Assistência jurídica integral e justiça gratuita nos conflitos individuais do trabalho / Complete legal aid and exemption from court fess on individual labor conflicts

O trabalho apresentado propõe-se a descrever e analisar os institutos da assistência jurídica (que tem como subtipo a assistência judiciária) e da justiça gratuita no Brasil, em benefício de pessoas pobres na acepção jurídica do termo, com enfoque nos conflitos individuais do trabalho. Abrange o estudo dos serviços de orientação jurídica pré-processual e o patrocínio das causas judiciais com isenção de honorários e de todo tipo de despesa oriunda dos processos. Para atingir esse objetivo, utiliza-se a compilação e análise crítica de informações extraídas de obras doutrinárias, de jurisprudência e de pesquisas de levantamento de dados realizadas por terceiros, tudo com base em material nacional e estrangeiro, com final apresentação de conclusões e proposições acerca das divergências doutrinárias e jurisprudenciais existentes. Demonstra-se que a assistência jurídica, a assistência judiciária e a justiça gratuita possuem antecedentes ainda na antiguidade e evoluíram até a conformação atual no direito brasileiro. O objetivo dessa evolução é proporcionar o acesso à justiça e a efetivação do princípio da igualdade, que são ao mesmo tempo fundamentos daqueles institutos. Para o mais amplo atendimento aos necessitados, não há exclusividade na prestação dos serviços de assistência jurídica nem limites nas isenções de despesas judiciais. Os benefícios e a lista de prestadores dos serviços são vastos. Além disso, o procedimento foi simplificado ao longo do tempo até a existência atual de presunção relativa de pobreza daquele que afirma essa condição. / The presented dissertation aims to describe and analyze the institutes of legal aid and exemption from court fees in Brazil, for the benefit of poor people in the legal sense, focusing on individual labor conflicts. It covers the services of free legal advice and advocacy with exemption from legal representatives fees and other charges relating to proceedings. To achieve this objective, it uses the compilation and review of information extracted from doctrinal works, case studies and data collection, all based on national and foreign material, with a final presentation of conclusions and proposals about the doctrinal and case study discussions. It demonstrates that the different systems of legal aid and exemption from court fees have evolved over time until the present existence in Brazilian law, always with the goal of providing access to justice and the realization of the principle of equality, which are also its foundations. To assist the needy to the fullest, there is no exclusivity in the provision of legal aid services or limits on the exemptions from charges relating to the proceedings. The benefits and the list of service providers are vast. Moreover, the procedure has been simplified over time until the existence of the presumption of poverty which states that this condition.

The methodology used by the author was about bibliographic researchs and the analysis, the synthesis, and the critique applied to the actual stage of comprehension of the legal phenomenon from the perspective of the Philosophy of Law. From the contributions of Mauro Cappelleti and Bryant Garth, contained in their relatory about the access to justice, the author have found two different points of view and heading for the second: the production of just and effectiveness decisions to the people and to the society. The author’s research lead to the conceptions of Metaphysic and Physic in Aristotle’s Philosophy as the original source of this possibility exposed by Mr. Chiappin, as well as in Charitas doctrine in St. Thomas as possibility of universalization of the doctrine of the four causes that covers all the mankind, gathered under the label of natural law. The opening that this analysis provided, lead the author to a brand new level of understanding about the access to justice, which was examined under the aitiologic component of the aristotelic metaphysics. The conclusion was that the rehabilitation of the aristotelic-thomist way of think can magnify the men as the ground, the support and the end of the law through access to justice / A presente dissertação tem por objetivo empreender uma análise do princípio constitucional do acesso à justiça à luz da metafísica e da física aristotélico-tomista. O método utilizado serviu-se de levantamento bibliográfico, análise, síntese e crítica do modelo jurídico atual do ponto de vista da filosofia do direito. Baseado nas contribuições de Mauro Cappelleti e Bryant Garth, que fizeram histórico relatório sobre o tema, encontrou-se dois significados distintos em sua interpretação, concentrando-se este texto no segundo, qual seja: produção de decisões justas para o indivíduo e sociedade. Resgatou-se em Aristóteles e Tomás de Aquino as origens desse pensamento. Fez-se uma análise da doutrina da justiça à luz do direito natural aristotélico e do tratado da caridade em Tomás de Aquino e situada possibilidade do acesso à justiça como um abrir-se essencial à interpretação e universalização do acesso. Esse movimento de abertura foi visto à luz da componente aitiológica da metafísica. There is no point in an extensive list of civil, political and social rights, if there are no instruments to implement them in practice. The fundamental right to full and free legal aid is, in this context, the principal means of access to justice for those in need. It is through free legal aid that the economic and organizational hype can demand the realization of their rights before the Judiciary. In addition to legal action, full and free legal aid is designed to protect the rights of the needy in other areas, including through extrajudicial channels (through the use of alternative means of conflict resolution), and rights education. In view of the essentiality of this right for the protection of the dignity of the human person, the present work seeks to relate it to the existential minimum, that is, to an intangible content of rights necessary to guarantee a minimum standard of dignity. Thus, as a right integral to the existential minimum, the fundamental right to legal aid must be treated as a priority public policy, which is not subject to the “under reserve of the possibilities” argument. Therefore, the proper structuring of the Public Defender, which is the institution constitutionally designed to effect the fundamental right to legal aid, should receive the same priority attention by the constituted powers / Mais que proclamar direitos, o maior desafio das sociedades democráticas atuais é garantir a sua efetividade. De nada adianta um extenso rol de direitos civis, políticos e sociais, se não existirem instrumentos destinados a concretizá-los na prática. O direito fundamental à assistência jurídica integral e gratuita é, nesse contexto, o principal meio de acesso à justiça destinado aos necessitados. É mediante a assistência jurídica gratuita que os hipossuficientes econômicos e organizacionais podem exigir a realização de seus direitos perante o Poder Judiciário. Para além da atuação em juízo, a assistência jurídica integral e gratuita destina-se à proteção dos direitos dos necessitados em outros âmbitos, inclusive por vias extrajudiciais (com a utilização de meios alternativos de resolução de conflitos), e também se volta à promoção da educação em direitos. Diante da essencialidade desse direito para a proteção da dignidade da pessoa humana é que o presente trabalho busca relacioná-lo ao mínimo existencial, ou seja, a um conteúdo intangível de direitos necessários para a garantia de um padrão mínimo de dignidade. Assim, como direito integrante do mínimo existencial, o direito fundamental à assistência jurídica deve a ser tratado como política pública prioritária, que não se sujeita ao argumento da reserva do possível. Portanto, a devida estruturação da Defensoria Pública, que é a instituição constitucionalmente concebida para efetivar o direito fundamental à assistência jurídica, deve receber a mesma atenção prioritária pelos poderes constituídos

O presente trabalho visa a uma reflexão sobre necessidade da utilização da mediação, como procedimento útil na administração dos conflitos coletivos de trabalho. Pondera-se que o desenvolvimento da mediação em todos os campos da vida social não deve ser apresentado apenas como uma alternativa ao Judiciário, e sim como um novo modo de regulação social, que prioriza a reconstrução das relações futuras e o respeito às suas necessidades específicas. Partindo do conceito de conflito, dos fatores que o influenciam, de suas formas de exteriorização e de suas especificidades no direito coletivo do trabalho, o estudo questiona se o excessivo intervencionismo estatal presente em nosso ordenamento jurídico não limita a efetiva autonomia sindical e engessa o comportamento dos grupos sociais. Trata do contra-senso existente entre o ilusório estímulo à negociação coletiva e o reconhecimento da solução jurisdicional compulsória, já que o Poder normativo ainda é o meio utilizado para tornar certo o conflito coletivo do trabalho. Propõe um conceito da mediação, indicando seus objetivos, princípios e diferenciando-a dos demais meios de solução de conflitos. Procura esclarecer de que maneira a mediação pode ser utilizada como instrumento de transformação cultural e pacificação social, abordando-a como meio capaz de auxiliar o Poder Judiciário, tanto no aspecto da diminuição do número de ações judiciais, quanto na utilização de seus métodos para aprimoramento da atividade jurisdicional. O acesso à Justiça é um direito fundamental, que não está limitado ao acesso ao Poder Judiciário, podendo servir de ferramenta às organizações da sociedade civil para pressionar o Estado na busca da realização de políticas públicas eficientes, com vistas à disponibilização de instrumentos jurídicos necessários à aproximação do Direito da idéia de Justiça como força transformadora dos conflitos. Trata, assim, da necessidade de desenvolvimento de uma política pública de incentivo à utilização da mediação como instrumento de acesso à Justiça, voltada à construção de uma cultura da paz e à manutenção das relações continuadas. / The present work objectives a reflection on the need of mediation as a useful process in the management of collective labor conflicts. It is considered that the development of mediation in all fields of social life should not be presented exclusively as an alternative to the Judiciary, but as a new mode of social regulation, which gives priority to the reconstruction of future relations and the respect to its specific needs. Assuming the concept of conflict, of the factors that influence it, of its forms of outward expression and of its particularities in the collective right of labor, the study investigates if the excessive state interventionism present in our juridical ordinance does not limit the effective union autonomy and controls the behavior of social groups. It deals with the existing paradox between the apparent stimulus to collective negotiation and the acknowledgement of compulsory jurisdictional solution, once the normative Power still is the used mean to make right the collective labor conflict. A concept of mediation is proposed, appointing its objectives, principles and differentiating it from the other means of solution for conflicts. It attempts to make clear that a mean of mediation may be used as an instrument of cultural modification and social pacification, approaching it as an able mean to help the Judiciary, both on the reduction of the number of juridical suits, and on the employment of its methods for the improvement of jurisdictional activity. The access to Justice is an essential right, which is not limited to the access of the Judiciary, being able to serve as a tool for organizations of civil society to pressure the State on the search of effective public policies, examining the availability of necessary juridical instruments in the approach of Law to the notion of Justice as a transforming strength of conflicts. It deals with the need of the development of a public policy of incentive to the employment of mediation an instrumental of acess to Justice, facing the construction of peace culture and of the maintenance of continuous relations.

A Defensoria Pública como instrumento político de transformação social: entre narrativas e práticas profissionais / The Public Defender as a political instrument of social transformation: between narratives and professional practices

O objetivo principal do trabalho é investigar como defensores públicos de São Paulo compreendem o papel da Defensoria Pública e de que forma eles têm conduzido as demandas sociais de caráter político advindas da sociedade civil. A pesquisa se enquadra no campo da Sociologia Política do Direito, pois pretende analisar dentro do contexto jurídico-político brasileiro a dinâmica e atuação da Defensoria Pública frente as demandas apresentadas pelos usuários, a partir das explicações sobre a relação entre Direito e Política oferecidas pela ideia de responsividade do direito. O estudo parte desses referenciais para verificar como a atuação da defensoria afeta o fenômeno de judicialização da política e a crença de que o Poder Judiciário é capaz de promover significativas transformações sociais. Para essa análise, a metodologia contou com duas partes de base empírica. A primeira levantou dados referentes a ações judiciais propostas pelos defensores públicos de São Paulo no período de 2007 a 2017, bem como dados referentes às propostas aprovadas em três ciclos de conferências estaduais da instituição, ambos em bases informatizadas da Defensoria Pública. Esse levantamento, ainda em etapas exploratórias da pesquisa, constatou um aumento considerável de ações judiciais propostas pelos defensores nos últimos anos e identificou que grande parte do conteúdo das propostas aprovadas pela sociedade civil nos ciclos de conferências demanda intervenção no campo político. Após a coleta inicial desses dados, na segunda parte, foram realizadas dez entrevistas semiestruturadas em oito unidades da defensoria paulista, posteriormente organizadas em cinco categorias analíticas: a) visão dos defensores sobre o Direito; b) percepção acerca do Poder Judiciário; c) compreensão do papel da defensoria Pública; d) a atuação ordinária dos defensores públicos; e, e) o impacto das conferências estaduais e do plano anual de atuação. As três primeiras categorias observaram como defensores públicos atribuem sentido ao papel institucional a partir de suas distintas percepções acerca do direito e do Poder Judiciário. O exame das demais categorias verificou como a atuação desses defensores tem sido desempenhada e se as propostas advindas da sociedade civil influenciam a atuação no campo político. O estudo empírico permitiu concluir que: embora tenham dedicado, quase exclusivamente, suas atividades ao campo judicial, os defensores não enxergam o Poder Judiciário como capaz de responder efetivamente às demandas sociais de ampla repercussão; os defensores reproduzem um discurso que visa reafirmar a Defensoria Pública como um instrumento de transformação social no campo político; e, há um descompasso entre essas narrativas acerca do papel institucional e as atribuições ordinárias. / The main objective of this study is to investigate how public defenders in São Paulo understand the role of public defence and in what ways they have dealt with the social demands of a political nature coming from civil society. The research falls within the field of Political Sociology of Law, since it intends to analyze within the Brazilian legal-political context the dynamics and action of the public defender against the demands presented by the users, starting from explanations of the relation between Law and Politics offered by the idea of responsive law. The study begins from these references to verify how the actions of the defence affects the phenomenon of judicial control of politics and the belief that the Judiciary Power is capable of promoting significant social transformations. For this analysis, the methodology had two empirical parts. The first examines data on lawsuits filed by public defenders in São Paulo from 2007 to 2017, as well as data regarding the proposals approved in three cycles of state conferences of the institution, both found on the computerized databases of the Public Defender\'s Office. This survey, still in the exploratory stages of the research, has seen a considerable increase in lawsuits filed by defenders in recent years and has identified that much of the content of the proposals approved by the civil society in cycles of conferences demands intervention in the political arena. Following the initial collection of these data, in the second part, ten semi-structured interviews were carried out in eight units of São Paulo public defenders, subsequently organized into five analytical categories: a) the defenders\' view of the Law; b) perception about the Judiciary Power; c) understanding the role of the Public Defender; d) the ordinary performance of public defenders; and, e) the impact of the state conferences and the annual action plan. The first three categories observed how public defenders attribute meaning to the institutional role from their different perceptions about the law and the Judiciary. The examination of the other categories verified how the actions of these defenders has been performed and if the proposals from civil society influence the performance in the political field. This empirical study allowed us to conclude that: although they have almost exclusively dedicated their activities to the judicial field, defenders do not see the Judiciary as capable of responding effectively to social demands that have a wide repercussion; the defenders reproduce a discourse that aims to reaffirm public defence as an instrument of social transformation in the political field; and there is incongruity between these narratives about the institutional role and the ordinary tasks.

This thesis entitled, A Comparative Study of Paralegalism in Australia, the United States of America and England and Wales, examines the role that paralegals play in the delivery of legal services and the educational opportunities that are available to support that role in Australia as compared to England (and Wales) and the United States of America (US). As in other parts of the common law world it is accepted in Australia that not all work which is of a legal nature is performed by qualified legal practitioners. This is despite a rigid demarcation between qualified lawyers and other legal workers. The structure and regulation of the legal profession have an impact in determining the nature of paralegalism in Australia. The legal profession’s monopoly in Australia is, however, confined to the right of appearance in a court of law and to the preparation of certain documents for reward, which leaves a vast field of legal tasks open to performance by other workers, including paralegals. The legal profession is facing many challenges in the twenty first century, including the need to deliver better and cheaper legal services. Paralegals, as part of the legal service industry, are affected by the same tensions but are well placed to contribute to a more “streamlined” practice and to assist in providing greater access to justice for many disadvantaged Australians.This thesis explores the difficulties for Australian paralegals given that there is little formal recognition of, or status accorded to, the paraprofession. Indeed, the word paralegal is not easily understood nor widely used and this translates into uncertainties as to qualifications, market position and function to provide a definition and to determine the parameters of the profession. Paralegals work in a variety of legal environments which include, but are not limited to, working in private legal practices where they are supervised by lawyers.Further, in order to achieve recognition and to make a meaningful contribution to legal service delivery, paralegals require specialist education. This thesis examines the educational opportunities which are available to paralegals in Australia and makes recommendations as to future accreditation based on appropriate qualifications and experience.In order to gain further insight, comparisons are made between the role that paralegals play in the delivery of legal services in two other common law jurisdictions and Australia. Paralegals play a significant role in the delivery of legal services in the US, where many states constitute bigger jurisdictions than the whole of the Australia. American paralegalism has a twenty year “head start” on that of Australia and it is reasonable to anticipate that their challenges will mirror ours in the future. England, on the other hand, has a legal system very close to our own and the examination of paralegals in both England and Wales has revealed both similarities and differences to our Australian experience, both of which inform the research.

Paralegals work in a variety of legal environments which include, but are not limited to, working in private legal practices where they are supervised by lawyers.Further, in order to achieve recognition and to make a meaningful contribution to legal service delivery, paralegals require specialist education. This thesis examines the educational opportunities which are available to paralegals in Australia and makes recommendations as to future accreditation based on appropriate qualifications and experience.In order to gain further insight, comparisons are made between the role that paralegals play in the delivery of legal services in two other common law jurisdictions and Australia. Paralegals play a significant role in the delivery of legal services in the US, where many states constitute bigger jurisdictions than the whole of the Australia. American paralegalism has a twenty year “head start” on that of Australia and it is reasonable to anticipate that their challenges will mirror ours in the future. England, on the other hand, has a legal system very close to our own and the examination of paralegals in both England and Wales has revealed both similarities and differences to our Australian experience, both of which inform the research.

Para tanto utilizar-se-á das impressões decorrentes da análise dos novos instrumentos processuais de julgamento das causas repetitivos especificamente nos tribunais superiores quando dos julgamentos dos recursos repetitivos.
