A critical evaluation of the 2009 Niger Delta Amnesty Disarmament Demobilisation and Reintegration programme

Disarmament, Demobilisation and Reintegration (DDR) have become a key component of the postconflict peacebuilding orthodoxy. Therefore, this study evaluates the efficacy of Amnesty, Disarmament, Demobilisation and Reintegration (ADDR) in conflict prevention and resolution using the 2009 Niger Delta ADDR programme as a case study. The study evaluated the effectiveness of the programme using the minimalist and maximalist framework advanced in the DDR literature. The key findings and conclusions of the Study were that a minimalist DDR would only achieve security stabilisation and return excombatants to the status quo- ante society with all the pre-conflict grievances unaddressed thereby bequeathing a high potential of relapse to violence. Furthermore, for DDR to be an effective conflict prevention and resolution mechanism and postconflict peacebuilding force, its conceptualisation, design and implementation must be maximalist in nature with a transformative agenda that aims to address the roots causes of violence.

Alhoewel 1910 as vertrekpunt geneem is, is die fokus in die grootste mate geplaas op ontwikkeling sedert 1962. Bepaalde aksies deur onder andere die Inrigtingskomitee en Paroolraad kulmineer in die vrylating van die gevangene en om die rede bet die navorser ook die samestelling, bevoegdhede en werksaamhede van vermelde liggame nagevors en beskryf. / This research is aimed at the release of the prisoner and the objective is to historically elucidate the release system within the South African correctional system on the basis of a literature study, with the necessary penological perspective. Considering the fact that the existing literature on penology has hardly any information regarding the release of the prisoner and more specifically the different types of release, various sources have been identified in order to condense the historical information and to discuss contemporary policy in this regard. Although 1910 was taken as the starting point, the focus has largely been placed on development since 1962. Specific actions by, inter alia, the Institutional Committee and the Parole Board culminate in the release of the prisoner and for this reason the compilation, the competencies and the activities of the mentioned bodies were also described by the researcher. / M.A. (Penologie) / Sociology

Isto porque, após mais de 50 anos do deflagrar do regime autoritário no Brasil, considerando as recentes decisões antagônicas proferidas pelo Supremo Tribunal Federal e pela Corte Interamericana de Direitos Humanos, percebe-se que esse período de transição na organização do poder político ainda não foi superado e compreendido na sua totalidade. Ao abarcar as proposições-chave nos pensamentos de Hannah Arendt – que opõe poder a violência e desvela a banalidade do mal – e de Walter Benjamin – com ênfase nas teses que fundamentam “Sobre o conceito de história”, por conseguinte, a relação dialética entre o tempo e o espaço – nossa pretensão é elucidar a lógica perversa que tem nos aprisionado num presente constante. O objetivo é alcançar a preliminar de todo conhecimento, ou seja, a compreensão desse período por meio de pesquisa histórica (fontes primárias e secundárias) e apreensão das categorias-chave de/para análise conceitual da ditadura, perdão e memória em alusão às três frentes: a primeira trata da cultura da impunidade e do esquecimento engendrada ainda sob a égide do regime autoritário (1964-1985) e consubstanciada na Lei da Anistia como óbice à persecução penal; a segunda busca compreender a (im)possibilidade da generalização do perdão e a dominação sem sujeito; e, por fim, trata-se do perigo da construção de uma memória baseada em narrativas, vivências, reprodução de testemunhos e de arquivos sem passarem pelo crivo da razão e do debate público. Para tanto, foram utilizados os métodos de abordagem indutivo e dialético desenvolvidos interdisciplinarmente, uma vez que a riqueza de interface do tema assim o exige. A metodologia está pautada em conexões qualitativas a partir de revisão historiográfica, uso de registros escritos de sujeitos históricos e entrevistas com mulheres que viveram e narraram suas experiências. Foram delimitadas, a partir da análise de conteúdo aplicado através de narrativas e textos de mulheres militantes que viveram o período ditatorial – categorias-chave e avaliação numérica da frequência de ocorrência de determinados termos, expressões, construções e referências categorizadas. / This paper follows the “state, society and social policies” research line within the Interdisciplinary Graduate Program in Social Policy and Citizenship, and it is a contribution to the critique of the Brazilian civil-military dictatorship (1964/1985) and the movements arising from it, its consequences in the social policies development in the construction of the historical memory of individuals - with respect to the socio-metabolic mutation of historical subjects into goods predicates - and the possibility of forgiveness beyond the Amnesty Law (Law No. 6.683/79). This is because it is clear that this transition period in the organization of political power has not yet been overcome and understood in its entirety, even after more than 50 years of the authoritarian regime outbreak in Brazil, considering the recent antagonistic judgments handed down by the Supreme Court and the Inter-American Court of Human Rights. To encompass the key proposition in the thoughts of Hannah Arendt - that opposes power and violence, revealing the banality of evil - and the ideas of Walter Benjamin - with emphasis on theories that underlie “the concept of history”, therefore, the dialectical relationship between time and space - our intention is to elucidate the perverse logic that has trapped us in a constant present. The goal is to achieve the primary of all knowledge, that is, the understanding of this period through historical research (primary and secondary sources) and seizure of the key categories of / to conceptual analysis of the dictatorship, forgiveness and memory in reference to the three fronts: the first one deals with the culture of impunity and oblivion still engendered under the aegis of the authoritarian regime (1964-1985) and based on the amnesty law as an obstacle to criminal prosecution; the second seeks to understand the (im)possibility of generalization of forgiveness and domination without a subject; and, finally, this work will be treated from the danger of building a memory based on narratives, experiences, the playback of testimonies and files without all these going through the test of reason and public debate. Therefore, we will make use of the inductive and dialectical approach methods, which will be developed in an interdisciplinary way, since the theme interface wealth so requires. The methodology is guided by qualitative connections from historiographical review, i.e. the use of written records of historical subjects and interviews with women who have lived and narrated their experiences. They were defined from the applied content analysis through narratives and texts made by women activists who lived through the dictatorship period - key categories and numerical evaluation of the occurrence frequency of certain terms, expressions, buildings and categorized references. Senses, meanings and memories, their lines overflow time and space and provide the ability to understand the country history through individual and collective memories.

An investigation into the structure and process of forgiveness following gross human rights violations

This study focuses on the structure and process of forgiveness as experienced by individuals, from the East London and surrounding areas, who either suffered gross human rights violations or who are related to someone who suffered gross human rights violations during the Apartheid era. Those who participated in the study testified at the Truth and Reconciliation Commission and expressed forgiveness towards the perpetrators of the violations. The aims of the study were to reveal: the participants' structure cif forgiveness, i.e. how they define forgiveness; the process of forgiveness, i.e. the changes that took place from the time of the violation up until the participants forgave the perpetrators: and, the relation. if any. between the participants' structure and process of forgiveness. It is argued that mainstream Psychology has neglected to study forgiveness because the subject matter is incompatible with the natural scientific method. For this reason, the study was approached from a hermeneutical paradigm. This was motivated by its ability to explicate the meaning and content of phenomena. Unstructured qualitative interviews were conducted with the participants. Data was analyzed using a multi-layered process of progressively deeper interpretation, employing a reading guide technique. Results indicated that authentic forgiveness is an unconditional commitment on the part of victims and survivors to relate positively towards the perpetrators. The relationship should include non-bitterness, non-vengeance, unconditional love and respect for their human rights. Another significant dimension of the structure of forgiveness is the fact that the desire for the truth is not abandoned although forgiveness has taken place. Forgiveness also does not take away the effects of the violation. This means that one does not forget although forgiveness has been granted. Results further indicate that the forgiveness process is highly complex, individualized and not instantaneous. The individuals have to deal with various intrapersonal conflicts and anxieties as a result of the violation, before forgiveness is explored as an option, and before they can finally forgive. Significant interrelations between the structure and process of forgiveness were also identified.

Aprovada há mais de duas décadas, a anistia foi um marco no processo de abertura do país. Cinco anos depois de sua sanção pelo então presidente do Brasil, general João Baptista Figueiredo, encerrava-se o regime militar-autoritário iniciado em 1964. Tema desta dissertação, a anistia ora em análise não se limita à lei aprovada em 1979, sendo aqui definida como um processo político de longa duração, orientado por legislação federal e composto de três momentos fundamentais. São eles: a lei 6.683 (a Lei da Anistia propriamente dita), a lei 9.140 (Lei dos Desaparecidos) e a lei 10.559. Com a intenção de reconstituir tal processo e a fim de apreender seu sentido político, este estudo parte das primeiras demandas que antecederam cada uma das leis, passa pelos mais importantes acontecimentos históricos relacionados ao tema no período em exame e pelos debates que marcaram o processo até chegar na aprovação da legislação, pelo Congresso Nacional. Além de identificar, caracterizar e analisar o papel dos principais atores sociais que participaram de cada um dos três momentos, reconstitui-se aqui também o papel desempenhado pelas instituições envolvidas, examina-se a entrada em vigor das leis e os efeitos de sua aplicação. Conquanto não se trate de um estudo comparado, contribuem para o entendimento do caso brasileiro experiências semelhantes de outros três países da América do Sul que foram governados por regimes militares e sancionaram anistias: a Argentina, o Chile e o Uruguai. Percorrendo as últimas quatro décadas da história do país, este estudo trata do legado deixado pelo regime militar-autoritário à luz da teoria contemporânea de democracia e do desenvolvimento do conceito de direitos humanos. / Approved more than two decades ago, amnesty was a landmark in Brazil’s democratization process. Five years after its sanction by former Brazilian president, General João Baptista Figueiredo, the military-authoritarian regime initiated in 1964 was reaching its end. In analysis for the scope of this dissertation, amnesty does not limit itself to the law approved in 1979. Amnesty has been analyzed here as a long lasting political process, guided by federal legislation and integrated by three fundamental moments. These moments are: Law 6.683 (Amnesty Law), Law 9.140 (Missing Political Activists Law) and Law 10.559. This study describes and analysis the initial demands that preceded each of the laws. It also incorporates the main historical facts related to the issue and the debates and disputes along the process until the legislation approval by the Congress. Besides identifying, characterizing and analyzing the role of the main social actors that took part in each of the three moments, it also reviews the role issued by the institutions involved, it examines the entrance in force of the laws and their effects on its application. The final goal has been to reconstitute the process in order to understand its political meaning. The similar South American experiences of amnesty in dictatorial Argentina, Chile and Uruguay contribute for a better understanding of the Brazilian case, even though the present study is not a comparative one. Encompassing the last four decades in Brazil’s history, this study takes into account the legacy left behind by the military-authoritarian regime in light of the contemporary theory of democracy and the development of human rights’ concept.

O presente trabalho busca compreender a atuação das Torcidas Organizadas e, torantes especificamente, da Associação das Torcidas Organizadas do Rio de Janeiro, no contexto da anistia política vivenciada no Brasil. Esse também é um período onde se nota o esgotamento do Milagre econômico, com enorme inflação, que acarretou diretamente no aumento do custo de vida e, para os torcedores, na majoração do preço dos ingressos para os jogos de futebol. A alternativa encontrada é uma série de boicotes e greves das torcidas no afã de reduzir o valor das entradas, contando com ampla cobertura da mídia, especializada, Jornal dos Sports, Revista Placar, ou a mais geral, Jornal do Brasil. Nosso objetivo é compreender as diversas iniciativas tomadas pela ASTORJ para alcançar suas vitórias, o discurso presente em suas lideranças, e a maneira como foi construída essa relação dialética entre torcidas e órgãos da imprensa e, para tal, analisaremos reportagens de jornais, revistas e de colunas como A Voz da Galera, presente no Jornal dos Sports, que se somam a entrevistas realizadas por nós junto a figuraschave da Associação das Torcidas Organizadas do Rio de Janeiro. / This paper seeks to understand the role of association of football fans and torantes specifically , the Association of organized fans of Rio de Janeiro , in the context of political amnesty experienced in Brazil . This is also a period where we note the exhaustion of the "economic miracle " , with massive inflation, which led directly to the rising cost of living and, for fans , increase in the price of tickets to the football games .The alternative is found a series of boycotts and strikes twisted in his eagerness to reduce the value of the entries , with extensive media coverage , Specialty - Journal of Sports , Score Magazine - or more generally - Jornal do Brazil . Our goal is to understand the various initiatives taken by ASTORJ to achieve their victories , the present leaders in their speech, and the way it was constructed this dialectical relationship between supporters and media outlets , and for this , we will analyze reports from newspapers , magazines and columns - as " the Voice of Galera " , present in the Journal of Sports - that add up to interviews conducted by us with the key figures of the Association of organized fans of Rio de Janeiro.

A justiça de transição no contexto latino-americano: suas características, fundamentos e uma comparação entre Brasil e Argentina / Transitional justice in Latin American context

O presente trabalho se propõe a uma discussão sobre como pode ser encarada a questão da responsabilidade penal em relação às violações massivas de direitos humanos praticadas durante situações de repressão, considerando o caso brasileiro da edição da Lei n 6.683. Para tanto, apresenta-se o conceito de justiça de transição e o seu surgimento, que é acompanhado pela afirmação da proteção internacional dos direitos humanos. Este processo é dividido em três fases distintas, relacionadas ao fim da Segunda Guerra e o estabelecimento dos Tribunais de Nuremberg e Tóquio; à onda de democratização em algumas nações com o fim da Guerra-Fria e à criação dos tribunais internacionais e do TPI. Como forma de efetivação da justiça de transição, são apresentados os Princípios de Chicago, diretrizes a serem seguidas pelos Estados na transição democrática, que sugerem abordagens de diversas naturezas em relação às violações de direitos humanos. Como fundamento da justiça de transição, dando destaque à questão da responsabilização penal, são trazidos os dispositivos sobre o tema presentes em normas e tratados internacionais, enfatizando os aspectos do Sistema Interamericano de Direitos Humanos. Parte-se, em seguida, à apresentação do exemplo argentino na realização da justiça de transição sob o aspecto da declaração de inconstitucionalidade de suas leis de anistia, como meio de reflexão para o caso brasileiro. Conjugando os elementos anteriores, apresenta-se a situação brasileira no contexto da realização da justiça de transição, com o julgamento da ADPF 153 e com a condenação do Estado pela Corte Interamericana de Direitos Humanos. / This paper proposes a discussion on how it can be given to the issue of accountability in relation to the massive human rights violations committed during times of repression, considering the case of the Brazilian edition of the Law No. 6683. To this end, we present the concept of transitional justice and its appearance, which is accompanied by the statement of the international protection of human rights. This process is divided into three distinct phases, related to the end of World War II and the establishment of the Nuremberg and Tokyo Tribunals, the wave of democratization in some countries with the end of the Cold War and the creation of international tribunals and the ICC. As a way of realization of transitional justice, presents the Chicago Principles, guidelines to be followed by states in democratic transition, suggesting approaches of different nature in relation to human rights violations. In support of transitional justice, highlighting the issue of accountability, the devices are brought on the present subject standards and treaties, emphasizing the inter-American Human Rights. Breaks, then the presentation of the Argentine example in the realization of transitional justice in the aspect of the declaration of unconstitutionality of their amnesty laws as a means of reflection for the Brazilian case. Combining the previous elements, it presents the situation of Brazilian the realization of transitional justice, with the trial of ADPF 153 and the condemnation of State for Inter-American Court of Human Rights.

IndenizaÃÃes sÃo concedidas Ãqueles que sofreram perseguiÃÃo polÃtica, casas legislativas restituem o decoro parlamentar Ãqueles que exerciam essas funÃÃes e foram cassados por motivaÃÃo polÃtica durante a ditadura militar (1964-1985), instituiÃÃes homenageiam figuras ilustres que se destacaram na luta contra o regime e reintegram simbolicamente pessoas a cargos. Esses atos trazem à tona distintos significados de ordem moral, polÃtica, jurÃdica, material e simbÃlica, envolvendo diferentes instÃncias para alÃm dos diretamente atingidos. Assim, as famÃlias, os media, entidades da sociedade civil, os poderes pÃblicos e jurÃdicos entram no jogo das disputas e construÃÃes de versÃes sobre o passado. A presente tese busca compreender como esses valores, disputas e representaÃÃes articulam-se em torno desses movimentos reparatÃrios, entendendo-os como espaÃos de luta, acionados nos diferentes eventos criados por ocasiÃo dos atos de reparaÃÃo, nas contendas criadas nos media e nas narrativas dos atingidos. / In the past few years, laws have been passed in Brazil directed towards maintaining and amplifying a process that was started in 1979 with promulgation of the Amnesty. The process named generically of âreparationâ goes beyond what is established by the laws. Compensations in money are paid to those who suffered political persecution, present legislatures have restored to a previous effective state the honorability for representatives who were serving during the military dictatorship (1964-1985) and lost their mandate by arbitrary annulment, institutions pay homage to illustrious citizens who became known for their struggle against the regime, and symbolically reinstated them to their former positions. Those acts bring up distinct meanings of a moral, political, juridical, material and symbolic nature involving several levels beyond which stand those who were directly hit. Thus, families, newsmen, private organizations and public juridical institutions join the dispute in order to advance their own versions of the past. This thesis aims at understanding how those values, disputes and representations fit themselves around those amending movements that are seen as public arenas spurred by different events found in the time of reparation, in the struggles created in the media and in the stories told by the victims..

Toma-se como ponto de partida, a hipÃtese de que hà um diÃlogo comum entre as pelÃculas em relaÃÃo ao discurso produzido nas telas que corroboram ou refutam o posicionamento a favor da anistia âampla, geral e irrestritaâ. Para o estudo à fundamental pensar as formas pelas quais os discursos acerca da ditadura presentes no cinema brasileiro produzido entre 1994 e 2002 se relacionam com seu perÃodo de produÃÃo, distribuiÃÃo e consumo, bem como perceber como os filmes dialogam entre si. Os filmes sÃo analisados tomando como premissa a ideia de que sÃo documentos importantes para o entendimento do seu perÃodo de produÃÃo, perÃodo esse de mudanÃas econÃmicas e sociais de cunho neoliberal e ainda de mudanÃas na Lei de Anistia com um aumento da abrangÃncia dos indenizados pelo Estado e discussÃes em torno da possibilidade de mudar a lei no sentido de investigar e punir torturadores. As pelÃculas estudadas trazem representaÃÃes e pontos de vista que tentam reconfirmar a Lei de Anistia ou revÃ-la, a partir de seus personagens e das situaÃÃes em que estÃo envolvidos e das abordagens da ditadura militar. / This paper analyzes a group of national films made between 1994 and 2002 whose plot deals with the period of the Brazilian civil-military dictatorship (1964-1985) in dialogue with the Amnesty Act of 1979. Take as a starting point, the hypothesis that there is a common dialogue between the films in relation to the discourse produced in the screens that confirm or refute the position in favor of amnesty "wide, general and unrestricted." For the study is fundamental to consider the ways in which discourses about the dictatorship present in Brazilian cinema produced between 1994 and 2002 relate to its period of production, distribution and consumption as well as realize how movies interact with each other. The films are analyzed taking as its premise the idea that they are important documents for the understanding of their production period, a period of economic and social changes of neoliberal and even changes in the Amnesty Law to increase the scope of the indemnified by State and discussions about the possibility of changing the law to investigate and punish torturers. The films studied bring representations and views that attempt to reconfirm the Amnesty Act and revising it from his characters and the situations they are involved and approaches of military dictatorship.
