Medling vid brottsfall med unga lagöverträdare : En litteraturstudie med tematisk analys / Victim offender mediation in juvenile offences. : A literature review with applied thematic analysis.

Bakgrund: Brottsmedling i brottsmål som involverar unga lagöverträdare är en viktig del av rättsväsendet och av socialt arbete. Medlingen, som är en del av filosofin reparativ rättvisa ämnar vara till nytta för både gärningsman och offer. Syfte: Syftet med studien är att undersöka vilka huvudteman som går att identifiera i tidigare forskning inom ämnet. Metod: En scoping review version litteraturstudie med tematisk analys användes som metod för att svara på syftet. Sökningar utfördes i databasen Primo. Tio studier valdes ut. De valda artiklarna kvalitetsgranskades och analyserades enligt teman. Resultat: Intresset bland brottsoffer för att delta i medling är stort och medlingen kan vara en mycket viktig del i offrets rehabiliteringsprocess. Många brottsoffer har positiva upplevelser av medlingsförfarandet och dess effekter, men upplever även besvikelse på processen och dess resultat är vanligt förekommande hos deltagande brottsoffer. Att få en ursäkt av sin gärningsman är för merparten av brottsoffren som deltar i medling mycket viktigt. Ursäkten är även viktig för gärningsmannen och förhoppningar om förlåtelse från sitt offer är vanligt bland gärningsmännen. Förlåtelse är tillsammans med andra aspekter påverkande på huruvida medlingsprocessen skapar minskad på återfallsförbrytelse för dessa gärningsmän. Medlaren har en mycket viktig roll i medlingsprocessen och påverkar alla aspekter av hur den fortskrider samt vad den resulterar i. Slutsats: Medlingsprocessen är viktig för de individer som erbjuds att delta och har potential att påverka ett brottsoffers rehabilitering samt en gärningsmans framtida sociala beteende och kriminella bana. / Background: Victim offender mediation in criminal cases involving youth offenders is an important part of the judiciary and of social work. Mediation, which is part of the philosophy of reparative justice, intends to benefit both the perpetrator and the victim. It also strives to promote recidivism and prosocial behavior of the perpetrator. Aim: The aim of the study is to investigate which main themes can be identified in previous research on the subject. Method: A scoping review approach of literature study with applied thematic analysis was used as a method to answer the purpose. Searches were performed in the database Primo. Ten studies were selected. The selected articles were quality reviewed and analyzed according to the themes. Result: The interest among crime victims in participating in mediation is large and mediation can be a very important part of the victim's rehabilitation process. Many victims have positive experiences of the mediation process and its effects, but also experience of disappointment in the process and its results are common among the victims. Receiving an apology from your perpetrator is very important for most victims who participate in mediation. The apology is also important to the perpetrator and hope of forgiveness from one’s victim is common among the perpetrators. Forgiveness, together with other aspects, affects whether the mediation process creates a reduction in recidivism for these perpetrators. The mediator has a very important role in the mediation process and affects all aspects of how it progresses and what it results in. Conclusion: The mediation process is important for the individuals who participate and has the potential to influence a victim's rehabilitation and a perpetrator's future social behavior and criminal path.

A criminological analysis of the transfer of juveniles to adult correctional centre

Many young people in South Africa are involved in crime, especially violent crime. This statement is supported by statistics obtained from the Annual Report (2013:37) of the Judicial Inspectorate for Correctional Services which indicates that 26 282 young people were serving sentences in South African Correctional Centres at the end of the 2012/13 financial year. This annual report of the Department of Correctional Services (2013:13) indicates that at the time of the report, 11 000 offenders were sentenced to life imprisonment and a third of them were youth offenders. The majority of these young people have to be transferred from juvenile facilities to adult centres to continue their incarceration when they turn twenty one. This transition holds a number of challenges, both for these young people and the Department of Correctional Services. Young people are confronted with the reality of possibly falling victim to HIV/AIDS, gangs, sodomy and rape in overcrowded, adult correctional facilities. The Department of Correctional Services encounters problems in assisting these young people to adjust to this transition and the protection of these young people from assault and abuse by older inmates remains an institutional concern. The main aims of this research are to examine: the age at which juveniles are transferred to adult correctional centre to continue with their sentences; the factors taken into account before transfer; the challenges faced by youth offenders in adult correctional centre; and the needs of youth offenders in adult correctional facility. A life-skills intervention programme addressing the selfconcept of Afrikaans-speaking youth offenders

Life-skills education and training forms part of life orientation and helps to address the abovementioned aspect. Life-skills education and training falls under the most recent and powerful approaches in handling psychological problems. It strives to adapt the principles of psychology and social science into teachable skills to ensure intra-personal effectiveness and improve the general quality of peoples' lives. The aim of this pilot study was to alter The Path programme to design and develop an intrapersonal life-skills programme aimed at enhancing the self-concept of youth offenders. The intervention research model of Rothman and Thomas (1994) was employed as foundation for the design and development of The Altered Path programme. The intervention research model was chosen as it aimed at creating a means to address problems experienced by individuals and society. It strives to improve the life, health and well-being of individuals and society. This purposeful sampling consisted of six Afrikaans-speaking, male youth offenders from the Drakenstein Juvenile Centre. The Altered Path programme was implemented in three stages. The first stage consisted of sessions one to seven. The following topics were covered during this stage: introduction and programme orientation, conceptualisation of mission statements and elements, past personality influences and Cup of Sorrow, the Positive Prophecy and Talent Shield, the mission statement, the vision statement and goal setting. The second stage, which consisted of sessions eight and nine, entailed the training of the participants for service learning. The third stage entailed the implementation of the service learning process. The study found that The Altered Path programme could contribute towards a growth in intra-personal skills with regard to self-awareness, personal goal setting, spirituality, morals and values, self-esteem and self-regulation (both emotional and cognitive). The result of the intra-personal growth was that the interpersonal skills with regard to communication and helping skills of participants improved. In answer to the research question the finding was made that the intra-personal development positively affected the following dimensions of their self-concept: personal, ideal, cognitive, spiritual, social self and psychological self. In the light hereof the statement can be made that The Altered Path programme seems to have a positive effect on the overall self-concept of the participants. Conscious development of self-knowledge was identified as an element of the programme that could be refined to ensure that all participants develop self-knowledge in the same way during the field study.

A penological perspective on unit management as a rehabilitation tool for youth offenders

The purpose of this study was to evaluate the implementation of the components of unit management, namely; architecture, case management, risk management and human rights in South African Youth Development Centres. The concept of unit management in correctional centres was adopted by the South African Correctional system in March 1995. However, the formal introduction of the concept was announced by the former Minister of Correctional Services, Dr. Sipho Mzimela, on 16th February 1996. The implementation of unit management was viewed as a vehicle for service delivery in South African correctional centres. Moreover, this concept was also viewed as a strategic move to ensure that corrections and the rehabilitation of inmates, as the core business of the department, are achieved. In an attempt to assess the application of unit management at South African Youth Development Centres, and how unit management influences the rehabilitation of sentenced youth offenders, a descriptive study was conducted to obtain knowledge and perspective from the available literature. In addition to a descriptive study, the researcher employed a quantitative methodology. Using the quantitative approach, data was collected by means of a structured questionnaire. In the case of coding and data analysis, a Statistical Analysis System (SAS) was utilized. In sum, Frequency Tables and Bar Charts were used to simplify the analysis per section and category. The findings from this study revealed that the conditions of detention at Youth Development Centres, specifically the level of overcrowding, influence of old correctional centre structures and the absence of custodial therapists contribute to the violence, violation of basic human rights and failure to rehabilitate youth offenders in these centres. La thérapie par le plein air représente une alternative aux programmes d’intervention conventionnels pour jeunes antisociaux. Elle donne à ses participants l’occasion de modifier leurs pensées et leurs comportements dans un contexte d’expédition, à travers la participation à diverses activités de plein air. Ce faisant, ils développent leur répertoire d’habiletés personnelles et sociales, ce qui pourrait faciliter le désistement d’une conduite antisociale. Un devis expérimental prospectif, avec pré-test et post-tests à trois et six mois, a été utilisé afin d’évaluer l’effet de la durée d’une intervention de thérapie par le plein air sur le niveau d’antisocialité et l’insertion socio-professionnelle de jeunes contrevenants. De plus, l’effet potentiellement médiateur des progrès réalisés au chapitre des habiletés interpersonnelles et de la motivation d’accomplissement a été examiné. Un échantillon de 220 jeunes contrevenants a été observé, divisé aléatoirement selon deux conditions expérimentales, soit un programme de 8 à 10 jours et un programme de 17 à 20 jours. Il apparaît que la durée n’a pas d’effet direct significatif sur le niveau d’antisocialité et l’insertion socio-professionnelle des participants. En revanche, la durée du programme a un effet positif indirect sur le niveau d’antisocialité subséquent des participants, à travers l’amélioration des habiletés interpersonnelles et la motivation d’accomplissement des sujets. Aucune des variables mises en jeu n’a eu un impact significatif sur les progrès observés au niveau de l’insertion socio-professionnelle des sujets. La thérapie par le plein air semble favoriser le désistement d’une conduite antisociale en encourageant le développement de certaines habiletés personnelles qui font habituellement défaut chez les jeunes antisociaux. / Wilderness therapy is an alternative to more traditional interventions for antisocial youth. This expedition-based intervention requires participation in various outdoor activities, through which participants have the opportunity to modify thought patterns and behaviors. In doing so, they broaden their existing, and often poor, repertoire of personal and social skills, heightening the possibilities of desistence from an antisocial path. An experimental and prospective design, with pre-test and post-tests at three and six months, was used to evaluate the influence of the length of the program on the antisociality and socio-professional status of young offenders. The potential impact as mediators of interpersonal skills and accomplishment motivation was also observed. A sample of 220 young offenders was used, which was divided at random into two conditions; a program lasting between 8 to 10 days or one lasting between 17 and 20 days. Length of program had no direct and significant influence on the antisociality levels or the socio-professional status of the participants. However, length had a positive indirect effect on lowering the level of antisociality of the subjects, through the development of their interpersonal skills and accomplishment motivation. None of the variables had a significant impact on the socio-professional status progress noted for most subjects. Wilderness therapy appears to support young offenders in desisting from an antisocial pathway by facilitating the development of personal and social skills.

This study aimed to explore and describe the role perceptions of social workers working with children who have been sentenced to compulsory residence due to being in conflict with the law. Exploratory, descriptive, and contextual research designs were applied in using a qualitative research approach. The researcher collected the data using semi-structured interviews with all the social workers working with children sentenced to compulsory residence at Bosasa Child & Youth Care Centres. The data analysis was done using the eight steps identified by Tesch (in Creswell, 2014:198). The data verification was accomplished using Guba’s model (in Krefting, 1990:214-220). The research study provided valuable conclusions and recommendations to different role-players who have an interest in the role of social workers working with children sentenced to compulsory residence. The findings indicated the importance of regular training for social workers who work with children sentenced to compulsory residence to help children to deal with risk factors that may increase the probability of offences occurring. / Social Work / M.A. (Social Science, Social Work)
