are good procurement procedures. That premise will lead to propose legal solutions likely to put the french law in accordance with these new requirements.

Based on study, suggestions for social enterprises to achieve long term development are exhibited.   Method: This research is a qualitative research based on case study. Relay on previous knowledge about social enterprises, I formulate questions which serve my study’s aim. There are three companies be selected in my case company list. Those three companies are divided in two categories: one type is social enterprise consultant company whose mission is to aid regional social enterprise to make health business operation; another type is social enterprise. There are four interview used in the research to ensure that the research result contains different perspectives and opinions.   Result & Conclusions: This study depicts an overall view about social enterprise business expansion. Certain suggestions have been listed relay on the combination of previous literature result with case studies. In the study, various elements have been determined which have significant impacts on social enterprise business expansion operation. They are divided in two segments, internal and external. Internal aspects include human resource and social entrepreneur. External factors include third Part Company, non-profit charity groups and authority. Social enterprise who wants business expansion needs to integrate different resources from various social institutions. Meanwhile to enhance internal product capability as well as competitive advantage social enterprise needs to more emphasize on social entrepreneurs’ characteristics.   Suggestion for further research: Further study should emphasize on various sizes of social enterprises in multi-stakeholders co-operation model. This study mainly focuses on SMEs type of SE, but with the time passing by, due to SE can offer solutions to social crisis and economic crisis, SE will be popular, and this idea will spread quickly. Therefore, more and more large size SE will emerge which needs guide and help with business maintaining and expansion plans.   Contribution of the thesis: This study contributes to three aspects. First, this study analyses the present situation of social enterprise, exhibit internal and external factors which affect social enterprise to make business expansion. It offers social enterprise a path to implement business expansion, and help social enterprise to identify its potential capabilities which could help them achieve long term development. Secondly, during this work, author explains the ideology of social enterprise, what are its contributions to society as well as the reason why it exists. Since the results offer an explicitly structured conclusion, they are valuable information to society as well as local municipality to re-considerate the important role social enterprise can play. Last not the least, this research presents a new model of key elements for social enterprise business expansion. It is critical and crucial for further research in academic study.

A Time Study of Audiological Practice Patterns and the Impact of Reimbursement Changes from Third Part Payers

The primary objective of the project was to survey audiologists in clinical practice setting to determine the amount of time taken to perform various audiologic tests using Current Procedural Terminology, (CPT) codes to define these tests and if these CPT codes were felt to be adequate. Audiologists were also asked to respond regarding possible impact and reimbursement changes in their clinical practices related to managed care. Responses of audiologists were analyzed to determine: a) adequacy of CPT codes; b)average time to perform various audiologic tests; c) impact managed care onclinical practice; and d) changes in reimbursement as a result of managed care. The survey was designed to determine the type of work setting, typical job duty, average monthly caseload and hours per day spent on patient care for each respondent. The survey with a cover letter explaining the purpose was mailed to 93 audiologists in clinical setting in the state of Florida. Five were returned undeliverable, and 39 of the remaining 88 were returned either completed or partially completed. The survey results revealed over 71% of the audiologists felt the current CPT codes were adequate. Time spent performing traditional audiologic tests, such as comprehensive audiometric evaluations and impedance testing, was fairly consistent. Greater time variability occurred in tests used to determine vestibular function. Over three-quarters of the respondents believed managed care has had a negative impact on their clinical practices, while 11% believe they have been positively impacted. Approximately 82% of the audiologists have had reductions in reimbursement as a result of managed care, while 10% have seen no change and 5% have enjoyed slightly greater reimbursement.

Vid både ny- till- och ombyggnation sker ofta arbete tätt inpå redan befintlig bebyggelse. Då dessa innehåller både kontor, bostäder samt övriga verksamheter är risken stor att dessa påverkas negativt av buller från närliggande byggarbetsplatser. I dagsläget finns allmänna råd som Naturvårdsverket har tagit fram. I dessa går det att utläsa vilka ljudnivåer buller från byggarbetsplatser inte bör överstiga samt under vilka tider på dygnet dessa gäller. Det är viktigt att komma ihåg att allmänna råd inte är bindande utan endast riktvärden som i möjligaste mån bör följas. Tillsynsmyndigheten på Länsstyrelsen ansvarar för att dessa följs och tar beslut i samband med byggnation vilka bullernivåer som är lämpliga. Trots förekomsten av de allmänna råden uppkommer det i stor utsträckning tvister mellan den byggande parten och tredje man. Det behöver inte enbart handla om att råden inte efterföljs utan kan i fler fall bero på andra faktorer, till exempel att informationen om kommande störningar varit otydlig. Klagomål kan även förekomma då riktvärdena följs.   Genom att diskutera bullerproblematiken med byggföretaget STRABAG Projektutveckling AB har kunskap om deras syn och erfarenhet av ämnet inhämtats. Företaget lägger stort fokus på att informera tredje man genom att skylta om kommande störningar. Enligt oss bör företaget dock arbeta mer med bland annat planering av avskärmningar mot omgivande bebyggelse. Hur bullerskärmar bör placeras i förhållande till omgivningen, hur de ska utformas och vilka områden som ska skyddas är viktiga frågor att ta upp redan under planering av projekt. Ytterligare information har inhämtats genom en enkätundersökning och intervjuer med Naturvårdsverket, kommuner och Tillsynsmyndigheten. / Construction work is often performed in close contact to existing buildings such as offices, homes and stores. The people working and living in these buildings may thereby be affected negatively by the noise occurring from the construction site. There are guidelines compiled by Environmental Protection Agency regarding the level of noise that should not be exceeded. It’s important to remember that these guidelines are only guidelines and not binding values. “Tillsynsmyndigheten” at “Länsstyrelsen” is responsible for the adherence of the guidelines and make decisions related to which noise levels are appropriate at the construction site. Even though the existence of the guidelines there are times when the construction company can disturb the third party. This does not always have to do with the fact that the noise levels have been exceeded. It could also occur if the information about upcoming disturbances has been unclear. Complaints may also occur when the guidelines are followed. By interviewing representatives at STRABAG Projektutveckling AB about disturbance caused by noise we have received their opinions and experience in the matter.  The company puts great effort to distribute the information about upcoming noise and posting it on billboards. By our opinion more effort should be added to planning upcoming projects and deciding what kind of protection should be used and the most efficient way of placing it due to its surroundings. These are questions that are to be decided in an early stage of the planning process. Additional information has been obtained through a questionnaire survey and interviews with Environmental Protection Agency, municipality and “Tillsynsmyndigheten”.

<p>Syftet med uppsatsen är att analysera ett tredjepartslogistiskt samarbete mellan en vinimportör och dennes distributör utifrån importörens perspektiv. Arbetet avser att lyfta fram vilken typ av relation som finns dem emellan. För att finna svaren till vår undersökning har frågor skapats utifrån valda teorier om partnerskap, samverkan och riskhantering. Frågorna har sedan ställts till personer som arbetar hos både vinimportören och distributören. Spontana samtal och en observation har genomförts i kontorsmiljön hos vinimportören. Vidare har ett studiebesök genomförts hos distributören för att studera deras lagerverksamhet. Efter analys av den empiri som vi erhållit och av utvalda teorier har vi funnit att samarbetet mellan vinimportören och distributören är mer av partnerskapskaraktär än det traditionella kund-/leverantörsförhållandet. Det som styrker detta är följande:</p><p>· Deras nuvarande relation baseras på ett ömsesidigt ge och ta.</p><p>· Det finns varken en inre konkurrens eller styrkemätning dem emellan.</p><p>· Partnerna gör vad de är bäst på inom respektive verksamhet</p><p>· Dessutom bedriver de inom vissa områden ett gemensamt utvecklingsarbete, vilket slutligen leder till en vinst för båda parter.</p><p>Vi har även funnit att stabiliteten i partnerskapet är hög, de har arbetat ihop under lång tid, men graden av närhet i partnerskapet kan anses vara låg. Dessutom visar studien att vin-importören och distributörens partnerskap bygger på mellanting mellan ett främjande och integrerat samarbete. Vidare har vi funnit att den miljö de verkar i är väldigt styrd av Systembolaget.</p>

FundaÃÃo de Amparo à Pesquisa do Estado do Cearà / CoordenaÃÃo de AperfeiÃoamento de Pessoal de NÃvel Superior / Conselho Nacional de Desenvolvimento CientÃfico e TecnolÃgico / nÃo hà / Esta tese tem como objetivo analisar atà que ponto e sob quais circunstÃncias a presenÃa da terceira parte influencia ou interfere nos chats educacionais virtuais por meio das mudanÃas de footing dos participantes desses chats e da polidez linguÃstica que eles investem em momentos de mudanÃa. Para tanto, tomamos como base os estudos de Goffman (1967; 1981), Brown; Levinson (1978; 1987), Leech (1983; 2005), e as investigaÃÃes de Paiva (2004), Paiva; Rodrigues-Junior (2008) e Pereira (2009). Para a realizaÃÃo da pesquisa, contamos com a colaboraÃÃo dos alunos e dos professores das disciplinas SociolinguÃstica, LinguÃstica Textual e Leitura e ProduÃÃo de Textos AcadÃmicos, ofertadas no curso de graduaÃÃo Letras-PortuguÃs da Universidade Federal do CearÃ. Cada participante respondeu a um questionÃrio com questÃes que visaram compreender seus hÃbitos e afinidades com a ferramenta chat educacional virtual. Depois de tabular e cruzar as informaÃÃes presentes nos questionÃrios, e de analisar quinze chats, verificamos que a figura do professor conteudista nÃo somente atua como terceira parte ou zona de influÃncia como tambÃm chega a interferir na mudanÃa de footing dos participantes da interaÃÃo. O tipo de mudanÃa de footing mais significativo à o de formato de produÃÃo, no qual foi possÃvel observar que na presenÃa da terceira parte tutores e alunos procuram ser mais animadores do que responsÃveis ou autores. TambÃm na presenÃa da terceira parte, os alunos evitaram inserir frames de longa duraÃÃo. Com relaÃÃo à mudanÃa de footing por estrutura de participaÃÃo, a presenÃa da terceira parte parece ter condicionado a exclusÃo momentÃnea do tutor na interaÃÃo durante a sua presenÃa, que, por sua vez, excluiu alunos, neste mesmo momento interacional. Estes resultados demonstram que o movimento interno Ãs interaÃÃes sociais (footing) realizadas em chats educacionais virtuais à bastante sensÃvel à presenÃa de membro hierarquicamente superior, podendo inclusive se prolongar na sua ausÃncia. Com esta investigaÃÃo, concluÃmos que a escolha de determinadas estratÃgias de polidez como use marcadores de identidade e grupo, inclua ouvinte e falante na mesma atividade, nominalize, distancie-se do ator e adicione formalidade; distancie-se dos pronomes eu e vocà auxiliam no estabelecimento e na mudanÃa de footings pelos participantes, pois demonstram o nÃvel de engajamento empreendido, sinalizando em quais momentos o observador interfere na projeÃÃo de suas faces. / This research aims at analyzing what extent and under what circumstances the presence of third part influences or interferes with the educational virtual chats through changes in participantsâ footing in these chats and linguistic politeness that they invest in turning points.Our work in this dissertation seeks to achieve this relationship which, in our view, seems inseparable for understanding social relations. Therefore, as the basis of our studies we take Goffman (1967, 1981), Brown; Levinson (1987, 1978), Leech (1983, 2005), and more recently, investigations by Paiva; Rodrigues-Junior (2008), Paiva (2004) and Pereira (2009). To achieve the researchâs aims, we had the collaboration of students and teachers from Sociolinguistics, Linguistics and Textual Reading and Production of Academic Texts disciplines, offered in the Portuguese Literature course at the Federal University of CearÃ. The participants answered a questionnaire that aimed to understand their habits and affinities with educational virtual chat tools. After crossing and tabling the information provided in the questionnaires and analyzing fifteen chats, we found that the figure of the content teacher does not only act as a third part or zone of influence, but also he/she interferes in some instances to the changing in participants of the interactionâs footing. The most significant type of footing change is in the format of production, in which tutors and students demonstrate that in the presence of the third part, they seek to be more impeller than sponsors or authors. Also, in the presence of the third part, students avoid inserting frames of long duration. Regarding the change of footing for participation structure, the presence of the third part seems to have conditioned the momentary exclusion of the tutor interaction during its presence, which in turn, excluded students, even in this moment of interaction. These results demonstrate that the internal motion to social interactions (footing) held in virtual educational chats is very sensitive to the presence of higher-ranking member, and it can even extend during its absence. With this investigation, we can conclude that the choice of certain politeness strategies, such as use group and identity markers, include listener and speaker in the same activity, nominalize, hold off yourself from the author and add formality, hold off yourself from pronouns such as I and you assist in establishing and changing footings by the participants because they demonstrate the level of engagement undertaken, signaling to which moments the observer interferes with the projection of their faces.

Title:  The effects of online third-party opinions toward Consumer Purchasing Decision on cosmetics products in Thai market Seminar date: June 4th , 2012 Course: Master thesis in International marketing, 15 credits Purpose: The overall purpose of this research is to explain the understanding of the effects of online third-party opinions toward consumer purchasing decision process on cosmetics products in Thai market. This includes the investigation of effective used of online third-party opinions with regards to source credibility and product involvement, specifically toward cosmetics products. Theoretical framework: The theoretical framework of this research is based on literature concerning online third party opinion, consumer decision journey (CDJ), product involvement and source credibility. Methodology: Both quantitative and qualitative method was applied. And thus a questionnaire with 147 respondents on Thai market and two interviews of expert marketers were conducted. The respondents for questionnaire are Thai women with specific age range and criteria. Conclusion: The online third-party opinion plays the important role in nowadays in the marketing perspective. And it does affect the consumer purchasing decision process both pre-purchase and post-purchase stage. However, it mostly affects in Consider and Evaluation Stage. With regards to the product involvement and source credibility applying to cosmetics products, these two variables affect to the use of online third-party opinion. Online third-party opinion works best with high involvement product. However, low involvement product also be considered as suitable to use with online third-party opinion. For source credibility, both online expert and consumer reviews perform better when using with high involvement product comparing with low involvement one.
